To whom it may concern:
Yesterday Leonard Sandavol was good enough to point out two areas at the above resldence
that needed to be addressed in order to comply with the T.O.V. codes. The rock wall on the
north side, which was to high, now has a planter at its foot. This is in compliance with the
original drawings and all Town regulations. lhave provided a sketch and letter from LKP
engineering regarding the structural integrit',, of this wall.
ft was also discovered that a 10 foot section of the concrete drive was in excess of 12o/o.
Depending on the angles and radii used the results varied lrom 12.9o/o to 15%. I was able to
get Peak Land Surveying out yesterday afternoon to reshoot the area in question and they
have provided a more accurate drawing showing the area in question to be 11.77o/o.
I believe these items should satisfy the concerns of the public works department. Thank you

At your request on Jrrly 29, 1999, we visited the constructlon site at Lot B, Valley Phase
5, Replat of Lots 3 & 4, Town of Vail, Eagle County, Colorado, The purpose of our site visit was
to inspect the boulder retaining wall at the rear ofthe nsw residence, specifically the section
whsre the boulder wall section is 6.5 toct high.
Two boulder walls wcro constlwtcd. Both walle wcrc bcrilt from luge (Zfeet aud larger)
rocks, with rectangular surfaccr. Subroqucnt layers ofbotrklers wtrc laid offset ftom thc layer
below, resulting in a stablc wall, filtdl toward the hilleidc. At thc lsar of the boulder wall a
dtainage swale was constnrcted. This swule will divert thc surfacc runofffrom the eteep hillside
above, away ftonr the boulder wall and fiorn the resideme.
The constnrction of the bouldst retaining walls dt the rsff of the resideuce is satisfactory.

3. The Developer may at any time substitule lhe collateral originally set forth above for another form of collateral acceplable lo the Town to guarantee the faitliful completion of those improvements referred lo herein and lhe performance of the terms of this Agreement. Such
acceptance by the Town of alternative collateral shall be at the Town's sole discretion.
4. The Town shail not, nor shail any officer or emproyee thereot, be liabre or responsible for any accident, loss or damage happening or occuiring to the work specified in this Agreement prior to the completion and acceptance of the same, nor-shall the Town, nor any
ofiicer or employee thereof, be liable for any persons or property injured by reason of the nature ol said work, but all of said liabilities shall and are hereby assumed-by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and nay of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the Town or any of its officers, agents or employees may become suOyect to, insofar as any such losses, claims, damages or liabilities (or actions in respect thereofj that arise out of or ire based
upon any performance by the Developer hereunder; and the Developer shall reimburse the Town for any and all legal or olher expenses reasonably incurred by the Town in connection with investigating or defending any such loss, claim, damage, tiaOitity or action. This indemnity provision shall be in addition to any other liability which the Dev-eloper may have.

6. lf the Town determines, at its sole discretion, that any of the improvements
contemplated hereunder are not constructed in compliance with the plans and specifications set forlh in this Agreement on or belore the date set forth in Paragraph d, the To*n may, but shall not be required to, redeern the letter of credit as necessary to complete the unfinished improvements. The Bank shall release such funds upon written request from the Town stating that lhe improvements have not been completed as iequired by this agreement. The Bank shall not require the concurrence of the developer prior to reiease oi tne tunos to the Town nor shall the Bank be required to verify independently ihat such improvements have not been completed as required by this agreement, but shall release such lunds solely upon the Town,s written request.
lf the cosls ol completing the work exceed the amount of the deposit, the excess,together with interest at lwelve percent per annum, shall be a lien againlt the property and may be collected by civil suit or may be certified to the treasurer of EaglJCounty to be collected in the same manner as delinquent ad valorem taxes levied against such property. tt tne permit holder fails or refuses to complele the cleanup and landscaping, ad defined in lhis chapter, such lailure or refusal shall be considered a violation of the Zoning Code.

Alt of the above work to be completed in a substantial and workmanlike manner for the sum of $7.800.00
This proposal must be accepted as provided and delivered to Elam Construction, lnc., 30 days from above date, or it shall expire.
The contract amount is payable to Elam Construction, Inc. monthly for work as it progresses with the entire balance payable upon
completion unless otherwise provided in this contract or in the plans and specifications. Unless otherwise specified herein, the plans
and specifications, if any, are expressly made a part of this contract. The contractor shall perform all of the work in a substantial
and workmanlike manner and in accordance with the terms ofthe plans and specifications.
The customer may order additional work or changes in writing at any time, at an agreed price or at the contractor's regular rates
lor the time and material work
If payments for work are not made when due, the contractor may stop work or terminate this contract and recover from the
customer payment for all work executed and loss sustained and reasonable profit and damages. It is hereby mutually agreed that
the contractor shall not be hetd responsible or liable for any loss, damage, liquidated damages or delay caused by fire, strike, civil
or military authority or any other cause beyond its control.
A late charge of 187o per annum on the outstanding balance may be imposed upon all past due payments. Customer agrees to pay
all costs of collection and a reasonable attorney's fee ifthe account becomes delinquent and is referred for collection.
Ifthe customer disposes of the real estate by sale or otherwise, the full amount remaining unpaid on this contract becom€s due at
once and payable within forty-eight (48) hours after date ofsuch disposal.
The contractor agrees to carry Workmen's Compensation and public liability insurance and to pay all sales taxes, old age benefit
and unemployment compensation taxes upon the material and labor fumished under this contract, as required by the United States
of America and the State in which this work is performed.

I. DESCRIPTION OF THE REQUEST
Special Development District #34 was approved by the Town Council in February of
'l997, allowing for the subdivision of Lots 3 and 4 of The Valley Phase 5 into 3 lots (Lots
A, B, and C.) Due to a computer error, the building envelope was placed incorrectly on
Lot B. To correct the siluation, the applicant is requesting a resubdivision of Lot B. The
only change is the location of the building envelope. The corrected plat corresponds
with all previous approvals of the ForkeniLindstrom Residence.
II. DEVELOPMENT STANDARDS

III. MINOR SUBDIVISION CRITERIA
A basic premise of subdivision regulations is that the minimum standards for the creation of a
new lot must be met. This subdivision will be reviewed under Title 13, Subdivision Regulations,
of the Town of Vail Municipal Code.
A. The first set of criteria to be considered by the Planning and Environmental Commission
for a Minor Subdivision application is:
Lot Area: The lot size standards as prescribed by SDD #34
Staff Response:
As proposed, this minor subdivision meets this requirement.
Frontage: The Subdivision Regulations require a minimum Street Frontage of 30'.
Staff Response:
As proposed, this minor subdivision meets this requirement.
B. The second set of criteria to be considered with a Minor Subdivision application, as
outlined in the subdivision regulations, is:
"The burden of proof shall rest with the applicant to show that the application is in
compliance with the intent and purposes of this Chapter, the Zoning Ordinance
and other pertinent regulations that the Planning and Environmental Commission
deems applicable. Due consideration shall be given to the recommendations
made by public agencies, utility companies and other agencies consulted under
subsection 13-3-3C. The Planning and Environmental Commission shall review
the application and consider its appropriateness in regard to Town policies
relating to subdivision control, densities proposed, regulations, ordinances and
resolutions and other applicable documents, environmental integrity and
compatibility with the surrounding land uses and other applicable documents,
effects on the aesthetics of the Town."
The Specific Purpose of the Subdivision Regulations is as tollows:
1. To inform each subdivider of the standards and criteria by which development proposals will
be evaluated, and lo provide information as to the type and extent ol improvements
required.
Staff Response:
The review of this request has followed the regulations prescribed for minor subdivision
in the Municipal Code.
2. To provide for the subdivision of property in the future without conflict with development on
adjacent land.
Staft Response:
Staff believes that this resubdivision will not conflict with development on adjacent
properties.
3. To protect and conserve the value of land throughout the Municipality and the value of
buildings and improvements on the land.
SfaffPesponse:
Staff does not believe that the request will have a negative impact of the value of land in
the Town of Vail generally, nor in the immediate area.
4. To ensure that subdivision of property is in compliance with the Town's zoning ordinances,
to achieve a harmonious, convenient, workable relationship among land uses, consistent
with Town development objectives.
Staff Responre:
The resubdivision meets the minimum zoning requirements of SDD #34.
5. To guide public and private policy and action in order to provide adequate and efficient
transportation, water, sewage, schools, parks, playgrounds, recreation, and other public
requirements and facilities and generally to provide that public facilities will have sufficient
capacity to serve the proposed subdivision.
Staff Response:
The resubdivision will have no additional effects on the above criterion.
6. To provide for accurate legal descriptions of newly subdivided land and to establish
reasonable and desirable construction design standards and procedures.
Statf Response:
Because this resubdivision is necessary to correct a mistake on an existing plat, the
resuMivision will provide for a more accurate legal description of the subdivided land.
7. To prevent the pollution of air, streams and ponds, to assure adequacy of drainage facilities,
to safeguard the water table and to encourage the wise use and management of natural
resources throughout the Town in order to preserve the integrity, stability and beauty of the
community and the value of the land.
Staff Response:
Staff does not believe that the resubdivision will have any adverse effects on the above
criterion.
lV. Staff Recommendation
The Community Development Department recommends approval of the proposed minor
subdivision subject to the following finding:
That the proposed minor subdivision plat complies with the review criteria and
requirements of Chapter 13 of the Town of Vail Municipal Gode and development
standards as outlined in Ordinance 2, Series of 1997 (SDD #34).

The Community Development Department has reviewed your application for a resubdivision of Lot
B, Lots 3 and 4, The Valley Phase 5. The following revisions need to be addressed prior to the
Planning and Environmental Commission meeting on November 9, 1998:
1. Buffehr Creek Road is misspelled. The correct spelling is Buffehr Creek Road.
2. The last line of the plat title should read: Town of Vail, County of Eagle, State of Colorado
3. Please complete the addresses ofthe owners, and include the address ofthe Notary Public.
4. It is not necessary to include the Town Council or the Zoning Administrator's Certificate on
a minor subdivision plat. Please revise the plat accordingly.
5 Dimensions should be to the nearest one-hundredth.
The resubdivision of Lot B, Lots 3 and 4, The Valley Phase 5 is scheduled for review by the Planning

FINAL PLAT - REQUIREMENTS AND PROCEDURE:
(Some of these requirements may be waived.)
a. The subdivider shall submit four copies of the final plat, two of which shall
be mylars, twelve copies of the final EIR (if required) and any additional
material as required below. Within thirty days of receiving the complete
and correct submittal for a final plat, the zoning administrator shall cause a
copy of a notice of the time, place and general nature of the hearing and
proposal to be published in a newspaper of general circulation in the Town
of Vail at least fifteen days prior to said hearing. Also, adjacent property
owners to the proposed subdivision shall be notified in writing at least
seven days prior to the public hearing.
Final Plat - Staff Review.
The final plat shall be circulated to and reviewed by the town's departments,
including, but not limited to Public Works, Transportation, Community
Development, Recreation, Administration, Police and the Fire Department.
Comments and concerns of these departments will be forwarded to the PEC prior
to the public hearing.

The linal plat and supplementary material shall contain the following information:
1. The final plat shall be drawn in India ink, or other substantial solution, on a
reproducible medium (preferably mylar) with dimension of twenty-four by
thirty-six inches and shall be at a scale of one hundred feet to one inch or
larger with margins of one and one-half to two inches on the left and
one-half inch on all other sides.

Accurate dimensions to the nearest one-hundredth of a foot for all lines.
angles and curves used to describe boundaries, streets, setbacks, alleys,
easements, structures, areas to be reserved or dedicated for oublic or
common uses and other important features. All curves shall be circular
arcs and shall be defined by the radius, central angle, arc chord distances
and bearings. All dimensions, both linear and angular, are to be
determined by an accurate control survey in the field which must balance
and close within a limit of one in ten thousand.

A systematic identification of all existing and proposed buildings, units,
lots, blocks, and names for all streets.
Names of all adjoining subdivisions with dotted lines of abutting lots. lf
adjoining land is unplatted, it shall be shown as such.
An identification of the streets, alleys, parks, and other public areas or
facilities as shown on the plat, and a dedication thereof to the public use.
An identification of the easements as shown on the plat and a grant
thereof to the public use. Areas reserved for future public acquisition shall
also be shown on the olat.
A written survey description of the area including the total acreage to the
nearest appropriate significant figure. The acreage of each lot or parcel
shall be shown in this manner, as well.
A description of all survey monuments, both found and set, which mark the
boundaries of the subdivision, and a description of all monuments used in
conducting the survey. Monument perimeter per Colorado statutes. Two
perimeter monuments shall be established as major control monuments,
the materials which shall be determined by the town engineer.
A statement by the land surveyor explaining how bearing base was
determined.
A certificate by the registered land surveyor as outlined in Chapter 17.32
of this title as to the accuracy of the survey and plat, and that the survey
was performed by him in accordance with Colorado Revised Statutes
1973, Title 38, Article 51 .
A certificate by an attorney admitted to practice in the State of Colorado,
or corporate title insurer, that the owner(s) of record dedicating to the
public the public right-of-way, areas or facilities as shown thereon are the
owners thereof in fee simple, free and clear of all liens and encumbrances
except as noted. (See example in Chapter 17.32)
The proper form for approval of the plat by the PEC chairman and
acceptance of dedication and easements by the council with signature by
the mayor and attestation by the town clerk. Examples are found in
Chapter 17 .32 ot this title.
The proper form for filing of the plat with the Eagle County Clerk and
Recorder as per example in Chapter 17.32.

of land or improvements to the public, all beneficiaries of deeds of trust
and mortgage holders on said real property will be required to sign the
certificate of dedication and ownership in addition to the fee simple owner
thereof.
All current taxes must be paid prior to the Town's approval of plat. This
includes taxes which have been billed but are not yet due. The certificate
0f taxes paid must be signed on the plat or a statement from the Eagle
County Assessor's Office must be provided with the submittal information
stating that all taxes have been paid.
Additional material which shall accompany the final plat includes, but is not
limited to:
a. Complete and final environmental impact report if required by the
zoning ordinance;
b. Complete engineering plans and specifications for all
improvements to be installed, including but not limited to water and
sewer utilities, streets and related improvements, pedestrian and
bicycle paths, bridges and storm drainage improvements;
c. Maps at the same scale as the final plat showing existing
topography and proposed grading plan (contour interval
requirements same as preliminary plan), a landscape and or
revegetation plan showing locations, type and sizes of existing and
proposed vegetati0n.
d. A map the same scale as the final plat depicting all high and
moderate avalanche hazard areas, forty percent and high slope
areas and one hundred year flood plain areas as defined in the
hazard ordinance of the Vail Municipal Code;
e. Title insurance company proof of ownership of all lands within the
proposal;
f. Copies of any monument records required of the land surveyor in
accordance with Colorado Revised Statutes 1973, Title 38, Article
53;
g. Any agreements with utility companies when required;
h. Protective covenants in form for recording;
i. Other data, certificates, affidavits, or documents as may be
required by the zoning administrator or PEC or council in the
enforcement of these regulations.
j. lf this application requires a separate review by any local, State or
Federal agency other than the Town of Vail, the application fee
shall be increased by $200.00. Examples of such review, may
include, but are not limited to: Colorado Department ol Highway
Access Permits, Army Corps of Engineers 404, etc.
The applicant shall be responsible for paying any publishing fees
which are in excess ot 50% of the application fee. lf, at the
applicant's request, any matter is postponed for hearing, causing
the matter to be re-published, then the entire fee for such re-
publication shall be paid by the applicant.
Applications deemed by the Community Development Department
to have significant design, land use or other issues which may
have a significant impact on the community may require review by
consultants other than town staff. Should a determination be made
by the town staff that an outside consultant is needed to review
o
any application, the Community Development Department may hire
an outside consultant, it shall estimate the amount of money
necessary to pay him or her and this amount shall be fonrtrarded to
the Town by the applicant at the time he files his application with
the Community Development Department. Upon completion of the
review of the application by the consultant, any of the funds
forwarded by the applicant lor payment of the consultant which
have not been paid to the consultant shall be returned to the
applicant. Expenses incurred by the Town in excess of the amount
forwarded by the application shall be paid to the Town by the
applicant within 30 days of notilication by the Town.
THE DEPARTMENT OF COMMUNITY DEVELOPMENT WILL BE RESPONSIBLE FOR SEEING
THAT THE APPROVED PLAT IS PROMPTLY RECORDED WITH THE EAGLE COUNW CLERK
AND RECORDER.

The Residential OptimarM Concealed
is the world's first 20' x 20' concealed
residential sprinkler. lt is UL Listed
for residential occupancies as
outlined in NFPA 13, NFPA 13D and
NFPA 13R with very low flows and
pressures while providing the
aesthetic appeal of a flat concealed
ceiling plate.
It is designed to compensate for
varying ceiling heights by utilizing a
droo down deflector and an
adjustable thread-on escutcheon.
This feature is signiiicant because it
allows the ceiling to fluctuate over'/2"
in height. The thin cover plate
proiects only 3/'s" below the ceiling for
the maximum in unobstructed and
aesthetic appearance.
To prevent damage to the sprinkler
and to allow the sprinkler to be
located in the ceiling, a special
protective cap is provided. This plastic
cap has a cone shaped point that can
be pressed against the wall board to
locate the position of the sprinkler and
allow the hole to be cut correctly.
The Residential OptimarM Concealed
Sprinkler employs Central's exclusive
link activating mechanism. The
sprinkler is brass and the cover plate
is available in brass, chrome plated or
white painted.
Operation: The Central Residential
Optima Concealed Sprinkler absorbs
heat through the ceiling cover plate
which is soldered to the adjustable
retainer ring with a fusible alloy. At
the rated temperature, the alloy
fuses, resulting in the plate dropping
away from lhe sprinkler. At this point,
the deflector drops down below the
ceiling surface, bringing about the
link's exposure to the fire's heat. The
heat fuses the link's thermal element
resulting in a rapid expulsion of both
the activating mechanism, as well as
the sealing cap. Water can now flow
in a pattern engineered to meet the
coverage requrremenls.

For custom painted finishes, the customer must furnish a quick-drying paint,
preferably lacquer-based, to ensure proper color duplication. One quart of
paint is required for each 200 plates.

The Central Model ROC Residential
OptimarM Concealed Sprinkler must
be installed in conlormance with
cunent NFPA 13, NFPA 13D and
NFPA 13R Standards. Deviations
from these requirements and stan-
dards, or any alteration to the sprin-
kler assembly itself will void any
warranty made by Central Sprinkler
Company. In addilion, installation
must also meet local governmenl
provisions, codes and standards, as
applicable.
The system piping must be prop-
erly sized to ensure the minrmum
required flow rate at the sprinkler.
Check for the proper model, style,
orifice size and temperature rating
prior to installation. Install sprinklers
after the piping is in place to avoid
mechanical damage; replace any
/^. damaged units. Wet pipe systems tt_ must be protected from freezing.
Upon completion of the installation,
the system must be tested per
recognized standards. In the event of
a thread leak, remove the unit, apply
new pipe joint compound or tape, and
reinstall.
Installation Sequence
Step 1. The unit must be installed in
the pendent position.
Step 2. The face of the sprinkler
fitting should be installed a nominal
2" (x'/i') behind the finished ceiling
line. Adjustments, to compensate for
variations in fitting face to ceiling
height, may be made by threading the
cover plate retainer in and out of the
unit's support cup.
Step 3. Use only a non-hardening
pipe joint compound, or Tellon- tape.
Apply only to the male threads.
Step 4. Hand tighten the sprinkler
into the fitting. Avoid making contact
with the deflector when using the
Central Sprinkler OptimarM Con-
cealed Wrench to tighten the unit into
the fitting. The wrench is designed to
mate with the body's wrench bosses.

leak tight joint requires a only 7 to 14
fl. lbs. of torque. Torque levels
greater than 21 tt. lbs. may distort the
orifice seal, resulting in leakage.
Step 5. After initial installation and
before the cover plate is installed,
cover the sprinkler with the special
plastic protective cap. The cap is
specially designed to not only protect
the sprinkler, but allow the ceiling
installers to locate the sprinkler by
pressing the ceiling board up against
it. The end of the cap has a special
tip. therefore leaving an impression in
the ceiling board for the location of
the sprinkler. Care should be taken
to only press the ceiling lightly against
the cap as excessive pressure will
damage the sprinkler. This cap must
be removed for the sorinkler to
iunction correctly.
Step 6. To install the ceiling cover
plate, manually thread the cover
retainer into the support cup. Con-
tinue threading until the cover
retainers flange rests against the
surface of the ceiling.
Caution: Special care must be taken
when installing wilh a CPVC system.
Sprinklers must be installed aiter the
manufacturer's recommended setting
time for the primer and cement to
ensure that neither accumulale within
the sprinkler.
Special care must be taken when
installing with a copper system.

Sprinklers rrust be handleo carefully.
They must not be transported or stored
where ambienl temperature may exceed
100"F/38"C. For best results, store them
in a dry, cool location in the origrnal
shipping package.
Do not install spnnklers that have been
dropped or visibly damaged. Sprinklers
must never be painted, coated, plated or
altered in any other way from manufac-
tured condilion or they may not function
properly. Any spranklers allered in such
manner must be replaced.
The owner is responsible for the prcper
operating condition of all fire protection
devices and accessories. The NFPA
standard 25 entitled, "lnspection, Testing
and Maintenance of Water-Based Fire
-'Jtection Systems" contains guidelines
d minimum maintenance requirements.
Furthermore, lhe local Authority Having
Jurisdiction may have additional regula-
tions and requirements for maintenance,
testing, and inspection that must be
ooeyeo.
It is advisable to have sprinkier systems
inspected regularly by a qualilied inspec-
tion service. Lenglh of time between
such inspections can vary due to accessr-
bility, ambient atmosphere, water supply,
and sile activity.
Do not attemot to reassemble or
otherwise reuse a sprinkler that has
operated. Replace any sprinkler exhibit-
ing corrosion or damage: always use new
sprinklers of the same orifice, style, and
iemperature rating as replacements.

mode, first refer to the system operating
guide and valve instruction. Drain water
and relieve pressure in the pipes.
Femove the existing unrt and install the
replacement, using only the recom-
mended sprinkler wrench. Be certain to
match model, style, orilice. and tempera-
ture ralrng.
A fire protection systern that has been
shut off after an activation should be
repaired and returned to service immedi-
ately. Inspect the entire system for
damage and replace or repair as neces-
sary. Sprinklers that did not operate but
were subjected to corrosjve elements of
combustion or excessive temperatures
should be insoected. and reolaced if need
be. The Authority Having Jurisdiction will
detail minimum replacement requirements
and regulations.
Guarantee: Central Sprinkler Com-
pany will repair and/or replace any
products lound to be defective in material
or workmanship within a period of one
year f rom the date oi shipment. Please

The BBSC can be inslalled in any orientation in
a piping system using standard National Pipe
Threads. Wrench should be used to hex on lhe
end ol valve being threaded lo pipe. Pipe
sealants should be used sparingly.
The valves with internal swilches can be easily
wired in the field. They will have hvo switches,
switch-1 will have dual leads on the terminals.
This switch is to be connected to the supervisory
circuit of a Listed alarm control panel. Switch-2
will have single leads and may be connected to
auxiliary equipment per direction of the local
authority having jurisdiction. Cap any unused
wire leads with wire nuts and tuck into junction
box. All connections shall be reviewed and
approved by the local authority having jurisdiction.
A 14 gage green wire has been fastened to the
interior of the housing and is to be used as a
housing ground.
Recommended type of wire to be used is No. 16
Dual Rated UL 300V 80 C and 300V 105 C.
Installation must be in compliance with NFPA 72
and 13, or bonded and grounded per Canadian
Electrical Code Part 1.
The BB-SC, BBHSC (threaded-end) and BBVSC,
BBHSC (grooved-end) valves are intended
lor use with schedule 40 and/or 80 pipe, sizes
1", 1'l.", 1'12",2" and 2'l'" perANS| 836.10.
INSTALLATION FOR NEWYORK CITY VALVES
N.Y.C. special valves have a large flow indicator
which points in the direction of the valve disc, indi-
cating open or closed. The valve should be installed
in a position where the indicator is readily visible.

The Model VS-SP is a vane type waterflow switch for
use on wel sprinkler systems. These devices may be
used as sectional f low indicators on large sprinkler
systems and on smaller sprinkler systems such as
mobile homes and residential dwellings.
INSTALLATION: These devices may be mounted in
horizontal or vertical pipe. On horizontal pipe they should
be installed on the top side of the pipe where they will be
accessible. The units should not be installed within 6" of
a valve, drain or fitting which changes the direction ol the
vraler flow.
The unit has a 1" NPT bushing for threading into a non-
corrosive TEE. See Fig.2 tor proper TEE size, type and
installation. Screw the device into the TEE fitting as
shown in Fig.2. Care must be taken to properly orienl
the device tor the direction of waterflow.
The vane must not rub the inside of the TEE or bind in
any way. The slem should move freely when operated
by hand.
TESTING: Check the operation of the unit by opening
the inspector's test valve at the end ol the sprinkler line,
or the drain and test connection if a test valve is not
provided.
lf there are no provisions for testing the operation of the
flow detection devlce on the system, application of the
VS-SP is nol recommended or advisable.

WHEREAS, the Developer is obligated to provide security or collateral sufficient in the
judgment of the Town to make reasonable provisions for completion of certain improvements
set forth below; and
WHEREAS, the Developer wishes to provide collateral to guarantee performance of
this Agreement, including construction of the above-referenced improvements by means of the
following:
Developer agrees to establish a cash deposit with the Town of Vail in a dollar amount

NOW, THEREFORE, in consideration of the following mutual covenants and
agreements, the Developer and the Town agree as follows:
1. The Developer agrees. at its sole cost and expenses, to furnish all equipment
and material necessary to perform and complete all improvements, on or before
a'i''\ ,' , Y\'\t.' The Developer shall complete, in a good workmanlike manner, all
improvements as listed above, in accordance with all plans and specifications filed in the
office of the Community Development Department, the Town of Vail, and to do all work
incidental thereto according to and in compliance with the following:
a. Such other designs, drawings, maps, specifications, sketches, and other matter
submitted by the Developer to be approved by any of the above-referenced
governmental entities. All said work shall be done under the inspection of, and
to the satisfaction of, the Town Engineer, the Town Building Official, or other
official from the Town ol Vail, as affected by special districts or service districts,
as their respective interest may appear, and shall not be deemed complete until
approved and accepted as completed by the Town of Vail Community
Development Department and Public Works Department.
2. To secure and guarantee performance of its obligations as set forth herein, the
Developer agrees to provide security and collateral as follows:

A cash deposit account in the amount ot g__/,e.,ffE).--to be held by the Town, as
escrow agent, shall provide the security for the improvements set forth above if there is
a default under the Agreement by Developer.
3. The Developer may at any time substitute the collaterai originally set forth
above for another form of collateral acceptable to the Town to guarantee the faithful
completion of those improvements referred to herein and the performance of the terms of this
Agreement. Such acceptance by the Town of alternative collateral shall be at the Town's sole
discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occurring to the work specified in
this Agreement prior to the completion and acceptance of the same, nor shall the Town, nor
any officer or employee thereot, be liable for any persons or property injured by reason of the
nature o{ said work, but all ot said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any ol its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are
based upon any performance by the Developer hereunder; and the Developer shall reimburse
the Town for any and all legal or other expenses reasonably incurred by the Town in
connection with investigating or defending any such loss, claim, damage, liability or action.
This indemnity provision shall be in addition to any other liability which the Developer may
nave.
5. lt is mutually agreed that the Developer may apply to the Town and the Town
shall authorize lor partial release of the collateral deposited with the Town for each category
of improvement at such time as such improvements are constructed in compliance with all
plans and specilications as referenced hereunder and accepted by the Town. Under no
condition will the amount of the collateral that is beino held be reduced below tne amount
necessary to complete such improvements.
6. lf the Town determines that any of the improvements contemplated herein are
not constructed in compliance with the plans and specilications set forth herein by the date set
forth in paragraph 2, the Town may, but shall not be required to, withdraw from the cash
deposit such funds as may be necessary to complete the unfinished improvements. The
Town shall release such funds upon the written request of the staff of the Community
Development Department stating that the improvements have not been completed as required
by the agreement. The Town shall not require the concurrence of the developer prior to the
release of the funds, nor shall the Town be required to verify independently that the
improvements have not been completed as required by this Agreement, but shall release such
funds solely upon the request of the Community Development Department.
lf the costs of completing the work exceed the amount of the deposit, the excess,
together with interest at twelve percent per annum, shall be a lien against the propefi and
may be collected by civil suit or may be certified to the treasurer of Eagfe County to be
collected in the same manner as delinquent ad valorem taxes levied against such property. lf
the permit holder fails or refuses to complete the cleanup and landscaping, as defined in this
chapter, such failure or refusal shall be considered a violation of the Zoning Code.
7. The Developer warrants all work and material for a period of one year after
acceptance of all work referred to in this Agreement by the Town pursuant to Section
17.16.250 if such work is located on Town of Vail property or within Town of Vail right-of-way.
8. The parties hereto mutually agree that this Agreement may be amended from
time to time, provided that such amendments be in writing and executed by all parties hereto.

I. DESCRIPTION AND BACKGROUND OF THE REOUEST
On February 18, 1997, the Town Councilapproved SDD #34 (Ordinance 2, Series of 1997). This
SDD allowed for the development of 3 single-family homes on 3 lots, thus allowing the
subdivision of Lots 3 and 4, of The Valley Phase 5, into 3 lots (Lots A, B, and C).
Each lot is allowed a maximum of 2,933 sq. ft. of GHFA and one EHU is required for the entire
development.

restricted tor use by EHU only. Up to 300 sq. ft. garage credit allowed per
EHU per lot.
Per building envelopes delineated on development plan. No GRFA is
permitted within 20' of the front property line. Garage area is allowed
within 20'from the front property line within the established building
envelopes.

III. MINOR SUBDIVISION CRITERIA
One of the basic premises of subdivision regulations is that the minimum standards for the
creation of a new lot must be met. This subdivision will be reviewed under the Minor Subdivision
Criteria, pursuant to Chapter 17, Subdivision Regulations, of the Town of Vail Municipal Code.
The first set of criteria to be considered by the Planning and Environmental Commission
lor a Minor Subdivision application is:
Lot Area - The lot size standards are prescribed in SDD #34.

"The burden of proof shall rest with the applicant to show that the application is in
compliance with lhe intended purpose of Chapter 17, the Subdivision Regulations and
other pertinent regulations that the PEC deems applicable. Due consideration shall be
given lo the recommendations by public agencies, utility companies and other agencies
consulted under Section 17.16.090. The PEC shall review the application and consider
its appropriateness in regard to Town policies related to subdivision control, densities
proposed, regulations, ordinances and resolutions and other applicable documents,
effects on the aesthetics of the Town, environmental integrity and compatibility with
surroundino uses."
The subdivision purpose statements are as follows:
1. To inform each subdivider of the standards and criteria by which development and
proposals will be evalualed and to provide information as to the type and extent of
improvements required.
SFtf Response:
The review of this request has followed the regulations prescribed for minor
subdivrsrbns in the Municipal Code.
2. To provide for the subdivision of property in the future without conflict with development
on adjacent properties.
Slaff flesponse:
The proposal increases the number of lots but will reduce the total number of
dwelling units allowed. The proposal will not conflict with development on
adjacent properties.
3. To protect and conserve the value of land throughout the municipality and the value ot
buildings and improvements on the land.
Staff Fesponse;
Staff does not believe that the applicanls request will negatively impact the value
of land in the Town of Vail generally, or in the immediate area specifically.
4. To insure that subdivision of property is in compliance with the Town Zoning Ordinance,
to achieve a harmonious, convenient, workable relationship among land uses, consistent
with municipal development objectives.
SFlt Besponse:
The proposed suMivision meets the minimum zoning requirements as outlined in
sDD #34.
5. To guide public and private policy and action in order to provide adequate and efficient
transportation, waler, sewage, schools, parks, playgrounds, recreational and other public
requirements and facilities and generally to provide that public facilities will have sufficient
capacity to serve the proposed subdivision.
Sbft Besponse:
Staff does not believe the requested minor subdivision will have any new adverse
impacts on the above-described criterion. The proposal reduces the number of
allowable dwelling units and therefore will reduce any impacts on these rssues.
6. To provide for accurate legal descriptions of newly subdivided land and to establish
reasonable and desirable construction, design standards and procedures.
Sbff Besponse:
The proposal will aeate an accurate legal description for the subdivided land.
7. To prevent the pollution of air, streams, and ponds, to insure adequacy of drainage
facilities, to safeguard the water table and encourage the wise use and management of
natural resources throughout the municipality in order to preserve the integrity, stability
and beauty of the community and the value of land.

Staff does not believe the proposed minor suMivision will have any negative
impacts on the above described criterion.
IV. STAFF RECOMMENDATION
The Community Development Department recommends approval of the proposed minor
subdivision subject to the following finding:
1. That the proposed minor subdivision plat complies with the review criteria and
requirements of Chapter 17 ol the Town of Vail Municipal Code and development
standards as outlined in Ordinance 2, Series of '1997 (SDD #34).

Dear Dominic:
This letter is in reference to the comments sent on June 27 regarding the proposed
Lindstrom-Forken Residence. We believe all items have been resolved with the
exception of ltems 1 and 5.
Regarding ltem 1, all utility verification forms have been signed with the exception
of TCI Cable, who refuse to sign due to the economics of crossing the road.
During construction, when we bring water and sewer across, we will bury a conduit
to provide cable service. lf this is not acceptable to TCI Cable, a satellite system
will be used.
Regarding ltem 5, we have submitted a stamped survey of this site but without
spot elevations at 10' increments along the edge of pavement. We are proposing
to update the survey with the 10' spot elevations at the same time as field work is
done for the plat, which we estimate to occur sometime in the next two weeks.
The updated survey will also show the existing retaining walls on the south side of
Buffehr Creek Road that will need to be rebuilt after utility work is done.
