written notice should the Director determine that any activity permitted by this

I understand the staff is grappling with the proposed sign location for the skier parking lot.
As you are aware the entrance to the VVMC parking structure is located within the Frontage road right of way. A review of
the site does not provide a location for the skier parking sign where it is adequately visible from the traveling motorist and
which is located within the VVMC property.
The only logical location is within the right-of- -way directly adjacent to the gate /entrance to the parking structure.
I am not aware of any specific provision in Title 11 that prevents the installation of a sign within the rightof -way or that
regulates 'off -site advertising." Additionally, a variance may be granted where special circumstances exist. Given the
orientation of the parking structure entrance and the right-of -way line, locating the proposed sign on the site proper would
substantially restrict the effectiveness of the proposed sign.
Additionally, given that the intended use will provide a communitywide benefit by providing additional parking to the
general public and thus removing parked cars from the rightof -way, it could be interpreted that the sign is more like a Traffic
Control Sign which can be erected in the right-of- -way.
The VVMC has attempted to provide this community service in the past and it was the strict interpretation of the sign
regulations that prevented the use from being operated. We are hoping the Town can be creative and flexible to allow this
use to occur.
