are made directly on the form, the Town will presume that there are no problems and the development can
proceed.
2, If a utility company has concerns with the proposed construction, the utility representative shall note directly
on the utility verification form that there is a problem which needs to be resolved. The issue should then be
detailed in an attached letter to the Town of Vail. However, please keep in mind that it is the responsibility of the
utility company and the applicant to resolve identified problems.

C. All seed shall be furnished in bags or containers clearly labeled to show the name and address of
the supplier, the seed name, the lot number, net weight, origin, the percent ofweed seed conteng
the guaranteed percentage ofpurity and germination, pounds ofpure live seed (PLS) ofeach
seed species, and the total pounds of PLS in the container. All brands shall be free from
noxious seeds as Russian or Canadian Thistle, Europe and Bindweed, Johnson Grass, and kaff
Spurge. The Contactor shall furnish to the Engineer a signed statement certiffing that the seed
is from a lot that has been tested by a recognized laboratory for seed testing within six months
prior to the date of delivery. Seed which has become we! moldy, or damaged in transit or in
storage will not be acceptable. Seed types and arnount of PLS required per acre shall be
provided in accordance with the Contract. Seed and seed labels shall conform to all current
State and Federal regulations and will be subject to the testing provisions of the Association of
Official Seed Analysis. Computations for quantity of seed required on the project include the
percent ofpurity and percent ofgermination. Ifseed available on the market does not meet the
minimum purity and germination percentages specified, the Confractor must compensate for a
lesser percentage of purity of germination by fumishing sufficient additional seed to equal the
specified project. Product comparison shall be made on the basis ofPLS in pounds, stated one
each seed bag. The formula used for determining the quantity of PLS shall be : Pounds of Seed
x @urity x Germination) = Pounds of PLS.

Use "Biosol" or other Engineer approved natural fertilizer having the following guaranteed

B. Fertilizer shall conform to the applicable State fertilizer laws. It shall be uniform in
composition, dry and free flowing, and shall be delivered to the site in the original unopened
containers, each bearing the manufacturer's guaranteed analysis. Fertilizer which becomes
caked or damaged will not be accepted.
TOPSOIL
Material stripp"d from site consisting of loosg friable loam, reasonably free of admixtures of subsoil,
refuse, shrmps, rocks, brush, weeds, or other material detimental to proper development of vegetative
growth.
STRAWMULCIIING
Straw or hay, free ofnoxious weeds, containing not more ttran 5% seed by weight.
Straw shall be in natural, field-cut lengths, not chopped or in lengths less than 12", typically.
ITYDRAULIC MT]LCHING
Wood cellulose fiber for hydraulic mulching shall not contain any substance or factor which might
inhibit germination or growth of grass seed. It shall be dyed an appropriate color to allow visual
chemical analysis:

metering of its application. The wood cellulose fibers shall have the property of becoming evenly
dispersed and suspended when agitated in water. When sprayed uniformly on the surface ofthe soil, the
fibers shall form a blotterlike ground cover which readily absorbs water, and allows infiltration to the
underlying soil. Weight specifications from suppliers, and for all applications, shall refer only to air dry
weight of fiber, a standard equivalent to l0 per cent moisturc. The mulch material shall be supplied in
packages having a gross weight not in excess of 100 pounds, and shall be marked bythe manufacturer to
show the air dry weight content. The Contactor shall obtain certifications from suppliers that laboratory
and field testing of their product has been accomplished, and that it meets all of the foregoing
requirements pertaining to wood cellulose fiber mulch.
PART3-DGCUTION
3.01 TOPSOILEXCAVATION

Remove all sod, topsoil, organic earth. Stockpile topsoil as designated on drawings, or directed by
Engineer.
TOPSOILPLACEMENT
A. General: When job has been shaped and ready for placement oftopsoil, cover all cut-fill areas
and construction scars with topsoil to depth of6". Contour all surfaces in accordance with
drawings to blend with existing adacent terrain. Deposit all excess topsoil in areas designated
by Engineer. Grade, shape, fertillze, seed, and mulch designated topsoil waste area.
B. Slope Rounding: Round top and bottom of slopes and feather into undisturbed natural terrain.
Avoid abrupt grade changes by making smooth transitions from slopes to more level areas.
C. Slope Molding: Avoid long, continuous slope faces by molding face of slope to accent existing
adjacent terain. Steepen slope faces near ridges and bluffs, laid back to link to natural draws,
creating an undulating face.
D. Surface Roughing: Gouge slope surfaces of4: I or steeper with horizontal ridges and trenches
to minimum depth of 6", creating roughened surface to lessen erosion, improve moisture
percolation, and soil-layer binding. Trenches or ridges shall not be longer than 30' to prevent
water accumulation or flowins water to cause rivulets.
SEEDING
A. Apply seed mix at uniform rates indicated.
B. Hydraulically seed all slopes.
3.04 FERTILIZING
Apply fertilizer at rate of 1000 lbs per acre.
IIYDRAT]LIC MULCHING AND TACKIFIER
A. Straw Mulching: Apply to all areas, after seeding and watering has been completed, at uniform
coverage rate of80 baleVacres.

B. Hydraulic Mulching and Applying Tackifien Hydraulic mulch and tackifier shall be applied to
all areas after seeding and straw mulching. Cellulose fiber mulch shdl b€ added after the
proportionate quantities ofwater and other approved rnaterials have been placed in the slurry
tank. All ingredients shall be mixed to form a homogeneous slurry. The operator shall spray
the slurry mixnue uniformly over 0re designated seeded area Unless otherwise ordened for
specific areas, wd cellulose fiber mulch shall be applied at a rate of200 pounds per acr€.
Hydraulic mulching shall not be done in tlre presence of free surface water. Mulch tackifier
shall be applied over the seeded area at a rate of200 pounds per acre.
WATERING
When required by Engrneer, apply water at rate specified on the plans until project acceptance.

Thls process is called "kerfing."
Roberts supplies a clear rubber silicone sealant to be used to apply
the extrusion to clean and level surfaces.'l'his silicone will stretch to
thrce times lts original size and will adhere in suh-zero or extrcmely
hiSh temperaures.

The proposed Forest Place development is located at Tract A, Lots 1-4, offof Forest Road in
Lioniheld, Vail, Colorado, in Eagle County. It is located in the North half of Section 7,
Township 5 South, and Range 80, West of the 6* Principal Meridian.

The site consists of a variable cover of grass and dirt with minimal spruce and aspen
trees. Grass covers approximately 80o/o of the site.

Vehicle fqeling will be done wherever construction is taking place by mobile fuel trucks.
Fertilizers or chemicals will be stored in a trailer or covered with a waterproof material.

The site drains to the Gore Creek.
3. BMPs FOR STORMWATER POLLUTION PREVENTION
(a) Erosion and Sediment Controls:
1. Structural Practices
Scdiment transport is to be ntinimized on the site by silt fence and straw bale check dams.
Silt fence shall be used to filter sediments from small disturbed areas that are in sheet
flow. Straw bales shall be used to dissipate velocities along ditches and at culvert inlets
while revegetation of ditches is taking place.
Silt fence will be kept in a state of repair throughout the project, and sediments will be
cleaned out from behind straw bale check dams after each rainfall event and/or when
sediment is built up to one half the capacity.
2. Non-structural Practices
Ditches that are used during construction shall be seeded, fertilized and mulched as soon
as they are installed. Once construction is complete and the disturbed areas are stabilized
the ditches are to be removed and the disturbed area from this activity shall be topsoiled,
seeded, fertilized and mulched.
Disturbed areas from water and sewer lines, shallow utilities, building construction and
grading shall be topsoiled, seeded, fertilized and mulched.
Damage to trees and mature vegetation is to be kept to a minimum. Limits of disturbance

are to be kept to the minimum area possible.
(b) Materials Handling and Spill Prevention
Stockpiles oftopsoil and road base material shall have proper sediment controls such as
silt fence sunounding them. Equipment maintenance or fueling operations will take place
wherever the construction equipment is working at the time. Care should be taken to
avoid spills during maintenance and fueling operations, and any accidental spills shall be
cleaned up promptly and completely. Should above-ground temporary fuel tanks be
placed on-site, an earth berm shall be constructed around the tank area to contain any
possible spills or leaks to prevent any spilled material from entering state waters. The
contractor shall prepare a plan that immediately mitigates all problems associated with
any potential fuel sPills.
There shall be no fertilizers or chemicals left exposed to the elements. The contractor
shall prepare a plan that immediately mitigates all problems associated with any potential
fertilizer or chemical exposure or accident. There shall be no dedicated concrete batch
plants or dedicated asphalt plants on the site'
The contractor shall not discharge concrete wash water into state waters or the storm
sewer system.
Should the status of any of these items change, a revision to the stormwater management
plan shall be submitted u'ith response procedures identified'
4. FINAL STABILIZATION AND LONG-TERM STORMWATERMANAGEMENT
Final stabilization shall occur by topsoiling, seeding, fertilizing and mulching all disturbed areas.
Final stabilization is reached when all soil disturbing activities at the site have been completed,
and uniform vegetative cover has been establishcd with a density of at least 70 percent of pre-
disturbance levels or equivalent perrnanent, physical erosion reduction methods have been
employed.
5. OTHERCONTROLS
Off-site soil tracking will be limited by providing a stabilized construction entrance at the
entrance to the project or wherever temporary dirt access roads meet Hummingbird road. The
stabilized construction entrance will consist of2" crushed screen rock 10 feet wide for a length of
50 feet at the entrance to the site. The contractor is responsible for not tracking soil off-site.
6. INSPECTION AND MAINTENANCE
The permittee shall make a thorough inspection of their stormwater management system at least

The operator shall keep a record of inspections. Uncontrolled releases of mud or

releases as well as any measure taken to clean up the sediment that has left the
site. This record shall be made available to the Division upon lequest.
7. REPORTING
If the construction activity lasts more than l2 months, a copy of the inspection record shall be
sent to the water Quality control Division by May I of each year, covering April I to March 3l
of each year.
8. RETENTION OF RECORDS
(a)ThepermitteeshallretaincopiesoftheSWMPandallreportsrequiredbythis
permit and records of all data used to complete the application to be recorded by
this permit, for a period of at least three years from the date that the site is finally
stabilized.
(b) The permittee shall retain a copy of the SWMP required by this permit at the
consiruction site from the date of project initiation to the date of final
stabilization.

Amendment to the 1999 N.E.C. Town of Vail Ordinance 10-1-6.
Overhead services are not allowed in the Town of Vail.
Underground services have to be in conduit (PVC) from the transformer to the electric meter, main disconnect
switch and to the first electrical distribution circuit breaker panel.
The main disconnect switch shall be located next to the meter on the exterior wall of the structure easilv
accessible.
All underground conduits are required to be inspected before back-filling the trench.
In multi-family dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common
walls and spaces are accepted.
NM Cable (Romex) is not allowed in commercial buildings or structures exceeding three (3) stories.
No use of aluminum wire smaller than size #8 will be permitted with the Town of Vail.
TOWN OF VAIL ELECTRICAL PERMIT GUIDELINES
All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade, you must also obtain a building permit.
If this permit is for installation of an exterior hot tub or spa on any existing deck or elevated platform,
a structural engineer must review the existing condition and verify that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
If this is a remodel in a multi-family building with a homeowners association, a letter of permission
from the association is required.
If this permit is for a commercial space, two (2) sets of stamped drawings are required.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Depaftment review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
The Town of Vail Public works Depaftment will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culvefts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at479-2198 to request an insDection from
the Public Works Department. Allow a minimum of 24 hour notice.
Also, the Town of Vail Public works Department will be approving all final drainage
and culveft installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Certificate of Occupancy issuance.

u Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand/ gravelr rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
o Notice; Abatement: The Director of Public Works may notify and require any person who viotates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocksf mud, dirt, snow, icef debris or any other material to be removed
from any street or alley at the expense of the notified.
u Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 of this code.
o Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of

No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to interfere with the free movement of vehicular traffic or proper

Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a
street or upon any place within this Municipality in such a manner as to constitute a violation of any
section of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in

\ 2. To secure and guarantee performance of the obligations as set forth herein, the
Developer agrees to provide collateral as follows:
A cash deposit qccount with the Town of Vail, as escrow agent, in the amount of

Agreement, in the event there is a default under this Agreement by the Developer.
3. The Developer may at any time substitute the collateral originally set forth above
for another form of security or collateral acceptable to the Town to guarantee the faithful
completion of those improvements referred to herein in this Agreement and the performance of
the terms of this Agreement. Such acceptance by the Town of alternative security or collateral
shall be at the Town's sole discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or'6ccurring to the work specified in this
Agreement prior to the cryBletion and acceptance of-the same, nor shall the Town, nor any

r 5. lt is mutually agreed that the Developer may apply for and the Town may
auftlorize a partial. release of the qgllateral deposited with the Town for each category of
improQment after thg sutihct imprdrement is constructed in compliance with all plans and
specififbtifns as referenced hereqSder and accepted by the Town. Under no condition shall the
dollar amount of the collaterd that i-s lging held by the Town be reduced below the dollar amount
necessary to cornplete all unconQ{rted improvements referred to in this Agreement.
]}t 6. lf the Tcrrun determines, at its sole discretion, that any of the improvements
referred b in thp Agreement.are not constructed in compliance with the approved plans and
specifications fileE{r the olffice of the Community Development Department of the Town of Vail or
not accepted by the Town lls complete on or before the date set forth in Paragraph 'l of this
Agreement, the Towil may, but shall not be required to, draw upon the security referred to in this
Agreement and complete the uncompleted improvements referred to in this Agreement. Pursuant
to Section 12-11-8, Vail Town Code, the Temporary Certificate of Occupancy refened to in this
Agreement may be revoked until all improvements referred to herein are completed by the
Developer or the Town in accordance with this Aoreement.

lf the costs of completing the uncompleted improvements referred to in this Agreement
exceed the dollar amount of the deposit, the excess, together with interest at twelve percent
(12%) per annum, shall be a lien against the property and may be collected by civil suit or may be
certified to the treasurer of Eagle County to be collecled in the same manner as delinquent ad
valorem taxes levied against such property. lf the Developer fails or refuses to complete the
improvements refened to in this Agreement, such failure or refusal shall be considered a violation
of Title 12 (Zoning Regulations), of the Vail Town Code, and the Developer shall be subject to
penalties pursuant to Section 12-3-10 (Violations: Penalties) and Chapter 14 (General Penalty),
of the Vail Town Code.
7. The Developer shall warranty the work and materials of all improvements refened
to in this Agreement located on Town property or within a Town right-of-way, pursuant to Chapter
8-3, of the Vail Town Code, for a period of two years after the Town's acceptance of said
improvements.
8. The parties hereto mutually agree that this Agreement may be amended from time
to time, provided that such amendments be in writing and executed by all parties hereto.
