Re: Sonnenalp: Bavaria House Landscaping
Dear Ray:
The existing bond that the Town has for the excavation of the Bavaria House
kitchen will be transferred to cover the landscaping which will be completed in
the spring of 1987. The total amount for the bond is $6,100. I am also asking
that you adjust the landscape plan to allow for only one tree adjacent to the
trash dumpster. The tree should be pulled back as close as possible to the
deck area so that in the event of a future path going through this area, there
will be no conflicts.

RE: Sonnenalp Hotel
Dear Kristan:
Earlier this year the Sonnenalp Hotel deposited with the
Town of Vail a bond for excavation without a building
permit. The purpose for this bond has now been eliminated.
The owner now wishes to obtain a Certificate of Occupancy
for this project and is unable to complete the landscaping
until spring of 1987 . Therefore, would you please transfer
the existing bond from an excavation bond to a landscaping
bond.

Re: Building identification sign for the Sonnenalp
Dear Karl :
On September 30, 1986, I sent you a letter concerning the Sonnenalp sign
adjacent to the west entrance of the hotel . Due to the fact that you are now
proposing to remove the existing sign and adding new sign north of the entry, a
new deadline for the completion of the work must be set. The new sign will
need to be reviewed by the Design Review Board. The sign changes should be
made by November 26, 1986. We hope that you will be able to complete this work
by this deadline, as technically there is a sign code violation concerning the
existing free standing sign. If this time table is not possible, please give
me a call so that we can work out a reasonable schedule for rectifying the
signage problem.

Re: Color Change of Sign
Dear Karl :
On July 30, 1986 the Design Review Board gave final approval to the revised
color scheme for the Sonnenalp sign adjacent to the west entrance of the
Sonnenalp. I am asking that you make the color changes to the sign as soon as
possible. I would appreciate it if you would try to have this work completed
by October 17, 1986. I must emphasize that our department will not be able to
release any temporary certificates of occupancy for the construction until the
repainting of the sign is completed. Thank you for your cooperation.

Dear Ray:
This letter is to follow-up the conversation we had regarding the
Sonnenalp (Bavaria House) kitchen last week. The following items are
those that we discussed and which I need to make sure are addressed in the
overall plan. These are:
(1) Stairs to the downstairs storage/prep area must be sealed and
finished - no exposed wood surfaces.
(2) Wall along the stairs must be sheetrocked and sealed - smooth,
easily cleanable surface along entire length.
(3) Floor tiles in the existing kitchen; especially along the cookline,
must be replaced, repaired and regrouted if loose or damaged.
(4) Coved baseboard must be installed throughout the kitchen area and
small waitress/service area off of the kitchen.
(5) Ceiling tiles in the existing kitchen must be replaced if damaged,
dirty or not vinylclad. The tiles must be replaced with vinylclad
fire resistant ceiling tiles.
(6) If either dishmachine is to be high temperature as opposed to low
temperature with chemical sanitization it must be equipped with a
condensation capture hood.
(7) The downstairs storage/prep area must be completely finished,
including the ceiling, so that the entire area is smooth,
light-colored and easily cleanable.

Dear Carrie,
After our discussion last Friday, August 8th, regarding the menu
displayed on the easel at the Sonnenalp entrance, I was disappointed
yesterday morning to note that it was once again being displayed. As
I explained on Friday, the easel is considered to be a free-standing
sign which is prohibited under Section 16.26.010 (G) of the Town of
Vail Sign Code. It is also considered as additional signage and in
violation of the allowable number of signs per establishment.
The easel could in fact be displayed in the lobby of the hotel or in
the little foyer inside of the exterior doors. If you have any .
questions I would be willing to discuss them with you so that further
action is not required in this matter. If you do have questions,
please feel free to contact me at 476-7000 ext. 105. I am looking
forward to your cooperation in this matter.

RE: Review of Sonnenalp Landscaping
Dear Johannes:
On July 2nd I sent you a letter concerning the first landscape
review for the Sonnenalp. I am proposing that the Town return
$3 , 600 of the total bond of $6, 100 due to the fact that most of
the landscaping work has been completed. The Town would keep
the $2 ,500 to cover restriping of the parking lot, relocation
of the two evergreens adjacent to the west trash room and
additional sod or topsoil and seed for the area adjacent to
Gore Creek.
I discussed the cost of doing this work with Gary Murrain to
determine a fair price. If you wish, you may submit a bid from
your contractor if you do not agree with the $2,500 amount for
the work. The bid should indicate how long the bid will be
active.
Please let me know if you feel that this option is reasonable.
If you feel that it is appropriate, I will take the steps to
return the $3 , 600 to you. Thank you for your cooperation on
this issue.

RE: Sonnenalp Landscaping Adjacent to the Delivery Area
Dear Johannes,
The Town of Vail Finance Department is in the process of
reimbursing you for $3 ,600. 00 for landscaping that has been
completed at the Sonnenalp Hotel. Recently, we received a copy
of your letter concerning the two trees adjacent to the trash
room on the west side of the Sonnenalp Hotel.
The staff's point of view was made very clear and was marked on
approved landscape plans to indicate the relocation of the
trees. In addition, on November 26, Kristan sent a letter to
Mr. Ray Story concerning the trees adjacent to the dumpster.
We felt it was unreasonable to ask you to re-draw the landscape
plan for such a small change and therefore made notations to
the approved plans.
The staff realizes your opposition to the proposed stream walk
along Gore Creek and your reasoning behind planting trees in
this location in order to screen the delivery area. We believe
that guests of the Sonnenalp Hotel would view the stream walk
as a positive amenity. In the near future, we hope to be able
to show you design drawings for the path so that you will have
a more thorough understanding of what this project involves.
It appears that at this point the Town is interested in
Proceeding ;with the stream walk project. We feel that you can
still accomplish the screening of the delivery and trash area
by moving the trees further to the east. The relocation of the
trees will avoid any further problems concerning the
displacement of the trees for the potential path.
The current placement of the trees is in violation of your
Design Review approval. For this reason, we have only returned
a portion of your letter of credit. The Town will keep the
$2 , 500. 00 to cover re-striping of the parking lot, relocation
of the two evergreens, and additional sod, topsoil and seeding
for the area adjacent to Gore Creek.
To resolve the issue of the tree location, we have suggested
several alternative solutions. First, you may re-apply to the
Design Review Board to revise your landscape plan to allow for
the trees to remain in their existing location. If you choose
this option we request that you submit an application by August
31, 1987 for the September 16th Design Review Board meeting.
Secondly, if you prefer to complete the landscape work
(seeding, tree relocation and striping) as listed above, we
request that the work be completed by September 23 , 1987. If
no Design Review Board approval is obtained for the existing
location of the trees, then the Town of Vail would utilize a
portion of the remaining money to relocate the trees further to
the east on your property.
Enclosed is a copy of the Design Review Board application for
you if you choose to resubmit your proposal to the Design
Review Board. Also enclosed are two xeroxes of landscape plans
with notations and the letter to Ray Story.

Re: Sonnenalp: Bavaria House Landscaping
Dear Ray:
The existing bond that the Town has for the excavation of the Bavaria House
kitchen will be transferred to cover the landscaping which will be completed in
the spring of 1987. The total amount for the bond is $6,100. I am also asking
that you adjust the landscape plan to allow for only one tree adjacent to the
trash dumpster. The tree should be pulled back as close as possible to the
deck area so that in the event of a future path going through this area, there
will be no conflicts.

RE: Review of Sonnenalp Landscaping
Dear Johannes,
I have reviewed the landscaping for the Sonnenalp remodel and
feel that I cannot give final approval to the plan until the
following items are addressed:
1. The two spruce trees planted at the southwest corner
of your property adjacent to the trash room must be
moved back to the east to allow for possible future
access down to the Town of Vail stream tract. I have
attached a letter dated November 26th which was sent
to Mr. Ray Story requiring that the landscaping
adjacent to the trash area be pulled back to the east.
I also indicated this on the building permit drawings
for the project.
2 . I feel that additional topsoil and seeding is needed
in the area directly south of the dumpster area. It
appears that some seed has been added to this area.
However, the soil is very gravelly and it seems that
some additional topsoil with more seed would be
helpful to returning this area to grass.
3 . The landscaping plan approval also requires that the
parking lot be restriped to show the new parking
configuration which actually increases the number of
parking spaces on your property. The restriping work
will need to be completed before I can sign off on the
final Certificate of Occupancy.
In general, I think the project looks outstanding and I hope
that these final details will be attended to quickly. I
especially like the patio area and new entrance. If you have
any questions about these concerns please feel free to call me.
Please let me know when this work has been completed and I will
be happy to come out and recheck the landscaping.

Dear Ron,
I would like to make a few comments regarding our recent conversations
about our clean-up deposit.
I made arrangements with Gidley Landscaping to take care of sodding t -
river bank, among other things. The parking lot stiping will not be lone
this year since we will repave the entire lot next spring and don't ee
much sense in restriping it this year only to pave over those stri.-s
next spring. Kristin's objections are correct and accepta.- - . ,�
Regarding the pine trees at thesouthwest corner of th - Bavaria - I
would like to let you know the following after thinki • __ _ -i or
quite some time. Those two pine trees are on my property. We planted
them mainly because trees make that corner look nicer and cleaner. You
are asking us to move those trees to the east and away from the point
where they accomplish what we planted them for in the first place - to
hide the delivery, trash, and kitchen entrance area from people walking
up Vail Road. I will not move those trees away from the place they should
be in my opinion, and neither the Town of Vail nor anybody else will tell
me where to plant trees on my property. I like all the restrictions being
imposed on changes ii, the village, but I feel that the Sonnenalp standards
of quality and keep:Lng Vail beautiful" are much higher than those of the
Town of Vail. If you choose to hold back money because of the tree issue,
you should be prepared to have to fight me all the way. This is a matter
of high principle, and I will not let this issue annoy me any longer.

. ASSOCIATES, INC., a Colorado corporation (hereinafter referred to as Grantor), and VAIL WATER AND
SANITATION DISTRICT, a governmental subdivision of the State of Colorado (hereinafter referred to as
Grantee),

paid to Grantor by Grantee, the receipt of which is hereby acknowledged, Grantor hereby sells, conveys, .
and grants unto Grantee an easement and right-of-way over, across, through and under the following
described lands situate in Eagle County, Colorado, for the uses and purposes and upon the terms •

Grantor grants to Grantee the.right to enter upon the above described lands for the purpose
of installation, repair, replacement, removal, or otherwise.
Grantor further grants to Grantee the right to use so much of the adjoining land of Grantor
as shall be reasonably necessary to enable workmen and equipment to properly and conveniently construct
repair or remove said facilities.
Grantee shall restore the subject lands to original conditions and shall repair any damage
to adjoining land or structures as a result of said construction, maintenance, or removal, except for
replacement of grass, trees, and shrubs, if the removal of such is necessary for construction,
maintenance or removal.

Grantee hereby agrees to hold and save Grantor harmless from any and all damage arising
from Grantee's use of the right, easement, and right-of-way herein granted and agrees to pay any
' damages or damage which may arise to the property, premises, or rights of the Grantor through

Conditions of Approval of the Sonnenalp Variances
Planning and Environmental Commission Meeting
May 28, 1986
Hobbs moved and Schultz seconded to approve the requests for variances per the
staff memo with the following conditions:
1. If and when a pedestrian path is constructed along the Town of Vail
stream tract south of the Sonnenalp property, the owners will allow the
Town access across their property in the area between the northeast
corner of the Vail Road bridge abutment and the new trash room for
construction purposes only. This shall be a legal agreement submitted
at the time of building permit. The Sonnenalp owner shall be
responsible for submitting this agreement to the Town of Vail staff for
their review.
2. The vacant utility easement that bisects the Bully III Restaurant will
be vacated before a building permit is released for the project.
3. The parking calculations for recreational facilities inside all four
buildings assume that these facilities would be private. If the
recreational facilities become available to the general public, the
Sonnenalp will go through the appropriate Town of Vail review
procedures.
4. The applicant agrees to provide the 6" curb and gutter system with a
drainage swale along the west side of the property along Vail Road from
the west entry south to the Vail Road bridge.
5. The planters which exist adjacent to the kitchen will remain.

Meeting.
Dear Ray,
On June 4, 1986, the Design Review Board gave final approval to the
Sonnenalp Remodel with the following conditions:
1 Moss rock will be used on the retaining walls located on the
south elevation below the trash room.
2 The planters along the west elevation will be stucco.
3 The retaining wall on the south side of the trash room will
be on Sonnenalp property.
4 The trees around the new breakfast deck will be removed and
relocated so that two trees are placed by the new ski room
addition and three trees are placed by the trash compactor.
The trees by the trash compactor should be located on
Sonnenalp property and still allow for access for a potential
future pedestrian path.
5 The grade into the loading dock should be lowered so that the
dock can handle 14 foot high trucks.
6 The stone column by the trash room will be all stucco with a
rock base rather than stone
7 Please address the utility box screening for building permit
review.
8 A sign program shall be submitted for the project for the
June 18, 1986 Design Review Board meeting.

11 The asphalt by the trash room will be removed and the area

planter walls and retaining wall on the south side of the
site. He requested an Engineer's stamped drawings showing
heights, dimensions, and design calculations.

We wish to start demolition on portions of this project
for the purposes of investigation and to remove existing
tenant finish materials. This work would be limited to
removal of floor, wall and ceiling finishes and tenant
non-bearing walls. We will not remove electrical,
plumbing or heating and ventilating devices. Also, we
will maintain the fire alarm and sprinkler system with the
exception of smoke detectors which we will cover so they
are not activated by dust.
This demolition shall be limited to the tenant finish,
i.e. interior, non-structural items, in the area of the
former Mariachi' s Restaurant and the commercial space
above. Required safety and clean-up procedures shall be
followed.

Dear Ray:
I have given the Kiandra submittal a preliminary review and have come up with
the following list of items that will be helpful in reviewing the project in
further detail .
1. A written description of the actual proposal which will outline
specifically what areas of the building are being remodeled. This
statement should also be accompanied with the drawings that reflect the
areas of construction. For example, at this time I do not have in the
submittal what you would like to do with the spa.
2. I will need a letter from Dave Mott concerning the sewer line that is
in the same area as the proposed dumpster. It is my understanding that
there is not an approved easement for the sewer line. However, we will
need to hear from Dave Mott to determine how this problem should be
handled.
3. The centerline of the creek should be indicated along the entire length
of the property. Presently, the survey shows the centerline on only a
portion of the stream. This centerline is particularly important in
the area of the dumpster. The survey should also show the edge of the
stream and bridge abutments in the area of the second floor patio and
dumpster. This information will be helpful in determining if a walkway
will still be able to be constructed through this area once the
dumpster is constructed.
4. A title report should be submitted, particularly Schedule B, in order
to check easements.
5. The existing parking layout and proposed parking should be submitted.

This information should be submitted by May 15, 1986. The sooner the
information is submitted, the better. However, May 15th is the latest date
that is feasible given the PEC meeting on May 28.
At this time, I do not have any specific comments about the plan. One

dumpster in order to allow for better access. I will try to have any further
comments to you as soon as possible.

Re: Kiandra Minor Subdivision
Dear Jay:
The staff had the opportunity to look at the minor subdivision for the Kiandra
property. The minor subdivision will not be accepted for the Planning
Commission meeting on February 24, as further information is needed,
particularly an application form and fee for the minor subdivision. If you
submit all of the information listed below by noon on February 3rd, the staff
will accept your submittal for the February 24th PEC_.meeting......If. you, are unable
to meet this deadline, you will need to resubmit for a future PEC meeting. The
staff will be happy to look at the minor subdivision on a preliminary basis.
However, the staff feels strongly that further information is necessary to
complete a thorough review of the proposal .
The additional information that the staff would like to receive includes:
1. A completed application form signed by the appropriate parties and a
check to cover the application fee.
2. Three copies of the minor subdivision, two of which must be mylars.
3. Title insurance company proof of ownership of all lands within the
proposal .
4. A written description of the submittal . Staff is particularly concerned
about how the parking for the Kiandra is affected if the parking area
becomes a separate lot from the Kiandra property.
5. A written summary of any lease agreements that exist concerning these
properties.
6. The staff would like to see an improvement survey that shows existing
property lines, ownership, buildings and parking areas.
The staff will need this additional information to evaluate the
submittal . At this time, it is difficult to determine if other
information will be necessary. However, these minimum items are needed.

Nay comments and questions are as follows:
1 . How does proposed renovation and remodel relate to plans for new
commercial building along East Meadow Drive?
2. Why is estimated cost of improvements ($1 .25 million) so low compared
to the requested $10 million in bonds?
3. We would need more detailed plans to give an opinion on zoning
compliance for the renovation (although it sounds like it fits
with PA zoning).
4. This is a quite complicated site regarding ownerships with all
the leases and easements. We need to make sure everything works
together.
5. Basically, I have no objections and feel the site needs an upgrade.
We will ask for some tradeoffs (possibly improving the trash area,
looking at the potential for a bike/pedestrian path and/or bridge
over the creek) and will discuss this further.

Dear Johannes:
I am disappointed to learn that the computer lines for which
you requested an easement from the Town of Vail this winter
have already been placed on Town of Vail property. Kristan
Pritz' January 11, 1988 letter to you outlining the process by
which you could obtain an easement from the Town of Vail
assumed the lines were not in place. The lines in their
existing state present problems from both an aesthetic and a
safety standpoint.
I am now receiving complaints about these computer and phone
lines from adjacent property owners and am hereby requesting
you to promptly remove them. I urge your cooperation in this
matter. If you wish to obtain an easement from the Town of
Vail to place the computer lines in a proper manner, I refer
you to the enclose January 11, 1988 correspondence. I believe
a number of the issues noted on page 2 of the letter have been
resolved with the exception of the evergreen tree on the
southwest corner. I would expect that resolution of that
problem would be an element in our discussions to grant you an
easement, among the other more standard considerations on our
part.

Re: Sonnenalp Easement Request
- Dear Johannes:
The staff discussed your request to locate an easement for
computer and phone lines on Town of Vail property. To begin
the submittal process, please provide the staff with the
following information:
1. A survey for the general vicinity of the proposed
easement. The survey should indicate building edges, the
creek edge, grades, and the actual location for the
easement.
2 . A legal description of the easement.
3 . A written legal easement agreement. The Town Attorney
will need to review the wording of the agreement, but
basically it should address the term of the agreement as
well as the rights of the property owner and easement
user.
Once this information has been submitted, the staff will review
your request and it will be presented to the Town Council at a
work session for preliminary review. The easement would be
given final approval at a Town Council evening meeting.
It is important that you know we are interested in addressing
many of the unresolved issues related to the Sonnenalp property
when reviewing your easement request. These issues include:
1. The curling rink and valet parking: Staff has sent a
letter asking that you submit a site plan showing how you
will handle valet parking on the property. At this time,
the information has not been submitted.
2 . The evergreen tree on the southwest corner of the
Sonnenalp property. The tree has not been relocated. The
present location of the tree does not comply with your DRB
approval. In addition, we would also look at the option
of obtaining a permanent access easement across your
property adjacent to the Vail Road Bridge.
3 . Talisman access request. Peter Patten has been contacted
by the Talisman Association concerning their desire to
access their property through East Meadow Drive. They
have indicated that there are a number of problems with
the existing situation going through your property. Due
to the obvious serious implications of the access from the
mall, we would like to discuss the resolution of these
problems and the attainment of an easement for the
Talisman across your property.
4 . Fire access on the northeast corner of the Swiss Chalet:
The Fire Department and Community Development Department
had asked that you remedy this situation by moving the
boulders per the approved DRB access plan. You had agreed
to move the boulders as soon as possible. According to
the Fire Department, this work has not been completed.
Once again, we will emphasize that this is a very
dangerous situation, as fire trucks are presently unable
to access through this area. The signs that have been
erected are also not designed per the approved Design
Review Board sign.
Regardless of whether or not you proceed with the easement
agreement request, we must ask that you submit the valet
parking plan, relocate the boulders per the approved Design
Review Board plans, and erect the approved fire access signs by
January 29, 1988 . If these issues are not addressed, the staff
will have no choice but to take further actions to insure
compliance with the plans. Many of these issues are related to
safety concerns. I hope that you can see the importance of
addressing our concerns.

requesting that you write a preliminary access agreement which
would allow the Talisman owners access through the Sonnenalp
property. (I know you have 0 work to do these days! I told
the Talisman people it would be 3 to 4 weeks before we could
have an agreement due to your work load. )
The conditions of the easement are that:
1. It is not an easement in perpetuity. The easement must be
able to be revoked by the Sonnenalp for any reason.
2 . The easement's maintenance will be by either the Talisman
or Sonnenalp. At this time, I do not know which group
wants this responsibility.
3 . The easement area is presently paved, and this area will
continue to be paved.
4 . There needs to be a clause in the agreement addressing how
the revocation of the easement will be handled.
5. Vail Associates must also sign off on the easement, as the
Sonnenalp has the ownership right from Vail Associates
through a deed.

Please find enclosed a sketch of our parking lot describing the manner
in which we plan to substitute for the lost parking spaces due to our
ice rink with valet parking.
We effectively lost 8 spaces through the ice rink (marked in yellow) and
gained at least that many through valet parking (orange) . You can see
that we could come up with more speces than presently marked orange, if
need be. We found throughout last winter and so far this winter that it
was never necessary to double park vehicles, but we do have at all times
two bellman on duty for valet parking purposes if needed.
I realize that I am not giving you an architectural piece of art, but I
hope that it will satisfy your immediate needs in the matter.

Since the Talisman Condominiums were built in 1970 its owners
have enjoyed a friendly, cordial and neighborly relationship with
all previous owners the Talisman and Kiandra Lodges. _
Unfortunately, we do not enjoy the same relationship with the
Sonnenalp group and we find the terms they have imposed on us in
exchange for entry to our property thru their west gate entirely
unsatisfactory.
Please consider this letter as The Talisman Condominium
Association ' s official request to the Town of Vail to immediately
provide us free and unencumbered access to our property in
accordance with the terms of Ordinance #14 of 1978. We request
this access to our property be established prior to the Christmas
Season so there will be no interruptions to the flow of traffic
in and out of our area.

Dear Mr. Shaffer:
Needless to say, I was not pleased to receive your letter of
February 17th regarding the possibility that the Talisman
Condominium Association is interested in pursuing direct access
onto East Meadow Drive. We feel this would have major negative
impacts upon the pedestrian area as well as the bus lane that
we have all strived to create.
Although the Town of Vail has not been involved in any of your
discussions with the Sonnenalp to date, we feel that there must
be some type of compromise agreement which could be reached to
avoid creating a new access for the Talisman property. At this
point, I would offer our department's assistance in an attempt
to reach a solution amenable to all parties. Please let me
know if you are interested in our participation.
Concerning the procedures to follow if all else fails, it
appears that Ordinance #14 of 1978 does allow (through an
access easement) the access you are referring to. After
receiving a title report or other confirmation that this access
easement has been recorded, we would simply conduct an internal
review process with other affected departments. I am not sure
how the access through the bus control gate at Vail Road would
work -- this would need to be discussed with Public Works.
Again, I believe it is of the utmost importance that this
situation be worked out in a manner that will not change the
access for the Talisman Condominiums onto the controlled bus
lane and pedestrian street. This would have adverse impacts
upon a number of properties in the area as well as the general
pleasant pedestrian atmosphere that has been created. Please
call me if we can be of further assistance or if you have
questions.

Dear Johannes:
The staff discussed your request to locate an easement for
computer and phone lines on Town of Vail property. To begin
the submittal process, please provide the staff with the
following information:
1. A survey for the general vicinity of the proposed
easement. The survey should indicate building edges, the
creek edge, grades, and the actual location for the
easement.
2 . A legal description of the easement.
3 . A written legal easement agreement. The Town Attorney
will need to review the wording of the agreement, but
basically it should address the term of the agreement as
well as the rights of the property owner and easement
user.
Once this information has been submitted, the staff will review
your request and it will be presented to the Town Council at a
work session for preliminary review. The easement would be
given final approval at a Town Council evening meeting.
It is important that you know we are interested in addressing
many of the unresolved issues related to the Sonnenalp property
when reviewing your easement request. These issues include:
1. The curling rink and valet parking: Staff has sent a
letter asking that you submit a site plan showing how you
will handle valet parking on the property. At this time,
the information has not been submitted.
2. The evergreen tree on the southwest corner of the
Sonnenalp property. The tree has not been relocated. The
present location of the tree does not comply with your DRB
approval. In addition, we would also look at the option
of obtaining a permanent access easement across your
property adjacent to the Vail Road Bridge.
3. Talisman access request. Peter Patten has been contacted
by the Talisman Association concerning their desire to
access their property through East Meadow Drive. They
have indicated that there are a number of problems with
the existing situation going through your property. Due
to the obvious serious implications of the access from the
mall, we would like to discuss the resolution of these
problems and the attainment of an easement for the
Talisman across your property.
4 . Fire access on the northeast corner of the Swiss Chalet:
The Fire Department and Community Development Department
had asked that you remedy this situation by moving the
boulders per the approved DRB access plan. You had agreed
to move the boulders as soon as possible. According to
the Fire Department, this work has not been completed.
Once again, we will emphasize that this is a very
dangerous situation, as fire trucks are presently unable
to access through this area. The signs that have been
erected are also not designed per the approved Design
Review Board sign.
Regardless of whether or not you proceed with the easement
agreement request, we must ask that you submit the valet
parking plan, relocate the boulders per the approved Design
Review Board plans, and erect the approved fire access signs by
January 29, 1988 . If these issues are not addressed, the staff
will have no choice but to take further actions to insure
compliance with the plans. Many of these issues are related to
safety concerns. I hope that you can see the importance of
addressing our concerns.
If you have further questions about the easement review

Dear Johannes:
:I have noticed that the skating rink is in operation again at
the Bavaria House. As we had discussed last year, the staff
must review your skating rink in respect to its effect on your
parking. The Sonnenalp may provide valet parking services to
make up for the spaces that are lost due to the skating rink.
We must ask that you submit a site plan showing where you would
provide the valet parking to make up for the 10 to 12 spaces
that are lost due to the skating rink. Please keep in mind
that Mite access will also need to be provided.
I will appreciate it very much if you will cooperate with the
staff by submitting promptly the site plan showing your valet
parking proposal. The staff agrees that the skating rink is a
positive guest amenity and does not wish to try to remove the
rink. However, the parking situation does need to be

Re: Ski Shuttle to Mill Creek Circle
Dear Johannes:
The staff discussed your request to provide a ski shuttle
service from the Sonnenalp to Mill Creek Circle. The staff is
unable to approve the Sonnenalp 's request for several reasons.
First, the Sonnenalp would be using either the public
right-of-way or Vail Associates ' land (Vista Bahn site - Tract
E) for dropping off skis. The Vail Associates' proposal was
acceptable to the staff, as the shuttle van would be using Vail
Associates ' property for the actual drop-off area.
The conditions of Vail Associates ' shuttle approval were that:
1. The van would pull off of Mill Creek Circle and unload
passengers on Vail Associates ' property to avoid any
conflicts with traffic.
2 . The van would be manned at all times to ensure that the
vehicle could be moved if necessary.
3 . The vehicles would be stored at the Golden Peak base
facility.
4 . The vans would run between 8:30 and 11: 00 AM and 2: 00 and
4: 00 PM. The estimated number of trips per time period
was 3 to 4.
Staff's opinion was that the Mill Creek Circle drop-off was a
better approach as opposed to the original idea of running a
shuttle on the bike path between the Village and Golden Peak or
Seibert Circle. Vail Associates had a logistical problem in
directing skiers to the appropriate starting points for their
ski lessons. The shuttle van helps VA to bring skiers who are
taking lessons to the appropriate starting points. This is an
important guest service that is critical to the functioning of
Vail Associates' Ski School.
Secondly, if the staff approved the Sonnenalp's request, all
other lodges would have to be allowed the same privilege to
drop-off skis or passengers in the Mill Creek Circle area. The
additional congestion that could occur on Mill Creek Circle is
not acceptable to the staff. Basically, the staff feels that
the type of ski valet service you are proposing is the same as
other shuttle vans run by lodges. These vans must operate in
compliance with guidelines for drop-off points which include
two sites in Lionshead and the Vail Transportation Center. The
Town has granted approximately 127 permits for shuttle vans.
If the staff were to approve your request, it would be very
difficult to say no to any of the other lodges who wish to
provide this service at Mill Creek Circle.
I hope you can understand our concerns with your request. The
staff appreciates the fact that you are trying to provide
additional guest services. However, this specific proposal is
not feasible. Recently, Vail Associates has installed many ski
lockers in the Vistabahn area. Perhaps renting these lockers
would be another means to provide this type of guest service.
If you wish to appeal the staff' s decision, your request would
be reviewed by the Town Council at a work session. Please
contact me if you wish to schedule a discussion with the
Council. It would also be necessary that you have written
permission from Vail Associates to use their land as a ski
valet drop-off.

RE: Sonnenalp Landscaping Adjacent to the Delivery Area
Dear Johannes,
The Town of Vail Finance Department is in the process of
reimbursing you for $3,600.00 for landscaping that has been
completed at the Sonnenalp Hotel. Recently, we received a copy
of your letter concerning the two trees adjacent to the trash
room on the west side of the Sonnenalp Hotel.
The staff' s point of view was made very clear and was marked on
approved landscape plans to indicate the relocation of the
trees. In addition, on November 26, Kristan sent a letter to
Mr. Ray Story concerning the trees adjacent to the dumpster.
We felt it was unreasonable to ask you to re-draw the landscape
plan for such a small change and therefore made notations to
the approved plans.
The staff realizes your opposition to the proposed stream walk
along Gore Creek and your reasoning behind planting trees in
this location in order to screen the delivery area. We believe
that guests of the Sonnenalp Hotel would view the stream walk
as a positive amenity. In the near future, we hope to be able
to show you design drawings for the path so that you will have
a more thorough understanding of what this project involves.
It appears that at this point the Town is interested in
proceeding with the stream walk project. We feel that you can
still accomplish the screening of the delivery and trash area
by moving the trees further to the east. The relocation of the
trees will avoid any further problems concerning the
displacement of the trees for the potential path.
IT.
The current placement of the trees is in violation of your
Design Review approval. For this reason, we have only returned
a portion of your letter of credit. The Town will keep the
$2,500. 00 to cover re-striping of the parking lot, relocation
of the two evergreens, and additional sod, topsoil and seeding
for the area adjacent to Gore Creek.
To resolve the issue of the tree location, we have suggested
several alternative solutions. First, you may re-apply to the
Design Review Board to revise your landscape plan to allow for
the trees to remain in their existing location. If you choose
this option we request that you submit an application by August
31, 1987 for the September 16th Design Review Board meeting.
Secondly, if you prefer to complete the landscape work
(seeding, tree relocation and striping) as listed above, we
request that the work be completed by September 23 , 1987. If
no Design Review Board approval is obtained for the existing
location of the trees, then the Town of Vail would utilize a
portion of the remaining money to relocate the trees further to
the east on your property.
Enclosed is a copy of the Design Review Board application for
you if you choose to resubmit your proposal to the Design
Review Board. Also enclosed are two xeroxes of landscape plans
with notations and the letter to Ray Story.

SUBJECT: Sonnenalp Swiss Chalet Building Permit for the
Faessler Residence Remodel
This Building Permit allowed the Faessler to remodel the fourth
floor of the Swiss Chalet in order to remodel three existing
dwelling units into two dwelling units. A GRFA exchange allowed
for the addition for the two bedrooms and common hall. On the
south side of the building on the fourth floor level, existing
GRFA was removed in order to create three larger balconies. On
the north side of the project a common hall was made into a
private hall for the two units. When the GRFA was originally
calculated for this project during the major remodel of 1986,
there was common area above and beyond what was allowed. The
additional common area had to be counted as GRFA. Due to the
fact that this common hall was already counted as GRFA, there is
no change in the original total of GRFA as it simply changed
from common area to straight GRFA. In both instances, the hall
was counted as GRFA. The two bedrooms were allowed due to the
fact that square footage was lost on the south side of the
building.
The dormers were approved by staff with Kathy Warren' s approval
as Chair of the Design Review Board. Given these circumstances,
the only statistic that has changed on the project is that the
fourth floor had a decrease in number of dwelling units from
three to two units. The total density for this project then
becomes 32 dwelling units or 60a.u. ' s plus 2d.u. ' s with a total
GRFA of 27,495 square feet.

RE: Review of Sonnenalp Landscaping
Dear Johannes,
I have reviewed the landscaping for the Sonnenalp remodel and
feel that I cannot give final approval to the plan until the
following items are addressed:
1. The two spruce trees planted at the southwest corner
of your property adjacent to the trash room must be
moved back to the east to allow for possible future
access down to the Town of Vail stream tract. I have
attached a letter dated November 26th which was sent
to Mr. Ray Story requiring that the landscaping
adjacent to the trash area be pulled back to the east.
I also indicated this on the building permit drawings
for the project.
2 . I feel that additional topsoil and seeding is needed
in the area directly south of the dumpster area. It
appears that some seed has been added to this area.
However, the soil is very gravelly and it seems that
some additional topsoil with more seed would be
helpful to returning this area to grass.
3 . The landscaping plan approval also requires that the
parking lot be restriped to show the new parking
configuration which actually increases the number of
parking spaces on your property. The restriping work
will need to be completed before I can sign off on the
final Certificate of Occupancy.
In general, I think the project looks outstanding and I hope
that these final details will be attended to quickly. I
especially like the patio area and new entrance. If you have
any questions about these concerns please feel free to call me.
Please let me know when this work has been completed and I will
be happy to come out and recheck the landscaping.

Please be advised that on June 15, 1987, Mike Chapman and Kraige Kinney
conducted an annual fire prevention inspection. Overall, the building
showed a very complete, comprehensive maintenance program. However, we did
find the following building or life safety violations that may contribute
to fire and smoke spread or increase life safety hazards:

1 . UFC 12.104E: Self closure is needed on the porch door by Room 403 to
completely close and latch the door.
2. UFC 11 .207: Fire rating is required for the attic space if it is to

ovens if grease laden vapors are produced; currently

GENERAL BUILDING AREAS
23. UFC 12.109: The east, west and center stairwells are considered
exit enclosures. However, they are furnished with
over-stuffed chairs, carpeting, and wooden hand rails.
Consult with the Fire Marshal as to whether these
combustible materials must be removed.
24. UFC 10.402: Secure and repair all linen chutes so they are securely
anchored to the wall, self-close and latch when the
door is released.
25. UFC 12.106E: The stairwells require the Stairwell Identification
System as outlined in the Uniform Fire Code, Appendix
I-B (attached with this letter) .
26. UBC 5103E: Pictorial signs shall be posted at all elevator call
buttons (except at the main entrance level) indicating,
"IN CASE OF FIRE, USE STAIRWELL, NOT ELEVATOR."
27. UFC 12.114B: Check and maintain all exit signs so all burnt out
bulbs are replaced, and all exit signs have at least
two bulbs illuminated at all times.
28. UFC 12.109: Storage closet under the east stairwell is apparently
classified as "storage in an exit enclosure." Such
storage is generally prohibited. Check with the
Building Department to see if this is permissible.
29. UFC 12.1090: In all exit stairwell enclosures, a barrier shall be
place at any point where the stairwell goes below
grade. If all these stairwells are considered "exit
enclosures" by the Building Department, barriers must
be installed.

30. UFC 12.114: Consult with the Building Department on placing exit
signage throughout the entire conference room level.
There are currently few, if any, exit signs on the
temporary room dividers or in the common hallways.
31 . UFC 12.103 : Remove the three doors stored in the south west
stairwell.
32. A Fire Department electrical shunt key must be, obtained
for the key access on the exterior of the building
(permit requirement) .
LOBBY / LOUNGE AREA
33. UFC 85.106B: Replace or repair the damaged or spliced wiring to the
lamp by the fireplace.
Please correct these conditions before July 12, 1987. Should you have any

the Bavaria Haus. In a previous letter I had asked that you remove the skating
rink by January 14, 1987. I decided to write you one more letter in order to
make it clear that if the rink is not removed by January 28, 1987, I will have
no choice but to cite you as the owner of the Sonnenalp property for the
parking violation. The specific section of the code which applies to the
parking problem is:
18.52.050 Construction and Maintenance
All off-street parking and loading facilities required by this chapter shall
be constructed and maintained in accordance with the minimum standards for
such facilities prescribed by this chapter, and shall be maintained free of
accumulated snow or other materials preventing full use and occupancy of the
facilities in accordance with the intent of this chapter, except for
temporary periods of short duration in event of heavy or unusual snowfall .
I feel that the date of January 28th for removing the skating rink provides
more than enough time to remedy the situation. I hope our department will not
end up having to issue a citation for the violation. If you wish to discuss

Re: Sonnenalp Easement Request
Dear Johannes:
The staff discussed your request to locate an easement for
computer and phone lines on Town of Vail property. To begin
the submittal process, please provide the staff with the
following information:
1. A survey for the general vicinity of the proposed
easement. The survey should indicate building edges, the
creek edge, grades, and the actual location for the
easement.
2 . A legal description of the easement.
3 . A written legal easement agreement. The Town Attorney
will need to review the wording of the agreement, but
basically it should address the term of the agreement as
well as the rights of the property owner and easement
user.
Once this information has been submitted, the staff will review
your request and it will be presented to the Town Council at a
work session for preliminary review. The easement would be
given final approval at a Town Council evening meeting.
It is important that you know we are interested in addressing
many of the unresolved issues related to the Sonnenalp property
when reviewing your easement request. These issues include:
1. The curling rink and valet parking: Staff has sent a
letter asking that you submit a site plan showing how you
will handle valet parking on the property. At this time,
the information has not been submitted.
2 . The evergreen tree on the southwest corner of the
Sonnenalp property. The tree has not been relocated. The
present location of the tree does not comply with your DRB
approval. In addition, we would also look at the option
of obtaining a permanent access easement across your
property adjacent to the Vail Road Bridge.
3 . Talisman access request. Peter Patten has been contacted
by the Talisman Association concerning their desire to
access their property through East Meadow Drive. They
have indicated that there are a number of problems with
the existing situation going through your property. Due
to the obvious serious implications of the access from the
mall, we would like to discuss the resolution of these
problems and the attainment of an easement for the
Talisman across your property.
4 . Fire access on the northeast corner of the Swiss Chalet:
The Fire Department and Community Development Department
had asked that you remedy this situation by moving the
boulders per the approved DRB access plan. You had agreed
to move the boulders as soon as possible. According to
the Fire Department, this work has not been completed.
Once again, we will emphasize that this is a very

I have been the owner of Condominium No. 340 in the Talisman
Condominiums since 1970. I direct your attention to two items
which require your attention and assistance:
1. Someone has placed cables along the side of Gore Creek
on the town property directly in front of my apartment. These
cables are both unsightly and dangerous and I am strongly opposed
to their presence. I believe that they should be removed by the
town immediately. I am enclosing photographs which are self
evident as to the arrogance of the user.
2. The Sonnenalp East has placed a rain gutter directly
in front of my window which affects my view of Golden Peak and the
Village of Vail. I don't know if this was done maliciously or
just stupidly, but there is no reason why the down spout and gutter
could not have been placed 10 inches to the left. In any event,
it affects my sight line and shows a serious lack of sensitivity
on the part of the people who installed it. I am also enclosing
pictures of the down spout and the way it affects my view.
May I hear from you at your earliest convenience as to what steps
are being taken with respect to these complaints.

Dear Johannes:
I am disappointed to learn that the computer lines for which
you requested an easement from the Town of Vail this winter
have already been placed on Town of Vail property. Kristan
Pritz' January 11, 1988 letter to you outlining the process by
which you could obtain an easement from the Town of Vail
assumed the lines were not in place. The lines in their
existing state present problems from both an aesthetic and a
safety standpoint.
I am now receiving complaints about these computer and phone
lines from adjacent property owners and am hereby requesting
you to promptly remove them. I urge your cooperation in this
matter. If you wish to obtain an easement from the Town of
Vail to place the computer lines in a proper manner, I refer
you to the enclose January 11, 1988 correspondence. I believe
a number of the issues noted on page 2 of the letter have been
resolved with the exception of the evergreen tree on the
southwest corner. I would expect that resolution of that
problem would be an element in our discussions to grant you an
easement, among the other more standard considerations on our
part.

Re: Sonnenalp Easement Request
Dear Johannes:
The staff discussed your request to locate an easement for
computer and phone lines on Town of Vail property. To begin
the submittal process, please provide the staff with the
following information:
1. A survey for the general vicinity of the proposed
easement. The survey should indicate building edges, the
creek edge, grades, and the actual location for the
easement.
2 . A legal description of the easement.
3 . A written legal easement agreement. The Town Attorney
will need to review the wording of the agreement, but
• basically it should address the term of the agreement as
well as the rights of the property owner and easement
user.
Once this information has been submitted, the staff will review
your request and it will be presented to the Town Council at a
work session for preliminary review. The easement would be
given final approval at a Town Council evening meeting.
It is important that you know we are interested in addressing
many of the unresolved issues related to the Sonnenalp property
when reviewing your easement request. These issues include:

1. The curling rink and valet parking: Staff has sent a
letter asking that you submit a site plan showing how you
will handle valet parking on the property. At this time,
the information has not been submitted.
2 . The evergreen tree on the southwest corner of the
Sonnenalp property. The tree has not been relocated. The
present location of the tree does not comply with your DRB
approval . In addition, we would also look at the option
of obtaining a permanent access easement across your
property adjacent to the Vail Road Bridge.
3 . Talisman access request. Peter Patten has been contacted
by the Talisman Association concerning their desire to
access their property through East Meadow Drive. They
have indicated that there are a number of problems with
the existing situation going through your property. Due
to the obvious serious implications of the access from the
mall , we would like to discuss the resolution of these
problems and the attainment of an easement for the
Talisman across your property.
4 . Fire access on the northeast corner of the Swiss Chalet:
The Fire Department and Community Development Department
had asked that you remedy this situation by moving the
boulders per the approved DRB access plan. You had agreed
to move the boulders as soon as possible. According to
the Fire Department, this work has not been completed.
Once again, we will emphasize that this is a very
dangerous situation, as fire trucks are presently unable
to access through this area. The signs that have been

proposal for employee housing and ask that you submit the following:
1. A stamped survey with topographic lines.
2 . A 4Oo slope analysis.
3 . Floor plans.
4 . All elevations.
5. A written proposal describing your project, including the extent

Re: Removal of trees along Town of Vail Stream Tract
Dear Johannes,
This letter is written in order to give you official notice that if you
wish to maintain or remove any vegetation along the Town of Vail Stream
Tract, approval from the Town of Vail must be obtained before any work
is started. It is inappropriate for an adjacent property to go onto
Town of Vail property and remove any vegetation without first obtaining
permission from the Town.
We hope you can see the reasonableness of this position. We are simply
requiring that as property owners the town be informed of and have the
opportunity to review, approve, and or deny, an adjacent property
owner's request to remove community owned trees.
The Town of Vail Design Review Guidelines state specifically that
removal of vegetation must receive design approval either from the
staff or Design Review Board. I have listed these sections of the code
below for your benefit:
18.54. 030 Design Approval
A. No person shall commence removal of vegetation, site
preparation, building construction or demolition,
dumping of material upon a site, sign erection, exterior
alteration or enlargement of an existing structure,
paving, fencing or other improvements of open space
within the corporate limits of the Town of Vail unless
design approval has been granted as prescribed in this
chapter. The addition of plant materials to existing
landscaping, gardening and landscape maintenance shall
be exempt from this provision.
B. It shall be a violation of this chapter and the
building permit for any person to commence, continue or
complete work that has not received design approval as
prescribed in this chapter and or is not in conformity
with the plans approved and authorized by the zoning
administrator and or DRB and the chief building
official.

Removal of tress, shrubs, and other native vegetation
shall be limited to removal of those essential for.
development of the site or those identified as
diseased.
We appreciate adjacent property owners who are willing to water and do
the minimal maintenance to keep the landscaping looking healthy.
However, the cutting down of trees is not supported by the Town of Vail
unless there are special considerations which make the removal of the
vegetation the most prudent action.
I must emphasize that if you wish to do any additional maintenance of
landscaping on Town of Vail property, you first obtain the Town's
