Thank you for appearing before the Planning and Environmental commission on Monday, 1
12,lg66,with thi request for an amendment to an approved sitgdevglggrnent plan to allow
snift in the building envelope of Building # 8, located at2792 B Kinnickinnick Road/Innsbru
Meadows # 8. As you *" u*u.", the llanning and Environmental Commission unanimousll
approved your request with threc conditions. These three conditions of approval are as foll<
l. That the footprint for Building # 8 be further amende4 by the applicant, so as not to
encroach aerihly, or otherwis-e into the platted 20'wide pedestian/drainagdutility
easement, located to the north of Lot 8, Innsbruck Meadows'
2. As originally conditione4 all buildings within the Innsbruck Meadows Subdivision sl
maintain a minimum 15'separation between structures, including all decks and

Henry pran is reluctant to give a permanent approval for a conditional use permit. He would like
the maximum amount of time to be 5 years.
John Scholield had no comments.
Gene Uselton had to disagree with Henry Pratt. He would like todo away with the bureaucratic
red tape. As long as the FEC could call-up the permit at any time, or as stated in Condition #5'
he felt that was sufficient.
Greg Amsden agreed with Gene's comments.
Greg Moffet asked the applicant how soon they anticipated going to 4 days?
Larry Gaul said they are going to 3 days as soon as the litF open and will wait and see when 4
days would be needed.
Greg Moflet felt indefinite approval, agreeing with Gene's comments. He told Pam Stenmark to
advise the PEC it there were any complaints.
Gene Usalton made a motion for approval, subject to the 5 conditions as listed in the stalf memo.
The motion was seconded by John Schofield.
It passed unanimously by a vote of 7-0.

George Ruther gave an overview of the request. Since the proposed relocation of Building #8 is
by more than 2', stafl could not administratively approve the relocation. Statf is recommending
aiproval of the request with the 3 conditions as listed in the staff merno and with the additional
condition that the applicant move the building out of he utility easement.
Greg Motfet asked lor any public comment, there was none.
Greg Amsden abstained, since he is a listing agent lor the property.
There were no comments from Gene Uselton or John Schofield.

The meeting was called to order by Greg Moftet at 2:00 p.m.
1. A request for a renewal ol a conditional use permit to allow for the continued o099ti91 of
a mobite caheterization laboratory at the Vail Valley MedicalCenter, located at 181 West
Meadow Drive/Lots F & E, Vailvillage 2nd Filing'
Applicant: VailValley MedicalCenter, represented by Dan Feeney

Dirk Mason gave an overview of the request. Dirk stated that he applicant was requesting to
_
extend the rEnewal of a conditional use permit indefinitely, or at least for more than a period ol
one year. He explained that no complaints had been recorded. He stated that staff was
recoinmending approvatwith the conditions stated in the staff memo, with an additionalconditlon
for indelinite appidval. Dirk then handed out to the Board members, a late arriving letter
submitted by Joan Norris.
Lany Gaul, a cardiologist, thanked the community and said that the mobile catheter lab exceeded
theii expectations for usage. They have not experienced any complaints. The conditional use
permit illows the lab to be operating three days per month, but the request is forjour days p9r.
inonth to better distribute the patients and make it easier to get the van out by 9:00 p.m. at night.
Four days per month will allow them to miss skier tratfic when departing the site.
pam Stenmalk, General Partner at the Evergreen Lodge, requested that the corditional use
permit not be indefinite, but reviewed each year.
Greg Motfet asked lor any public comment' There was none.

Diane Golden thought it tvas nice for the community having the mobile lab.

Roger Staten, a Vail Point homeowner, would like to voice his objection. Mr Hiller, the real estate
ag6nt, snowed him the plans for the development across the street. He woukl have thought
tfrice about buying his unit had he known this was going to happ€n. H.e. said variances are
gianied Gcaub 6t narOsnip. This is a profit orientbd request. This will not benefit the Town of
Vail and will create a tunneieffect. The existing codes were put there for a reason' The
homeowners of Vail Point have had to pay for Mr. Gensler's back taxes. How can the Town of
Vait reurarO anyone when they naven't hdde good on their promises to his Vail Point projec{?
This is a protit motivated request.
Larry Eskwith, representing Vail Point, reviewed the variance and the staff memo. He would like
to know wher6 m'e narOsni-p is here. The first reason for the variance request to do away with the
front setback, is because dt the targe road right-oFway. lt doesn't mean thelewill always.be a
large Town of Vail right-of-way. lt is not perpetual, as stated pV GreO Hall. Thls request doesn'l
shdw any hardship. tne secdnO and chief reason for the variance request is to presenre certain
landsca{ing that the Capstone Condo owners placed there. ln other words, to prgsonF the rear
setbackfor Gapstone lahdscaping. Capstone would like to see this gq thlougf, since they put a
tot of landscaping on trespassed property.The development could be builtrvithoutp0ecting
itsetf into the iron"t setcaci<. Rgain, uihatis the hardship and why are my clients being subjected
to this. One of the key findings is that the variance will not be a grant of special prlvilege. Hort
many variances havebeen gianteO with a 19' out of a 20' setback. There is no hardship to
support it.
Marty Walbaum, Vail Point owner of Unit #8, stated that calculations on Phase ll do not retlect
overbuilding Phase ll and underbuilding Phase lll. Reasons for granting a variance must prove
that the granting would not be detrimentalor materially injurious to adjacent property 9wll9rs.
Thirty eight troperty owners in Vail Point object to the request, as it would be materially iniurious
to us. Phas'e llhas not been completed in the three years that I have lived there. We have been
obligated to pay the developer's tiaxes. I feel the granting of this is a special favor to the
applicant, who is not even here.
Steven Gensler stated hat he was here.
Ken Sortland, a resident of the Town of Vail and resident in the valley for 16 years, owns Vail
Point #3. Whed the road was first put in, it was not put in the right place. Setbacks are for the
purpose of buffering between units. The applicant got this property in 1989, when he purchased
Vail Point. There is no hardship. I see no condition to grant a variance. The developer hasn't
clmpleted the work on the first job, nor is the job properly done. Owners had to pay for fixing a
leak in the driveway when asphalt had been dumped onto it by the contractor. Orners had to
come up with back taxes to the tune of $300 per unit' Please deny the variance and have the
developer build within the envelope.
Phillis Mango, owner ol Capstone #1, has no problem with the granting of this variance.
Regarding Section V, item 4, where the emergency vehicle turnaround is addressed; where is the
snow going to be dumped? How are you going to preserve the plantings that are there, as
identilied in item 5?
Marlene Zemmers of Vail Point, stated that instead of a town of chimneys, she would like to
preserve what we have now. These are substandard buildings done by a developer wih a debt
ol back payment of taxes. She is getting the leeling that he is catering to Capstone. We care
about Vail and not the profit motive.

the aijacent property owners received bythe Town olyll. George had recelved another letter

ibilicition. George went over ttre statt memo and the zoning analysis.. Staff is recommending

Mary Ann Vanetta, a property owner at capstone, south of the appllcant, thought lt shouldbe
reddsigned to include increased landscaping improvements. We see this new prgposed plan as
Mr. Gdnsbr's response to a previous worksession. This doesn't address he landscaping
problem.
Greg Amsden said he was on the Commission at the time of the originalworksession. This plan
seems better for the preservation of tr|e trees.
Mary Ann Vanetta said the applicant thought if he redesigned the request, he could get a-front
setback variance. The redesign could have been approved if he didn't increase the dwelling
units from 8 to 12.
Greg Amsden reminded Ms. Vanena hat the applicant's lot is private property. lf a new
developer came in, he could bulldoze the property' if he chose to.
Darryl Brady, an owner of Vail Point Unit #7, stated that his realtor, Mr. Hiller, represented and
consummati:d the deal. We are violently opposed. We have a setback of 20' to protect them
lrom encroaching. We are opposed to the setback variance request. We thought the zoning
was there to protect us.

NOW, THEREFORE, in consideration of the following mutual covenants and
agreemenls, the Developer and the Town agree as follows:
'1. The Developer agrees, at its sole cost and expenses, to furnish all equipment- ,andmateria|neceSsarytoperformandcomp|etea||improvements,onorbefore#7

inlprovements as listed above, in accordance with all plans and specifications filed in the
office of the Community Development Department, the Town of Vail, and to do all work
incidental thereto according to and in compliance with the following:
a. Such other designs, drawings, maps, specifications, sketches, and other matter
submitted by the Developer to be approved by any of the above-referenced
governmental entities. All said work shall be done under the inspection of, and
to the satisfaction of, the Town Engineer, the Town Building Official, or other
official from the Town of Vail, as affected by special districts or service districts,
as their respective interest may appear, and shall not be deemed complete until
approved and accepted as completed by the Town of Vail Community
Development Department and Public Works Department.
2. To secure and guarantee performance of its obligations as set forth herein, the
Developer agrees to provide security and collateral as follows:

A cash deposit account in the amount ot $3Jry-=@-to be held by the Town, as
escrow agent, shall provide lhe security ior the improvements set lorth above if there is
a default under the Agreement by Developer.
3. The Developer may at any time substitute the collateral originally set torth
above for another form of collateral acceptable to the Town to guarantee the faithful
completion of those improvements referred to herein and the performance of the terms of this
Agreement. Such acceptance by the Town of alternalive collateral shall be at the Town's sole
discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occurring to the work specified in
this Agreement prior to the completion and acceptance of the sarne, nor shall the Town, nor
any officer or employee thereof, be liable for any persons or property injured by reason of the
nature of said work, but all of said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
olficers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are
based upon any performance by the Developer hereunder; and the Developer shall reimburse
the Town for any and all legal or other expenses reasonably incurred by the Town in
connection with investigating or defending any such loss, claim, damage, liability or action.
This indemnity provision shall be in addition to any other liability which the Developer may
have.
5. lt is mutually agreed that the Developer may apply to the Town and the Town
shall authorize for partial release of the collateral deposited with the Town lor each category
of improvement at such time as such improvements are constructed in compliance with all
plans and specifications as referenced hereunder and accepted by the Town. Under no
condition will the amount of the collateral that is being held be reduced below the amount
necessary to complete such improvements.
6. lf the Town determines that any of the improvemenls contemplated herein are
not constructed in compliance with the plans and specifications set forth herein by the date set
forth in paragraph 2, the Town may, but shall not be required to, withdraw from the cash
deposit such funds as may be necessary to complete the unfinished improvements. The
Town shall release such funds upon the written request of the staff of the Community
Development Department stating that the improvements have not been completed as required
by the agreement. The Town shall not require the concurrence of the developer prior to the
release of the lunds, nor shall the Town be required to verify independently that the
improvements have not been completed as required by this Agreement, but shall release such
funds solely upon the request of the Community Development Department.
lf the costs of completing the work exceed the amount of the deposit, the excess,
together with interest at twelve percent per annum, shall be a lien against the property and
may be collected by civil suit or may be certified to the treasurer of Eagle County to be
collected in the same manner as delinquent ad valorem taxes levied against such property. lf
the permit holder fails or refuses to complete the cleanup and landscaping, as defined in this
chapter, such failure or refusal shall be considered a violation of the Zoning Code.
7. The Developer warrants all work and material for a period of one year after
acceptance of all work referred to in this Agreement by the Town pursuant to Section
17.16.250 if such work is located on Town of Vail property or within Town of Vail right-of-way.
8. The parties hereto mutually agree that this Agreement may be amended from
time to time, provided that such amendments be in writing and executed by all parties hereto.

PUBLIC WORKS PERMIT PROCESS
How it relates to Building Permits:
1) Fill out our check list provided with a buildino permit aoolication.
lf yes was answered to any of the above questions then a "Public Way" is
required. You can pick up an application at either Gommunity Development,
located at 75 S. Frontage Road or PublicWorks, located at 1309 VailValley Drive.
2l Notice sign otfs for utility companies. All utilities must field verify (locate)
respective utilities prior to signing application. Some utility companies require up
to a 48 hour notice to schedule a locate.
3) A construction traffic controUstaging plan must be prepared on a separate sheet
of paper.An approved site plan may also be used. This plan will show locations
of all traffic control devices(signs, cones, etc..) and the work zone, (area of
Construction, Staging, etc..). This plan will expire on Oct. 15th. and will need to
be resubmitted for approval through the winter.
4) Sketch of work being performed must be submitted indicating dimensions (length,
width & depth of work). This may be drawn on the tratfic control plan or a site
plan for the job.
5) Submit completed application to the Public Works's otfice for review. lf required,
locates will be scheduled for the Town of Vail Electricians and lrrigation crew. The
locates take place in the morning but, may require up to 48 hours to perform.
6) The Public Work's Construction Inspector will review the application and approve
or disapprove the permit. You will be contacted as to the status and any that may
needed. Most permits are released within 48 hours of being received, but please
allow up to one week to process.
7) As soon as the permit is processed, a copy will be faxed to Community
Development allowing the "Building Permif'to be released. Please do not confuse
the "Public Way Permit" with a "Building Permit" to do work on a project itself.
NOTE:

developed the following procedures to ensure that new constructionsites have adequately established proper drainage from buildingsites along and adjacent to Town of Vail roads or streets.

access points fron tb,e road or street on to the construction site.
Such approvaL must be obtained prior to any request for inspection
by the Town of Vail- Building Department for footings or temporaryelectrical or any other inspection. Please call 479-2L60 torequest an inspection from the Publlc Works Department. AIIow a
minimum of 24 hour notice.
Also, the Town of Vail Public Works Departnent will be approvingall final drainage and culvert installation with resulting roadpauching as necessary. Such approval must be obtained prior to

PUBLIC WORKS PERMIT PROCESS
How it relates to Building Permits:
1) Fill out our check list provided with a buitdino permit aoptic;tion.
lf yes was answered to any of the above questions then a "public way" is
required. You can pick up an application at either community Development,
located at 75 S. Frontage Road or Public Works, located at 1309 Vail Valley Drive.
Notice sign offs for utility companies. All utilities must field verify (locate)
respective utilities prior to signing application. Some utility companies require up
to a 48 hour notice to schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet
of paper.An approved site plan may also be used. This plan will show locations
of all tratfic control devices(signs, cones, etc..) and the work zone, (area of
construction, staging, etc..). This plan will expire on oct. 1Sth. and will need to
be resubmitted for approval through the winter.
sketch of work being performed must be submitted indicating dimensions (length,
width & depth of work). This may be drawn on the tratfic control plan or a site
plan for the job.
Submit completed application to the Public Works's office for review. lf required,
locates will be scheduled for the Town of Vail Electricians and lrrigation crew. The
locates take place in the morning but, may require up to 48 hours to perform.
The Public work's construction Inspector will review the application and approve
or disapprove the permit. You will be contacted as to the status and any that may
needed. Most permits are released within 48 hours of being received, but pleasi:
allow up to one week to process.
As soon as the permit is processed, a copy will be faxed to Community
Development allowing the "Building Permit" to be released. please do not confuse
the "Public way Permit" with a "Buitding Permit" to do work on a project itself.
NOTE:
* The.above,process isJor work.ln a, publlc way,only.* Public Way Permits are valid onty until November 15th.* A new Public way Permit is required each year if work ls not complete.

Effective June 20, 1991, the Town of Vail Building Department has
developed the following procedures to ensure that new constructionsites have adequately established proper drainage from buildingsites along and adjacent to Town of Vail roads or streets.
The Town of VaiJ. Public Works Department will be required toinspect and approve drainage adjacent to Town of Vail roads orstreets and the installation of ternporary or permanent culverts ataccess points f,rom the road or street on to the construction site.
Such approval must be obtained prior to any request for inspectionby the Town of Vail Building Department for footings or temporaryelect.ricaL or any other inspection. Please call 479-2L60 torequest an inspection from the Public Works Department. AIIow a
minimum of 24 hour notice.
Also, the Town of VaiI Public Works Department wiII be approvingaII final drainage and culvert installation with resulting roadpatching'as necessary. Such approval must be obtained prior toFj.naf Certificate of Occupancy issuance.
