George Ruther I, DESCRIPTION OF THE REOUESTS The applicants, Howard and Cathy Stone, represented by Michael Hazard, are requesting a side- yard setback variance and up to 170 square feet of additional GRFA (250). The variance and additional GRFA are requested to allow the applicants to construcl a living room addition to their residence located al 1241 Westhaven Circle. The proposed new living room addition would be located on the wesl side of the property, within the required, 1s-foot, side-yard setback. The addition would encroach up to 7.5 feet into the side-yard setback and is proposed to be 170 square feet in size. The total area of the living room addition proposed in the setback is approximately 85 square feet. Due to the orientation of the existing structure, the new living room addition would not be visible from Westhaven Circle. Additionally, the applicants are proposing to convert several crawl space areas to GRFA utilizing the interior conversion ordinance. The crawl spaces that are to be converted to GRFA are located on the lowest level of the residence. The total area to be converted to GRFA is approximately 237 square feet in size. The interior conversion will have no impact on the setback or site coverage figures. A written description from the applicant, and a copy of the plans have been attached for reference. Since the applicant is propoaing a rcduction in the minimum side-yard setback (15 feet) to 7.5 feet, and an incrpase in GRFA utilizing the additional 250 GRFA, a side-yard setback variance of 7.5 feet and an additional 170 square feet of GRFA must be approved by the Planning and Environmental Commission. CRITERIA AND FINDINGS A. Gonsideration of Fac{ons Regardinq the Setback Variance: Upon review of Section 12-17-6 of the Vail Municipal Code, Criteria and Findings, the Community Development Department recommends approval of the requested setback variance based on the following faclors: 1. The relationship of the requested variance to other existing or potential uses and structures in the vicinity. Setback Staff believes that the proposed residential addition will be compatible with the sunounding development. The additional mass and bulk that is proposed is similar to that enjoyed by sunounding homes in the area, and will not be visible from Westhaven Circle. The applicant is proposing to construct the addition up to 7.5 feet into the required, side-yard setback. The proposed building location will result in a distance of approximately 7.5 feet from the fireplace chimney of the building to the side (west) property line. 2. The degree to which relief from the strist and literal interpretation and enforcement of a specified regulation is necessary to achieve compatibility and uniformity of treatment among sites in the vicinity or to attain the objec{ives of this title without a grant of special privilege. Setback The requested side-yard setback varience is wananted. Staff believes lhere ere unique circumstances and extraordinary conditions which impact the applicants' lot. Staff believes that the existence of a platted and recorded twenty-foot wide waier and sewer easement and a required ski lift setback and easement significantly reduces the developable area of the applicants' property. The total lot size is 17,908 square feet. An analysis of the impacts of the easements on development revealed that the developable area of the property is approximetely 5,109 square feet (28%). The developable area of the property without the easements and factoring in only the area of the required setbacks is 6,414 square feet (360/o). Staff feels that the easements have a significant negative impact on the developability of the site. Staff reviewed the final plat for the Glen Lyon Subdivision and does not believe that any other platted lot in the subdivision is as negatively impacted as Lot 44. Overall, staff believes that there would not be a granting of special privilege if the variance were approved. 3. The efrect of the rcquested variance on light and air, distribution of population, transportation and traffic facilities, public facilities and utilities, and public safety. Setback Staff does not believe that there will be any negative impacts associaled with this proposal, if constructed, on the above-referenced criteria. Consideration of Factors Regarding Grantino GRFA Under the 250 Ordinance: Before acting on an application for additional GRFA, the Planning and Environmental Commission shall consider the following factors with respect to the proposed use: Effec-t upon the existing topography, vegetation, drainage and existing structures. The proposal will not negatively impact the existing topography and vegetation on the site. The area of construction for the new exterior addition was regraded when lhe residence was originally built and is relaiively flat. Staff believes that the proposed addition will not significantly affec{ the existing site topography, vegetation, drainage, and existing siructures. lmpact on adjacent properties. The addition should not adversely affect views, light, or air enjoyed by adjacent struclures. Staff believes that the proposed additions will not have a significant impact on adjacent properties. Compliance with the Town's zoning requirements and applicable development standards. Staff believes that an approval of the additional 170 sq. ft. of GRFA will not have any negative impac{s on the applicable development standards of the Town. According to the applicant's representative, in order for the applicant to add the proposed 170 sq. ft. of additional GRFA to the existing 1. 2. property, a setback variance must be approved. Staff believes that, in this instance, the additional square footage can be accommodaled on the site and that lhe variance will not result in a grant of special privilege. The Planning and Environmental Gommission shall make the followino findings before oranting a variance: 1. That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same district. 2. That the granting of lhe variance will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. 3. That the variance is wananted for one or more of the following reasons: a. The strict literal interpretation or enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of this title. b. There are exceptions or extraordinary circumslances or conditions applicable to the same site of the variance that do not apply generally to other properties in the same zone. c. The strict interpretation or enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same dislrict. IV. STAFF RECOMMENDATION The Community Development Department recommends approval of the requested setback variance and the additional 170 square feet of GRFA utilizing the 250 Ordinance. Staffs recommendation of approval is based upon lhe review of the criteria and factors outlined in Sestion lll of this memorandum. Should the Planning and Environmental Commission choose to approve the applicant's requests, staff would recommend the Planning and Environmental Commission make the following findings: 1. The remodel, as proposed, will require the granting of a variance so that the new Living Room extension can be allowed to encroach into the 15' side yard setback (L2-6D-6) a distance of approximately 5'-4", In addition to the standard front (20'), side (15') and rear (15') setbacks, the subject site is further encumbered by a sewer easement (20' to either side of the centerline) along the rear of the sit€ and a ski lift setback, inboard of the side-yard setback to the Northeast. The effective net buildable area counting only the standard setbacks is I 1,597 S.F. . As a result of the easements and additional setbacks the effective net buildable area is reduced to 5.151 S.F.. This site, due to the extraordinary easements and setbacks described above, has a net buidable area that is less than one half the comparable area of the surrounding sites with normal setbacfts. Further, the Ski Lift Easement, to the Northeast has forced the home to be offset to the Southwest, immediately adjacent to the side yard setback. Given the roof configuration and strict geometry of the present home there is no other practical solution, that is acceptable to the Owners and will allow them to adequately expand their Living Room. The Developer hereby agrees to indemnify and hold harmless the Town, and any of its officers, agents and employees against any losses, claims, damages, or liabilities to which the Town or any of its officers, agents or employees may become subject to, insofar as any such losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are based upon any performance by the Developer hereunder; and the Developer shall reimburse the Town for any and all legal or ofier expenses reasonably incured by the Town in connection with investigating or delending any such loss, claim, damage, liability or action. This indemnity provision shall be in addition to any ofier liability which the Developer may have. 5. lt is mutually agreed that the Developer may apply lo the Town and the Town shall authorize for partial release of the collateral deposiled with the Bank for each category of improvement at such time as such improvemenb are constructed in compliance with all plans and specifications as referenced hereunder and accepted by the Town. 6. lf the Town determines that any of such improvemenb as contemplated hereunder are not constructed in compliance with the plans and specifications set lorth herein, it shall fumish the Developer a list of specific deficiencies and shall be entitled to continue to withhold collateral to insure such compliance. lf he Town determines that the Developer will not construct any or all of the improvements in accordance with all of the specilications and time tables as set forth herein, the Town may give the Developer written notice and unless such improvements are completed by the dates as set forth above or within a reasonable period after such date if weather does not permit the completion ol such improvements, the Town may withdraw from the cash escrow account such funds as may be necessary to complete the unfinished improvemenb, but not in an amount greater than the amount as set forh opposite the category listed above and not before such improvements are completed. The Bank may release such funds upon written request and representation by the Town that such improvements are completed. The Bank shall not be obligated to independently verify that such work is complete, but shall fund sucfr requsst, upon the Town ol Vail written authorization. 7. SUbnittal qequirements: the owner or authorized agentof any project requiring design approval. as prescribedby this chapter may submit plans for conceptual reviewby the Design Review Board to the Department ofCommunity DeveLopnent. The conceptuat review isintended to give the appllcant a basic understanding ofthe compatibility of their proposal with the Town, sDesign Guidelines. This procedure is recommendedprimarily for applications more compLex than single-family and two-family residences. However, developersof single-family and two-family projects shall not beexcluded from the opportunity to request a conceptualdesign review. Complete applications must be submitted10 days prj.or to a scheduled DRB neeting. The following information shall be submitted for aconceptual review: 1. A conceptual site and Landscape plan at a minimunscale of one inch equals twenty feeLt 2. Conceptual elevations showing exterior materiaLs and a description of the character of the proposedstructure or structuresi 3. Sufficient infornation to show t,he proposal complies with the developrnent standards of thezone district in which the project is to beIocated (i.e. GRFA, site coverage calculations, number of parking spaces, etc.); 4. Procedure: Upon receipt of an application forconceptual deslgn revlew, the Department of ComnunityDevelopment sha.Ll review the submitted naterials forgeneral compliance with the appropriate requirements ofthe zoning code. If the proposal is in basicconpliance with the zoning code requirements, theproject shall be forwarded to the DRB for conceptualreview.
