A pre-application meeting with a member of the planning staff is strongly encouraged to determine if any additional application information is needed. It is the applicantrs responsj.bility to make an appointment with the staff to determine if there are additional submittal reguirements.Please note that a coMpLETE application wilr streamline the approval process for your project.
III. IMPORTANT NOTICE REGARDING ALL SUBMISSIONS TO THE DRB:
II PRE-APPLICATION MEETING :
A. In addition to meeting submittal requirements, the applicant must stake and tape the project site to indicate property lines, building lines and building corners. A11 trees to be removed must be taped. AI]site tapings and staking must be conpleted prior to the
DRB site visit. The applicant rnust ensure that staking done during the winter is not buried by snow.
B. The review process for NEW BUILDINGS normally requires two separate meeUings of the Design Review Board: a conceptual approval and a final approval . Applicants should plan on presenting their deveJ_opment proposal at a mj.nimum of two meetings before obtaining final approval .
C. Applicants who fail to appear before the Design Review Board on their scheduled meeting date and who have not asked in advance that discussion on their item be postponed, will have their items removed from the DRB docket until such time as the item has been republished.
D. The following items may, at the discretion of t,he zoning administrator, be approved by the Community Development Department staff (i.e. a formal hearing before the DRB may not be required):
a. Windohrs, skylights and similar exterior changes which do not alter the existing plane of the building; and
b. Building addition proposals not visible from any other 1ot or public space. At the tirne such a proposal is submitted, applicants must include Ietters from adjacent property owners and/or from the agent for or manager of any adjacent
condominium associat.ion stating the association approves of the addition.
E. If a property is located in a mapped hazard area (i.e.
enow avaLancbe, rockfall, flood plain, debris flow,uetland, etc) r a hazard study rnust be submitted and the owner rnust sign an affidavit recognizing the hazard report prlor to the issuance of a building permit.
Appl-icants are encouraged to check wit.h a Town planner
prior to DRB application to determine the relationship of the property to afl napped hazards.
F. For all. residentlal construction:
a. Clearly indicate on the floor plans the inside faee of the exterior structural walls of the building; and b. Indicate with a dashed Line on the site plan a four foot distance fron the exterior face of the building wal1s or supporting columns.
If DRB approves the application with conditions or nodifications, all conditions of approval must be resolved prior to Town issuance of a building permit
IV.NEw coNSTRUCaN
A. Three copies of a recent
a Licensed survevor, at a scale of 1" - 20t or larger,
on which the following information is provided:
Lot area.
Two foot contour intervals unless the parcel
consists of 5 acres or morer in which case, 5l
contour intervals may be accepted.
3. Existing trees or groups of trees having trunks with diameters of 4" or more, as measured from a point one foot above grade.
Rock outcroppings and other significant natural
features (large boulders, intermittent streams,
etc. ) .
Hazard areas (avalanche, rockfall-, etc.),
centerline of stream or creekr required creek or
stream setback, 100-year flood plain and slopes of
40* or more, if applicable.
Ties to existing benchmark, either USGS landmark
or sewer invert. This information should be
clearly stated on the survey so that all
measurements are based on the same starting point.
This is particularly important for height
measurements. See Policy On Survey rnformation,
for more information regarding surveys.
Locations of the following:a. Size and type of drainage culverts, swales,
etc. must be shown.

and proposed service lines from their source

A.Submitt.al requirements: The owner or authorized agent of any project requiring design approval as prescribed
by this chapter may subnit plans for conceptual review by the Design Review Board to the Department of
Community Development. The conceptual review is intended to give the applicant a basic understanding of the compatibility of their proposal with the Town's
Design Guidelines. This procedure is recommended primarily for applications more compLex than single-fanily and two-family residences. However, developers of single-family and two-family projects shalL not be
excluded from the opportunity to reguest a conceptual design review. Compl.ete applications must be submitted
10 days prior to a scheduled DRB meeting.
The following information shall be subnitted for a conceptual review:
l-. A conceptual site and landscape plan at a mininum scale of one inch equals twenty feet;
2. Conceptual elevations showing exterior materials
and a description of the character of the proposed
structure or slructures;
3. Sufficient information to show the proposal-
complies with the development standards of the
zone district in which the project is to be located (i.e. GRFA, site coverage calculations,
nurnber of parking spaces, etc.)i
4. Completed DRB application form.
Procedure: Upon receipt of an applicat.ion for
conceptual design review, the Department of Community
Development shall review the submitted rnaterials for general compliance with the appropriate requirements of the zoning code. If the proposal is in basic
compliance with the zoning code requirements, the project shall- be forwarded to the DRB for conceptual review. If the application is not generally in
compliance with zoning code requirements, the application and submj.ttal materials shall be returned to the applicant with a written explanation as to why the Community Developnent Department staff has found
the project not to be in compliance with zoning code reguirements. Once a complete application has been received, the DRB shall review the submitted conceptual review application and supporting naterial in order to
determine whether or not the project generally complies with the design guidelines. The DRB does not vote on
conceptual reviews. The property owner or his
representative shall be present at the DRB hearing.

Dear sirs:
As the Architect for Mr. & Mrs. John Maclean I am reguesting
your approval for the proposed remodel shown on the attached
drawings dated September 6, 1991 for unit #4 in the Vail Point
Condominiums.
The remodeL wouLd consist of two iterns. The first is the
enlargenent of the exterior deck off the living room. Presently
there is a 5 foot wi-de deck on the south side. we proPose to wrap
this around the west side with the new deck measuring 10 ft. by
17ft. This would afford the Macleans a more usable deck. The
deck would be detailed to match the present deck. There j.s
approxirnately 40 feet between unit #a and his western neighbor,
unit #5. With the 10 foot width of the new deck there would sti1l
be about 30 feet between the units. All disturbed vegetation
(sod) would be replaced at the Macleants expense. No trees or
bushes would be disturbed by this deck.
The second part of the remodel would involve adding a bedroorn
and bath within the volume of the existing building. This
involves building a staircase over the existing one to a new level
over the garage floor. There would be two sets of windows. One
set of windows facing west with a pair of casements and
trapazoidal windows. The second set would face south (see the
attached drawj.ngs). These windows would be clad casement windows
matching the finish of the existing windows and would be trimmed
out similar to the existinq trim.
As of now the exact status of the total project GRFA (Gross
Residential Floor Area) has not been determined. The town of VaiI
recently changed the way in which GRFA is determined. If there is
enough left over GRFA we would be using about 300 square feet for
this rernodel. If not we will be applying under the 250 rule which
allows up to 250 sq. ft. per unit for rernodels. The plan would be
revised without a bathroom to reduce the square footage. As soon
as there is a determination as to the amount of square footage
avail-abte we wiII advise the board to our intentions. fn either
case the basic plan and its irnpact are the same, especia)-Iy as
viewed from the outside.

As a part of the town approval process lte are required to
submit plans and a letter from the board of the condominium
approving of this project. I have left at the bottom of this
letter a place for a signature of approval. If this project is
favorable please sign and date below returning one copy to the

The subdivider shall complete, in a good worXmanlike nanner, all
public irnprovements as shown in the final plat documents for tbe
bubdivision in accordance with all plans and specifications for tbe
Subdivision filed in the office of the Couurunity Developrnent
Departnent, the Town of Vail, and to do all work incidental thereto
according to and in courpliance with the following:
a. A11 final plat docurnents subnitted prior to or at the tine
of final plat approval .
b. All laws of the United States of Anerica, State of Colorado,
or Town of Vail and its respective agencies, affected
special districts and,/or service districts.
c. Such other designs, drawings, naps' specifications,
sketches, and other natter subnitted by the Subdivider to
be approved by any of the above-referenced governnental
entities. All said Idork shall be done under the inspection
of, and to the satisfaction of the Town Engineer, the Town
Building official , or other officiaL f,ron the Town of Vail,
affected special districts or ser:vice districts, as their
respective interest nay appear, and shafl not be deeroed
conplete until approved and accepted as cornpleted by the
Town of VaiL Connunity Developrnent Departnent and Public
l{orks Departnent.
2. The.estinated cost ofnsaid work and inprovenents is the sun

To secure and guaranted performance of its obligations as set
forth herein, the Subdivider agrees to provide security and collateral
as follows:

An irrevocable letter of credit frou First Bank of Silverthorne in
the anount of $19,108.00 on a forT acceptable to the Town
Attorney, shall provide the security for the inprovements set
forth above if there is a default under this Agreenent by the
Subdivider.
3. The Subdivider may at any tine substitute the collateral
originally set forth above for another fom of collateral acceptable
to the Town to guarantee the faithful conpletion of those public
inprovernents refeired to herein and the perfor:mance of the teras of
this Agreement. Such acceptance by the Town of alternative collateral
shall be at the Townrs sole discretion.
4. The Town shall not, nor shall any officer or enployee
thereof; be liabLe or responsible for any accident, Ioss or danage
happening or occurring to Lhe work specifl.ed in this Agreenent prior
to- Lhe corrpletion and acceptance of the sane' nor sha1l the Tohln, nor
any officer or employee thereof, be liable for any Persons-or Property
in]ured by reason of the nature of said work, but all of said
lilbilitias shal1 and are hereby assuned by the subdivider.
The Subdivider hereby agrees to indennify and hold harnless the
Town, and any of its oifiiers, agents and enployees against any
Losses, claini, darnages, or liabilities to which the Tonn or any such
of its officers, agents, or employees nay becone subject to, .insofar as any such losset, ciains, dlnages or liabilities (or actions in
respe-t tbereof) that arise out of or are based upon,any .perfornance ly the Subdivider hereunder; and the Subdivider shall reirnburse the
f6wn for any and all legal or other expenses reasonably incurred by
ttre Town in-connection with investigating or defendinq any such loss,
cLaim, darnage, liability or action. This indennity-provision shall be
in addition to any othei liability which the Subdivider nay have.
5. It is nutually agreed that the subdivider nay apply to the
To\rn for partial releasl oi ttre collateral deposited with the Town for
each catelory of improvement at such tine as such inprovements are
construct6a - tn courlliance with all plans and specifications as
referenced hereundefand accepted by the Town. By way of- exanple,
upon compfetion and acceptance by -the Town of the dernolition and
rlvegetalion of existing foundation the surn of 921700.00 shall be
released.
6. rf the Tonrl detemines that any of such improvernents as
contemplated hereunder are not constructed in compliance t+tl, the
plans ind specifications set forth herein it shall furnish the
Subdivider a list of specific deficiencles and shalt be entitled to
continue to withhold collateral to insure such coupliance. ff the
Town detenlines that the Subdivider will not construct any or afl of

Inspection.
Dan the following will need to be corrected:
1) The ditch, edge of asphalt and shoulder along Lionsridge Loop will need to be reestablished.It appears that during construction, access was taken at times from the projectts staging area on the south side of Lionsridge Loop through the ditch area to the site. This has caused damage to the north side of the
roadhray.
2) A drainage swale frorn above (just east of the new units) needs to be rip-raped from where the cobbles end all the way down to the roadside drainage ditch.
3) The drainage at the entryway will need to be handled in a way so it does not enter the roadway, but enters the ditch. If the drainage makes it to the west side of the culvert. ft will need to be rip-raped to protect the culvert fron washing out. Work on the drive entry may reguire additional asphalt work or a concrete pan to ensure the water is diverted to the west side of the drive and into the ditch.
4) The asphalt driveway in front of the eight new units is not installed properly. The asphalt in the swa1e, is alligatoring and punping. It will need to be saw cut out, the subgrade and base course be recompacted, and then patched back in.
5) If any landscaping is placed in the right of way, a revocable right of way permit wiII be required..
