Upon performing a site inspection of Units 7 and 8 | found that two complete kitchens still existed in the unit and lherefore by Code there still existed two dwelling units regardless of the removal of a shared wall. In light of this information you may replace the wall between Units 7 and 8 thereby reestablishing two separate dwelling units. All applicable building codes must be met and the proper building permits received prior to the start of any construction. Aften limited reseanch the most dinectly applicable law which i fou nd pentaining to pollution of a public watencounse is the [973 Colonado act known as the Colonado Waten Quality Contnol Act, CRS 66-28-lot. 3. 'I-he Division of Administnation of the cotonado state Depantment of Heatth,is the enfoncement agency fon the waten iontnol statute. 4. In the event the condominium ownens fai.l to comply with youn .dinective fon it to abate the pottution I nequest that you pnomptly notify the Division of the poltution vioiation and nequest that it seek to enforce the waten contnot statute in a timely rnarrnen 5. Although the Town penhaps could seek injunctive on othei^ relief against the condominium ownens thnough count action on the basis that ihe poltutton is a nuisance and,/on is darrrag ing the Townrs waten supply, I thinl< that such action would be less efl'ective than timety State admintstnative action to prewent f unthen pollution, pnesuming that the State does endeavon to enfonce the waten contnol statute and pnevent potlution of the Staters waiencoun-ses.
