The Planning and Environrnental Commission neeting began at 3:15 p.n.

Kristan Pritz started the staff presentation by giving some backgroundon the reguest. She noted that a side setback variance request had
been approved on June 27, l-988 by the PEC. The variance had been
requested to construct an addition to the Zadeh residence. Concerningthe current request for a rear setback variance, Kristan explained thatthe variance is necessary due to the fact that during construction, the
deck had been changed and extended. The deck now maintains a 2 fooL, 2inch setback from the rear property line and the stairs are 4 inches
frorn the rear property line.
The staff's recommendation was for denial . Although it was concededthat it is unfortunate when mistakes occur in construction, the staffdid not feel that the error in the construction justified an approvalof the variance reguest. No representative for the applicant waspresent. Discussion took place between PEC members and the staff.
Jim Viele made a motion for approval.based on the fact that theadjacent property o\^rner did not object and the fact that the adjacentproperty owner had rnade changes which necessitated the requestedchanges. The notion was seconded by Diana Donovan.
Vote: 2-l--L, Peqqy Osterfoss opposed, Kathy Warren abstaininq.

I.DESCRIPTION OF VARIANCE REQUESTED
On June 27, L988, the Planning and Environmental Conmission

encroached a maximum of 5 feet into the rear setback. Decksare allowed to encroach 7 L/2 feet into setbacks as long asthey are not higher than 5 feet from ground level . The stepsoff of the deck may not encroach more than Z L/2 feet intoany setback.
A variance is needed due to the fact that during construction

Upon review of Criteria and Findings, Section t-8.62.050 ofthe municipal code, the Department of Conmunity Development
reconmends denial of the requested variance based upon thefollowing factors:

The deck and stair encroachment will have verylittle impact on adjacent properties. However, the
, trt staff does believe that more than a 4 inch't . separation frora development on this property andthe property to the east should be maintained.
Apparently, during the construction process, theonner agreed to adjust the location of the deck towork with the adjacent property owner, Mr. RogerTilkeneler. Unfortunately, at that tirne, Mr. Zadehdid not realize that it would create setbackproblens. Please see the attached letter from Mr.Roger Tilkamier supporting the variance request.

The staff does not believe that is appropriate toallow for flexibility in a setback requirernent inthis situation as the encroachments could have beenavoided. ft is unfortunate when rnistakes occur inconstruction. However, the staff cannot condonethese encroachments.

Dear Firooz:
I owe you an apology due to the fact that you are correct thatthe staff did approve a deck addition for your project. Acondition of approval was that the deck be I ft-. in length andL2 ft. in diameter. The deck was also to be located so that 7I/2 ft. was maintained from the base of your stair to theproperty line. The deck was allowed to encroach approxinately 5ft. into the setback per your drawing.
Joe Norris and I visited the site and it appears that the deckhas been built so that the portion of the deck closest to yourneighbor is actually 11 ft. in length. This is a problen ls thedeck is only allowed to encroach 7 L/Z ft. into the setbackarea.
In order to rectify this situation concerning the length of thedeck, we first ask that you subnit an inprovement locitioncertificate indicating exactly where the deck is located on yourproperty. .According to your building perrnit drawings and giventhe dimensions of the deck, it is highly likely ttrat tne aicXencroaches into the setback. rf the deck is found to encroachbeyond the 7 L/2 ft. fron the property line, you must subnit areguest for a setback variance for planning cornnission review.I ask that you address this issue by May 20, 1989.
As we discussed in our office on April 10, you may cut back thedeck to meet your approval and this would solve the problen.

It has been brought to the Cornnunity Developnent Departmentrsattention that the addition you constructed under pernit No.3432 was not built according to ptan. After visiting the site,it is apparent that a deck has been added, the roof slopechanged, and the siding has not been cornpleted per the approvedbuilding pernit plans. In order to rectify this situation, itis reguired that you obtain Design Review Board approval for therevisions. It will also be necessary for you to piovide animprovement survey to verify that ttre deck does not encroach

On June 27, L988, the Zadehvariance for the bedroom and

During the review process, r noticed that the lot is actuallyin the residential cluster zone district as opposed to theprinary/secondary zone district. previous apliovals hadtreated the lot as if it was in a prinrary/seCondary zonedistrict. Due to the faet that the rot is zoned r6sidentialcluster according !9-"gf zoning nap, the GRFA is carculated by
9"!9"_rlling the Sultdable .tea] riinty-five percent of thebuildable area gives you tbe allowable GRFA. Mr. Zadeh wasallowed-to proceed !o-planning conrnission and Design ReviewBoard with the condition that he would submit a surveyi-ndicating forty percent srope areas and froodplain areas onhis property before a building pennit would be released.
Danny corcoran, of Eagre Valrey Engineering, detennined thatLot 2, core creek Meadows fiting t had actually been dividedinto two lots in 1970. At that point, the Towi'r of VaiI had notannexed this area. For this reason, the survey that wassubnitted to identify the buildabre area only iddresses theportion of the property that is owned by Mr.-Zadeh and isreferred to as part of Lot 2, core Creek lleadows Filing 1.This lot or parcer has a total sguare footage of .3385 acres or14'745 square feet. The surveyors deterninia that 1g8 squarefeet of the lot has a slope of over forty percent and 2,i40square feet of the rot is within the 100 year floodplain. whenthese two areas are taken out of the total rot areal you have arenaining buildable area of L2,3L7 square feet. tnil -fzrafz
square feet provides for 3 ro79 sguare feet of arlowable GRFAusing the residential cluster diJtrict density standards.Before the addition was built, l,[r. zadeh had i total GRFA of

I reviewed the zoning for this property with the other TownPlanners on Jury 27, 1999. we deternined that we should treatthe two lots withln Lot 2, Gore Creek lteadows Filing 1, as twoseparate lots having residentiar cruster zoning. we deterrninedthat it wourd not be necessary to send ttr. zad6h back throughthe.variance process due to the addition extending up to ttr6centrar conmon property line between the two rots. this was a

Tom Braun explained the reguests and showed site plans andelevations. He reviewed the criteria, explaining the inter-relatedness of the requests. Tom then discussed the criteriaand findings, the related policies to the Comprehensive plan,
and the concern about valet parking. He explained that thestaff was concerned about the proposal for many reasons. TheyfeLt that tlre mass could be reduced, thereby minirnizing impactson adjacent properties and the public walk way. Anotherconcern rras the interin and perrnanent parking solution. Tomstated that the Action Plan recomrnended a rrsnall infilltt inthis area. ft was felt that the level of development proposed
and the number of variances involved outweighed the benefits,and the staff recomrnended denial of the requests.
Jay-Peterson, representing the applicant, stated that the planenvisioned by the Master Plan proposed parking on the p-2 Lotand Jay felt that these spaces were actually on sj-te, as theywere owned by the Tivoli. He rnentioned that the applj-cantcould have requested an SDD, but without the SDD, nanyvariances were needed. Jay stated that the purpose of theproposal was to up-grade the farnily-owned lodge. He statedthat one purpose of the Action Plan was to increase the numberof acconmodation units. He felt that the Town needed to
encourage proposal.s that added more hotel rooms. fie disagreedwith the staff. Jay added that the parking demand was sirnplynot there. He also added that the view irnpacted was notsacred. Jay fel-t that the proposal nodified views, but did noteliminated then.

building had been pulled back, and that now there was no needfor a setback variance, merely an exterior alteration. Rick
showed the revised site plans and landscape plans. He added
that the applicant had also changed the design at the SkiersSculpture, but that the staff preferred the original design.
The new proposal showed only the addition of trees in this
area.
Torn Briner, representing the applicant, showed a sketch of thewest end of the building with changes. Parn Hopkins expressed
appreciatj.on for the changes made to the building. Sid feltthat the applicant had addressed all of his concerns. Diana
Donovan r,ranted to pass along to the DRB her feeling that nostof the trees should be evergreens, or else if not, thatChristmas lights be placed in the trees in the winter. JirnViele agreed with Diana. He also added that he felt the plan
represented a significant improvenent.
Rick asked the board how they felt about the desiqn at theSkiers Sculpture. They seemed to feel that just f.he additionof the trees vtas O.K. Diana.suggested encouiaging the DRB tosoften the area with the addition of grass.

The Applicant requests a side setback variance from Ehe fifteen foot side
setback required in the Two Fanily Residential District. The proposed
project is to expand the lower level naster bedroom and upper 1evel kitchen
and dining area on the back (south-east) of the existing duplex unit. The
Applicant wishes to expand the above living areas due to the fact that the
cur.ettt 8tx9r kitchen and effectlve floor areas of the dining area (9tx11t)
and master bedroom (10rx12t) have proven i.nadequate for a four bedroon
residence .
The two-level addition would add approximately 360 SF of additional GRFA
to the Zadeh unit. The total a11owable duplex GRFA is 4955 SF. Ttre Zadeh
unit currently has 1865 SF (GRFA) and the adjacent duplex unit has 2255 SF
(GRFA) for a total of 4I2Q SF of existing GRFA. The proposed addition would
bring the toral existing GRFA to 4480 SF, 475 SF under the rnaximum allovable.

Each unit of the existing duplex currently encroaches on the sideyard set-
backs. The existing Zadeh unit is currentl-y+1d' fron the side property
Line at the south corner of the buiLding. The proposed addition would
reduce that distance by approximately Ewo feet. The adjacent duplex unit
constructed an addition in 1978-79 that encroaches on the sideyard setback.
Due to the location of the existing residence on the adjacent Lot 3 and
the existing stand of mature trees Ehat wil-l- not be affected, the APplicant
does not feel that the proposed addition wiLl have a neS,ative inpact on
adjacent structures or properties. 0n the contraryr the addition would
enhance the aesthetics of the building and serve to ttclean uptt the rear
elevation. A11 materials and detailing would be compatible with the exist-
ing building. The lower leve1 is approximately three feet below existing
grade, further reducing the visual impact.
The Applicant does not feel that the proposed variance wil1 constitute a
grant of speci.al priviledge, due to Ehe extraordinary circumsLances of the
site, such as the existing configuration of the building, the adjacent unit
expansion being Located in the setback and sinilar setback variances in the
