I, DESCRIPTION OF THE REOUESTS
The applicants, Howard and Cathy Stone, represented by Michael Hazard, are requesting a side-
yard setback variance and up to 170 square feet of additional GRFA (250). The variance and
additional GRFA are requested to allow the applicants to construcl a living room addition to their
residence located al 1241 Westhaven Circle. The proposed new living room addition would be
located on the wesl side of the property, within the required, 1s-foot, side-yard setback. The
addition would encroach up to 7.5 feet into the side-yard setback and is proposed to be 170
square feet in size. The total area of the living room addition proposed in the setback is
approximately 85 square feet. Due to the orientation of the existing structure, the new living
room addition would not be visible from Westhaven Circle.
Additionally, the applicants are proposing to convert several crawl space areas to GRFA utilizing
the interior conversion ordinance. The crawl spaces that are to be converted to GRFA are
located on the lowest level of the residence. The total area to be converted to GRFA is
approximately 237 square feet in size. The interior conversion will have no impact on the
setback or site coverage figures.
A written description from the applicant, and a copy of the plans have been attached for
reference.
Since the applicant is propoaing a rcduction in the minimum side-yard setback (15 feet) to
7.5 feet, and an incrpase in GRFA utilizing the additional 250 GRFA, a side-yard setback
variance of 7.5 feet and an additional 170 square feet of GRFA must be approved by the
Planning and Environmental Commission.

III. CRITERIA AND FINDINGS
A. Gonsideration of Fac{ons Regardinq the Setback Variance:
Upon review of Section 12-17-6 of the Vail Municipal Code, Criteria and Findings, the Community
Development Department recommends approval of the requested setback variance based on
the following faclors:
1. The relationship of the requested variance to other existing or
potential uses and structures in the vicinity.
Setback
Staff believes that the proposed residential addition will be compatible with
the sunounding development. The additional mass and bulk that is
proposed is similar to that enjoyed by sunounding homes in the area, and
will not be visible from Westhaven Circle. The applicant is proposing to
construct the addition up to 7.5 feet into the required, side-yard setback.
The proposed building location will result in a distance of approximately
7.5 feet from the fireplace chimney of the building to the side (west)
property line.
2. The degree to which relief from the strist and literal interpretation and
enforcement of a specified regulation is necessary to achieve
compatibility and uniformity of treatment among sites in the vicinity or
to attain the objec{ives of this title without a grant of special privilege.
Setback
The requested side-yard setback varience is wananted. Staff believes
lhere ere unique circumstances and extraordinary conditions which impact
the applicants' lot. Staff believes that the existence of a platted and
recorded twenty-foot wide waier and sewer easement and a required ski
lift setback and easement significantly reduces the developable area of the
applicants' property. The total lot size is 17,908 square feet. An analysis
of the impacts of the easements on development revealed that the
developable area of the property is approximetely 5,109 square feet (28%).
The developable area of the property without the easements and factoring
in only the area of the required setbacks is 6,414 square feet (360/o). Staff
feels that the easements have a significant negative impact on the
developability of the site. Staff reviewed the final plat for the Glen Lyon
Subdivision and does not believe that any other platted lot in the
subdivision is as negatively impacted as Lot 44.
Overall, staff believes that there would not be a granting of special
privilege if the variance were approved.
3. The efrect of the rcquested variance on light and air, distribution of
population, transportation and traffic facilities, public facilities and
utilities, and public safety.
Setback
Staff does not believe that there will be any negative impacts associaled
with this proposal, if constructed, on the above-referenced criteria.
Consideration of Factors Regarding Grantino GRFA Under the 250 Ordinance:
Before acting on an application for additional GRFA, the Planning and Environmental
Commission shall consider the following factors with respect to the proposed use:
Effec-t upon the existing topography, vegetation, drainage and existing
structures.
The proposal will not negatively impact the existing topography and
vegetation on the site. The area of construction for the new exterior
addition was regraded when lhe residence was originally built and is
relaiively flat. Staff believes that the proposed addition will not significantly
affec{ the existing site topography, vegetation, drainage, and existing
siructures.
lmpact on adjacent properties.
The addition should not adversely affect views, light, or air enjoyed by
adjacent struclures. Staff believes that the proposed additions will not
have a significant impact on adjacent properties.
Compliance with the Town's zoning requirements and applicable
development standards.
Staff believes that an approval of the additional 170 sq. ft. of GRFA will not
have any negative impac{s on the applicable development standards of the
Town. According to the applicant's representative, in order for the
applicant to add the proposed 170 sq. ft. of additional GRFA to the existing

property, a setback variance must be approved. Staff believes that, in this
instance, the additional square footage can be accommodaled on the site
and that lhe variance will not result in a grant of special privilege.
The Planning and Environmental Gommission shall make the followino
findings before oranting a variance:
1. That the granting of the variance will not constitute a grant of special
privilege inconsistent with the limitations on other properties classified in
the same district.
2. That the granting of lhe variance will not be detrimental to the public health,
safety or welfare, or materially injurious to properties or improvements in
the vicinity.
3. That the variance is wananted for one or more of the following reasons:
a. The strict literal interpretation or enforcement of the specified
regulation would result in practical difficulty or unnecessary
physical hardship inconsistent with the objectives of this title.
b. There are exceptions or extraordinary circumslances or conditions
applicable to the same site of the variance that do not apply
generally to other properties in the same zone.
c. The strict interpretation or enforcement of the specified regulation
would deprive the applicant of privileges enjoyed by the owners of
other properties in the same dislrict.
IV. STAFF RECOMMENDATION
The Community Development Department recommends approval of the requested setback
variance and the additional 170 square feet of GRFA utilizing the 250 Ordinance. Staffs
recommendation of approval is based upon lhe review of the criteria and factors outlined in
Sestion lll of this memorandum.
Should the Planning and Environmental Commission choose to approve the applicant's requests,
staff would recommend the Planning and Environmental Commission make the following
findings:
1. ThEt the granting of the setback variance does not constitute a grant of special
privilege inconsistent wilh the limitations on other properties classified in the Glen
Lyon Special Developmenl District.
2. That the granting of the variance will not be detrimental to the public health, safety
or welfare, or will not be maierially injurious lo properlies or improvements in the
vicinity of Lot 44, Glen Lyon Subdivision.
3. That the strict literal interprelation or enforcement of the setback regulation results
in a prac'tical difficulty or unnecessary physical hardship inconsistent with the
development objectiv€s of the Municipal Code or the Glen Lyon Special
Development Distric{.
4. There are exceptions or extraordinary circumstances or conditions applicable to
the applicant's property that do not apply generally to other properties in the Glen
Lyon Special Development District.
5. The strict interpretation or enforcement of the setback regulation deprives the
applicants of development privileges enjoyed by the owners of other properties in
the Glen Lyon Special Development District.
6. That the addition of 170 square feet of additional GRFA does nol negatively effect
the existing topography, vegetation and drainage on Lot 44, Glen Lyon Subdivision.

In addition to the standard front (20'), side (15') and rear (15') setbacks, the subject site is
further encumbered by a sewer easement (20' to either side of the centerline) along the rear of
the sit€ and a ski lift setback, inboard of the side-yard setback to the Northeast.
The effective net buildable area counting only the standard setbacks is I 1,597 S.F. . As a result
of the easements and additional setbacks the effective net buildable area is reduced to 5.151
S.F..
This site, due to the extraordinary easements and setbacks described above, has a net buidable
area that is less than one half the comparable area of the surrounding sites with normal setbacfts.
Further, the Ski Lift Easement, to the Northeast has forced the home to be offset to the
Southwest, immediately adjacent to the side yard setback.
Given the roof configuration and strict geometry of the present home there is no other practical
solution, that is acceptable to the Owners and will allow them to adequately expand their Living
Room.

THIS AGREEMENT, made and entered into fiis _day of . 19_, by
and among R.E. NIKKEL (herelnafter called the 'Developer'), and the TOWN
OF VAIL (hereinafter called the 'Town"), and the FTRSTBANK 0F vArL (hereinafter cqlled
the'Banf).
WHEREAS, the Developer, as a condition of approval of the DRP aPProva
wishes to enter into a Developer lmprovement Agreement; and
WHEREAS, the Developer is obligated to provide security or collateral sufficient in the
judgment of the Town to make reasonable provisions for completion of certain improvements
set forth below; and
WHEREAS, the Bank has agreed to hold the cash escrow account on terms and
conditions as set forth herein.
WHEREAS, the Developer wishes to provide collateral to guarantee performance of
this agreement, induding construction of the above-referenced improvements by means of the
following:
Developer agrees to establish a cash escrow account at he Bank in a dollar amount
as set forth below, such cash escrow account shall provide security for the following:

NOW, THEREFORE, in consideration of the following mutual covenants and
agreemenb, the Developer and the Town agree as lollows:
1. The Developer agrees, at its sole cost and expenses, to furnish all equipment
and material necessary to perform and complete, on or before June I, 1992 . The
Developer shall complete, in a good workmanlike manner, all improvements as listed above,
in accordance with all plans and specifications filed in the office of the Community
Development Department, the To$rn of Vail, and to do all work lncldential thereto according to
and in compliance with the following:
a. Such other designs, drawings, maps, specificiltions, sketches, and other ma$er
submitted by the Developer to be approved by any of the above-referenced
govemmentiat entities. All said work shall be done under the inspection of, and
to he satisfaction of, the Town Engineer, the Town Building Official, or oth€r
official from the Town of Vail, as affected by special disfbE or service disticb,
as their respective interest may appear, and shall not be deemed complete until
approved and accepted as completed by the Town of Vail Community
Development Department and Public Works Department.

To secure and guarantee performance of its obligations as set forth herein, the
Developer agrees to provide security and collateral as tollows:

a default under the Agreement by Developer.
3. The Developer may at any time substiute the collateral originally set torth
above for another form of collateral acceptable to the Town to guarantee the faithful
completion of hose improvements refened to herein and the performance of the terms of this
Agreement. Such acceptance by the Town ol alternative collateral shall be at the Town's sole
discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occuning to the work specified in
this Agreement prior to the completion and acceptance of the same, nor shall the Town, nor
any officer or employee thereof, be liable for any persons or property injured by reason of the
nature of said work, but all of said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are
based upon any performance by the Developer hereunder; and the Developer shall reimburse
the Town for any and all legal or ofier expenses reasonably incured by the Town in
connection with investigating or delending any such loss, claim, damage, liability or action.
This indemnity provision shall be in addition to any ofier liability which the Developer may
have.
5. lt is mutually agreed that the Developer may apply lo the Town and the Town
shall authorize for partial release of the collateral deposiled with the Bank for each category of
improvement at such time as such improvemenb are constructed in compliance with all plans
and specifications as referenced hereunder and accepted by the Town.
6. lf the Town determines that any of such improvemenb as contemplated
hereunder are not constructed in compliance with the plans and specifications set lorth herein,
it shall fumish the Developer a list of specific deficiencies and shall be entitled to continue to
withhold collateral to insure such compliance. lf he Town determines that the Developer will
not construct any or all of the improvements in accordance with all of the specilications and
time tables as set forth herein, the Town may give the Developer written notice and unless
such improvements are completed by the dates as set forth above or within a reasonable
period after such date if weather does not permit the completion ol such improvements, the
Town may withdraw from the cash escrow account such funds as may be necessary to
complete the unfinished improvemenb, but not in an amount greater than the amount as set
forh opposite the category listed above and not before such improvements are completed.
The Bank may release such funds upon written request and representation by the Town that
such improvements are completed. The Bank shall not be obligated to independently verify
that such work is complete, but shall fund sucfr requsst, upon the Town ol Vail written
authorization.
7. The Developer wananb all work and matedal for a period of one year after
acceptrance of all work reterred to in his Agreement by the Town if such work is located on
Town of Vail or road right-of-way.
8. The parties hereto mutually agree that this Agreement may be amended from

review or Health Department review, and a review by the Building
Department, the estinated time for a total review may take as long
as three weeks.

workmen vehicles upon any street, sidewal.k, alley or publicplace or any portion thereof. The right-of-way on all Town ofVail streets and roads is approxirnately 5 ft. off pavement.This ordinance will be strictly enforced by the Town of VailPublj.c Works Departrnent. Persons found violating this ordinancewill be given a 24 hour written notice to remove said rnaterial .In the event the person so notified does not comply with thenotice within the 24 hour tine specified, the Public WorksDepartment will remove said material at the expense of personnotified. The provisions of this ordinance shall not beapplicable to construction, maintenance or repair projects ofany street or alley or any utilities in tbe right-a-way.

DEVELOPER IMPROVEMENT AGREEMENT
THIS AGREEMENT, mado and entored into this _ day of _, 19_, by

oF vAlL (hereinafter called the 'Town'), and the FTRSTBANK 0F vArL (herelnafter called
the'Bank").

WHEREAS, the Developer is obligated to provide security or collateral sufficient in the
judgment of the Town to make reasonable provisions for completion of certain improvements
set forth below; and
WHEREAS, the Bank has agreed to hold the cash escrow account on terms and
conditions as set forth herein.
WHEREAS, the Developer wishes to provide collateral to guarantee performance of
this agreement, induding construction of the above-refersnced improvements by means of the
following:
Developer agrees to establish a cash escrow ac@unt at he Bank in a dollar amount
as set forth below, such cash escrow account shall provide security for the following:

NOW, THEREFORE, in consideration of the following mutual covenants and
agreemenb, the Developer and ths Town agree as follows:
1. The Developer agrses, at its sole cost and expenses, to furnish all equiprnent
and material necsssary to perform and complete, on or bgforo June 1, 1992 . The
Developer shall complete, in a good workmanlike manner, all improvements as listed above,
in accordancs with all plans and specifications filed in the office of the Community
Development Department, the Town of Vall, and t0 do all work incidental thereto accoding to
and in compliance with the following:
a. Such other designs, drawings, maps, specifications, sketches, and other matter
submittsd by the Dsvsloper to be approved by any of the abovs-rsferenced
govemmental entitiss. All said work shall be done under the inspeAion of, and
to he satlsfactlon of, the Town Englnesr, the Town Bulldlng offlclal, or other
official from the Town of Vail, as affec'ted by speclal districts or service disticts,
as their respective interest may appear, and shall not be deemed complete until
approved and accepted as completed by the Town of Vail Community
Development Department and Publlc Works Department.
2. The total estlmated cost ot sald work and lmprovements ls the sum of$ 2s, ooo.o0_.
To securs and guarantee performance ot its obligations as set forth herein, the
Developer agrees to provlde securlty and collateral as follows:
A cash escrow account in the amount ol $31,250.00 to be held by the Bank, as
escrow agent, shall provlde the secudty for the lmprovemenb set tonh above if there is
a default under the Agreement by Developer.
3. The Developsr may at any time substitute the collateral originally set forth
above for anolher form of collateral accsptable to the Town to guarant€e he faithful
completion of those improvemenb retened to herein and the performance of the terms of this
Agreement. Such acceptance by he Town of altsrnaUve collateral shall be at the Town's sole
discretion.
4- The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occuning to the work specified in
this Agreement prior to the completion and acceptrance of the same, nor shall ths Town, nor
any officer or employee thereof, be liable for any persons or property injured by reason ot the
nature of said work, but all of said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereo| that arise out ot or are
based upon any performance by the Developer hereunder; and the Developer shall reimburse
the Town for any and all legal or other expenses reasonably incuned by the Town in
connection with investigating or defending any such loss, claim, damage, liability or action.
This indemnity provision shall be in addition to any other liability which the Developer may
have.
5. lt is mutually agreed that the Developer may apply to the Town and the Town
shall authorize tor panial release of the collaleral deposited with the Bank for each category of
improvement at such time as such improvemenb are constructed in compliance with all plans
and specifications as referenced hereunder and accepted by the Town.
6. lf the Town determines that any ol such improvements as contemplated
hsrsunder are not constructed in compliance with he plans and specifications set fofth hereln,
it shall fumish the Developer a list of specific deficiencies and shall be entitled to continue to
wifrthold collateral to insure such compliance. lf lhe Torn delermines that the Developer will
not construct any or all of the lmprovements In accordance with all of the specifications and
time tables as set forth herein, the Town may give the Developer written noUce and unless
such improvements are completed by the dates as set forth above or within a reasonable
period after such date if wsathsr does not permit the completion of such improvements, the
Town may withdraw from the cash escrow account such funds as may bo nocessary to
complete ths unfinlshed lmprovemenb, but not in an amounl greater than the amount as set
forth opposite he cat€gory listed above and not betore such lmprovements are completed.
The Bank may release such funds upon written rsqusst and repesentation by the Town that
such improvemenls ars completed. The Bank shall not be obllgated to independently verify
that such work is complete, but shall furd sucfr request, upon the Town of Vail written
authorization.
7. The Developer wanants all work and matedal for a pedod of one year after
acceptance of allwork referred to in this Agreement by the Town if such work is located on
Town of Vail or road right-of-way.
L The parlies hereto mutually agree that this Agreement may be amended from
time to time, provided that such amendments be In writing and executed by all parties hereto.

II . PRE-APPLICATION I.JEETING:
In addition to meeting submitt,al requirements, theapplicant. mus! stake and t.ape the pfoject slte toindicate property lines, building ltnes and buildingcorners. All trees to be removed must be taped. Allsite tapings and staking nust be conpleted piior to the
DRB site visit. The applicant must ensure that stakingdone during the winter is not buried by snow.
The review process for NEll BUILDINGS normally regul-restwo separate meetings of the Design Revlew Board: aconceptual approval and a final approval . Applicantsshould plan on presenting their dlvetopment proposal ata minimun of two meetings before obtaining finalapproval.
Applicants who fail to appear before the Design ReviewBoard on their scheduled meeting date and who have notasked in advance that discussion on their item bepostponed, will have their items removed from the DRBdocket until such time as the item has beenrepublished.
The following items may, at the discretion of thezoning administrator, be approved by the Community
Development Department staff (i.e. a formal hearingbefore the DRB may not be required):
a. lVindows, skylights and simj.lar exterj.or changeswhich do not alter the existing plane of thebuilding; and
b. Building addition proposals not vislble from anyother lot or public space. At the time such aproposal is submitted, applicant,s must incl.udeletters from adjacent property owners and,/or fronthe agent for or manager of any adjacent
condominium association stating the association
approves of the addition.
If a property is located in a mapped hazard area (i.e.
snow avalanche, rockfall, f1ood plain, debris flow,wetland, etc) r a hazard study must be submitted and the
owner must slgn an affidavit recognlzlng the hazardreport prior to the issuance of a building pernlt.Applicants are encouraged to check with a Tovrn Plannerprior to DRB application to determine the relationshipof the property to all mapped hazards.
For all residential construction:
a. Clearly indicate on the floor plans the insideface of the exterior structural walls of thebuilding; andb. Indicate with a dashed Line on the site plan afour foot distance fron the exterior face of thebuilding walls or supporting colunns.
A pre-application meeting with a mernber of the plannJ.ngstaff is _ strongly encouraged to determine if any additlonalapplication lnformation is needed. It is the applicant'sresponsibility to make an appointment with the btaff todetermine if there are additional submittal requirements.Please note that a COMPLETE application wiLl sLreamline theapproval process for your project.

IV. NEW CONSTRUCTION
A. Three copies of a recent Lopoqraphic survev, stamped bva liggnsed survevor, at aon which the following information is provided:
1. Lot area.
2. Two foot contour lntervals unless the parcelconsists of 6 acres or more, ln which case, 5tcontour intervals may be accepted.
3. Existing trees or groups of trees having trunkswith diarneters of 4x or more, as measuled from apoint one foot above grade.
4. Rock outcroppings and other significant naturaLfeatures (Iarge boulders, intermittent streans,etc. ) ,
5. Hazard areas (avalanche, rockfall, etc.),centerline of stream or creek, required creek orsLream setback, 10O-year flood plain and slopes of40* or nore, if appticable.
6. Ties to existing benchmark, either USGS landmarkor sevrer invert. This information should beclearly stated on the survey so that all
measurements are based on the same start.ing point.This is particularly important for heightmeasurements. See Policy On Survey Information,for more information regarding surveys.
7. Locations of the following:
a. Size and type of drainage culverLs, swales,etc. must be shown.
b. Exact ]ocation of existing utility sources
and proposed service lines from their sourceto the structure. Utilities to include:
Cable TV
Telephone
Sewer
Water
GasElectric
c. Propert,y lines - distances and bearings and abasis of bearing must be shown.
d. ALl easements (Title report must also includeexisting easement locations)
8. Exlstlng and finished grades.
9. Provide spot elevations of the street, and a
minimum of one spot elevation on either side ofthe Lot, 25 feet out from the side property llnes.
B. Site Plan
1. Locations of the following:
a. Proposed surface drainage on and off site.
b. Proposed driveways. Percent slope and spotelevations must be shown.
c.
2. All exlsting improvenents including structures,landscaped areas, service areas, storage areas,walks, driveways, off-street parking, loadingareas, retaining walls (with top and bottom ofwall spot elevations), and other existing siteimprovements.
3. Elqvations of top of roof ridqes (with existlnqald prgposed qrades shown underneath). Theseelevations and grades nust bE prowided in orderfor the staff to determine building height. Allridge Lines should be indicated on the site plan.Elevations for roof ridges shall also be lndicatedon the site plan with corresponding finished andexisting grade elevations.
4. Driveway grades may not exceed 8t unless approvedby the Town Engineer.
Landscape PLan (1rt = 20r or larger) - 3 copies required
1. The following information rnust be provided on thelandscape pJ.an. The location of existing 4"diameter or larger trees, the location, size,spacing and type (common and Latin name) of aIIexisting and proposed plant naterial. A11 treesto be saved and to be removed must also beindicated. The plan must also differentiatebetween existing and proposed vegetation.
2. CompJ.ete the attached landscape materials list.
3. The location and type of existing and proposedwatering systems to be employed in caring forplant materiat following its installation.
4. Existing and proposed contour lines.
In order to clarify the inter-relation of the various
development proposaf components, please incorporate asmuch of the above information as possible ont,o the slteplan.

VIII.EONCEPTUAL DESIGN REVIEW
A. SUbnittal qequirements: the owner or authorized agentof any project requiring design approval. as prescribedby this chapter may submit plans for conceptual reviewby the Design Review Board to the Department ofCommunity DeveLopnent. The conceptuat review isintended to give the appllcant a basic understanding ofthe compatibility of their proposal with the Town, sDesign Guidelines. This procedure is recommendedprimarily for applications more compLex than single-family and two-family residences. However, developersof single-family and two-family projects shall not beexcluded from the opportunity to request a conceptualdesign review. Complete applications must be submitted10 days prj.or to a scheduled DRB neeting.
The following information shall be submitted for aconceptual review:
1. A conceptual site and Landscape plan at a minimunscale of one inch equals twenty feeLt
2. Conceptual elevations showing exterior materiaLs
and a description of the character of the proposedstructure or structuresi
3. Sufficient infornation to show t,he proposal
complies with the developrnent standards of thezone district in which the project is to beIocated (i.e. GRFA, site coverage calculations,
number of parking spaces, etc.);
4. Completed DRB application form.
B. Procedure: Upon receipt of an application forconceptual deslgn revlew, the Department of ComnunityDevelopment sha.Ll review the submitted naterials forgeneral compliance with the appropriate requirements ofthe zoning code. If the proposal is in basicconpliance with the zoning code requirements, theproject shall be forwarded to the DRB for conceptualreview. If the application is not generally in
compliance with zoning code requirements, theapplication and submittal materials shall be returnedto the applicant with a written explanation as to whythe Community Development Department staff has foundthe project not to be in compliance with zonlng codereguirements. Once a conplete application has beenrecelved, the DRB shall revlew the subnitted conceptualrevlew application and supporting naterial in order to
