In response to your letter, the proposed Ever Vail plat appears to show the 20' hatched area as ROW that may be
dedicated to the Town of Vail or CDOT. I believe this corridor is where our new primary electric feeders are designed to
be installed (correct me if I'm wrong). It is our requirement that our facilities be installed in a private easement on
private property or, at a minimum, in ROW controlled by the Town, not in CDOT ROW. Please let me know.

Energy upon completion of appropriate contractual agreements and subject to necessary governmental
approvals.
