6. lf the Town determines, at its sole discretion, that any of the improvements
contemplated hereunder are not constructed in compliance with the plans and specifications set
forth in this Agreement on or before the date set forth in Paragraph 2, the Town may, but shall not
be required, to complete the unfinished.
lf the costs of completing the work exceed the amount of the deposit, the excess, together
with interest at twelve percent ('l2o/o) per annum, shall be a lien against the property and may.be
collected by civil suit or may be certified to the treasurer of Eagle County to be collected in the .
same manner as delinquent ad valorem taxes levied against such property. lf the permit holder
fails or refuses to complete the cleanup and landscaping, as defined in this chapter, such failure
or refusal shall be considered a violation of the Zoning Code.
7. The Developer warrants all work and material for a'period of one year after
acceptance of all work referred to in this Agreement by the Town if such work is located on Town
of Vail property or within Town of Vail right-of-way pursuant to Section 8-3-1.
8. The parties hereto mutually agree that this Agreement may be amended from time

review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will bke as long as three (3)
weeKs.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Buildino Permit AoDlication'
If yes was answered to any of the questions then a "Public Way" permit is requircd. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verifo (locate) respective
utilifies prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc,). This
plan will o<pire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.

and depth of work). This may be drawn on the faffic control plan or a site plan fur the job.
Submit completed application to the Public WorKs office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to peform.
The public Work's Conshjction Inspector will review the application and approve or deny
fie permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to Process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permif'to be releaSed. Please do not confuse the "Public Way Permif' with a
"Building Permif,.
) NOTE: The above prccess is for work in a public way ONLY. Public Way
permits are vatid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vall roads or streeB.
o The Town of Vail Public Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culverB at access points ftom the road or sFeet onto the construction
site. Such approwl must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other

a person who violates or causes another b violaG the same, top remove such sand, gnvel, rock, mud,
dirt, snow, ice or any other debris or material within twenty fuur (24) hours after receipt of said noUce
by the Director of Public Works. In the orent the persor so notified does not comply with the nouce
within the period of time herein specified, the Director of Public WorK, or other authorized agent, may
ctuse any such sand, gravel, rocks, mud, di( snow, ice, debris or any other material to be rernoved
from any street or alley at the expense ofthe notified.

beiore the Municipal Court of the Town for said violations, and upon being found guilty of a violation

Director of public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the o(pense of removal incuned by the Director of Public WorK, as provided in subsection B

The proposed residence should be supported with
conventional type spread footings, designed for an
allowable soil bearing pressure of2000 psf. They
should construct the footings on the undisturbed
sandy gravel to gravelly sand with cobbles and
boulders. See Foundation Recommendations.
Based on the Offrcial Maps for the Town of Vail,
Lot 6, Gore Creek Meadows, is not classified as
geologically sensitive area. Geologic hazards study
is outside ofour scope ofservices.
SCOPE OT'STUDY
This report presents the results ofa subsurface Soil and Foundation Investigation for a
proposed residence to be constructed on Lot 6, Block l, Gore Creek Subdivision, at 5ll4 Grouse
Lane, in the Town of Vail, Eagle County, Colorado. The purpose of the subsurface soil and
foundation investigation was to determine the engineering characteristics ofthe foundation soil
and to provide recommendations for the foundation design, grading, and drainage. Geologic
hazard studies are outside ofour scope of services.

SITE DESCRIPTION
Lot 6 is at the northwest edge of the cul-de-sac, at 5 I l4 Grouse Lane. off Main Gore
Drive in the East Vail, Eagle County, Colorado. The topography of the site is moderate. Drainage
is to the north and northwest. Vegetation on the lot consisted of pine and aspen forest. Also,
there was about 3 feet ofsnow on the lot. Lot 6 is vacant.
PROPOSED CONSTRUCTION
We have assumed that the proposed residence will consist of two stories, wood frame
construction, with a concrete foundation and a possible walkout basement. We anticipate loads
to be light, typical of residential construction.
Ifthe finalized plans differ significantly from the above understanding, they should notiS
us to reevaluate the recommendations of this report.
FIELD INVESTIGATION
The field investigation conducted on March 23,2000, consisted of excavating, logging
and sampling two test pits. Excavation of the test pits was done with a Cat 3l5L Trackhoe. The
test pits' locations are shown on Drawing No. 1. We show the soil profile of the test pits on the
Subsurface Exploration Logs, Figure No's I and 2. Soil samples for laboratory soil analysis and
observation were taken at selected intervals.
SUBSURFACE SOIL AND GROUNDWATER CONDITION
The soil profiles encountered in the two test pits were fairly uniform. Test Pit No.l had 2
feet oftopsoil over 6 feet ofbrown, silty to clayey-sandy gravel with cobbles and boulders. Test

Pit No. 2 also, had 2 feet oftopsoil, over 5 feet ofreddish-brown, clayey to silty, gravelly sand
with cobbles and large boulders. Ground water was not encountered in either test pit.
We sampled the soil in the test pits at random intervals. The soil samples were tested in
our laboratory for natural moisture content and grain-size distribution. The test results are shown
on Figure No's 3 and 4.
F'OI]NDATION RECOMMENDATIONS
The proposed residence should be supported with conventional type spread footings,
designed for a maximum allowable soil bearing pressure of 2000 psf. The footings should be
placed on the undisturbed gravelly sand to sandy gravel with cobbles and boulders. We
recommend minimum width of 16 inches for the continuous footings and 2 feet for the isolated
footing pads. Continuous foundation walls should be reinforced top and bottom to span an
unsupported length ofat least 10 feet.
We recommend a minimum of 48 inches of backfill cover for frost protection of the
footing subsoils. The foundation excavation should be observed by the undersigned engineer to
verify that the soil conditions encountered during construction are as anticipated in this report.
The foundation excavation should be free from excavation spoils, frost, organics and standing
water. We recommend proof-rolling of the foundation excavation. Soft spots detected during
the proof-rolling, should be removed by overexcavation. Any overexcavation within the
proposed foundation, should be backfilled, in 8 inches loose level lifts and compacted to 100%
of the maximum dry density and within 2 percent of the optimum moisture content as
determined in a laboratory from a Standard Proctor test (ASTM D-698). A structural fill, placed
under footings should be tested by the engineer or her representatives on regular basis. Void left
in the foundation excavation due to removal of boulders should be filled with gravel or lean
concrete.

SLAB CONSTRUCTION
The natural on-site soils, exclusive oftopsoil, and organics, are suitable to support lightly
loaded slab-on-grade construction. The subgrade for the slab-on-grade construction should be
proofcompacted to detect and remove soft spots. They should backfill overexcavated soft spots
and other underslab fill with the on-site soil, free from topsoil and organics, or other suitable
material, compacted to a minimum of 95 percent of the maximum standard Proctor density
(ASTM D-698). Suitable material should be free from topsoil, organics and rock fragments
greaterthan 3 inches.
The concrete slab should be constructed over a 4-inch layer of clean gravel consisting of -
3i4 inch gravel with at least 50% retained on the No. 4 sieve and less than 3 percent passing the
No.200 sieve.
They should reinforce the concrete slab-on-grade and score control joints according to the
American Concrete Institute requirements and per the recommendations of the designer to reduce
damage due to shrinkage. The concrete slab should be separated from the foundation walls and
columns with expansionjoints to allow for independent movement without causing damage.
RETAINING WALLS
Foundation walls retaining earth and retaining structures that are laterally supported
should be designed to resist an equivalent fluid density of65 pcffor an "at-rest" condition.
Laterally unrestrained structures, retaining the on-site earth, should be designed to resist an
equivalent fluid density of 45 pcf for the "active" case.
The above design recommendations assume drained backfill conditions and a horizontal
backfrll surface. Surcharge loading due to adjacent structures, weight oftemporary stored
construction materials and equipment, inclined backfrll and hydrostatic pressure due to
undrained backfill should be incorporated in the design. They should try to prevent the buildup
ofhydrostatic pressure behind the retaining wall.

UNDERDRAIN SYSTEM
To reduce the risk of surface water infiltrating the foundation subsoil, we recommend
installation of a foundation perimeter drain (see Figure No. 5). The foundation perimeter drain
should consist ofa 4-inch diameter, perforated pipe, sloped to a suitable gravity outlet, or to a
sump pump location, at a l/4 inch per foot for flexible or at a l/8 of an inch for rigid pipe. The
drain pipe should be covered with a minimum of 6 inches of -3i4-inch free-draining granular
material. Geotextile (Mirafi l40N or equivalent) should be used to cover the free-draining gravel
to prevent siltation and clogging ofthe drain. The backfill above the drain should be granular
material to within 2 feet ofthe ground surface to prevent a buildup ofhydrostatic pressrue.
SITE GRADING AND DRAINAGE
Grading plan was not available for our review. The following recommendations are
general. Exterior backfill should be compacted at or near the optimum moisture content to at
least95Yo of the maximum standard Proctor density under pavement, sidewalk and patio areas
and to at least9}Yo of tle maximum standard Proctor density under landscaped areas. They
should use mechanical methods of compaction. Do not puddle the foundation excavation.
The site surrounding the building structure should slope away from the building in all
directions. A minimum of 12 inches in the first 10 feet is recommended in unpaved areas, and
three inches in the first l0 feet in paved areas. The top ofthe granular foundation backfill
should be covered with a minimum of I foot of relatively impervious fill to reduce the potential
of surface water infiltrating the foundation subsoils.
Swface water naturally draining toward the proposed building site should be diverted
around and away from it by means of drainage swales or other approved methods. The roof
drains and downspouts should extend and discharge beyond the limits ofthe backfill.

LAWNIRRIGATION
It is not recommended to introduce excess water to the foundation soils by installing
sprinkler systems next to the building. The installation of the sprinkler heads should insure that
the spray from the heads will not fall within l0 feet of foundation walls, porches or patio slabs.
Lawn irrigation must be controlled.
LIMITATION
This report has been prepared according to locally accepted Professional Geotechnical
Engineering standards for similar methods of testing and soil conditions at this time. There is no
other warranty either expressed or implied.
The findings and recommendations of this report are based on field exploration,
laboratory testing of samples obtained at the specific locations shown on the Location Sketch,
Drawing No.l and on assumptions stated in the report. Soil conditions at other locations may
vary, which may not become evident until the foundation excavation is completed. If soil or
water conditions seem different from those described in this report we should be contacted
immediately to reevaluate the recommendations of this report.
This report has been prepared for the exclusive use of Mr. Spencer Butts, for the specific
application to the proposed residence on Lot 6, Block 1, Gore Creek Subdivision in East Vail,
Eagle County, Colorado.

In order to prwent a non-emergency response from the Vail Fire
Department
su-pp-ression crews b the construction location you may be working on we
ask that you peform the following tasks:

Determine what kind of fire alarm system sists within the
structure you ane working in with Ure owner or the manager of
the propefi involved or by contacting the Vail Fire DepaftmenL
Debrmine with the owner or manager of the FrcFefi, which
alarm company services the systemfor them.-
AeccmL familiaiwith the difierent components that are
asst*iated with the fire alarm sysitem ahd how they operate
befiore the DEMO begins.
Never paint a smoke detector, thermal detector, or any other
gomponent of the fire alarm system, and never paint a sprinkler
head.
For small projects bag detector within the area you will be
working in before you start and lemove the bags afterrvor* is
done for the day.
For larger projects, please contact the Vail Fire Department so
that we can work with you in determining what needs b be done
to aher or oZone Ouf'specific areas of the alarm system for the
structure.

Amendment to the 1999 N.E.C. Town of Vail Ordinance 10-1-6.
Overhead services are not allowed in the Town of Vail.
Underground seryices have to be in conduit (PVC) from the transformer to the electric meter, main disconnect
switch and to the first electrical distribution circuit breaker oanel.
The main disconnect switch shall be located next to the meter on the exterior wall of the structure easily
accessible.
All underground conduits are required to be inspected before back-filling the trench.
In multi-family dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common
walls and spaces are accepted.
NM Cable (Romex) is not allowed in commercial buildings or structures exceeding three (3) stories.
No use of aluminum wire smaller than size #8 will be oermittedwith the Town of Vail,

All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).

o If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade, you must also obtain a building permit.
o If this permit is for installation of an elterior hot tub or spa on any existing deck or elevated platform,
a structural engineer must review the existing condition and veriry that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
o If this is a remodel in a multi-family building with a homeowners association, a letter of permission
from the association is required.

NOW, THEREFORE, in consideration of the following mutual covenants and
agreements, the Developer and the Town agree as follows:
1. The Developer agrees, at the sole cost and expenses, to fumish all equipment
end materi4necessary to perform and complete all improvements, on or belore
l./(rt | ,?,@U . The Developer shall complete, in a good workmanlike manner, all
improvements as listed above, in accordance with all plans and specifications filed in the otfice
of the Community Development Department, the Town of Vail, and to do all work incidental
thereto according to and in compliance with the following:
a. Such other designs, drawings, maps, specifications, sketches, and other matter
submitted by the Developer to be approved by any of the above-referenced
governmental entities. All said work shall be done under the inspection of, and
lo the satisfaction of, the Town Engineer, the Town Buiding Official, or other
official from the Town of Vail, as atfected by special districts or service districts,
as their respective interest may appear, and shall not be deemed complete until
approved and accepted as completed by the Town of Vail Community
Development Department and Public Works Department.
2. To secure and guarantee perlormance of its obligations as set forth herein, the
Developer agrees to provide security and collateral as follows:
A cash deposit account in the amount ot S ZfdO, t D to be held by the Town,
as escrow agent, shall provide the security lor the improvements set forth above
if there is a default under the Agreement by Developer.
3. The Developer may at any time substitute the collateral originally set lorth above
for another form of collateral acceptable to the Town to guarantee the faithful completion of
those improvements referred to herein and the performance ol the terms of this Agreement.
Such acceptance by the Town of alternative collateral shall be at the Town's sole discretion,
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occurring lo the work specilied in
this Agreement prior to the completion and acceptance of the same, nor shall the Town, nor
any officer or employee thereof, be liable for any persons or property injured by reason of the
nature of said work, but all of said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnily and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the

Town or any of its officers, agents or employees may become subject io, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) that arise oul of or are
based upon any performance by the Developer hereunder; and the Developer shall reimburse
the Town for any and all legal or other expenses reasonably incurred by the Town in
connection with investigating or defending any such loss, claim, damage, liability or action.
This indemni$ provision shall be in addition to any other liability which the Developer may
have,
5. lt is mutually agreed that the Developer may apply to the Town and the Town
shall authorize lor partial release of the collateral deposited with the Town for each category of
improvement at such time as such improvements are constructed in compliance with all plans
and specifications as relerenced hereunder and accepted by the Town. Under no condition
will the amount of the collateral that is being held be reduced below the amount necessary to
complete such improvements.
6. It the Town determines, at its sole discretion, that any of the improvements
contemplated hereunder are not constructed in compliance with the plans and specifications
set forth in this Agreement on or before the date set forth in Paragraph 2, the Town may, but
shall not be required to, redeem the lener of credit as necessary to complete the unfinished
improvements. The Bank shall release such funds upon written request from the Town stating
that the improvements h3ve not been completed as required by this agreement. The Bank
shall not require the concurrence of the developer prior to release of the funds to the Town nor
shall the Bank be required to verify independently that such improvements have not been
completed as required by this agreement, but shall release such funds solely upon the Town=s
written request.
lf the costs of completing the work exceed the amount of the deposit, the excess,
together with interest at twelve percent'per annum, shall be a lien against the property and
may be collected by civil suit or may be certified to the treasurer of Eagle County to be
collected in the same manner as delinquent ad valorem taxes levied against such property. lf
the permit holder fails or refuses to complete the cleanup and landscaping, ad defined in this
chapter, such failure or refusal shall be considered a violation of the Zoning Code.
7. The Developer wanants all work and material for a period of one year after
acceptance of all work relerred to in this Agreement by the Town if such work is located on
Town of Vail property or within Town of Vail right-of-way pursuant to Section 17.'16.250.
8. The parties hereto mutually agree that this Agreement may be amended from
time to time, provided that such amendments be in writing and executed by all parties hereto.

The Design Review Board conceptually reviewed the plans for the Dreyer Residence, to
be located at 5114 Grouse Lane / Lot 6, Block 1, Gore Creek Sub. The following were
their comments and concems, which must be addressed prior to final approval:
1. The Design Review Board would like more exploration of the two trees proposed
to be removed for the driveway. Please involve an arborist to explore the
possibility of saving these trees should the driveway be relocated.
2. Please revise the windows on the front elevation so that they are consistent.

Meeting.
At the Design Review Board meeting on April 19, the board requested revised
design of the access to the site, rotaining treos noar the Etre€t and an arborist
repon addressing the regrading and rock walls adjacent to th€ tr6es.
Following this meeting we provided an alternate sit€ plan showing a bridge
structur€ from the streot onto the land going between the trees. We met with th€
Town of Vail on April 24. Allison Ochs and Tom Casmill attended this meeting,
Attached are the site plan and site s€ction for this alternate site design. Tom
advised us that the bridge would need to bs at 8% and sv€n with an open grate
construction to allow the snow to fall through the bridge declq this grade could not
be increased. Allison advised us that this lot is not sufficiently sts€p to permit
higher than 3'-0" retaining walls within the 20' front sotback to support tho
driveway. Thorefore, the bridge to grade conn€ction had to b€ 3O' back from th€
strs€t.
Our clients rejocted this site plan option for the following r€asons:-o The grade of the bridg€ places the car parking and turn-around area, 1'-6'
higher above th€ oxisting grade than an'at grad€" driveway.o The bridge structure provides a direct view of the front of the hous€ and the
garage doors, A curved landscaped driveway obscuring th€ view of the garage
doors is a more pleasing ontry to the property.o There is a real concorn about t're saf€ty of gu€sts cars backing out on a bridge
strustur€ in icy conditions, compar€d with an "at Orade' heated driveway.r We obtained cost €stimates from Harney-Naill Construction to compare an 'at
grade' heated concr€te driveway of the same length as th€ bridg€ structure,
and the bridge structuro.
At grad€ driveway = 918,500
Bridge driveway - $33,800
r Tom advised u8 that the fire department vehicles will not drive onto th€ lot via
a bridg'o structure.
In an attempt to rsach an acceptable compromise our submitted site plan shows the
following revisions:o The driveway has been moved to ths south into a driveway easemont on the
adjacsnt lot,

and the adiacent topography.r The new driveway now requires minimum retaining walls, mostlY thoss are a

with additional evergreen trees (see landscape planl. We are proposing
removing 3 of 9 mature €v€rgr€en tr€es, We are replanting othet small
ovsrgroen troes to new locations. We are proposing 6 new 6'to 8' evergreen
tre€8.e The Town of Vail Works Depanment hae advised us that the culvert under the
adjacont driveway does not ne€d to extend under my clients driveway as only a
small quantity of water will discharge from this culvert and thie can be diverted
by a swail between th6 two lots.r The Town of Vail Works Department has advised us that the two concrete pans
do not need to adioin, allowing for landscape to como up to tho future cul-de-
sac pavement edg8.e We have obtained a report from Rick Herwehe of 'A Cut Above Forestry'
r€portang on tho recommendations for ensuring the health of the retained trees.
