I. The Ouestion
Tom Braun, representing Carol Orrison, would like to know if the caretakers units
constructed in the Lionsridge 4th Filing should be deed resFicted as Type I, il. ilI. IV' or
V Employee Housing Units.
ll. Background
Carol Orrison is the ou.ner of Lot 10. Block 4. Lionsridge Filing No. 4. There is currently
a single family home and a tu'o-car garage on the propertv. The property has less than
100 sq. ft. of GRFA available for furure development. He would like to build a t$'o-car
garage and a caretaker on the properfy.
Lionsridge 4th Filing is zoned Single Family. Horvever. Ordinance l5 of Series i 989
allou's a caretaker to be constructed on each lot. As a result. each lot has the potential to
support a Primary/Secondary qvpe of stmcture. Per Ordinance 15 of Series 1989. tbe
caretaker cannot exceed one third of the total GRFA allou,ed on the lot. The Ordinance
specifies that the employee unit "shall be permitted on each lot." The definition of the
employee unit is provided in Section 18.13. which is the Primary/Secondary section of the
code. That citation has since been removed and transferred to the Type I portion of the
Employee Housing Ordinance.
lll. The Employce Housing Ordinance
The Employee Housing Ordinance provides for five different types of employee housing.
There are different affi-ibutes of each type that match the Lionsridge 4th Filing standards,
but there is not a clean match between any of the types and the situation in the 4th Filing.
Staff believes that it is a closer match to the Type I. as there are six attributes of the
Employee Housing Ordinance which match the situation under a Type I scenario. The
Type II has only one attribute that matches this situation; however staff understands that
the one is significant. Staffbelieves that all of the attributes are important and would like
yorn interpretation as to which restriction, a Type I or Type II is appropriate.
Planners: please keep this in mind for all development in Lionsridge 4th Filing

On January 4,1996, Tom Moorhead and I reviewed tle attached memo and analyzed the
Employee Housing Chart, located in tbe zoning code at the end of the Employee Housing
Chapter. He concluded that the caretaker dwelling units in Lionsridge Fourth Filing should be
deed restricted as Tlpe I EHU's.

Failure to notify the Town will result in forfeiture of bond money. Scheduled inspections which are not ready may
result in the Town charging the contractor a reinspection fee.

Dear Mr. Pool:
This lelter is a follow up on our telephone conversalion on January 11, 1993. During our
conversation, I informed you that the conditions that you were required to meel from our
inspection on1214/92 have not been met. Please see the altached code violations correclion
sheet.
As we discussed on December l atti, 1992, the town has agreed to issue a lemporary certificate
of occupancy lor your residence wilh the provision that you complete the corrections and submit
a letter of credit lo the town. At our meeting on December 14th you agreed to address these
items promptly. I also documented this underslanding in a letter lo you dated 1?/14B2. The town
gave you until 12123/921o make lhese corrections. At this lime our department has nol received
the letler of credit nor has the building division been contacled to inspecl the corrections.
It is imperative lhat you provide the lelter of credit, request an inspeclion o{ the code violations
and get an ok of the corrections, and pass the inspection by January 1gth, 1993, 5 pm. lf you do
not comply with this deadline, lhe town will have no olher choice but to cite you for the violations.
You are in violation of Sec.3OB of the 1991 Uniform Building Code, which states that no building
shall be occupied until a certificate of occupancy is issued, and Sec.300-5 of the 1987 National
Eleclrical Code, which states that the leeder cable conduit to your house is not buried to lhe
proper depth. Also note that your building permit has lapsed and that you must make a request
in writing to the building official to extend your permit, stating why work has been suspended for
more lhan 180 days. This permit can only be exlended once. Please address lhe permit matter
immediately.

With reference to our telephone conversation in the sprj-ng and
sunmer of this year, regarding the underground power line which feeds the above residence. You have yet to fix the problem of the
exposed power line which according to code must be at least 24
inches below grade. This problem has now become more serj-ous since
snow plowing is being done near the exposed power line. The danger of a snowplow hitting the power line is very great. Therefore, the power line must be buried at least 24 inches below grade immediately. If t.his is not done, I will be forced to caII HoJ-y

Dear Hap:
Upon review of the Improvernent Location Certificate (I.L.C.)subrnitted on January 17, i.99L for the residence under construction on Lot 6, Block L, Lionts Ridge Subdivision Filing #4, I found the ridge height indicated on the I.L.C. to be 8293.5 ft. which is 1.5 ft. over the height which was proposed at the tine that the house was approved by the Design Review- Board and approved for building perrnj_t. At this time, the ridge is 30 ft. above existing grade and 34.5 ft. above proposed grade. The Town of Vail zoning code does not allow ridge lines to exceed 33 ft- in height frorn either existing or propoied grade which ever is nore restrictive.
rn order to rectify the 1..5 foot overage in height from proposed grade, the proposed grade must be raised 1.5 feet on the south side of the structure. The buil-ding code requires that the grade extend 5 feet from the structure.
The forlowing itens nust be subrnitted and approved prior the the approval of the subnitted f.L.C.:
1. Revised grading plan indicating a change in grade that will bring the approved plans into coniornanie; and
2. Revised Structural plans that will allow for the raising of the grade.
, upon approval , a framing inspection will be done. The revised
grades must be installed prior to the issuance of a Tenporary Certificate of occupancy for the prirnary unit. A f.c.o. can be
requested and issued for the caretaker unit prior to the installation of the proposed grades.
