Box 959 137 Benchmark Road ' Avon, CO 81620-0959 PROPERTY: Proposed Ever Vail Subdivision, Town of Vail 'i SUBJECT: Ever Vail Initial Letter for Water and Sewer Service �� Dear Mr. Kennedy, In response to your request, I am writing to outline the Eagle River Water& Sanitation District's procedures to obtain water and sewer service to the proposed Ever Vail development(Project). The Eagle River Water& Sanitation District (District) is aware of Vail Resort Development Company's (VRDC) plan to develop the Ever Vail Project in the West Lionshead area of the Town of Vail (Town). The District is the utility provider for both water and sewer service within the Town's boundary. � This Initial Letter is intended to explain the District's Development Approval Process required for obtaining water and sewer service for new development and re-development projects. The District's process entails 4 steps: 1. Project Definition: requires submission of property descriptions and project scope. 2. Inclusion of property into the District's boundaxy: all properties proposed to receive water and wastewater service must be included within the District's service area boundaries. 3. Water Rights Dedication: water of sufficient quantity, location and timing to serve the uses of the proposed development must be provided by the Developer. Such provision may be accomplished through the dedication of water rights, or at the discretion of the District's Board of Directors, through a cash in lieu of water rights dedication payment. 4. Infrastructure Approval: includes District review and approval of Developer's plans for water and sewer main extensions, construction by the Developer, inspection by the District, and conveyance of new infrastructure from the Developer to the District. This step also includes dedication of treated water storage sufficient to serve the development, or at the District's discretion, payment of a treated water storage fee in lieu of storage dedication. The District is aware of the following facts related to the Ever Vail Project at this time: • VRDC is in the planning review process with the Town for zoning changes, creation of a new Ever Vail subdivision, and amendments to the Lionshead Redevelopment Master Plan for several existing properties within the proposed development. • All of the property within the proposed area of the Project is included in the District boundaries. � WATER,WASTEWATER,OPERATIONS 8c MANAGEMENT SERVICES � F:\ISWSD\4CIP\WATER RIGHTS\ERWSD\EVER VAIL\EVER VAIL INITIAL LETTER.DOC Bill Kennedy , January 5, 2011 i Page 2 �� �..�. • The Project includes plans to move portions of the South Frontage Road adjacent to I-70, and to incorporate vacated portions of the South Frontage Road into the Development. • VRDC and its Engineer, Alpine Engineering (Alpine),have met with the District to introduce the Project and discuss water and wastewater infrastructure requirements related to re-alignment of the South Frontage Road, and also to discuss infrastructure requirements of the proposed Project. The proposed Project as discussed with the District is subject to change during the Major Subdivision process with the Town. • Water and wastewater infrastructure currently exists within the boundaries of the Project; some up-sizing will likely be required to serve the Project. Alpine has been in contact with the District's water and wastewater modeling engineer, Schmueser, Gordon, Meyer, regarding sizing of mains for this Project. • The proposed development will result in increased density and water use and will increase � demand for wastewater treatment. A water demand worksheet providing details of such increased demand for District services was submitted to the District in November, 2009, but an updated Water Demand Worksheet has not been submitted. To complete Step 1. Definition, the District will need the following: • Submission of an electronic boundary for the Ever Vail Subdivision. • Access to the property to perform fixture assessment of the existing commercial development on � the Property. • Information for the District to assess existing residential square footage on the Property. All District requirements for Step 2. Inclusion have been completed. Upon completing the District's Development approval process and upon satisfying the District's approval conditions to receive service, the District intends to serve the Project. I This is not an Ability to Serve Letter, as referenced in § 29-20-304, C.R.S.,but is intended to indicate �� that we are ready and able to supply such a commitment when the above conditions, and any other I conditions imposed on the developer that arise during the District's Developer Approval Process, are ', met.
