Samson Companies, Inc. 2121 N Frontage Rd, W Vail, CO 81657 Permit B04-0021 Musella Residence Dear Greg: The purpose of this letter is to clarify the Town of Vail Building Safety and Inspection Service's position regarding the above referenced project. First I apologize for the erroneous information I have provided previously. It is not how the Town of Vail or I conduct business. Secondly this has stimulated much discussion amongst our team regarding interpretation of the code and the consistent application of it. The proposed change in use of the under floor area submitted to me, does require an emergency escape and rescue opening. The basis for this decision is our conclusion that any under floor area over five feet in head height with permanent access is a basement. Per the 1997 Uniform Building Code (UBC) Section 310.4 Access and Means of Egress Facilities and Emergency Escapes,Basements in dwelling units and every sleeping room below the fourth story shall have at least one operable window or door approved for emergency escape or rescue that shall open directly into a public street,public alley, yard or exit court. Permanent access would be a set of stairs constructed to meet the requirements of the UBC Section 1003.3.3 Stairways (see attached). If the owner desires to make the under floor area more usable by pouring a concrete floor without increasing the head height to greater that five feet the building department would have no objection. If the space is to be habitable a minimum head height of 7'6"would be required. Light and ventilation would also be required per UBC Chapter 12 (see attached), which the emergency egress opening would most likely meet. The Town of Vail Building Safety and Inspection Services strives to be fair and consistent in the application for the building code. To that end I have researched our files back to 1995, and determined that all of the other basement conversions that have been %il RECYCLED PAPER done, have an emergency egress window meeting the requirements outlined above, regardless if the basement was finished or not. I hope this provides you and Mr. Musella with the information necessary to decide how you wish to proceed with this project. All commercial (large or small) and all multi-family permits will have to follow the above mentioned maximum requirements. Residential and small projects should take a lesser amount of time. However, if residential or smaller projects impact the various above mentioned departments with regard to necessary review, these projects may also take three (3) weeks to review and approve.
