To memoralize our phone conversations, I wish to reiterate and deny Mr. Karlin's accusations on my
person and reputation.
We have been mired in domestic litigation in matrimonial court - which includes child custody, support
and visitation issues -throughout the past eight years which has created an adversarial and
acrimonious environment from which Mr. Karlin cannot seem to extricate himself.
Unfortunately, the DRB has been caught in the middle, and my project is one of the casulties.
I do appreciate your understanding ear, and I look forward to meeting you this July.

I am confirming our phone conversation today regarding the subject of the
Wolf Residence DRB0801 18 review for an addition of GRFA (bedroom, bathroom).
Until I read of this project in the DRB Agenda website information, I had no
knowledge nor was I advised by Mary Wolf (owner) or KH Webb Architects PC of
any construction project involving Unit A of 1330 Greenhill Ct.
Under the terms of the Townhouse Declaration, no owner may make changes to
the exterior without the prior written consent of the other owner.
You have faxed me a document (non dated) submitted to the Town of Vail from
Mary Wolf that represents lhat I have approved and signed lhe document. I am
hereby indicating that I did not ever see nor sign any such document however
the signature is mine and appears to be a "cut and paste" job from a Circuit
Court of Cook County document filed within the last year.
I have no knowledge nor am I giving any approval whatsoever to any
modification of the exterior of the 1330 Greenhill Court townhouse units.
After I have been properly and legally notified, advised and consulted as lo
the scope of the project, I will then advise any specific or contingent
approval at that time. This document which you have supplied and that I have
attached I believe constitutes fraud and I would trust that the Town of Vail
will not approved any further action on this project until proper and legal
approvals are obtained from me.

III. ]MPORTANT NO?ICE REGARDIN9 ALL SUBMISSIONS TO THE DRB:
A. In addition to meeting submittal requirements, the applicant must stake and tape the project site to indicate property lines, building lines and building corners. AII trees to be removed must be t.aped. All site tapings and staking must be completed prior to the
DRB site visit. The applicant must ensure that staking
done during the winter i.s not buried by snow.
B. The review process for NEW BUILDINGS normally requires
Lwo separate meetings of the Design Review Board: a conceptual approval and a final approval. Applicants should plan on presenting their development proposal at a minimum of two meetings before obtaining final
approval .
C. Applicants who fail to appear before the Design Review Board on their scheduled meeting date and who have not.asked in advance that discussion on t.heir item be postponed, will have their items removed frorn the DRB docket until such tine as the item has been republished.
D. The following itens may, at the discretion of the zoning administrat.or, be approved by the Community
Devel_opment Department staff (i.e. a formal hearing before the DRB may not be required) :

Dear Gerry:
According to the Town of Vail zoning code, Lot 15, Glen Lyon Subdivision has a total
allowable Gross Residential Floor Area (GRFA) of 5,551 square feet. Assuming Unit A is the
Secondary side, the GRFA for Unit A cannot exceed 40h ot the total allowable GRFA for Lot
15.
In addition to the above square footage, an additional 250 square feet of GRFA is available to
structures older than 5 years. Please call the Planning Department for further details on this
250 sq.ft. allowance.
John Lohre recently submitted plans and received Design Review Board approval for an
expansion of approximately 420 sq.ft. for Unit B, Lot 15. Design review approvals last for 1
year, should you wish to apply for a building permit for the approved addition. The architect
was Kurt Segerberg of Pierce, Segerberg and Spaeh Architects.

a) WaIl Replaced With Beam-The walt which is below the loft
bedroom waLl above nust be replaced with 3-2xL0 plus 1-ML L 3/4 x 9 L/2. llhe Microlam can be glued and nailed to the 2x4 wall bearing upon the existing 3-2xto. Support the 3-2x1O beau with
minimum 2-2x4 or 2-2x6 trinmers eactr end. Verify bearing to foundation.
b) Floor Construction-Add a 2-2xLO beau within the pack-outs for the Glulam ridge beam above. Infill with 2x1O e 24.1 oc between the new 2-2xLO and the existing balloon framed 2x4 wall. The area between the balloon franed 2x4 wal1 and the existing
bedroom floor can be framed with 2xG € 16rr oc.
IOFT LEVEL BEDROOI,I EXPAITSION-
a) Header Replacement-The existing 3-2xL2 header is continuous 3 span with spices at third points. Inorder to remove the 2 internediate supports th.e hea<ler musL be replaced rtltjn 2-2xL2 plus l-ltL L 3/4 x LL 7/A. Alt header nembers must be continuous. Glue and nail all nulti-nenber headers and beaus.Support each end of the new header with nininum 2-2x4 or
2x6 trinners each end. Verify bearing to foundation.

restricting or regulating or prohibiting the occupancy, use or enjoyment of the land, or regulating the character,
dimensions or location of any improvement now or hereafter erected on the land, or prohibiting a separation in
ownership or a reduction in the dimensions or area of the land, or the effect of any violation of any such law,
ordinance or governmental regulation.
2. Rights of eminent domain or governmental rights of police power unless notice of the exercise of such rights
appears in the public records at Date of Policy.
3. Defects, liens, encumbrances, adverse claims, or other matters (a) created, suffered, assumed or ageed to by the
insured claimant;(b) not known to the Company and not shown by the public records but known to the insured
claimant either at Date of Policy or at the date such claimant acquired an estate or interest insured by this policy
and not disclosed in writing by the insured claimant to the Company prior to the date such insured claimant

of the Comp8ny shall cease and lerminste in regsrd to the matter o.
malters for which such prompt notice is required; provided, how-
ever, that failure lo nolify shall in no case prejudice lhe rights of
any such insured under this policy unless the Compsny shall be
preiudiced by such failure and lhen only lo the extent of such
prejudice.
(c) The Company shall have the right at its o\a! cost to
institute and without undue delay prosecute any action or
proceeding or to do any other act which in its opinion may be
necesiary or desirable to €stablish the title to the estate or interest
as insuied, and the Company may take any appropriate action under
the terms of this policy, whelher or not it shall be liable thereunder,
and shall not thereby concede liability or waive any provision of this
policy.
(d) Whenever lhe Company shall have brought 8ny action or
inletpos€d a defense as requir€d or permitied by th€ provisions of
this policy, the Compsny may pursue any such litigation to final
dete.mination by a court of competent judsdiction and expressly
reserves the ri8ht, ifl its sole discretion, to appeal from any adverse
judgment or order,
(e) ln all cas€s where lhis policy permits or requires lhe
Company to pros€cute oa provide foa the defense of any action ot
proceeding, the insured hereunder shall secure to the Company the
right _to so prosecute or provide defense in such action or
proceeding, and all appeals therein, and permit the Company to use,
at its opaion, the naire of such insured for such putpos€. Whenever
requested by the Company, such insured shall give lhe Company all
reasonable aid in any such action or proceeding, in effecling
seltlement, securing evidence, obtaining witnesses, or prosecuting o!
defending such action or proceeding, and the Company shall
reimburse such insured for any expense !o incurred.
4. Nolici of Loss - Limitation of Action
ln addition to the notices required under paragraph 3(b) of thesc
Conditions and Stipulations, a statemenl in writing of ony loss or
damage for which il is claimed the Comprny is liablc under this
policy shall be furnished to the Company wilhin 90 days afler Euch
loss or damage shsll hsve b€en dete.mined and no righl of action
shall accrue to an insured claimant uniil 30 days after such
statcmenl shall have been furnished. Failure to furnish such
statement of loEs or damage shall terminate any lisbility of the
Company under this policy as to such loss or damrge.
5. Options to Pay o. Othorwiss Srtlla Clsim3
The Comp8ny shall have the option to p8y or otherwise seltle
for or in the name of sn insured claimant any claim ingured against or to terminate all liability 8nd obligalions of lhe Company
hereunder by paying or tendcring payment of the amount of
insurance under lhiE policy log€ther with any cost$, attorneys'fees
and expenses incurred up to the time of such psymenl or tender of
psyment, by the insured claimanl and aulhorized by the Comp8ny.
6, Dstermination rnd Prylf€nt ot Loss
(a) The liabilily of the Company under ahB policy shall in no
case exceed the least ofi
(i) the actual loss of the insured claimsnt; or
(ii) the amount of insurance stated in Schedule A; or
(b)The Company will pay, in addilion to sny loss insured
againsl by this policy, all costs imposed upon an insurcd in litigation
carried on by the Company for such insu.ed, and all costs,
attorneys'fees and expens€s in litigation carried on by such insured
with the wdtten aulhodzation of lhe Company.
(c) when liabilily has been definitely fixed in acco.dance
with the condilions of this policy, the loss or damagg $hall be
payable within 30 days thereafter.
7. Limitation ot Liability
No claim shall arise or be maintainable under this policy (a) if
the Company, after having received notice of an alle8ed defect,lien
or encumbrance insured against hereunder, by litigation or
oaherwis€, removes such defect, lien or encumbrance or establishes
the title, as insured, within a reasonable lime after .eceipt of such
notice; (b) in the event of litigation until there hss been a final
determinalion by a court of competent jurisdiction, and disposition
of all appeals lhe.efrom, adverse to lhe title, as insured, as provided
in paraFaph 3 hereof; or (c) for liability voluntarily assumed by an
insured in setiling any claim or suit wilhout prior written consent of
the Company.
6. Reduction ot Laability
All payments under this policy, except payments made for cosls,
aitorneys' fees and expenses, shall reduce the amount of the
insurance pro tanlo. No payment shall be made without producing
lhis policy for endorsement ol such payment unless lhe policy be
lost or dest.oyed, in which case proof of such loss or destruction
shall be furnished to the satisfaction of lhe Company.
9. Liability Noncumulativo
tl is expressly understood that lhe amount of insulance under
this policy shall be reduced by any amount the Company may pay
under any policy insuring either (a) a mortgage shown or referred to
in Schedule B hereof which is a lien on the estale or intetesl covered
by this policy, or (b) a mo.tgage hereafle. execuaed by an insured
u'hich is a charge or lien on the estate or inte.est described or
referred to in Schedule A, and the amounl so paid shall be deemed a
paymenl under ihis policy. The Company shall hav€ the option to
apply to the payment of any such mo gages any amount that
otherwise would be payable hereunde. lo the insured owner of lhe
estate or inlerest covered by this policy and the amounl so paid
shall be deemed a payment under this policy to said insured owner.
10. Appoftionment
tf lhe land described in Schedule A consists of two or more
parcels which are not used as a single site, and a loss is established
affecting one or more of said parcels but not all, the loss shall be
computed and settled on a plo rata basis as if the amount of
insurance under this policy'was divided pro rata as to the value on
Date of Policy of each separate parcel to the whole, exclusive of any
improrements made subsequent to Date of Policy, unless a liabilily
or value has otherwise been agreed upon as to each such parcel by
the Company and the insured al the time of the issuance of this
policy and shown by an expiess statement herein or by an
endorsement attached her€to.
1 l. Subrogation Upon Paymant or Sattlement
Whenever the CompaDy shall hav€ settled a claim under this
policy, all .ight of subrogation shall vest in th€ Company unaffected
by any act of lh€ insured claimant. The Company shail be
subrogated to and be entitled to all rights and remedies which such
insured claimant would have had against any percon or ptoperty in
.espect to such clairn had this policy not been issued, and if
requesled by the Company, such insured claimant shall t.ansfer to
tho Company 8ll rights and remedies against any person or property
necessary in order to perfect such right of subrogation and shall
permit lhe Company to use the name of such insuted claimant in
any transaction or litigalion involving such righls or remedies. If the
payment does not cover the loss of such insur€d claimant, the
Compony shall be subrogated to such rights and remedies in the
proportion which said payment bears to the amount of said loss. lf
loss should resull from any act of such insured claimanl, such act
shall not void lhir policy, but the Company, in that event, shall be
required to pay only that pa.t of any losses insu.ed againsl
hereunder which shau exc€ed the amount, if any, Iost lo the
Compaly by reason of lhe impairment of lhe righl of subrogation.
12, Liability Limitsd to this Policy
This inslrument together with all eDdorsements and olher
instrumenls, if any, altacbed hereto by the Company is the entire
policy and contract between the insured and the Company.
Any claim of loss or damage, whelher or not based on
negli8ence, and which arises out of the status of the title to the
estate or interest covered hereby or any aclion assetting such claim,
shall be restricted to the provisions a'ld condilions and slipulalions
of this policy.
No amendment of or endorsemena lo this policy can be made
except by writing endorsed hereon or attached hereto signed by
either the President, s Vice Presidelt, the Secrelary, an Assistant
Secretary, or validating office. ot auahorized signatory of the
Company.
13. Noticar, Wher€ Ssnt
All notices .€quired to be given the Company and any statement
in writing required to be furnished the Company shall be addressed
to its Home Office, Minneapolis, Minnesota 5540!.
