Staff has identified a few problems that surfaced a number of times fast summer which can be avoided without. much additional work. with the following policies, we think we canprevent most of these problems. Of the seven policies listed beJ-ow, five simply clarj.fy thepieces of information the Town currently requires. The last twopertain to projects involving setback or height variances or those built by owner/builders. A. Sunrey Policy Clarifications 1. Improvement Location Certificale (ILC) . An ILC will berequired prior to any framing inspections to verifythat height and setback standards have been met. No framing inspections will be scheduLed until the ILC isapproved. Please a11ow two working days from the timethe ILC is submitted to the tirne the inspection can bescheduled. Listed beLow are standards for the information to be shown on the ILC. Architects andBuilders shoul"d be aware that discrepancies exist in established monumentation in the Vail Valley. Please consult a surveyor to verify monumentation prior to developing plans for a site. 2. Format for fLC Information. On the survey prepared forthe framing inspection, indicat.e the highest points ofthe roof ridge using a symbol. Staff will indicate on the approved field set of the building permit drawings which ridge(s) need to be shot. The contractor can then let the surveyor know whatinformation is needed. The roof plan does not need to be drawn on the ILC. The planner will overlay the survey on the approved building permit plans. The roof ridge points identified with the symbol on the ILC should align with the roof plan on the Town's set ofbuilding pernit plans. 3.I Roof Heiqht. On the ILC, the surveyor should note the roof material (if any) on tbe highest point of the ridge which exists the day of the shooting. the planner will add the dirnensions of all other materials (except a cold roof vent) wlrich will be built in the following weeks. For example, if only the ridge beam has been constructed the day of the shooting, the surveyor should note that on the survey and then the planner will add ttre dinensions of the insulation, sheathing, etc. to verify that the finished product will not exceed the height timit. Ridge height will be measured to ttle top ridge of the sheathing. On the attsached diagrams, the point identified with anasterisk is the top ridge of the sheathing. A cold roof vent, not exceeding 12 inches in heightr measured frorn the sheathing to the toP of the shingles, is considered an architecturaf projection and will not be included in the height. A.Setbacks. when specifying the distance of a setback on the ILC, note the material existing on the structure the day of the shooting. Planners wilL then add any wall material to what is shown on the survey ln order to determine the final distance of the setbacks in the same way that tdi1l be done for height. If ledges or supports for rock veneer or any other facing material. have been built into the foundation, measure the setback to that exterior point (see diagram below). Finat distance will be neasured from the outside edgeof the exterior wa11 material . Benchmark. On the ILC, identify the benchmark used for the basis of the elevations. If the same benchmark is used throughout the construction process, the measurement of a building should be consistent. As long as the satne benchmark is used for every shooting, the building can be measured accurately and should not exceed the heigtrt linit. For ovrner/builders, the Town strongly suggests that aregistered surveyor stake out the foundation prior to excavation or pouring. Addltionally, after the foundation walls have been poured, we strongly encourage that a surveyor shoot the elevation of the foundation wa1l. With thj.s information, contractorswil] be able to accurately estimate the final height before the structure is bui1t. Contractors will be able to compensate in the construction process to ensure that t.he structure does not exceed the height 1imit. '1 . For all projects involving varj-ances to the height or setback standards, the suggestions ]isted in Number 5 above will be conditions of approval at the time Planning and Environmental Commission approval isreceived. A1l projects invofving a setback variance must be laid out by a registered surveyor prior to excavation or pouring. A11 projects involving a height variance must be surveyed after the foundation walls have been poured. It appears the intent ig to "streamline" the Procesar not reduce the illowab1e square footage permitted. However by applying the new G.R.F.A. calculition formula without any credits this the result. In Residential Cluster zoning the area of the stair is now included without any off-setting credits. Specifically, in project, Buffehr Creek Townhomes (approved by D.R.B. May 1'1991) the 1991 calculations generate a G.R.F.A. of 7902, whereas the 1990 formula produces a Equare footage of 6926. ObviouEly, a 1000 Equare foot, or 14t reduc€ion is a significant irnpaqt on these five units. Dear Sirs: This is a request to overturn the decision by staff to calculate the G.R.F.A. of residential cluster units'under the 1991 formula without the benefit of the credits applied to the other zone districts. The cover letter written by the office of couununity development on Deceurber 27, 1990 to introduce ordinance 37 (encloied) ligts a number of zone districtE to which the above ipplies; residential clueter is not included; and goee on to state; "TheEe revisions do not aPply to any other zone districta." It appears the intent is to "streartline" the p-roce€rs' not reduce the illowable square footage pernitted. However by applying the nett c.R.F.A. calculAtion formula without any creditg this the result. In Residential Clugter zoning the area of the gtair is nolt included without any off-setting credits. Specifically, in project' Buffehr Creek Townhornes (approved by D.R.B. Uay 1'1991) the 1991 calculationE generate a G.R.F.A. of 7902, whereas the 1990 formula produces a sguare footage of 6926. Obviously, a 1000 square foot, or 14t reduc€ion is a significant i'qpaqt on the,ge five units. Not only does this reduce the value of the remai:ring parcel it adds subltantial cogt to the townhomeg in terms of per:nitting and tap fees. \ f look forward to your reasonable regolution of this issue. No party shall encurnber any portion of the property otherthan its own Allocated Parcel . 6. Prior to commencing construction, the developing partyshall obtain the written aetreement of its general contractor andarl subcontractors that any lien filed by such contractor orsubcontractor sharl attach only to the Allocated parcel of thedeveloping party. 7. fn the event a mechanicts lien attaches to a portion ofthe Property other than the Alrocated parceL of the developingparty, the developing party shall post a bond in compliance witnc.R.s. section 38-22-L3L in order to obtain the release of theIien. whole, . the injured party (after 10 daysr written notice to thedeveloping party) shall have a lien upon the Allocated parcel ofthe developing party, which nay be evidence by a written lienstatement recorded in Eagle County, Colorado, and may be foreclosedthrough a judicial foreclosure. SALE PROCEEDS Each party shall be entitled to receive and dispose of thesale proceeds derived from the sal-e or developrnent of its AlLocatedParcel; provided, however, that the other party shall have areasonable right to reguire the discharge of liens or other encumbrances or liabilities from such sale proceeds to the extentthat such encurnbrances, liens, or liabilities affect the AllocatedParcel of such other party. rX. COOPERATTON 1. Subject to the other provisions hereof, each party shallcooperate with a developi-ng party by executing rezoning or siteplan submittals, subdivision subrnittals or plats, listingcontracts, sale agtreements, or other instruments appropriate toaccornplish the developing party's development of its Allocated Parcel . Notwithstanding the foregoing, such other party shall notbe required to execute construction contracts or loan documents(other than deeds of trust) for the developing party, and shall notbe obligated to execute deeds of trust encu:nbering anything exceptits interest in the Allocated Parcel of the devel-oping paity. 2. A non-developing party agrees to grant the developingparty such easements or use rights upon its Allocated parcel as maybe necessary to pemit ttre conternplated development to occur uponthe Allocated Parcel of the developing party, except to the extentthat any such easement or use right would unreasonably interferewith the development of the Allocated parcel of the non-developingparty. 3. Each party inatt endeavor in good. faith to facilitate andpromote the development activities of the other party. Crossview will cooperate with Buffehr Creekrs efforts toannex Phase r of development to Grouse Glen at vail condomj.niurnsby, among other things, executing such easements or otherreasonable agreements granting Grouse clen the power to use andnaintain the common area of portions of Tract B-L. 6. The parties shall cooperate in the drafting of covenants upon the Property which (subject to the rights of Grouse Glen asdescribed above) will govern the maintenance and use of common Areas of the Property and may establish a homeownerrs associationfor the Property. As presently contenplated, the Common Area willconsist of the undeveloped portions of Tracts B-1 and B-2. X. TAXES AND OTHER ROUTINE CARRYING COSTS 1. Each party shal1 pay real estate taxes upon improvementsconstructed upon its Allocated Parcel , as determined from the records of the Eagle County Assessor. Real estate taxes upon theunderlying land value shal} be prorated between the parties based upon their undivided interests in the Property. 2. Special assessments, Iocal irnprovement district assessments, and similar matters shall be prorated between theparties, to the greatest extent possible, in accordance wit,h theunderlying rationale which determined the anount of the assessment.For example, if an assessment is established on a per unit basis,then the number of units that can be constructed upon each All-ocated Parcel shall be utilized as the basis for apportionment. 3. Any fees or expenses readily allocable to a particularAllocated Parcel or inprovement thereon shatl be paid by the partyto whom such Parcel has been allocated. 4. Each party shall pay, or cause its purchase to pay, realestate transfer taxes arising from the conveyance of such partyrsAllocated Parcel or improvements thereon. 5. Any other routine carrying cost associated with ownershipof the Property, which cannot other*rise be readily or equitablyapportioned, shall be prorated between the parties based upon theirundivided interest in the Property. XI. PARTITTON AND TERMINATTON OF AGREEMENT 1. Each party waives any right to partition the property except in accordance with the terms of this Agreement. In theevent of a partition action, each party agrees that the property sha1l be partitioned in kind, and that the court decree orderingsuch partition shall allocate to each party its Allocated parcei as defined herein. 2. Each party agrees to cooperate with the other inatterupting to obtain the subdivision of the Allocated Parcels. Inthe event that such subdivision is obtained, each party shall deedto the other, by specj.al warranty deed, its interest in theAllocated Parcel of the other and this Agreement shall terminate. 3. Upon the completion of Phase I of development, and uponthe consunnation of the sale of units in Phase I, Buffehr Creek agrees to deed any remaining interest it nay have in the Property .to Crossview by special rilarranty deed, subject, however, to easements, covenants, or other matters which are permitted by this Agreement or which nere consented to by Crossview. This Agreementshall thereupon teminate. 4. ff not sooner teminated, this Agreement shall terminate upon the transfer of all interest in the Property by both of theparties hereto, except to the extent that the transferees of theparties have agreed to be bound hereby and the necessary consentsto assignrnent as provide herein have been obtained. XTI. UTSCELI,ANEOUS 1. Neither party may assign its rights or delegate itsobligations under this Agreement without the prior, written consentof the other party, which consent will not be unreasonablywithheld. 2. In the event one of the parties is in default on thepalanents of any debt secured by any portion of the Property, thedefaulting party shall hold the other party harmless, defend theother party if narned in any resulting action for collection, fullyindennify the other party for costs incurred by such non-defaultinqparty, and grant the non-defaulting party the right to cure anydefault. In the event a party cures a default owed by the otherparty, such cure shall entitle the curing party to receive aninterest in the defaulting partyrs tract in a percentage based onthe anount paid to cure divided by the sum of the original purchaseprice attributed to the tract held by the default,ing party plus thecost of improvements thereon. The right to cure a default owed bythe other party is to be exercised solely at the opt.ion of the non- defaulting party and does not give rise to a responsibility to do so. 6. This Agreement sill not be recorded and the purchasersof individual units or of the Phase II duplex lots wiII take theirinterest free and clear of this Agreenent, nith the exception of the terns herein applied to the conmon Areas. In the report dated April 18, 1979 addressed to Jeff Burleson concerning the drainage on Phase II of The Valley, it'is evident that some type of'drainage system r.lou'l d have to be constructed on Tract A. At this time jt is impossible to determjne vhat kjnd of drainage work would be needed for Tract A rvithout a detailed site plan. The most important point is that drainage work would probably have to be completed' and it would need to function in a compatible way rvith Tract B across the street. Planning and Environmental Commission approvals would also be necessary if it were deterrnined that it r.rould be a feasible idea to develop Tract A separately.
