Dear Warren,
I've enclosed some illustrations to clariff the scope and impact of the requested dormer
design change.
As discussed, of the numerous buildings comprising the complex there are only two that
contain units similar to that of Mr. Antonius and therefore the only two that can be potentially
affected by this review. They are highlighted on the overall site plan as buildings A and B.
You'll note, from the site plan and the photographs previously forwarded to you, that the two
buildings are spread out on two different faces ofthe slope and both are not easily visible
from one vantage point.
The existing dormer addition is located on unit number 12 in building A. Mr. Antonius'
proposed addition, to unit No. 7, is located in Building B. The Vail Point Architectural and
Homeowners' Boards voted to support the proposed design revision for the Antonius' unit
and any others in building B. For consistency and in view ofthe visual separation between
the fwo buildings, the Board also voted to have any future dormer additions in Building A
match the existing window arrangement used on Unit 12.

Warren,
Jeff & | fully appreciate and share your concerns for consistency. The
differentiation is an intentional design decision for which Jeff has
received both Vail Point Design & Architectural Committee and
Homeowner's Board of Directors approval. Specific in the Board approval
is the agreement that any and all future such additions, in his building
(Bldg. 3 and including Jennifer Krononberg's Unit 5 approval), will
match the newly proposed design.
I will fonryard the e-mail granting the Antonius' approval and expressing
the need for consistency. A formal letter of approval is forthcoming.
You will note that they have recommended that when the Unit 13 (Mike
Sample) and any other residents of that building submit their
applications that they should be made to conform to the existing design
used for unit 12. Do keep in mind that it is very difficult to
impossible to see both buildings from one vantage point.
I hope that this direction will address your concerns. Please call me

Michael,
Attached is an email from Jim Kearney, Vice President of Vail Point's Board of Directors, indicating the
Board's approval of the final window configuration of the south facing dormer for my Unit(#7) and Jennifer
Kronenberg's unit(#S).
I trust this is all that is needed for Warren Campbell, as the dormer's size and style along with the front
door movement was previously approved by Vail Point's BOD last summer. Those plans, which are not
changed, were submitted to the TOV Design and Review Board, for which we obtained approval.

area). This includes proposals for 250 additions and interior conversions. See Title 12, Chapter
15 - Gross Residential Floor Area for specific regulations.

as to the seller, the builder and/or the contractor; payment of the appropriate premium; fully executed

CONDITIONS AND STIPIJLATIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or
other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien,
encumbrance, adverse claim or other matter affecting the estate or interest or
mortgage thereon covered by this Commitment other than those shown in
Schedule B hereof, and shall fail to disclose such knowledge to the Company in
writing, the Company shall be relieved from liability for any loss or damage
resulting from any act of reliance hereon to the extent the Company is prejudiced
by failure to so disclose such knowledge. If the proposed Insured shall disclose
such knowledge to the Company, or if the Company otherwise acquires actual
knowledge of any such defect, lien, encumbrance, adverse claim or other matter,
the Company at its option may amend Schedule B of this Commitnent
accordingly, but such amendment shall not relieve the Company from liability
previously incurred pursuant to paragraph 3 ofthese Conditions and Stipulations.
3. Liability of the Company under this Commirnent shall be only to the named
proposed Insured and such parties included under the definition of Insured in the
form of policy or policies committed for and only for actual loss incurred in
reliance hereon in undertaking in good faith (a) to comply with the requirements
hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or
create the estate or interest or mortgage thereon covered by this Commitnent. In
no event shall such liability exceed the amount stated in Schedule A for the policy
or policies committed for and such liability is subject to the insuring provisions, the
Conditions and Stipulations, and the Exclusions from Coverage of the form of
policy or policies committed for in favor of the proposed Insured which are hereby
incorporated by reference and are made a part of this Commitment except as
expressty modified herein.
4. Any action or actions or rights of action that the proposed Insured may have or may
bring against the Company arising out of the status of the title to the estate or
interest or the status of the mortgage thereon covered by this Commitment must be
based on and are subject to the provisions of this Commitment.

Vail Point Condominiums GRFA Inlerpretation
The Vail Point Gondominiums, located at 1881 Lions Ridge Loop, is a development of 40
lownhome style residential dwelling units. The property was annexed inlo the Town of Vail in
1979 and the condominium project began in 1981 and abruptly stopped in 1 984 for unknown
reasons. The project was finished in 1991-1992.
The site was developed under the Medium Density Multi-family (MDMF) regulations and
proposed to be 860 square feet of GRFA less than the maximum allowable GRFA by MDMF
standards. However, two of the owners have indicated that they believe some of the buildings
may have a larger building footprint than shown on the developmenl plans. A development of
40 condo units could have easily utilized the excess GRFA (860 sq. ft. according to the lile).
Two condominium owners are proposing lo converl lhe upper portion of their garage, which has
a 20 foot high ceiling, into a bedroom and bathroom. Under Section 12-15-4Interior
Conversions, the conversion of existing floor space is only allowable if the GRFA for the entire
site has been exhausted. The unils are eligible for lhe 250 addilion and interior conversions
because the GRFA is at its maximum allowable under MDMF regulations.

VITI . CONCEPTUAI., DESTGN REVIEW
A. Submittal recruirements: The owner or authorized agent of any project reguiring design approval as prescribed.by this chapLer may submit plans for conceptual review by the Design Review Board to Lhe Department of Community Development. The concepEual review is intended to give the appricant. a basic understandino of the compat.ibility of Lheir proposal witb the Town,s Design Guidelines. This procedure is recommended primarily for applications more complex than single-family and Ewo-family residences. However, developers of single-family and two-family projects shalI not. be excluded from t.he opportunity t.o request a concepLual design review. Complete applications musE be subnit,ted 10 working days prior t.o a scheduled DRB meeting.
The following information sha1l be submitted for a conceptual review:
1_. A conceptual site and landscape plan at a minimun scale of one inch equals twenty feet;
