I am in reccipt ofyour October l, 1999 corrcspondence and thank you for the SAme. AS
you know, therc rc two major probleors which continue to effect Mr. Anderson's
propdy. The first concenrs tErnoral of tbe soil and debris dcposited on the lot by
becahwood md the gccond eooccms drainage issues aflectiag the properry. Both will
b4v€ to be ad&esred in order to restore Mr. Anderson's property to substantially its pre-
oriBting condition.
In direCt reply of pur correspondence, I have shared with lvlr. Anderson Beechwood's
offer to "provide E check..in an arnormt equal to the proposed €xp€nse of the cbove
refqe6ced wort.- In theory at leas! tJrat eolution (depending upon the breadth of
coverage) mry prove apce,ptable. To that cad, I will instruct Mr. Anderson's landscapen
to acccpt bids for rerroval ofetccss soils and debris, rc-grading, ncoessary revcgetation
and provision of ade,quata drrinage. Oncc these uumbers are "hard," I will slrarc thert
with you and we cln quibble over the dotted *i"s and crossed'?'s, if necessary. In alry

As you ftnow, this ofrce represeuts Toger Anderson regarding his real property adjacent
to the Overlook at Vail. Earlier today I conducted a thorougb inspection of thi premises
in the company of rom Kassmel (vail pubric works) ana anay Henkes, the land'scaper
who both performed the lindscaping work for the Ovsrlook and who has propored i re_grading and romediation plan for Mr. Anderson,s adacent property.
It was obvious to all of us that the Overlook project sheds runoffwater onto thc adjacent
properfy owned by Mr. Anderson. Tom Kassmel confinned my observation that the
overlook propcrty did not provide an adequate means to mitigste its water run-off
problems on its own propcrty but, instcad, improperly directed the run-offonto Mr.
Anderson's property. Mr. Kassmel offered that the overlook must (in the absence of
contrary agre€ment reached with Mr. Aaderson) recti$ the problem and address the issue
of run'ofrwater wholly on its own property. We both observed that to do so would likely
require removing the rear patro decks on the overlook property and inetallation of a
drainage swale in the vicinity where the pation decks now reside, and possibly several
additional meagureg-
The water mitigation iseues having not been adequately addressed, it is Mr. Anderson's
position that for the Town to iszue a finsl oertificate of completion, if it hae not yet done

CASH DEPOSIT FORMAT
DEVELOPEH IMPROVEMENT AGREEMENT
THIS AGREEMENT, made and entered into this 6th day o1 Deiember . rs21 Oy
and among Beectrwood Sandsrone * (hereinafter called the "Developer"), and the TOWN
OF VAIL (hereinafter called the "Town"). * Development corP-, a colorado corporation
WHEREAS, the Developer, a_s a condition of approval of the architectural

WHEREAS, the Developer is obligated to provide security or collateral sufficient in the
judgment of the Town to make reasonable provisions for completion of cerlain improvements
set forth below; and
WHEREAS, the Developer wishes to provide collateral to guaranlee performance of
this Agreement, including construclion of the above-referenced improvements by means of the
tollowing:
Developer agrees to establish a cash deposil with the Town of Vail in a dollar amount
of $ l2'199:9q (25% ot lhe total cost ol the work shown below) to provide security
for lhe following:
IMPROVEMENT
Installation of landscaping for Units 7,8,9, and 10' The Overlook at Vail
NOW, THEREFORE, in consideralion of the following mutual covenants and
agreements, the Developer and the Town agree as lollows:
1. The Developer agrees, at its sole cost and expenses, to furnish all equipment
and material necessary to perform and complete all improvements, on or before
Ausust 15. 1995 The Developer shall complete, in a good workmanlike manner, all
improvements as listed above, in accordance with all plans and specifications filed in the
olfice of the community Development Department, lhe Town of Vail, and to do all work
incidental thereto according to and in compliance with the following:
a. Such other designs, drawings, maps, specificalions, sketches, and other matter
submitted by the Developer to be approved by any of the above-referenced
governmental entities. All said work shall be done under the inspection of, and
to lhe satisfaction of, the Tqr,-,,';1 trngineer, lhe Tovrrn Building Official, or other
oflicial from the Town of Vail, as affected by special districts or service districts,
as their respective interest may appear, and shall not be deemed complete until
approved and accepted as completed by the Town of Vail Community
Development Department and Public Works Department.
2. To secure and guarantee performance of its obligations as set forth herein, the
Developer agrees to provide security and collateral as follows:

escrow agent, shall provide the security for the improvements set forth above if there is
a default under the Agreement by Developer.
3. The Developer may at any time substitute the collateral originally set forth
above for another form of collateral acceptable to the Town to gualantee the faithful
completion of those improvements referred to herein and the performance of the terms of this
Agreement. Such acceptance by the Town of alternalive collateral shall be at the Town's sole
discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible lor any accident, loss or damage happening or occurring to the work specified in
this Agreement prior lo the completion and acceptance of the same, nor shall the Town, nor
any officer or employee lhereof, be liable for any persons or property injured by reason of the
nature of said work, but all of said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are
based upon any performance by the Developer hereunder; and the Developer shall reimburse
the Town for any and all legal or other expenses reasonably incurred by the Town in
connection with investigating or defending any such loss, claim, damage, liability or aclion.
This indemnity provision shall be in addition to any other liability which the Developer may
have.
5. lt is mutually agreed that the Developer may apply to the Town and the Town
shall authorize for partial release of the collateral deposited wilh the Town lor each category
of improvement at such time as such improvements are constructed in compliance with all
plans and specifications as referenced hereunder and accepted by the Town. Under no
condition will the amount of the collateral that is being held be reduced below the amount
necessary to complete such improvements.
6. lf the Town determines that any of the improvements conlemplated herein are
not constructed in compliance with the plans and specifications set forth herein by the date set
forth in paragraph 2, the Town may, but shall not be required to, withdraw from the cash
deposit such lunds as may be necessary to complete the unfinished improvements. The
Town shall release such funds upon lhe written request of the statf of the Community
Development Deparlment stating that the improvements have not been completed as required
by the agreement. The Town shall not require the concurrence of the developer prior to the
release ol the funds, nor shall lhe Town be required to verify independently that the
improvements have not been completed as required by this Agreement, but shall release such
funds solely upon the request of the Community Development Department.
lf the costs of completing the work exceed the amount of the deposit, the excess,
together with interest at twelve percent per annum, shall be a lien against the property and
may be collected by civil suit or may be certified lo the treasurer of Eagle County to be
collecled in the same manner as delinquent ad valorem taxes levied against such property. lf
the permit holder fails or refuses to complete the cleanup and landscaping, as delined in this
chapter, such failure or refusal shall be considered a violation of the Zoning Code.
7. The Developer warrants all work and material for a period of one year after
acceptance of all work relerred to in this Agreement by the Town pursuant to Section
17.16.250 if such work is located on Town of Vail properg or within Town of Vail right-of-way.
8. The parties hereto mutually agree that this Agreement may be amended from
time to time, provided that such amendmenls be in wriiing and executed by all parties hereto.

2. Four (4) paper copies of the proposed Final Plat; and

Gentlemen:
We were asked by Monroe & Newell Engineers if the planned key along the base of footings
could be replaced with No. 5 reinforcing steel bars grouted into the rock exposed during
excavation for building Nos. 11 and 12. We were informed that a 1 foot long section of the
footing key was designed to resist 4 kips of lateral load. The rebar anchors will be spaced at 12
inches center to center and will be grouted a minimum 8-inches into the rock with a 4,000 psi
grout mix From a geotechnical viewpoint we believe that the footing key can be replaced with
the rebar anchors described above.

This report presents the results of our soils and foundation investigation for the
overlook at vail to be adjacent to the east side ol sandstone Drive in vail, colorado' we
explored the subsurface conditions to provide loundation recommendations for lour

SUMMARY OF CONCLUSIONS

SITE CONDITIONS
The site is adjacent to the east side of sandstone Drive on the lower part of the
south facing slopes which form the north side ol the Gore creek valley. single and muhi-
{amily residences are to the north and west'

I access drive and a small irrigation ditch cross the site. Vegetation is native grasses and
weeds, sage and patches of scrub oak and aspen trees. Numerous boulders up to eight
feet in diameter are strewn on the ground surfaces at the site'
PROPOSED CONSTRUCTION

were told overlot grading will involve cuts generally in the 5leet deep range, fills will be
up to 13 feet high and no lill will be below buildings. lf plans change however, lills may
be required to achieve lloor slab subgrade elevations'
Four (4) buildings are planned, two buildings will have two unils and two buildings
will have four units for a total of 12 units. The buildings will be three stories tall and be
stepped into the natural slopes at the site. Buildings will be wood framed' The lower
levels will be walkout basements. we have assumed exterior wall loads between 2000
and 4000 pounds per lineal foot and maximum columns loads ol 70 kips to prepare this
report. lf actual loads or the planned construction ditfers lrom our understanding we
should be advised to allow re-evaluation ol our conclusions and recommendations
presented herein.
SUBSURFACE CONDITIONS
six (6) test holes were drilled with a 4-inch diameter continuous flight power auger
at the locations shown on Fig, 1 to investigate subsurface condilions. our test holes
penetrated 0.5 to 1 foot of organic, sandy clays above 2 to 3 feet ol man made fill or 3
feet of loose to medium dense, sitty to clayey sands above 1 to 7 leet of dense to very
dense, sihy to clayey gravels with cobbles and boulders up to 8 feet in diameter underlain
by hard to very hard interbedded, siltstone, sandstone and claystone bedrock. Free
groundwater was found in our test hole, TH-3, at 12 feet the day of drilling. Drilling was
directed by our representative who logged the soils and obtained samples. Summary
logs of the soils found in our test holes and results of field penetration resistance tests are
shown on Figure 2. Laboratory test resuhs are shown on Figures 3 and 4 and on Table
1.
SITE GRADING
The buildings will be stepped into the existing slopes at the site. Maximum
excavation depths will be 5 feet. After the building loundations and basement and
foundation walls have been buift, fill will be placed to obtain subgrade elevations lor
access drives and parking areas. The deepest fill will be 13 feet near the west end ol unit
4. We were told at this writing no fill will be below the proposed buildings. lf plans
change, however, fill may be needed below floor slabs to obtain subgrade elevations.
Fill will need to be benched into the natural slopes at the site. Benches should
have a maximum height ol 5feet and a minimum width of 10 feet. Areas to receive fill
should be stripped ol existing lill, vegetation, organic soils, moisture conditioned to within
2 percent of optimum moisture content and compacted. Fill below lloor slabs, access
drives and parking areas should be moisture treated to within 2 percent of optimum
moisture content and compacted to at least 95 percent of standard Proctor maximum dry
densily (ASTM D 698). Landscaping areas should be compacted to at least 90 percent
of ASTM D 698 maximum dry densily. The existing lill soils and the on site sands or
gravels free of vegetation and other deleterious material can be used as lill. The rock

Department of Labor governing excavations. The publication indicates temporary sloPes

watertable. we should view the excavations to confirm that soils are as anticipated' we
suggest the contractor review the OSHA standards'
BUILDING FOUNDATIONS

The {oundation excavations should be checked by a representative of our
firm to conlirm subsurface conditions are as anticipated from our test
holes.
FLOOR SLABS AND
The buildings
EXTERIOR CONCRETE
lower levels will be walkout basements. Basement floors will be
O srabs-on-grade or structurally supported by the loundation system with a crawlspace
between the floor and ground. The native sands, gravels or fill constructed of the native
soils will provide subgrade for slab-on-grade floors. Floor slabs that bear on fill may
experience differential movement with respect to loundation walls that bear on the natural
gravels. Densely compacted structural fills may experience settlements of 1 to 2 percent
of the total fill thickness. In our opinion lills in excess ol 8 leet thick below lloor slabs may
experience unacceptable settlements. lf the owner wishes to lessen the probability of
cracked floor slabs the most reliable solution we know is to structurally support the floor
with the foundation and have a crawlspace between the floor and the ground. we
recommend the following design and construction details for slabs-on-grade:
1. Slabs-on-grade can be placed on the nalural soils or properly constructed
lills constructed as discussed above under "Site Grading'. Slabs'on-grade
should not bear on vegetation or organic material;
Slabs-on-grade should be separated l.rom. exterior walls and interior
;;ft ,:*ers. verticJ movJm"nt o{the stabs should not be restricted;
Plumbing below slabs should be pressure tested' Trench backtill should
be moisture treated and compacted'
Frequent control joints should be provided' The American Concrete
Institute (ACl) recommends maximum joint spacing of 15 to 20 leet to
control cracking.
BASEMENT AND FOUNDA]ION WALLS
Basement and foundation walls will be subjected to lateral eadh pressures. These
walls are restrained and cannot move, therefore, they should be designed lorthe'at'rest"
lateral earth pressure. Assuming the on-site soils are used as backfill, we recommend
using an equivalent fluid density of 50 pct to calculate lateral earth pressure' The above
equivalent fluid density does not include allowances for sloping backfill, hydrostatic
pressures, live loads or loads from adjacent structures'
Water from surlace run-off (precipitation, snow melt, inigation) lrequently flows

Test resutts show a water soluble sullate (SOJ concentration ol .001 and .006
percent in the silty to clayey sands. This is a negligible soluble sulfate concentration and
in our opinion will not be corrosive to concrete exposed to the sitty to clayey clays at this
site.
SURFACE DBAINAGE
The performance of foundations and concrete flatwork is inlluenced by moisture
condilions in the subsoils. Wetting of soils below foundation can be reduced by grading
the ground surface to cause rapid run-off of water away from the buildings. Wetting or
drying of the open foundaiion excavations should be avoided. During spring snowmelt
sheetwash will occur over ground surfaces at this site. Site grading should provide
surface drainage to direct sheetwash around the buildings. ln addition, the ground
surface surrounding the buildings should be sloped to drain away lrom the buildings in
all directions. We recommend a slope of at least'12 inches in the first 10 feet. Roof
downspouts and drains should discharge well beyond the limits of all backfill. Splash
blocks or downspout extensions should be provided at all discharge locations.
LIMITATIONS
Our test holes were spaced to obtain a reasonably accurate picture of the
subsurface. Variations in subsurface conditions not shown by our test holes will occur.
We should obserye and check fill placement on a daily basis during placemeni. We
should observe the completed excavations to confirm the soils are as anticipated from our
test holes.

Our report was based on conditions disclosed by our test holes' resuhs ol

Rubber out-riggers are required on excavating equipment when working on asphalt.
Asphalt surfaces underneath the bucket shall be protected at all times.
A signature below indicates a review of the area and utility locations and approvals. Once all ulility company
signatures are obtained, permittee has option of routing application through the Public Works office to ontain the
necessary Town of Vail signatures. Please allow one week to process.

9. THERE WILL BE NO TOTAL STREET CLOSURES! A construction traffic control plan must be approved by the
Public Works Deoartment prior to issuance of the permit. i
10. All excavation must be done bv hand within 18" of utilities - (Senate Bill 172).
11. Permittee must contact Public Works Department al479-2158 24 hours prior to commencing backfill opeFtions.
Failure to notify lhe Town will result in {orfeiture of bond money. Scheduled inspections which are not rea$l may
result in the Town charging the contractor a reinspection fee. \
