SCOPE
This report presents the results of our soils and foundation investigation on Parcel
D, Stevens Subdivision in Vail, Colorado, We explored the subsurface conditions to
provide foundation recommendations for flve single family buildings. This report includes
a descripilon of the subsurface conditions found in our t€st holes, a recommended
loundation system and geotschnical and congtruotion criteria for details influenced by the
subsoils. Our report was prepared from data developed during our field exploration,
laboratory testing, engineering analysis and our experience with similar conditions. A
8ummary of our conclusions is presented below.
SUMMARY OF CONCLUSIONS
1.Our test holes penetrated 0.5 to 1.5 feet of organic, sandy clays above 4.5
to 6.5 feet of very loose to medium dense, moist, clayey sands and silty
sands underlain by dense to very dense, moist sandy gravels with cobbles
and boulders. Drill rig refusal occurred at dePths of 7.5 to 13 teet. No free
groundwater was found in our test holes at the time of drilling.
We recommend founding the buildings with tootings bearing on the native
sandy gravels. A maximum soil bearing pressure is presented in the
"Foundations" section.
Ground level floors in living areas will be loundation supported with a
space betweEn the floor and soils.
A ground surface slope away from the buildings should be maintained at
all times to reduce the risk of wetting soils below foundations.
SITE CONDMONS
Parcel D, Stevens Subdivision is adjacent to Gore Creek at the west end of Vail,
Colorado. The bounds of the +/- 2 acre site are defined by a green fence. The site,
occupies an alluvial terrace formed by Gore Creek. Ground surface slopes are trom the
south to the north at grades measured and visual estimated at I to 16 porcent.

Vegetation consists of medium to large pine and fir trees, small birch trEEs, flowers,
grasses and weeds. Boulders and cobbles ars strewn sparsely on the ground surface.
PROPOSED CONSTRUCTION
Single family residential buildings willbe built. The buildings will be wood framsd,
two to three stories tall with attached garages. No basements are planned. Living areas
of ground level floors will be foundation supported with a space between the floor and
the ground. Foundation loads we assumed for our analysis were between 1000 and 3000
pounds per lineal foot on continuous footings and maximum interior column loads of 'l5
kips. We should be informed if actual construction is ditferent than described above.
SUBSURFACE CONDITIONS

Building ground floor elevations will be stepped to minimize grading. No fill will
be placed below buildings. Site preparation will be limited to stripping of the surficial
organic clays. We estimate stripping depths of 6 to 12 inches.

FOUNDATIONS
In our opinlon, the buildings can be founded with footings bearing on the native
mndy gravels. Footings should be designed and constructed with the following criteria.
1. Footings should bear on the native sandy gravels and be designed for a
madmum soil bearing pressure of SOOO psf. Materials loosened during the
sxcavation or forming process should bE removEd from the footing areas
prior to Placing concrete;
2, Foundation walls for continuous footings should be reinlorced top and
bottom, to span loose soil pockets. we recommend reinforcing steel
equivalent to that required for a simple span of 10leet. Reinforcement
should be designed by a qualified structural engineer;
3. Minimum footing sizes are desirable. we suggest a minimum width of 16
inches tor continuous footings and a size of at least 2 feet by 2 feet lor
isolated column pads. Larger size's may be required based on the
structural loads;
4, The soilE under Exterior footings should be protected lrom freezing. The
depth normal assumEd for frost protection in Vail is 48 inches. we
recommend contacting the local planning department to verifl lhe depth
of protection required.

FLOOR SLABS AND EXTERIOR CONCRETE
Uving areas on ground level floors will be foundation supported with a space
between the floor and the ground. Garage floors, patios and sidewalks will be slabs-on-
grade. We recommend the following design and construction details for slabs'on-grade:

Slabs should be placed directly on native sands or gravels;
slabs-on-grade should be separated from exterior walls and interior
bearing m-embers. Vertical movement of the slabs should not be restricted;
Plumbing below the slabs should be pressure tested. Trench backfill
should bL moisture troated and compacted to at least 95 p€rcent ol the
standard Prostor maximum dry density (ASTM D 698);
Frequent control joints should be provided. The American concrete "
Instiiute (ACl) rec6mmends maximum joint spacing of 15 to 20 feet to
control cracking.

tha solls become wet, but they will reduce the potential damage when movement occurs,
CNAWL SPACE CONSTBUCNON
Below grade walls will be subject to lateral earth pressure. These walls are
,dtdned and cannot move and should be designed for the "at rsst" latEral earth
Fessure. Assuming on-site sands will be used as backfill, we recommend using an
rqulvalent fluid density of 45 pcf to calculate lateral earth pressure. The above equivalent
luid density does not include allowances for sloping backfill, hydrostatic pressures, live
loads or loads from adiacent structures. Backfill adjacent to the foundation walls should
bc compacted to at least 95 percent of the standard Proctor ma:<imum dry density (ASTM
o 6e8).
SJRFACE DRAINAGE
The performance of foundations and concrete flatwork is influenced by the
nFisture conditions in the subsoils. Wening ol soils below foundations can be reduced
by planned and maintained surface drainage. WeUing or drying of the open foundation
cxcavations should be avoided. The ground surface surrounding the buildings should
be sloped to provide rapid runoff of water away from the buildings in all directions, We
tecommend a slope of at least 12 inches in the lirst 10 feet. Backfill of the foundation
walls should be moisture treated and compacted (see "Crawl Space Construction"). Roof
downspouts and drains should discharge well bayond the limits of all backfill. Splash
blocks or downspout extensions should be provided at all discharge locations'

Our test holes were spaced to obtain a reasonably accurate picture of the
subsurface. Variations in the subsurface conditions not indicated by our test holes will
occur. We should observe the completed excavations to confirm the soils ar€ as
antcipated from our test holes.
Our report was based on conditions disclosed by our test holss, results of
leboratory testing, engineering analysis, and our experience. Criteria present€d reflects

WHEREAS, th€ Devoloper, as a condition of approval of the
plans, dated 19_, wishes to enter into a Developer lmprovement
Agreement; and
WHEREAS, the Developer is obligated to provide security or collateral sufficient in the
iudgment of the Town to make rsasonable provisions for completion of certain improvements
set forth below; and
WHEREAS, the Developer wishes to provide collateral to guarantoe performance of
this Agreement, including construction of the above-referenced improvements by means of the
following:
Dweloper agrees to establish a letter of credit with a Bank in Eagle County in a dollar
amount of $-15-000.-00 (125h ot the total cost of the work shown below) to provide
security for the following:

NOW, THEREFORE, in consideration of he lollowing mutual covenants and
agreements, the Developer and the Town agree as follows:
1. The Developer agrees, at its sole cost and expenses, to furnish all equipment
and material necessary to perform and complete all improvements, on or beforeJulv 1' 1996 The Developer shall complete, in a good workmanlike manner, all
improvements as listed abovE, in accordance with all plans and specifications filed in the
office of the community Development Department, the Town of Vail, and to do all work
incidental thereto according to and in compliance with the following:
a. Such other designs, drawings, maps, specifications, sketches, and other mattEr
submitted by the Developer to be approved by any of the abovereferenced
govemmental entities. All said work shall be done under the inspection of, and
to the satisfaction of, the Town Engineer, the Town Building Otficial, or other
official from the Town of Vail, as affected by special distncls or sen'ice dlstrlcts,
as their respective interest may appear, and shall not be deemed complete until
approved and accepted as completed by the Town of Vail Community
Development Department and Public Works Department.
2. To secure and guarantee perlormance of its obligations as set forth herein, the
Developer agrees to provide security and collateral as follows:

FirstBank of Avon (name of bank in Eagle County) as the security for the
improvements set forth above il there is a default under the Agreement by Developer.
3. The Developer may at any time substitute the collateral originally set forth
above for another form of collateral acceptable to the Town to guarantee the faithlul
completion of those improvements referred to herein and the performance of the t6rms of this
Agreement. Such acceptance by the Town of altemative collateral shall be at the Town's sole
discretion.
4- The Town shall not, nor shall any otlicer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occuning to the work specified in
this Agreement prior to the completion and acceptance ol the same, nor shall the Town, nor
any officer or employee lhereof, be liable for any persons or property injured by reason of lhe
nature of said work, but all of said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its otficers, agsnts or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are
based upon any performance by the Developer hereunder; and the Developer shall reimburse
the Town for any and all legal or other expenses reasonably incurred by the Town in
connection with investigating or defending any such loss, claim, damage, liability or action.
This indemnity provision shall be in addition to any other liability which the Developer may
have.
5. lt is mutually agreed that the Developer may apply to the Town and the Town
shall authorize for partial release of the collateral deposited with the Town for each category
ol improvement at such time as such improvements are constructed in compliance with all
plans and specifications as referenced hereunder and accepted by the Town. Under no
condition will the amount of the collateral that is being held be reduced below the amount
necessary to complete such improvements.
6. lf the Town determines, at its sole discretion, that any of the improvements
contemplated hereunder are not constructed in compliance with the plans and specifications
set forth in this Agreement on or before the date set forh in Paragraph 2, the Town may, but
shall not be required to, redeem the lefter of credit as necessary to complete the unfinished
improvements. The Bank shall release such funds upon written request from the Town stating
that the improvements have not been completed as required by this agreement. The Bank
shall not require the concurrence of the developer prior to release of the funds to the Town
nor shall the Bank be required to verify independently that such improvements have not been
completed as required by this agreement, but shall release such funds solely upon the Town's
written request.
lf the costs of completing the work exceed the amount of the deposit, the excess,
together with interesl at twelve percent per annum, shall be a lien against the property and
may be collected by civil suit or may be certified to the treasurer of Eagle Coung to be
collected in the same manner as delinquent ad valorem taxes levied against such property. lf
the permit holder fails or refuses to complete th6 cleanup and landscaping, as defined in this
chapter, such failure or refusal shall be considered a violation of the Zoning Code.
7. The Developer warrants all work and material for a period of one year after
acceptance of all work refened to in this Agreement by the Town if such work is located on
Town of Vail property or within Town of vail right-of-way puruant to section 17.18.2so.
8. The parties herelo mutually agree that this Aoreement may be amended from
time to time, provided that such amendments be in writing and executed by allparties hereto.

TIMING OF OISHONOR
Und€r no circumstances shall Lender be precluded from relying upon any reason for dishonor given in a communication which
Beneficiary or the pres€nter receives within three (3) Banking Days after Lender has received the last docum€nt forming part of
Beneficiary's presentment (the Thr€+'Day P€riod'). Lender shall be enthled to rely upon any such reason without r€gard to either (i) th€
timing of any presentment made bebre th€ Expiration Data, or (ii) the timing inside th€ Three-Day Period of any pr€liminary
communication(s) from Lender concerning the dishonor decision itself or any reason for dishonor. For any such reason so given during
the Three-Day Period, Lender shall be conclusively deemed to have met the 'reasonable time', 'without delay', and other timing
r€ouirem€nts as the Uniiorm Customs and Practice for Documentary Crodits, 19St Revision, ICC Publication No 5OO, as most recently
published by the International Chamber of Commerce (hereinafter called the 'UCP") may impose. Th€ Expiration Date shall not be
extended to accommodate a presentm€nt made with less than thr€e (3) Banking Days to go bofore the Expiration Dat€, and Beneficiary
shall not be ertitl€d to submit a draw requ€st or provide Lender with any documents in support of a dravrr after the Expkation Date
her€of. Nor shall Lender ever b€ r€quired to communicate a dishonor d€cision or its reasons whhin a tim€ less than the Thr€€-Day
period. "Banking Day'' shall mean any day, €xcept Saturday, on which commercial banks located in the state of Lender's address are
either not authorized or are not required to close.
COMPLIANCE BURDEN
Under no circumstances shall Lender be held responsible for any impossibility or oth€r difficulty in achi€ving sirict complianc€ with the
r€guirem€nts of this LEtter ot Credit precisely as written. Beneficiary understands and acknoadedges: (i) tha unless and until the present
wording of this Letter of Credil is amended with Lender's prior written consent, tho burden of complying stricrtly with such wording
remains solely upon Beneficiary; and (ii) that Lender is relying upon the lack of such amendm€rt as constituting Beneficiary's initial and
continu€d approval of such wording.
NON-SEVERABILIry
lf any asp€ct of this Letter of Credit is ever d€clared unentorceable for any r€ason by any court or governmental body having jurisdiction,
LEnder's entire engagement und€r this Letter of Credit shall be deemed null and void ab infio, and both Lender and Ben€ficiary shall be
restored to the position eacfi would have occupied with all rights available as though this Letter of Credit had nev€r occurred. This
non-severability provision shall override all other provisions in this Letter of Credit, no matt€r where such provision appears within the
