As requested, we have reviewed the site grading condilions with respect to potential debris flow inpact on the subject site. Chen & Associates, Inc. previously conducted a subsoil
study for design of foundafions at the site and presented our findings on May 2J, 1986, Job No. 4 160 86.
The proposed building area is located above West Haven Circle
and below a relatively large residence recently constructed on Lot 18. LoE 22 has been identified as havjng a moderate debris flow hazard as described by Mears ( 1984 ) ' . The residence is
proposed to be developed by terracing of the floor and foundation levels which will lessen the i.mpaci on excavation depths and
final perimeter grading. The surface runoff as designed (Site
and Landscape Plan, Sheet A-1, May 13, 1986) will be directed
around the east and west ends of the building on natural graded
slopes. Flow of off-site water across the property will probably
remaln as sheet flow.
The potential for debris flow impact on the site appears to
be limited by the roadway construction and the residence directly
uph111 of the property. It appears that impact on the property
would be mainly by mud flooding rather than by debris. This type of flow should be mitigatable by a well-defined swale constructed
uphill of the residence. The swale should be graded to flat on either ends of the buildlng so that fhe flow returns to sheet

As requested, we have reviewed the site grading conditions with respect to potent,ial debris flow inpact on the subject site. Chen & Associates, Inc. previously conducted a subsoil study for deslgn of foundations at the sife and presented our findlngs on May 21, 1986, Job No.4160 86.
The proposed buildlng area is located above West Haven Circ1e and below a reLatively Iarge residence recently constructed on Lot 'l 8. LoE 22 has been ident j.f ied as havning a moderale debrls flow hazard as deseribed by Mears ( 1984) ' . The residence 1s proposed to be developed by terracing of the floor and foundation Ievels which will lessen t,he impact on excavation depths and flnal perimeter grading. The surface runoff as designed (Site
and Landscape Plan, Sheet A-1, May 13, 1986) will be directed around the east and west ends of the building on natural graded slopes. Flow of off-site water across the property w11l probably
rematn as sheet flow.
The potential for debris flow impact on the site appears to be limited by the roadway construction and the residence dlrectly uph111 of the property. It appears that impact on the property would be mai.nly by rnud floodlng rather bhan by debris. This type of flow should be mifigatable by a well-defined swale constructed ophill of the residence. The swale should be graded to flat on either ends of the buitdlng so that the flow returns to sheet

3. Declarant has constructed a single-fanily residential
unit on Parcel A and a single-farnily residential unit on Parcel B
as shown on PIat.
4. Declarant desires to and does hereby establish a plan
for the ownership of Parcel A and Parcel B as estates in fee
simple and the co-ownership, by the individual and separate
owners thereof, as tenants in comrnon, of the Cornnon Parce].
Declaration
Declarant does hereby publish and declare that the following
terms, covenants, conditions, easenents, restrictions, uses,
reservations, limitations and obligations shal.I be deened to run
with the land described herein, shall be a burden and a benefit
to Declarant, his successors and assigns, and any person
acquiring or owning an interest in the Property and inprovenents
uuitt thereon, their grantees, personal representatives, heirs,
successors and assigns.
1. Division of Real Property into Three Parcels. The
Property is hereby divided into three lots as folloqrs!
Parcel A
Parcel B
common Parcel

2. Division of Real Prooertv into Two Fee Sinple Estates'
The Property is hereby divided into two separate estates as
follows:
Tonnhouse unit A consisting of a fee sirnpte estate in Parcel
A and as an appurtenance thereto, an undivided one-half
interest in the -Cbnrnon parcel together with all improvements
thereon, all easements and rights-of-etay aPpurtenant thereto
in the same respective intereits and as provided herein.
Townhouse unit B consisting of a fee simple estate in Parcel
B and as an appurtenance thereto, an undivided one-half
interest in tfre common Parcel, together with all
improvenents thereon, all easernents and rights-of-way
appurtenant thereto in the same respective interests and as
provided herein.
3. Description of Townhouse Unit.
(a) Each townhouse unit shatl be inseparabLe and may
be leasedr' devised or encumbered only as a townhouse unit. No
ouner of a townhouse unit (rrownerrr) shall assert any rigttt of
partition with respect to the Connon Parcel and each owner waives
ity and aII rights of partition he nay hold by virtue of his
ownership of an undivided interest in and to the Common Parcel as
a tenant in connon with the other owner.
(b) Title to a townhouse unit uray be held individually
or in any forn of concurrent ownership recoqnized in Colorado.
In case of any such concurrent ownership, each co-owner shall be jointly and severally liable for perforrnance and observance of
aff tne duties and responsibilities of an rrownerrr with respect to
the townhouse unit in which he owns an interest. For all
purposes herein, except for paragraph 11(c), there shall be
aeerned to be only two owners, the owner of Townhouse Unit A and
the owner of Townhouse unit B. The parties, if uore than one,
having the ownership of a townhouse unit shall agree anong
thenselves how to share the rights and obligatlons of such
ownership, but all such parties shall be jointly and severally
tiable f-or perfornance and observance of all of the duties and
obligations of an rrottnerrr hereunder with respect to the townhouse
unit in which they own an interest.
(c) Any contract of sale, deed, Iease, deed of trustt
rnortgage, wiil or-other j.nstrument affecting a totnhouse unit nay
aesciibe it by its parcel and the undivided ! interest in the
Comnon Parcel or townhouse unit nunber and by reference to the
PIat.
(d) Each townhouse unit shall be considered a separate
parcel of real property and shall be separately asseEsed and
taxed.
4. LandscaDing, Service FaciLities. Access and, Pirkinq'
(a) rxcept as otherwise specifically provided in writing and
dxtept for any expense or tiiuitity caused through the negligelcg
or willful acl oi any owner, his fanily, agent or invitee, which
shall be borne soJ.ely by such oitner, each owner shall share one-
half of all expenses, tiabilities and general upkeep
responsibilities witfr respect to the Common Parcel and all
inpiovenents thereon. fhe owners from tirne to time shall
undertake such landscaping and general outdoor improvements- as
they nay nutually ana unanirnously deem proper for the harnonious
improvement of both townhouse units in a comrnon theme. The owner
of one townhouse unit shall not unreasonably danage the value of
the other townhouse unit such as by shoddy upkeep outside, but
both owners shall nake aII reasonable efforts to preserve a
har:monious conmon appearance of the residential units and Conmon
Parcel . Each ownei-may use the Cornmon Parcel and iroprovenents
Iocated thereon in accordance with the purposes for which they
are intended, including, but not linited to, access to his
residential unit, parking, landscaping, trash storage and ope!
space, without hindLring or encroaching upon the lawful rights of
the other owner.
(b) Common utility or service connections or lines,
comon facilities or other equipnent and property located in or
on the Comnon Parcel or either of the residential units or the
parcels upon which such residential units are located but used in
Lournon for the benefit of the Common Parcel or for both Parcel A
and Parcel B and the residential units located thereon, shall be
owned as tenants in common of equal undivided one-half interests
by the ouners of each townhouse unit and, except for any expense
or tiaUitity caused through the negligence or willful act of any
onner, his tarnily, agent or invitee, which shall be borne solely
by such olrner, a1l expenses and tiabilities concerned with such
property shall be shired proportionateJ.y with such ownership.
the- owner of the parcel and the residential unit thereon on which
such property is -not located shall have a perpetual easement in
and to ltraC part of such other parcel and residential unit
thereon containing such property as is reasonably necessary for
purposes of naintenance, repair and inspection.
(c) It is expected that colnmon parking. and access
facilitiei (inctuding, but not lirnited to, driveways ald
staircases) will be provided on a portion of the Common Parcel .
The ortners shall have egual right to the use of such access and
parking facilities and no owner shall hinder or pernit- his
invite6s to hinder reasonable access by the other o!'tner and his
invitees to the parking areas or such other ownerrs unit, ald
further, the ownei of a residential unit shall not take or pernit
his invitees to take more than one-half of the parking spaces
frorn tine to tiure provided on the Conmon Parcel without the
consent of the other owner. It is presumed that snowplowing wiIJ.
be required fron tinre to tirne, the costs of which will be shared
equaUy by the owners. other maintenance, repair or improvement
of suc-h farking and access facilities nay be required from tirne
to tirne, and tfre same shall be undertaken uPon the unanimous
agreement of the orrners who shall share all expenses equally.
5.Alterations. Maintenance and Repairs.
(a) If any inprovements on Parcel A or Parcel B is
danaged or destroyed, such damage or destruction shall be
prornptty repaired ind'reconstructed. Repair and reconstruction
rneans ttre restoration of the improvenents to substantially the
saDe condition in which it existed prior to such danage or
destruction. The cost to repair and reconstruct any inprovement
on Parcel A or Parcel B shall be the sole expense of the owner of
said townhouse unit except aa nodified herein and without
prejudice, however, to the right of any rule of law regarding
iia-Utfity for negligence or willful acts or omissions.
Notwithstanding anyfiring contained above to the contrary, if the
negligence or williul act or ornission of any oltner, his agent or
invit-ee, shall cause damage to, or destruction of ?ny
inprovernent on the other Parcef, such owner shall bear the entire
costs of repair or reconstruction.
(b) Each owner shall be solely responsible for alI
maintenance 'and repair of the exterior and interior of his
townhouse unit, including all fixtures and improvements therein,
on or upon his Parcel .
(c) Utility or service connections, facilities or
other utility equipnent and property located in, on or upon
either of Paicel A, Parcel a or the Conmon Parcel which is used
solely to supply a service or utility to one townhouse unit shall
be owned fy tle-onner of the townhouse unit using such utility or
service ind all expenses and liabilities for repair and
maintenance shall be borne solely by the owner of such tonnhouse
unit who shall have a perpetual easenent in and to that part of
such other Parcel containing such property for purPoses of
maintenance, repair and inspection.
(d) No oltner shall nake or suffer any structural or
design change (including a color scheme change), either per:manent
or ttmporary and of any tlpe or nature whatsoever to the exterior
of his townhouse unit or construct any addition or improvenent on
his townhouse unit, without first obtaining the prior written
consent thereto fron the other owner, vhich consent shall not be
unreasonably withheld or delayed.
(e) Where the ovtner ot either townhouse unit, - in
conpliance'with the other provisions of this Declaration, desires
to build, renovate, excavate, improve or otherwise alter the
structures or inprovements Iocated on his Parcel , and where the
owner has obtained the written consent thereto of the other ortner
as provided in subparaqraph 5(d) above' the owner of the other
towrihouse unit shall cobperate'to the extent necessary to enable
that owner to obtain "iy required building pernit or sinilar
p-rnit or license. It is understood and agreed,. however, that
inouta the Town of Vail allow an addition or nodification to be
rnade to either Townhouse Unit A or Townhouse Unit B, the owner of
i iownfrouse unit not making such addition shall not unreasonably
ritnf,of a his consent p-ursuant to this paragraph 5 (-9)-'
Notwittrstanding anything iontained herein, no oetner nay nodify
any inproveneit which would utilize more than that Unitsrs
frictio-n (hereinafter defined) of the available zoning density^or
other zoning rights available to the Property. The Fractl'on for
Townhouse Uiit i shal1 be 6Ot and for Townhouse Unit B shall be
4ot. Any costs or expenses, however, associated with the
obtaining -of a building or sinilar permit shall be the expenses
of the owner desiring- said per:niC and sha1l not be a joint
expense of the owners of both townhouse units.
(f) In the event that either townhouse unit'. or
fraction the'reof, is taken by eninent dornain or in condemnation,
the owner of that townhouse unit shall receive any sums payable
with respect to such taking. In the event that both townhouse
units, oi any fractions theieof are taken by eminent donain or in
conaeinnationl the owners shalL divide any sums -payabl-e wit!
respect to such taking in proportion to the relative values of
the townhouse units, or factions thereof, so taken.
6. Mechanicrs Liens, Indemnification.
(a) Except for items incurred as a common exPense as
provided for'herein-, if either owner shall cause any nateri_al to
be furnished to his townhouse unit or any labor to be perforned
therein or thereon, the other onner shall not under any
circumstances be tiaLte for the palment of any expense incurred
or for the value of any work done-oi material furnished; all such
work shall be at the expense of the owner causing it to be done'
and such ottner shaII be solely responsible to contractors,
laborers, rnaterialmen and other Persons furnishing labor or
rnateriali to his townhouse unit oi any irnprovements therein or
thereon. Nothing herein contained shall authorize either ovtner
or any person dJaling through, with or under either ownerr_ to
ctrarg6 tlhe townhouse init of-the other owner with any mechanicrs
lien-or other lien or encumbrance whateveri and, on the contrary
(and notice is hereby given), the ri-ght and poner to charge any
iien or encumbrance bf- any-kind against the other owner or the
other ottnerrs townhouse uni.t for work done or materials furnished
to one ownerrs tottnhouse unit is hereby express)-y denied'
(b) Except as provided for in paragraph 9 below, if
because of'airy acttr oniision of either owner any nechanicrs_or
ottt"t lien oi order for the palment of money shall be filed
against the other ownerrs townhouse unit or any inrprovenents therein or thereon, or against the other oqrner (nhether or not
such lien or order is valid or enforceable as such), the ovrner
whose act or onission forms the basis for such lien or order shall, at his own cost and expense, cause the same to be
cancelled and discharged of record or bonded by a surety conpany
reasonably acceptabte to the other owner, within 20 days after the date of filing thereof, and further shall indemnify and save the other owner harmless from and against any and all costs,expenses, clains, Iosses or damages, including reasonable
attorneyrs fees resulting therefron.
7. Use Restrictions.
(a) The residential units located on the Property shall be used for residential purposes only as a penoitted use,and conditional and accessory uses shall be allowed and as
defined by the Town of Vait Zoning ordinance as amended fron tine to time. No structures of a temporary character, trailer, tent,
shack, garalte, barn or other out-building shall be used on any portion of any of the Property at any time as a residence, either
tenporarily or pernanently.
(b) No aninals, livestock or poultry of any kind shall be raised, bred or kept on any of the Property, except that
dogs, cats or other household pets nay be kept provided that they are not kept, bred or maintained for any commercial purposes and
provided further that they do not unreasonably interfere with the quiet enjolment of the other townhouse unit by its owner.
(c) No advertising signs (except one rrFor Rentrr or ilFor Saler of not more than three (3) sqluare feet per townhouse unit if allowed by the Tonn of vaiL) billboards, unsightly objects or nuisances shall be erected, placed or pernitted to
renain on the Property, nor shatl any townhouse unit be used in
any way or for any purpose which nay endanger the health or
unreasonably disturb the osrner or resident of the adjoining
towntrouse unit.
(d) All rubbish, trash or garbage shalL be regularly
removed fron each townhouse unit and shall not be allowed to
accumulate thereon. AII such expenses are the expenses of each
individual owner, and are not a joint expense of the oltners.
(e) An owner shall do no act nor any htork that will inpair any easement or hereditrnents or do any act or allow any condition to exist which will adversely affect the other
townhouse unit.
(f) Parking of boats, trailers, campers' notor hones,
ATVs or recreational vehicles on either townhouse unit is
expressly prohibited. Parking of more than two automotive
vehicles by either owner or his fanily, agent or invitee on such
ownersrs townhouse unit for more than a 48 hour period is
expressly prohibited.
(S) No rrtime sharingrr, ninterval ownershJ.pr or sinilar interest, whereby ownership of a townhouse unit is shared by
owners on a tine basis, shall be established on ei.ther townhouse unit sithout the prior written approval of both owners and all lienors holding a first nortgage or first deed of trust of record
on any portion of the Property which approval shall be reflected in a docurnent of record.
8. Insurance.
(a) Each owner shall keep his townhouse unit, and aLl fixtures located therein insured against loss or damage by fire
and extended coverage perils (including vandalisn and malicious nischief) for the maxinun replacement value thereof, and
covering such other risks of a sirnilar or dissinilar nature as are or shall hereafter customarily be covered with respect to sinilar properties issued by a responsible insurance company or
conpanies authorized to do business in the State of Colorado.The insurance for each townhouse unit, shall provide that the policy cannot be cancelled or substantially rnodified until after thirty (30) days prior written notice is first given to each
onner and each first rnortgagee.
(b) Each owner shall provide and keep in force for the protection of himself, general public liability and property
danage insurance against claims for bodily injury or death or property danage occurring in, on or upon his townhouse unit and the inprovements thereon and the Common Parcel, in a linit of not less than Three Hundred Thousand Dollars ($300,000) in respect to bodily injury or death to any number of persons arising out of one accident or disaster, or for darnage to property, and if higher linits shall at any time be customary to protect against tort liability, such higher tinits shatl be carrLed and each
owner shall name the other ouner as an additional insured party
under such policy.
(c) Each olrner shall deliver to the other onner certificates evidencing aII insurance required to be carried
under this paragraph 9 upon reasonable reguest, each containing
agreements by the insurers not to cancel or nodify the policies
without giving the other owner written notice of at least thirty (30) days. Each owner sball have the right to inspect and copy all such insurance policies of the other owner and reguire
evidence of the payments of premiums thereon.
(d) Nothing provided in this paragraph shall prevent the owners from jointly acquiring a single policy to cover any
one or rnore of the hazards required in this paragraph 8. Such
premiums shall be apportioned according to the relevant coverage to each townhouse unit.
(e) Each owner nay obtain additional insurance at his
own expense for his own benefit provided that all such policies shall contain waivers of subrogation and, provided further, that the liability of the carriers issuing insurance covering the
townhouse units hereunder shall not be affected or dininished by
reason of any such insurance carried by any owner.
(f) Insurance coverage on any personal property itens stored vithin the improvements located on each townhouse unit shall be the responsibility of the o\rner thereof. However,nothing herein shall be construed to require such insurance.
9. Enforcement.
(a) If an ohrner, at any time, shall neglect or refuse to perform or pay his share of any obtigation reguired hereunder,the other ouner may, but shall not be obligated to, after twenty (2O, days written notice to the other owner unless the circumstances require irnnediate action, make such palment, or, on behalf of such other owner, expend such sum as nay be necessary to perform such obligation, including but not linited to the payment of any insurance premiums required hereunder, for repair,restoration or maintenance, and such other owner shall have an
easement in and to that part of such defaulting ownerrs lot as is reasonably necessary for such repair, restoration or maintenance.
(b) A11 sums so paid or expended by an owner, with interest thereon at the rate of fifteen percent (L5*) per annutn fron the date of such payrnent or expenditure, shall be payable by the owner so failing to perfor:n (the "defaulting ownerrf) upon
demand of the other ouner.
(c) AII suns so denanded but unpaid by the defaulting owner shall constitute a lien on the towntrouse unit of the defaulting ouner in favor of the other otrner prior to all other liens and encunbrances, except: (i) Iiens for taxes and special assessmentsi and (ii) the lien of any first nortgage or first deed of trust of record encurnbering such townhouse unit. The Iien shatl- attach fron the date when the unpaid sun shall becone due and nay be foreclosed in like manner as a mortgage on real property. To evidence such a lien, written notice of the lien shall be prepared, setting forth the amount of the unpaid
indebtedness, the nane of the defaulting ordner, and a description of the townhouse unit to which the lien shall attach. Such notice shall be signed by the ouner (or his agent) in whose favor the lien shall be fited, and the lien shall be recorded in the office of the Clerk and Recorder of the County of Eagle. In any foreclosure or other collection proceedings, the defaulting ohrner
shall be required to pay the costs and expenses of
proceedings, including reasonable attorneyts fees.
(d) The lien provided for herein shall be subordinate
to the lien of any first mortgage or deed of trust, including aII
additional advanbes thereon. Sale or transfer of either
townhouse unit as the result of court foreclosure of a mortgage'
foreclosure through the public trustee, or any proceeding i.n lieu
of foreclosure, including the transfer of a deed ln lieu of
foreclosure shall extinguish the lien as to paynents thereof
which become due prior to such sale or transfer, but shall not
relieve any former owner of personal liability therefor. The
first nortgagee of such townhouse unit who acquires title by way
of foreclosure or the taking of a deed in lieu thereof' shall
not, however, be liable for any past due amounts and/or
obligations due hereunder and shall only become liable for future
amounts and/or obligations on the date it becomes the owner of
such townhouse unit. No sale or transfer shall relieve euch
townhouse unit fron liability for any amounts and/or obligations
thereafter becomLng due or frorn the lien thereof. In the event
of the sale or transfer of a townhouse unit rtith respect to which
sums shall be unpaid by a defaulting ownerr except transfers to a
first mortgagee in connection with a foreclosure of its lien or a
deed in lieu thereof, the purchaser or other transferee of an
interest in such townhouse unit shal} be jointly and severally
tiable with the seller or transferor thereof for any such unpaid
sums.
(e) Upon written reguest of any owner' mortgagee'
prospective mortgagee, purchaser or other prospective transferee
of J townhouse unit, the owner of the other townhouse unit shall
issue a written statenent setting forth the anount his is owed
under this paragraph 10, if any. Such statement is binding upon
the executing owner in favor of any Person who may rely thereon
in good faith. Unless a request for such stateroent shall be
cornplied with within fifteen (L5) days after receipt thergof, all
unplia sums which become due prior to the date of rnaking such
request shall be subordinated to the lien or other interest of
the person requesting such statement.
(f) Each provision of this declaration shall be
enforceabli ly any owner by a proceeding for a prohibitive or
rnandatory injunction or by a suit or action to recover damages.
ff court- proceeding are instituted in connection with the rights
of enforcement and remedies provided in this Declaration, the
prevailing party shall be entitled to recover its costs and -xpenses in connection therewith, including reasonable attorneyrs
fees.
(S) Each owner hereby agrees that any and all actions
in eguity 6i at law which are instituted to enforce any provision
such
hereunder shall be brought in and only in the courts of the
County of Eagle, State of colorado.
(h) Failure to enforce any provision of thls
Declaration shatl not operate as a waiver of any such provision,
the right to enforce such provision thereafter, or of any other
provision of this Declaration.
(i) Any exercise of any right granted under this
Declaration by one orrner with respect to the other olrnerrs
townhouse unit, including but not linited to the use of any
easement granted herein, shall be exercised in a manner which
shall not unreasonably hinder, irnpede or impose uPon such other
ownerts use of his Unit.
10. Easement.
(a) Each unit and the parcel upon which it is situated
shall be subject to an easement for encroachrnents created by
construction, settling and overhang, previously existing or as
designed and constructed by the Declarant or as a result of any
addifion or improvenent pursuant to this agreement. A valid
easenent for such encroachments and for the nraintenance of same,
so long as they exist, shall and does exist. In the event.any
improvenent is partially or totalty destroyed, and then rebuilt,
th; orrners agree that ninor encroachments due to construction
shall be pirrnitted and that a valid easement for said
encroachment and the rnaintenance thereof shall exist so long as
the improvernents shall stand.
(b) Each townhouse unit and Parcel A, Parcel B and the
conmon Parcel are subject to a blanket easement for support and
blanket easement for the maintenance of the residences and other
structures or improvements presently situated, or to be built in
the future, on the Parcels.
(c) There is hereby created a blanket easement upon,
across, over and under the unimproved portion of each of the
Parcels for the benefit of the townhouse units and the structures
and inprovernents situated thereon, for ingress and egress,
instatlltion, replacing, repairing and naintaining all utilities,
including but not limited to water, sewer, gas' telephone' cable
tv and electricity. Said blanket easement includes future
utitity services not presently available to the townhouse units
which roay reasonably be required in the future. By virtue of
this easement, it shall be expressly permissible for the
companies providing utilities to erect and naintain the necessary
equ-ipnent bn either of the Parcels and to affix and rraintain
eleclrical and/or telephone wires, circuits and conduits ohr
above, across and under the roofs and exterior walls of the
improvenents, aII in a rnanner customary for such cornpanies in,the
area surrounding the Property. Notwithstanding the foregoing,

all such utility equipnent, wires, circuits and conduits will be placed on the Property benefitted thereby to the extent
practicable, and if placed on the other Parcel , will be placed
underground if possible, and to the extent practlcable will be
placed as close to the 1ot lines as practicable. Either owner
Itratt have the right to relocate within his Parcel any utility at
his sole cost and expense.
11. General Provisions.
(a) Notice. Each owner shatl register its uailing
address with the other owner and all notices or denands intended
to be served upon ohtners shall be sent certified mail, postage
prepaid, addresled in the name of the owner at such registered nailing address. In the alternative, notices may be delivered if
in writing, personally to owners.
(b) Duration. Each provision in this Declaration
which is subject to the Iarts or rules sometines referred to as
the rule against perpetuities or the rule prohiblting
unreasonable iestraints or alienation shall continue and remain
in full force and effect for the period of twenty-one (21) years
following the death of the Declarant and the survivor of his now
living issue, or until this Declaration is terminated as
hereinafter provided, whichever first occurs. AII other provisions contained in this Declaration shaII continue and
remain in full force and effect until January I in the year 2025
A. D. , and thereafter shall be automatically extended for

1. In addition to meeting submittal requirements, the applicant must stake the site
to indicate property lines and building corners. Trees that will be removed
should aiso be marked. This work must be completed before the DRB vjsits the
site.
2. The review process for NEW BUILDINGS will normally involve two separate meet'i ngs

map. The appficant muit stake the site to show lot l'i nes and building corners. Trees
th;t will be lost during construction must be tagged. The work should be completed
before the DRB site visit.

F. The Zoning Admjnistrator and/or DRB may require the submission of additional plans'
drawings, specifications, samples and other material (including a model) if deemed
necessary tb determine whether a project will comply w'i th design guidelines.
