L Two mylar copies and one paper copy, of the subdivision plat shall be submitted to
the Department of Community Development. The plat shall include the following:
a. The final plat shall be drawn by a registered surveyor in lndia ink, or other
substantial solution, on a reproducible medium (preferably mylar) with
dimension of twenty-four by thirty-six inches and shall be at a scale of one
hundred feet to one inch or larger with margins of one and one-half to two
inches on the left and one-halfinch on all other sides.
b. Accurate dimensions to the nearest one-hundredth of a foot for all lines,
angles and curves used to describe boundaries, streets, setbacks, alleys,
easements, structures, areas to be reserved or dedicated for public or common
uses and other important features. A1l curves sha1l be circular arcs and shall
be definedbythe radius, central angle, are scored distances and bearing. All
dimensions, both linear and angular, are to be determined by an accurate
control survey in the field which must balance and close within a limit of one
in ten thousand.

An identification of the streets, alleys, parks, and other public areas or
facilities as shown on the plat, and a dedication thereofto the public use. An
identification ofthe easements as shown on the plat and a grant thereofto the
public use. Areas reserved for future public acquisition shall also be shown
on the plat.
A written survey description ofthe area including the total acreage to the
nearest appropriate significant figure. The acreage ofeach lot or parcel shall
be shown in this manner as well.
A description of all survey monuments, both found and set, which mark the
boundaries of the subdivision, and a description of a1l monuments used in
conducting the survey. Monument perimeter per Colorado statutes. Two
perimeter monuments shall be established as major control monuments, the
materials which shall be determined by the town engineer.
A statement by the land surveyor explaining how bearing base was
determined.
A certificate by the registered land surveyor as outlined in Chapter l7 32 of
this title as to the accuracy ofthe survey and plat, and that the survey was
performed by him in accordance with Colorado Revised Statutes 1973, Title
38, Article 51.
A certificate by an attorney admitted to practice in the State of Colorado, or
corporate title insurer, that the owne(s) ofrecord dedicating to the public the
public right-of-way, areas or facilities as shown thereon are the owners
thereof in fee simple, free and clear of all liens and encumbrances except as
noted.
The proper form for filing of the plat within the Eagle County clerk and
recorder.
All current taxes must be paid prior to the Town's approval of plat. This
includes taxes which have been billed but are not yet due. The certificate of
taxes paid must be signed on the plat or a statement from the Eagle County
Assessors Office must be provided with the submittal information stating that
all taxes have been paid.
Certificate of dedication and ownership Should the certificate of dedication
and ownership provide for a dedication of land or improvements to the public,
all beneficiaries of deed of trust and mortgage holders on said real property
will be required to sign the certificate of dedication and ownership in addition
to the fee simple owner thereof

The plat must contain the following statement: "For zoning purposes:, the lots created
by this subdivision are to be treated as one lot with no more than two dwelling units
allowed on the combined areas of the two lots." The statement shall be modified to
indicate the number ofunits and lots proposed.
A copy ofthe declarations and/or covenants relating to the subdivision, which shall
assure the maintenance of any common areas which may be created. The covenants
shall run with the land and shall be in a form suitable for recording with the Eagle
County Clerk and Recorder.

F. APPROVAL PROCESS, REVIEW CRITEzuA
The burden of proof shall rest with the applicant to show that the subdivision complies with the
zoning ordinance with respect to building location and other aspects of the structure and ground, with
the original plat as approved by the Design Review Board ofthe Town and the accurateness and
integrity ofthe survey data found on the plat.
Upon receiving two copies of a complete submittal along with payment of the appropriate fee, the
zoning administrator shall route one copy ofthe site map to the town engineer for his review. The
zoning administrator shall then conduct this review concurrently. The town engineer shall review the
submittal and return comments and notifications to the zoning administrator who shall transmit the
approval, disapproval or approval with modifications of the plat within fourteen days to the applicant.
The zoning administrator shall sign the plat if approved or required modifications on the plat for
approval or deny approval due to inconsistencies with the originally approval plan or failure to make
other required modifications of the plat.
G. FILING AND RECORDING
The Department of Community Development will record the plat and any related covenants with the
Eagle County Clerk and Recorder. Fees for recording shall be paid by the applicant. the Community
Development Department will retain one mylar copy of the plat for their records and will record the
remaining mylar copy.
Ifthis application requires a separate review by any local, State or Federal agency other than the
Town of Vail, the application fee shall be increased by $200.00 Examples of such review, may
include, but are not limited to: Colorado Department of Highway Access Permits, Army Corps of
Engineers 404, etc.
The applicant shall be responsible for paying any publishing fees which are in excess of50% ofthe
application fee. I{ at the applicant's request, any matter is postponed for hearing, causing the matter
to be re-published, then, the entire fee for such re-publication shall be paid by the applicant.

Applications deemed by the Community Development Department to have significant design, land
use or other issues which may have a significant impact on the community may require review by
consultants other than town staff Should a determination be made by the two staffthat an outside
consultant is needed to review any application, the Community Development may hire an outside
consultant, it shall estimate the amount of money necessary to pay him or her and this amount shall
be forwarded to the Town by the applicant at the time he filed his application with the Community
Development Department. Upon completion of the review of the application by the consultant, any
of the funds forwarded by the applicant for payment of the consultant which have not been paid to
the consultant shall be returned to the applicant. Expenses incurred by the Town in excess ofthe
amount forwarded by the applicant shall be paid to the Town by the applicant within 30 days of
notification bv the Town.

My client wishes to make a change that etfects the presentation to and
approval by the Design Review Board.
The request is to eliminate the copper band at the roof's edge. Please
note the drawing shown on sheet 6, detail "D" of the approved plans. In
lieu of the copper edging, my client is requesting cedar shakes to the
eave with a cold roof. That roof area over the entry to unit 1 is to remain
copper.

Dear Mr. Pipcr:
As we discussed last week, I am providing an analysis of debris-flow hazard to the proposcd
Ray residence in Vail. According to Town of Vail hazard maps, the proposed building is
located in a "moderate hazard" debris-flow area dcfined as follows:
DEBRIS FLOW (MODERATE HAZARD)
"These areas can expcriencc property damage through flooding,
erosion and impact of muddy water, soil, rock, and debris."
This modcrat e hazard designation was dctermined in 1984 after study' of the slopes, soil, and
vegetation in the small drainage basin abovc the site, study of the alluvial fan upon which the
Glen Lyon Subdivision is located, and considcration of natural and man-made tenain features
on this alluvial fan. Drainage-basin and alluvial fans have not been changed, therefore the
potential for debris flows remains, however, several buildings have been built on the fan
above the proposed Ray residence since 1984.
CURRENT CONDITIONS AND HAZARD
Debris flows of the type that can cover lowcr portions crf the Glen Lyon Subdivision,
including the subject property, will consist primarily of muddy water and small stones
transportcd on the relativcly steep stopcs of thc fan. During a given cpisode of flooding and
debris flows, sevcral distinct surges of mud, rocks, and cntrained debris may occur in the
upper channel. Most of the material mass and energy will stop above the upper ieg (soutt'.ern
end) of Greenhill Court. As additjonal watcr discharges from the channei, the recentl'i -'
deposited debris will be eroded and transported across and down the alluvial fan, following
unpredictable channels and directions. Thesc small, muddy flood flows will be generally less
than onc foot thick and will transport stoncs lcss than six inchcs in diamctcr. Thcsc flows
can damage landscaping through erosion and deposition, but will not cause significant damage
to buildings unlcss windows or other openings at or slightly above grade enable material to
enter the building. In such cases, damage will obviously result; interior surfaces and
furnishings may be flooded by mud and stoncs.

Debris flows and muddy floods of the type dcscribed have obviously occurred and are
possible. However the probability of such events is small (or the "return period" is long).
An accurate estimate of the return period cannot be made because long-term records of debris
flows are not available here. A rough estimate of the rcturn period, judging from
observations of the alluvial fan and soil development, is at lcast several centuries at the Ray
residence. This means the annual orobabilitv of a debris flow is less than one percent.
RECOMMENDED DEBRIS FLOW MITIGATION
The existing buildings above thc proposcd Ray residence will themselves serve as debris-flow
mitigation structures because a flow directed toward the Ray residence will be intercepted by
the upper buildings. Some portion of the flow volumes may be diverted around the cxisting
buildings and reach the Ray site. Therefore, some type of mitigation will be required.
Thc uphill building walls 1 -- 8, (scc attachcd figurc) should be reinforced for static forccs
associated with deposition of debris and muddy water. Design for impact will not be required
because of the energy-dissipating effect of the upper buildings discussed above. As shown in
the figure inset, the pressure wedge resulting from flow deposition decreases from a
maximum of 80 lbs/ft'? at grade, to zero at two feet above grade. There exist no requirements
about the type of vertical building surfaces built within this two-foot mitigation zone.
Windows and doors are acceptable if they resist the design loads. One simple solution is to
ensure that no windows are within this two-foot zonc and to provide reinforcement within the
lower two feet of garage doors or other doors.
COMPLIANCE WITH VAIL ORDINANCE
This study concludes that debris-flow hazard (a) exists, (b) can be mitigated, and (c) can be
designed so that the mitigation will not increase the hazard on adjacent public or private
property, given a building layout shown on the attached figure. Specifically, the mitigation
can be designed to be fully in conformance with Town of Vail Hazard Regulations (paragraph
r8.6e.0s2 tcl tbl).
