This letter is being sent per the requirements of the Vail Town Code to inform you of the submittal of an
application for the review and approval of a preliminary plan, by Vail Resorts Development Company.
Vail Town Code, Chapter 13 -3, Major Subdivisions, requires the administrator of the Code to notify
certain agencies that may be impacted by the proposal of a preliminary plan and subsequent major
subdivision of land with the Town of Vail.
Vail Resorts Development Company is proposing a preliminary plan for the resubdivision of the area
commonly known as "Ever Vail ". Furthermore, as the proposed preliminary plan creates an
approximate 12 -acre development site for a new base village in the Town, Staff is requesting that
certain agencies review the proposed plans and provide any comments so that they can be addressed
Ever Vail is comprised of the current Vail Resorts Maintenance Yard, Vail Professional Building,
Cascade Crossing, the former Amoco /BP gas station site, and a portion of the South Frontage Road
West right -of -way. A significant aspect of this preliminary plan is the relocation of the South Frontage
Road West right -of -way to the north of its current location. The proposed new South Frontage Road
West right -of -way alignment would locate the road adjacent to the existing interstate right -of -way.
A disc containing information regarding the Ever Vail project including the proposed preliminary plan,
site plans, wetlands report, EIR report, etc. is included with this letter for your review. The information
on the disc is saved in pdf format and should open with the latest version of Adobe Reader. All
comments and concerns from your agency must be provided to me by December 8, 2008, in order to
be addressed. If no comment is received by December 8, 2008, at 5:00 p.m.'it will be determined that
there were no comments or concerns.

2. Such agencies shall be required to
make recommendations and com-
ments within fifteen (15) days from the
date of receipt of notification that the
preliminary plan is available for re-
view. Failure to make recommenda-
tions and /or comments within the
prescribed fifteen (15) day period shall
be deemed approval of the preliminary

13 -3 -4: COMMISSION REVIEW OF
APPLICATION; CRITERIA
AND NECESSARY FINDINGS: The plan-
ning and environmental commission shall
conduct a public hearing on an application
for a preliminary plan for subdivision. The
planning and environmental commission
shall consider the application, relevant
additional materials, staff report and recom-
mendations as well as any other comments
or public information given at the hearing.
The planning and environmental commis-
sion may discuss advisable changes to the
proposed subdivision with the applicant.
The burden of proof shall rest with the ap-
plicant to show that the application is in
compliance with the intent and purposes of
this chapter, the zoning ordinance and
other pertinent regulations that the planning
and environmental commission deems
applicable. Due consideration shall be giv-
en to the recommendations made by public
agencies, utility companies and other agen-
cies consulted under subsection 13 -3 -3C of
this chapter.
A. Before recommending approval, ap-
proval with conditions or disapproval
of the preliminary plan, the planning
and environmental commission shall
consider the following criteria with
respect to the proposed subdivision:
Town of Vail
1. The extent to which the proposed
subdivision is consistent with all the
applicable elements of the adopted
goals, objectives and policies outlined
in the Vail comprehensive plan and is
compatible with the development ob-
jectives of the town; and
2. The extent to which the proposed
subdivision complies with all of the
standards of this title, as well as, but
not limited to, title 12, "Zoning Regula-
tions", of this code, and other perti-
