Department, the estimated time for a total review may take as long

Dear Mr. Daniels:
The Board of Directors of the Sundial Townhome Association is in receipt of
your revised drawing for installation of an access window dated August 11,
1992. This drawing addresses the concerns expressed in my letter of August
1992. You have indicated the excavation of a gravel pit below the window
well that will assist in drawing water away from the foundation. You have
satisfied the Board's questions regarding the nature of the window and
indicated how you intend to reconstruct the wall beneath this window.
This letters serves as notification that the Board has approved this installation
and accepts your proposal. You may use this letter in ensuring the Town of
Vail that you have received Homeowner Association approval.
As mentioned in our prior correspondence, by proceeding ahead with this
construction, you relieve the Homeowner's Association of any obligation to
repair or maintain this wall, your installations, the window or the window
well. These improvements are the responsibility of the owner of Unit B-4 and
not a Homeowner's Association responsibility. Further, any damage to the
unit that is caused in whole or in part as a result of this modification will be
the sole responsibility of the unit owner. We appreciate your working with
the Homeowner's Association to clarify these issues and I look forward to
seeing you on my next visit to Sundial.
