Dear Resident,
It has come to the attention of the Town that the historic irrigation ditch, which runs from north to south thru
Flots23; 2t,23,24,:25|26,27,36,40, 39 of theBuffehr Creel6subdivision (see attached map), does not
currently have water rights for any type of use; irrigation or aesthetic. In addition, the diversion for this historic
irrigation ditch is on publicly owned property and has recently been altered to divert more flow from Buffehr
Creek into the historic irrigation ditch.
The Town is concerned about the long term health of Buffehr Creek and the lack of water rights during the low
flow months, July thru April. In our conversations with the Colorado Division of Water Resources it is
apparent that this historic irrigation ditch has no current water rights and is required to abide by state law. At a
minimum, this will require all flows to remain in Buffehr Creek during periods when there is a call on the river
typically from July thru April.
It is the Town's intent to remove the diversion and retum the creek back to its natural state. This will generally
limit flow to the ditch to high flow periods (May and June).
If you wish to discuss this matter further please contact me at970-479-2235.
Thank you for your attention to this matter.

1 Both the unit return air opening and the base return ai, opening must be covered by a single plenum or IAQ cabinet.
Minimum unit side return air opening dimensions for units requiring 1800 cfm or more of air (W x H): 23 x 11 in. (584 x 279 mm).
The opening can be cut as needed to accommodate plenum or IAQ cabinet while maintaining dimensions shown.
Side return air openings must be cut in the field. There are cutting guides stenciled on the cabinet for the side return air
opening. The size of the opening musl not extend beyond the markings on the furnace cabinet.
2 14 inches (356 mm) is the maximum size the height of the unit opening can be cut. This may interfere rvith the condensate drain
(if located on the same side of the unit as the opening).
To minimize pressure drop, the largest opening height possible (up to 14 inches) is preferred'
NOTE- Ootional Side Return Air Filter Kits are not for use with RAB Relurn Air Base.

Re: Lighting at the resi-dence located at 1969 chamonix Drive
Dear Loyette:
r visited Dick petersonrs residence at ni-ght to see the impactsof the liqht located in the area of his girage. the forlowingrnorning, f called Di.ck peterson to discu6s tlle issue of theliqht. His feering was that the light r"= .ppro[rlate due torecent vandalism of his car and house. FIe rLrt that it wa=very important for safety reasons. He also stated that one ofhis neighbors had.cornprimented hirn on the 1ight, as it alsogave her some additional protection in her "itryway.r. discussed your concern with the staff. we have come up withthe. followi-ng recommendations. First, we would ask thet rr..,,.,again try discussi-nq this issue with oi"k p"ter=o". -i;..nip=
some type of compromise solution can be arrived at between thetwo of you. one solution rnight be that he locate thro to threesmaller rights on the exterior of the house which stirl riqha-up the same area but are not as bright as the existing riqhi-Another sol-ution rnight be to put some type of a shade device onthe fixture so that the fight is focusslb dorn on DickPeterson t s property.
Tf, after discussing possible solutions with Dick peterson, youare stil1 at a road bJ-ock, you may make a citizenrs complaintand cite Dick into court concerning the rignting, rn secLion18.54.050 C. 11. it states:
rrExterior lightinq shar-r be designed and located in arnanner to minirnize irnpact or tignting upon living areaswithin a proposed project and ufon adia"."t-"ti"Jtures andproperti.es. tt
OIn Enl-s srtuatron,your concern.
this section of an" ".?rould compt-v to
Thirdly, if after discussing the li-ghting with Dick, a solutionis not reached, you may submit a petition from neighbors whohave lots adjacent to Dick peterson who are also unhappy withthe light. At this tirne, f have heard that you, ana peinaps asecond neighbor do not like the liqht. Dick peterson hasindicated that he has a neighbor who appreciates the lighting. The staff does prefer to not get into the rniddl_e of civildisputes between property owners. However, if it becomesevident that this is a problern that is affecting the propertyowners who own lots adjacent to the peterson property, thestaff wil] need to be involved.
I hope you find these recommendations reasonable. Our intentis certainly not to shirk any responsibility for enforcing Townof vail- codes. However, there i-s a point where the staff feelsthat j-t i-s appropriate for individuals to try to work outsolutions that are agreeable to both parties instead ofinvolving the court system. The staff would rike to ernphasizethat if the adjacent property owners have a problern witn theright and are willing to sign a petition, the staff would needto act on that ne ighborhood-wide concern.
If you want to talk about this further, please feel free tocal-1 me. r will try to call you to also discuss thi-s over thephone. However, I thought it would be best to write ourposition in a letter. please 1et me know how things go.

Kristan.Pritz presented the request and explained that because of the location
