How it relates to Building permits:
1) Fill out our check list provided with a buildino oermit aoolication.lf yes was answered to any public Way,, is required. you can pick up an application at eiiher community oevetopmeni,
located at 75 S. Frontage Road or Public Works, located at 1gdg Vait Viltey Diive.
2) Notice sign offs for utility companies. All utilities must field verify (locate)respective utilities prior to signing application. Some utility companies iequire u[to a 48 hour notice to schedule a locate.
3) A construction traffic controustaging plan must be prepared on a separate sheet of paper.An approved site plan may also be used. ' This plan will show locations of all traffic Tltfgl devices(signs, cones, etc..) and the work zone, larei of construction, !!aging, etc..). This plan wiliexpiie on oct. 15th. and rnill'neeo o be resubmitted for approval through the wintei.
4) Sketch of work being performed must be submitted indicating dimensions (length,width & depth of work). This may be drawn on the traffic controt ptan oi a iite ptan for the job.
5) Submit completed application to the Public Works's office for review. lf required,locates will be scheduled for the Town of vail Electricians and lrrigation .r"il. 1,-"focates take prace in the morning but, may require up to 4g hou-rs to perform- -
6) The Public wof s Construction Inspector will review the application and approve or disapprove the permit. You will be contacted as to the siatus and any that may needed' Most permits are released within 48 hours of ueint received, but please allow up to one week to process.
7) As soon as the permit is processed,, a copy wifl be faxect to Gommunity Development allowing the "Building Permit" to be released. please do not confuse the "Public Way Permit" with a "e-uitoing Permit" to oo uro* on a project itself.

I have finally received a copy of the Homeowner covenants
affecting Hettinga and I wanted to answer your concerns
regarding the building enveloPe,
As best r can determine, the covenants contain no language
governing the envelope or whether roofs may extend beyond the
envelope. Flolrever, Lh" covenants do say that the Architectural
Committee nay reject plans for ga reason.

Such other designs, drawings, maps, specifications, sketches, and other matter
submitted by the Developer to be approved by any of the above-referenced
governmental entities. All said work shall be done under the inspeclion ol, and
to the satisfaction of, the Town Engineer, the Town Building Official, or other
official from the Town of Vail, as affected by special districts or service districts,
as their respective interest may appear, and shall not be deemed complete until
approved and accepted as completed by the Town of Vail Community
Development Department and Public Works Department.
To secure and guarantee performance of its obligations as set forth herein, the
Developer agrees to provide security and collateral as lollows:

4. The Town shall not, nor shall any- officer or employee thereof. be liable or
responsible for any accident, loss or damage happening or occuning to the work specified in
this Agreement prior to the completion and acceptance of the same, nor shall the Town, nor
any officer or employee thereof, be liable for any persons or property injured by reason of the
nalure of said work, but all of said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) that arise out ol or are
based upon any performance by the Developer hereunder; and the Developer shall reimburse
the Town for any and all legal or other expenses reasonably incurred by the Town in
connection with investigating or defending any such loss, claim, damage, liability or action.
This indemnity provision shall be in addition to any other liability which the Developer may
have.
5. lt is mutually agreed that the Developer may apply to the Town and the Town
shall authorize for partial release of the collateral deposited with the Town for each category
of improvement at such time as such improvements are constructed in compliance with all
plans and specifications as relerenced hereunder and accepted by the Town. Under no
condition will the amount of the collateral that is being held be reduced below the amount
necessary to complete such improvements.
6. lf the Town determines, at its sole discretion, that any of the improvements
contemplated hereunder are not constructed in compliance with the plans and specifications
set forth in this Agreement on or before the date set forth in Paragraph 2, the Town may, but
shall not be required to, redeem the letter of credit as necessary to complete the unfinished
improvements. The Bank shall release such funds upon written request from the Town stating
that the improvements have not been completed as required by this agreement. The Bank
shall not require the concurrence of the developer prior to release of the funds to the Town
nor shall the Bank be required to verify independently that such improvements have not been
completed as required by this agreement, but shall release such funds solely upon the Town's
writlen request.
lf the costs ol completing the work exceed the amount ol the deposit, the excess,
together with interest at twelve percent per annum, shall be a lien against the property and
may be collected by civil suit or may be certified to the treasurer of Eagle County to be
collected in the same manner as delinquent ad valorem taxes levied against such property. lf
the permit holder fails or refuses to complete the cleanup and landscaping, as defined in this
chapter, such failure or refusal shall be considered a violation of the Zoning code.
7. The Developer warrants all work and material for a period of one year after
acceptance of all work referred to in this Agreement by the Town if such work is located on
Town of Vail property or within Town of Vail right-ol-way pursuant to Section 17.16.250.
8. The parties hereto mutually agree that this Agreement may be amended from
time to time, provided that such amendmenls be in writing and executed by all parties hereto.

Aspen trees were not planted in the keystone wall planting benches due to the construction
processes used, the aspen tre€ root structure would not have heen $upported sufficiently" in the
crushed stone, as the trccs matured.
The wirlls were backfilled with cmshed stoner nol topsoil. The cornpany which built thc wa]ls is
no longer in busines.s, and a.s a result, no one wirq available for consultation as to the walls
engmeenng.
Thc total quantity of aspur trccs, according to the TOV apploved landscape plan, were planted on
thc properry. Aspcn trees which would have been planted in the wall benches. were pla.oted in

3. The Developer may at any time substitute the collateral originally set forth
above for another form of collateral acceptable to the Town to guarantee the faithful

discretion.
4. The Town shall not, nor shall any olficer or employee thereof, be liable or
responsible lor any accident, loss or damage happening or occurring to the work specified in
this Agreement prior to the completion and acceptance of the same, nor shall the Town, nor
any officer or employee thereol, be liable lor any persons or property injured by reason of the
nature of said work, but all of said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are
based upon any performance by the Developer hereunder; and the Developer shall reimburse
the Town for any and all legal or other expenses reasonably incurred by the Town in
connection with investigating or defending any such loss, claim, damage, liability or action.
This indemnity provision shall be in addition to any other liability whicfi the Developer may
have,
5. lt is mutually agreed that the Developer may apply to the Town and the Town
shall authorize for partial release of the collateral deposited with the Town for each category
of improvement at such time as such improvements are constructed in compliance with all
plans and specilications as referenced hereunder and accepted by the Town. Under no
condition will the amount of the collateral that is being held be reduced below the amount
necessary to complete such improvements.
6. lf the Town determines, at its sole discretion, that any of the improvements
contemplated hereunder are not constructed in compliance with the plans and specifications
set forth in this Agreement on or before the date set forth in Paragraph 2, the Town may, but
shall not be required to, redeem the letter of credil as necessary to complete the unfinished
improvements. The Bank shall release such funds upon written request from the Town stating
that the improvements have not been completed as required by this agreement. The Bank
shall not require the concurrence of the developer prior to release of the funds to the Town
nor shall the Bank be required to verify independently that such improvements have not been
completed as required by this agreement, but shall release such funds solely upon the Town's
wrilten request.
lf the costs of completing the work exceed the amount of the deposit, the excess,
together with interest at tvvelve percenl per annum, shall be a lien against the property and
may be collected by civil suit or may be certified to lhe treasurer of Eagle County'to be
collected in the same manner as delinquent ad valorem taxes levied against such property. lf
the permit holder fails or refuses to complete the cleanup and landscafing, as defined in ihis
chapter, such failure or refusal shall be considered a violation of the Zoning code.
7- The Developer warrants all work and material for a period of one year after
acceptance of all work referred to in this Agreement by the Town il such work is located on Town of Vail property or within Town of Vait rignfot-way pursuant to Section 17.16.250.
. 8 The parties hereto mutually agree that this Agreement may be amended from
time to time, provided that such amendments be in writing ind executedby all parties hereto.

evaiuate the exposure of a proposed reiidential building to rockfall' This site is within a
"High-Severity rockfall atea" as indicated on Town of Vail maps'
As a result of my site inspection and discussion with you about the proposed building
location, I determined that ttre building and site will not be exposed to rockfall hazard for the
following reasons:
a. The building will be located on a ridge, therefore will be above rockfall
source areas; and
b. The driveway will not be exposed to rockfall hazard because outcloppings
or unstable slopes do not exist above the driveway'
Because this site is not exposed to rockfall hazard, mitigation to reduce the rockfall hazard
wili not be required.

In response to your letter conceming building envelopes for Uonsridge Filing No. 3
subdivision, the statf considered your commenls and believes that no portion of lhe structure
shorjld exlend beyond the buibing envelope line indicated on the plat. We did double-check
our position with our Town Attorney, Larry Esl$vith. He also agreed that the staff
interpretation is correct. Our position is that untess there is a specific reference in the
subdivision covenants whlch states what'portion of a building may extend beyond the building
envelope, the Town must take the position that all of the structure must be built within the
boundaries of the envelope. t know this is not lhe answer you wanted to hear. However, we
did try to look at all angles of issue in order lo be fair to you and oher Property owners within
this subdivision.

I have just met with Jeanine Hettinga and she has asked ne to
submit several minor changes to you for staff approval . The
changes listed below are within the plane of the building and do
not affect anything like sj.te coverage, GRI'A, or the building
envelope.
The changes are:
Due to the potential for long term water damage to the
smal1 windows in the showers of bathrooms no. 2 and 3,
she would like to delete windows J1 and J2. If you
Iook at sheets A3.1 and A3.2, you will see that they
are very sma1l and do not affect the aesthetic integrity of either elevation.2. Jeanine is not happy with the look of the wood trim
surrounding the exterior windows and is changing the
material from cedar to stucco.3. The wood soffits (especially at the living room
overhang) are so gorgeous that Jeanine would like to
delete the approved colored stain.4. Because of number 3 above, the color of the window
"trj-m" ( now stucco per number 2 above) will be changed
to a cofor that closely resembles the cedar soffits. I
am enclosing a color chip for your review.

Dear Shelly:
Due to a recent change requested by the Owner, r/\re are resubmitting the Hettinga Residence for DRB/Staff approval-. The only changes are to GRFA; hre are not doing anything to change the driveqray, the building materials, the landscaping or the location of the building on the site.
Based on the survey, the allowable total GRFA is 6634.9 SF including 850 Sr' in credj.ts. By my calculations, we are reguestlng addltional GRFA to a total of 4361 .8 SF (including
garage area in excess of 500 SF). This is still well below the
-,"total allowed. The locations of additional GRFA are clouded on the drawings and are further explained as follow:
.0v,-.1. The crawl space under the dining room has been
converted to storage. This was not shown on the original DRB submittal and was included in the permit application sets. I apologlze for any problems this created - the drawi-ngs had to be modified for contractor priclng.
2. The client has reguested that the dining room be
extended out 4'-0". To that end, we have simply
moved the south elevation of the dining room out 4'-0". The french door pai.rs on the east and west elevations are now three-paneL french doors.

lS name is larry Case and I filed and received the Desigrr Review
Board approval for llidgecrest/Vail l,ots 1r2, and 3 on January 3t
1980. Of the above Lots, I owned l,ot 1.
Ridgecrest/Vail has been sold and as a result of the sale, f non
own Iot 4. I would like to build on this lot using the approved
building for Iot 1. The original submital would remain the samel
Eloor Plans, Elevations, Dcberior Elnishes, Colorsr and Landscap-
ing. Therefore, I am subn:itting the original drawj:ngs showing
the new grading profile on the Elevations and a new Site Plan for

for thts subnrital uhile in Vail last week. It is rY understanding
that this proJect rill be heard by the Desi-gn Reriew Board on
July 30, 1980.
Please note that the approvals for Ipts 1r2, and 3 w,Ill not be
used by the new owners. Ipt 4 will be the only building bultt
of this type and style. .
