This letter is in response to your reques4 for additional informa6on to be provided for Ehe issuance af the
Phased Construction Building Permit ior the above referenced project. Thi�correspondence is
specificatly r�f�ted to the Town of Vai! F�re Qepartment eomments related fire flow and water supply
required for the project.The following is the requested informatian and the requested revised response
from the design team regarding the drawings dated 05/24/07 and subsequent rneetings held recan�y at
the site:
Town of Vail Fire Qepartment(Mike McGee) Review Comment#1 -Plans show an existing 8 inch water
main feeding a fire hydrant in the existing garage access. Rlans also show�4 inch domestic tap and a
six inch fire main being tapped into the 8 inch line. Revise C0006 plans to provide adequate flre flow.
Response—The design team conducted a fire flow test on June 20, 2007. dn attendance were
Alpine Engineering, BCER Engineering,VRDC representatives and T6V Building
and Fire DepartmeRt. This resu(ted in calculating available fire flow both the actual
and modeled fiaw available. It was ther�determined by the deslgn team that due to
the critical nature of the�re line and fire hydrant serving the Marriot, Gore Creek and
the Ritz C�rlton that fire protection and damestic water supply woul�best be serviced
from the existi�g 12 inch water line in Lionshead Circle. The relocation of the water
taps atso b�elped ensure that the fire lane and fire department access during
construction on the east side of the Ritz project would be rnaint�ined open as rr�uch
as possible, the design team has moved these taps fiurther to the west of the original
location ta facilitate the fire line 8nd domestic water service entrances and minimize
the construction impact an the fire lane an the east side of the site.

Due to construction progress the supply that feeds the temporary Fire Department
Connection on the north-west corner of the above referenced building(Bldg C
level 2)will have to be relocated. The connection will be temporarily out of
service while this work is taking place. All-State Fire Protection plans on
performing this work on Saturday morning 9/22(07 between 9 am and 12 noon.
The location of this connection will not change. The supply that fe�s the FDC
wil]be changed. Please confirm that it will be acceptable to perform this work at

Re: Reconciliation of Pending Actions - Fire Code Violations
Dear Lionshead Centre Condominium Association:
On April 21, 2006, Town of Vail staff inembers met with Jeffery Babb, representing the Lionshead
Centre Condominium Association. Items discussed included the elements presented by Mr. Babb contained in
a memorandum dated 4/2/06 (Exhibit A), two proposals to redevelop the property, and possible enforcement
actions by the Town of Vail.
At the conclusion of the meeting, it was agreed, pending review by the Town Attorney, that:
1. Lionshead Centre will immediately proceed with installation of a fire alarm system. A fire alarm
permit shall be submitted by June 1, 2006.
2. Lionshead Centre will rectify three building permits that have either expired, have not been picked up,
or are otherwise incomplete. The permits shall be cleared within 30 days.
3. Lionshead Centre will abate hazards identified in a letter sent to the Association dated 09/13/2005,
specifically items 1 through 10, excepting item # 7 (Exhibit B). The work shall be performed under a
valid Town of Vail permit and shall be completed on or before September 30, 2006.
4. Lionshead Centre will initiate an investigation and conditions pertaining to the presence of cellulose
insulation in the ceiling of Gar�nkles. The evaluation shall be conducted by a special inspector.
Hazardous conditions identified by the special inspector, if any, shall be immediately abated.
5. Lionshead Centre shall submit an application for an Exterior Alteration to the Design Review Board
with a viable plan to replace, remove, cover or otherwise remedy the threat to the building presented
by the exterior wood siding, on or before September 1, 2006.
6. On or before March 1, 2007, Lionshead Centre shall submit a fire sprinkler permit for a complete
retrofit, NFPA 13 compliant system or submit to the Town a complete redevelopment package (scrape
and replace).
7. On or before March 1, 2008, demolition of the existing building shall commence, with all applicable
permits and approvals already in the possession of Lionshead Centre.
Having consulted with Town Officials since the Apri121, 2006 meeting, it is furthermore stipulated
that in the event Lionshead Centre fails to meet any one or more of the aforementioned deadlines, fails to
obtain �nal inspections in a timely manner for work under permit, or otherwise fails to demonstrate
material progress towards abatement of the identified fire hazards, enforcement procedures shall

commence posthaste including but not limited to the issuance of a Summons to Appear in Municipal or
District Court. Each violation shall constitute a separate and distinct offense each day for failure to
comply with orders issued March 20, 2002, orders issued September 13, 2005, and may include additional
charges as applicable.

begin at 11:30 a.m. on August 17t"in the Sundown Room of the Vail Mountain Marriott Resort
and Spa, 715 West Lionshead Circle,Vail, CO. We will work through until 5:00 pm that day.
Our purpose in investing our precious time in a structured partnering process is to develop the
specific commitments we need to make to each other, in order to meet the business challenges
we face together and to build the trust required by a successful team. To make the most of our
session, your attendance is essential for the complete duration of the program.

A successful construction project is usually described in terms of
Brief Background achievements in the areas of quality, functionality, safety, schedule and
on Partnering finances; and the people who worked on the project will talk about open
and honest communications and the win/win teamwork they experienced.
Unforiunately, not all construction projects can be described this way: the
erosion of profit margins, tight technical tolerances, shortened schedules,
concern over the quality of work and the overuse of litigation to resolve
disputes are all factors which, when coupled with a high potential for
adversarial relationships among project members, tend to produce
win/lose situations.
Partnering can be an effective response to these negative forces. While
the contract establishes the legal relationships, the partnering process
establishes the working relationships among all the project team
members. It is a formal attempt to create an environment in which the
stakeholders clarify their expectations of each other,then use trust and
teamwork to their mutual success.
The Partnering workshops involve all the key players on the project.
Partnering Representatives from the owners, end users, designers, consultants,
Workshop general contractor, subcontractor, suppliers and specialty trades typically
get together to develop the specific commitments each partner requires to
achieve its goals.
At the conclusion of the workshop,the whole team signs the partnership
charter, which serves as an on-going reminder of the team's intentions.
Objectives The following are specific objectives of the workshop:

PARTNERING WORKSHOP
Ground Rules
1. Attendance•
Your attendance is your first commitment to our success. We know this time will be
difficult to set aside,but we need all of it if we are to achieve the objectives we have set
for the workshop. If we get it right, the payoffs will far exceed our investment of time
and effort.
2. Participation:
Since we consider everyone's viewpoint to be valuable, we encourage every team
member to make a contribution to our partnering charter. Please take a few minutes
prior to the workshop to prepare the two lists of the "deliverables" you see as keys
to our mutual success.
3. Interruptions:
Due to our ambitious agenda,we will need everyone's undivided attention throughout
the workshop. We want to keep outside interruptions and distractions to a minimum, so
we will be asking you to turn off your electronics during the sessions.
4. Attitude•
The success of our workshop is absolutely dependent on each one of us having an open
mind. This is a key mindset for you to be able to hear what your partners need from
you, and to be able to make the commitments they require of you and your stakeholder
team.
5. Attire•
Although the subject matter of the workshop is serious,the atmosphere will be relaxed.
Casual attire will be appropriate.

During the partnering workshop,you will mostly be seated and working with the other
representatives of your company. Your team will be asked to develop two lists. In preparation
for the workshop, please take a few minutes and do some thinking about the following:

times, to provide to your business partner. Please include tangibles like products, services,
decisions and outcomes, as well as intangibles like attitudes and operating principles.

able to achieve success in your partnership.
