and the accurateness and integrity of the survey data found on theplat.
Upon receiving two copies of a complete subrnittal along with paymentof the appropriate fee, the zoning adminisLrator shall route one copyof the site nap Lo the town engineer for his review. The zoningadminj.strator shall then conduct this revie$r concurrently. The town
engj-neer shall review the submittaf and return comments andnotifj.cations to the zoning administrator who shall transmit theapproval, disapproval or approval with rnodifications of the platwithin fourteen days to the applicant. The zoning administrator shallsign the plat if approved or require modifications on the plat forapproval or deny approval due to inconsistencies with the originally

G. FILING AND RECORDING
The Department of Conmunity Developnent, wil] record the plat and anyrelated covenants with the Eagle County Clerk and Recorder. Fees forrecording shalf be paid by the applicant. The Conrnunity Development
Department will retain one nylar copy of the plat for their records
and will record the remaining nylar copy.

17.U.010 PURPOSE
It is hereby dec'lared to be the policy of the Town that whenever there is
a major subdivision, which is subdivided for residentlal use on partlal
residential use, the owner of the land shall provide'l and for school needs
generated by the proposed residential use. It is the purpose of this chapter to
require the dedlcatlon of land on the payment of fees ln lieu thereof or both to
fulfill such needs.

require, in lieu of such conveyance of land, the payment in cash by the
subdlvlder of a amount not to exceed the full market value of such sltes and land
areas for schools.
The ful I market value shall mean the current market val ue of unimproved
land. This va'lue shal'l be set annually by the Town Council on an acre basis wlth
recommendatlons from the School Dlstrlct. The same value per acre sha'll be used
throughout the town.
If the subdivider does not agree with the value per acre, the subdivider
may submit the report by a qualified appraiser who is M.A.I. designated, which
establishes a new value. The Town Council shall review the report and determine
lf the value is reasonab'le. Based upon their review, the Town counci'l wilI
determine the value of such land.
When money in lieu of land is required or when monies have been paid to the
Town Council from the sale of such dedjcated sites for schools, it shalI be held
by the Town Council for the acquisition of reasonably necessary sites for the
construct'i on of school facilities, for the construction of employee houslng
required by the school district, for the purchase of employee housing units for
the school district, or for the development of such sites. If housing unlts are
purchased, a deed restriction restricting their use to school district employee
housing shall be requined and ownership sha'l I remain in the name of the School
D'istrlct. A subdivision school dedication shall apply onlyonce to the same land
area. Dedlcation sha'l I not be required of re-subdivisions of the same land on
a dedlcatlon that has previously been made.
Section 17.17.030. Town Exempted.
The Town of Vai'l is specifically exempted from the requlrements of this
chapter 17.17.
Section 2. If any
of thls Ordinance is for
part, section, subsection, sentence, clause, or phrase
any reason held to be invalid, such decision shall not

affect the yalidfty of the remaining pJrtions of this ordinance; and the Town
'council hereby declares it would have passed this Ordinance, and each part,
section, subsectlon, sentence, clause, or phrase thireof, regardless of the fact
that any one or more parts, sections, subsections, sentences, clauses, or phrases
be declared invalid.
Section 3. The Town Council hereby finds, determines, and declares that
this Ordinance is necessary and proper fon the health, safety, and we1fare of the
Town of Vail and the inhabitants hereof.
Section 4. The repeal or the repeal and reenactment of any provision of
the Ual'l Municipa'l Code as provlded ln this 0rdlnance shall not affect any right
which has accrued, any duty imposed, any violation that occurred prior to the
effective date hereof, any section cormenced, nor any other action or proceedings
as commenced under or by virtue of the provision repealed or repealed and
reenacted. The repeal of any provislon hereby shall not revive any provision or
any ordinance previously repealed or superseded unless expressly stated herein.
section 5. Repealer. Al1 bylaws, orders, resolutions, and ordinances, or
parts thereof, inconsistent herewith are hereby repealed to the extent only of
such inconsistency. This repealer shall not be construed to revise any by1aw,
order, resolution, or ordinance, or part hereof, heretofore repealed.

1. Tit'le 18 is hereby amended by the additjon of Chapter 18.67 to read
as fol'lows:
18.67.010 PURPoSE
The purpose of this Chapter ls to provide the procedures necessary to
implement the provisions of Artic'le 68 of Tlt1e 24, C.R.S., as amended.
18.67.020 DEFINITIONS
A. Site specific development plan shall mean and be'limited to a fina'l
majon or minor subdivision plat, or a special development district development
pl an.
B. Vested property right means the right to undertake and complete the
development and use of property under the terms and conditions of the site
specific development p1an, and shall be deened established upon approva'l of a
site specific development pl an.
18.67.030 NOTICE AND HEARING
No site specific development plan shall be approved by the Town Council
or any Town board or commission as applicable, unti'l after a public hearing
proceeded by written notice of such hearing, in accordance with Chapter 8.68
of the Vai1 Municipal Code. Such notlce may, at the option of the Town, be
combined with the notice for any other hearing to be he'ld in conjunction with
the hearing on the site specific development pl an for the subject property.
At such hearing, persons with an interest'in the subject matter of the hearing
sha1 'l have an opportunity to present re1evant on material evidence as
determined by the Town Council or Town board or commission as applicable.
18.67.035 ACTION FOR APPROVAL OF SITE SPECIFIC DEVELOPMENT PLAN -
CONDITIONS
The action of the Town Council or Town board or commission as applicable
for approva'l of a site specific development p'lan sha'l I be in the same form as
that required to approve any request being considered for the subject property
in conjunction with the hearing on the sjte specific development plan, such
action be-ing either by ordinance, resolution, or motion as the case may be.
If any action by any board or comnission ls appea'led to or ca1led up by the
Town Council, approval sha'l 'l be deemed to occur when a final decislon of the
Town Council is rendered approving the site specific development plan. The
approval may include such terns and conditions as may be reasonab'ly necessary
to protect the pub'l ic heal th, safety, and welfare, and the failure to abide by
any such terms and conditjons may, at the option of the Town Counci'l or Town
board or commission as applicable, and after public hearing, resu'l t in the
forfeiture of vested property rights.
18.67.040 APPROVAL . EFFECTIVE DATE
A site specific development plan shall be deemed approved upon the
effective date of the approval action re1 ating thereto by the Town Counci'l or
the Town board or cormission as the case may be.
18.67.045 VESTED PROPERTY RIGHTS - DURATION
A. A property right which has been vested as provided for ln this
Chapter shall remain vested for a period of three (3) years. In the event
amendments to a site specific development plan are proposed and approved' the
effective date of such amendments for purposes of the duration of the vested
property right, shall be the date of the approval of the original site
specific development p1an, unless the Town Councjl or applicab'l e board or
cormission specifically finds to the contrary and incorporates such finding in
its approval of the amendment.
18.67.050 NOTICE OF APPROVAL
Each map, p1at, or site plan or other document constituting a site
specific deve'l opment plan shall contain the following language: "Approval of
this p1 an may create a vested property right pursuant to Article 68 of Title
24, C.R.S., as amended." Fai'lure to contain this statement shall invalidate
the creation of the vested property right. In addition, a notice describing
generally the type and intensity of use approved, the specific parcel or
pancels of property affected, and stating that a vested property right has
been created, shal 1 be published once, not more than fourteen (14) days after
approva'l of the site specific development plan in a newspaper of general
circulation within the Town.
18.67.055 EXCEPTION TO VESTING OF PROPERTY RIGHTS
A vested property right, even though once established as provided in
this Article, precludes any zoning or land use action by the Town or pursuant

to an ini-tiated measure which wou'ld a'l ter, impair, prevent, diminish, or
' otherwise delay the development or use of the property as set forth jn the
site specific developnent plan except:
A. llith the consent of the affected landowners; or
B. upon the discovery of natura'l or man-made hazards on or in the
immediate vicinity of the subject property, which hazards cou'ld not reasonably
have been discovered at the time of site specific development plan approval ,
and which hazards, if uncorrected would pose a serious threat to the public
health, safety, and welfare; or
C. To the extent that the affected landowner receives Just compensation
for all costs, expenses, and'l iabi'l ities incurred by the landowner, lncluding
but not limited to a'l I fees paid in cons'ideration of financing, and all
architectural , p'lanning, marketing, legal , and other consultants fees incurred
after approval by the Town counci'l , or applicab'le town board or cormission,
together with interest thereon at the 1ega1 rate until paid. Just
compensation shall not inc'l ude any diminution ln the value of the property
which is caused by such action.
D. The estab'l ishment of a vested property right pursuant to law sha] 'l
not preclude the application of ordinances or regulations which are general in
nature and are applicable to all properties subject to land use regulation by
the Town of Vail, including but not limited to, building codes, fire,
plumbing, electrical and mechanical codes, housing, and dangerous building
codes, and design review guidelines.
18.67.060 PAYmENT 0F CoSTS
In addition to any and al'l other fees and charges.imposed by the
Mun'icipal code of the Town, the applicant for approval of a site specific
development plan shal'l pay a1 'l costs relating to such approval as a resu]t of
the site specific development plan review including publication of notices,
public hearing, and review costs. At the option of the Town, these costs may
be imposed as a fee of / nO .
18.67.065 OTHER PROVISION UNAFFECTED
Approva'l of a site specific deve'l opment plan shall not constitute an
exemption from or waiver of any provisions of this code pertainlng to the
development and use of property
18.67.070 LIMITATIONS
Nothing in this chapter is intended to create any vested property right,

but.only to implement the provlslons of Article 58 of Tjtle 24, C.R.S., as
amended. In the event of the repeal of said Article or judicial determlnation
that said Article ls invalid or unconstitutional or does not apply to home
rule municipalities such as the Town of Vajl, this Chapter shall be deemed to
be repealed, and the provisions hereof no longer effectlve.
2. If any part, section, subsection, sentence, clause or phrase of this
0rdinance ls for any reason held to be invalld, such decision sha'l I not affect
the validity of the remaining portions of this 0rdinance; and the Town Council
hereby declares it wou'ld have passed thls 0rdinance, and each part, sectlon,
subsection, sentence, c'lause or phrase thereof, regardless of the fact that
any one or more parts, sections, subsections, sentences, clauses or phrases be
dec'lared inva'lid.

1. Dietz, Inc., a Colorado Corporation (rrDeclarantrr) was the
Declarant in that certain Declaration of covenants and Restrictions for
Pinecreek at Vait recorded on March 2L, 1994 in Book 635 at Page 357 of
the real property records in the Office of the Clerk and Recorder of the
County of Eagle, State of Colorado ('rthe Declaration").
2. The Declaration established a Subdivision on the Property (as
defined in the Declaration). Pursuant to the Declaration and Final Plat
Pinecreek at Vail Phase I, Town of Vail, Eagle county, Colorado, the
Property ltas divided into Lot Lrthe Residence (as defined in the
Declaration) thereon and the Remaining Portion of Parcel D.In
Section 2 of the Declaration, Declarant reserved the right to divide the
renaining portion of Parcel D into four additional Lots' and to
construct a Residence on each additiona] Lot and to subject eachadditional I,ot to the terms and conditions of the Declaration.
3. On March L'l , L995 in Book 663 at Page 500 of the land records
of Eagle County, Declarant filed and recorded a First Supplemental
Declaration dividing the Property into Lot 1., Lot 2, I-ct 3,the Residence
constructed on each Lot and the Remaining Portion of Parcel D.
4. Declarant has divided the Property into two additionalLots; Lot 4 and Lot 5. Declarant has constructed a Residence on Lot 4
