PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Application.
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verify (locate) respective
utiliiles prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
NOTE: The above process is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Depaftment, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.

or permanent culverts at access points from the road or street onto the construction

CODE 5-2-10: DEPOSITS ON PUBLIC WAYS PROHIBITED
o Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof,
o Notice; Abatement: The Director of Public Works may notiff and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dift, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
o Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 of this code.
D Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code. (1997 Code: Ordinance 6 (1979).
CODES 7-3A-T AND 7-34-3: PARKING OBSTRUCTING TRAFFIC & IMPOUNDMENT AUTHORIZED
q No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to interfere with the free movement of vehicular traffic or proper

o Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a
street or upon any place within this Municipality in such a manner as to constitute a violation of any
section of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in
addition to a ten dollar ($10) impoundment charge, (Ord. 2(1968) $ 3: Ord. 28(1981) S 1)

burning appliance. Eacfi gas applianc€ MUST USE
a separale vent system. Common vent syslems are
PROHIBITED.
The gfass door assombly MUST ba in place and
sealed, and the tim door assembv lrusf be in
place on the fireplace before the unit can be plac€d
into saf€ operation.
The glass door assembly SHALL O,vly be
replaced as a complete unit, as supplied by the gas
fireplace manufucturer. ,vO SUBSfTfUfE material
may be used.
Tum off the gas before seMcing this appliance. ll is
recommended that a qualifed seNic€ technician
perform an appliance check-up at the beginning of
each heating season.
DO NOT place fumiture or any other combustible
household obiects wilhin 36 inches of the fireplace
fronl.

The fireplace installation must conform to local codes. Before
installing the fireplace, consult the local building code
agency to ensure lhat you are in compliance with all
applicable codes, including permits and rnspections.
In the absence of local codes, the fireplace installation must
conform to the National Fuel Gas Code ANSI 2223.'l (in
the United States) or the CAN/CGA-8149 Installation Codes
(in Canada). The appliance must be electrically grounded
in accordance with local codes or, in the absence of local
codes with the National Electric Code ANSI/NFPA No. 70
(in the United States), or to the CSAC22.1 Canadian Electric
Code (in Canada).
These models may be installed in a bedroom or bed-sitting
room in the U.S.A. and Canada.

High Altitude Installations
U.L. Listed gas fireplaces are tested and approved for
elevations from 0 to 2,000 feet In the U.S.A. and from 0 to
4,500 feet in Canada.
When installing this fireplace at an elevation above 2,000
feet (in the United States), it may be necessary to decrease
the input rating by changing the existing burner orifice to a
smaller size. Input should be reduced four percent (4olo) for
each 1,000 feet above sea level, unless the heating value of
the gas has been reduced, in which case this general rule
will not apply. To identify the proper orifice size, check with
the local gas utility.
When installing this fireplace at an elevation between 2,000
and 4,500 feet (in Canada), the input rating must be reduced
by ten percent (10%).
When installing this fireplace at an elevation above 4,500
feet (in Canada), check with localauthorities.
Consult your local gas utility for assistance in determining
the proper orifice for your location.

Gefting Started
Introducing the Heat-N-Glo Gas Fireplaces
Heat-N-Glo direcl vent gas fireplaces are designed to oper-
ate with all combustion air siphoned from outside of the
building and all exhaust gases expelled to the outside.
The information contained in this /nsfa//ers Gude, unless
noted otherwise, applies to all models and gas control
systems. Gas fireplace diagrams, including the dimensions,
are shown in this section.
Preinstall Preparation
This gas fireplace and its components are tested and safe
when installed in accordance with this lnstallers Guide.
Report to your dealer any parls damaged in shipment,
particularly the condition of the glass. Do not Install any
unit wlth damaged, Incomplete, or substltute parts.
The vent system components and trim doors are shipped
in separate packages. The gas logs may be packaged
separately and must be field installed.
Read all of the Instructlons before startlng the
Installatlon. Followthese Inatructlons carefully during
the installauon to ensure maxlmum safety and benefit,
Fallure to follow theae Instructions wlll vold the
owner's waranty and may present a flre hazard.
The Heat-N-Glo Wananty will be voided by, and Heat-N-Glo
disclaims any responsibility for, the following actions:
. Installation of any damaged fireplace or vent syst€m
component.. Modification of the fireplace or direct vent system.
. Installation other than as instructed by Heat-N-Glo.
. lmproper positioning of the gas logs or the glass door.
. Installation ancuor use of any component part not manu-
factured and approved by Heat-N-Glo, not withstanding
any independent testing laborabry or other party approval
of such component part or accessory.

When planning a fireplace installation, it's necessary to
determine:
. Where the unit is to be installed.
. The vent system configuration to be used.
. Gas supply piping.
. Electrical wiring.
. Framing and finishing details.
. Whether optional accessories-devices such as a fian,
wall switch, or remote control---are desired.
lf the fireplace is to be installed on carpeting or tile, or on
any combustible material other than wood tlooring, the
fireplace should be installed on a metial or wood panel that
extends the full width and depth of the fireplace.

Gonstructing the Flreplace Chase
A chase is a vertical box-like structure built to enclose the
gas fireplace and/or its vent system. Vertical vents that run
on the outside of a building may be, but are not required to
be, instialled inside a chase.

Factory-built fireplace chases should be constructed in the
manner of all outside walls of the home to prevent cold air
drafting problems. The chase should not break the outside
building envelop€ in any manner.
This means that the walls, ceiling, base plate and cantile-
ver floor of the chase should be insulated. Vapor and air
infiltration barriers should be installed in the chase as per
regional codes for the rest of the home. Additionally, Heat-
N.Glo recommends $at the inside surfaces be sheetrocked
and taped for maximum air tightness.
To further preventdrafts, the firestops should be caulked to
seal gaps. Gas line holes and other openings should be
caulked or stuffed with insulation. lf the unit is being in-
stalled on a cement slab, we recommend that a layer of
plywood be placed underneath to prevent conducting cold
up into the room. Be sure to include spark arrestors for
woodburning units if they are required.

Step 1. Locating tfre Fireplace
The following diagram shows space and clearance require-
ments for locating a fireplace within a room.
Glearance Requlrements
The top, back, and sides of the fireplace are defined by
sland-offs. The minimum clearance to a perpendicularwall
extending past the face of the fireplace is one inch (25 mm).
The back of the fireplace may be recessed 21 1/2 inches
(546 mm) into combustible construction.
The distance from the unit to combustible construction
is b be measured from the unit outer wraD surfiace to
the combustible construc'tion. NOT from the screw heads
that secure the unit together.
For minimum clearances, see the direct vent termination
clearance diagrams on pages 24 and 25 in this manual.

Flue Resfictor Insfuctions
1. Remove Exhaust Shield using a 1/4" nut driver by
removing the four screws securing it in place (see
Figure 7).
2,Break the Flue Restrictor into two pieces. Do this
by bending the part back and forth until it breaks
(see Figure 8).

4. Center the Flue Restrictor on vent and secure in
place by using two self-tapping screws (see Fig-
ure 9).
5. Reinstall the Exhaust Shield.
3. Match the amount of vertical you have in the sys-
tem with the chart to find the appropriate position
to set the Flue Restrictor.

B. Installing Vent Components
After determining which set of starting collars will be used
(top or rear), follow venting instructions accordingly.
Venting Out the Rear Vent
Remove the installed rear seal cap from the rear starting
collars by cutting the strap at each end. (see Figure 17).
Follow the vent configuration tables accordingly.
Remove the insulation from the REAR five inch flue. pull
the heat shield out from outside of the firebox.
Venting Out the Top Vent
Remove the two screws in the top ventcollar seal cap and
remove the top vent collar seal cap and two pieces of in-
sulation inside the top two starting collars (See Figure 17).
Remove the heat shield from inside the TOP five inch flue
from outside ofthe firebox.
The glass must be taken off again for positioning the logs
when the unit is finally installed in place and finrshed around
it. Re-install the glass door. Attach vent system to the top
starting collars.
1 . Attach the FlFt Vent Component to the
Starting Collals
To attach the first vent component to the starting collars of
the fireDlace:
Apply a 3/8 inch (9.Smm) bead of stove cement around
the 5 inch ('l27mm) fireplace stiarting collar (see Figure 19).
Make sure that the fiberglass gasket supplied in the
manual bag seals between the first 8-5/8 inch (21 gmm)
vent component and the outer fireplace wrap. Using the
2 selttapping 1/2" screws in the manual bag secure the
gasket to the outer wrap (see Figure 18).

Lock the vent components into place by sliding the con-
centric pipe sections with four (4) equally spaced interior
beads into the fireplace collar or previously instialled com-
ponentend with four (4) equally spaced indented sec{ions.
When the internal beads of each 8-5/8 inch (21gmm)
outer pipe line up, rotate the pipe section clockwise about
one{uarter ('ll4) turn. The vent pipe is no\ / locked bgether.
The first 90" elbow installed in the vent system of a rear
venting fireplace MUST BE in a vertical position.

lnstall the Heat Shleld:
Determine if the heat shield is required. Do so by mea-
suring the vertical distance between the top horizontal
surface of the elbow to any combustible surface above.
lf the distance is more than 4 inches, the heat shield is
NOT required. lf it is 4 inches or less, the heat shield lS
REQUIRED. Install per the following steps. See Figure 20.

2. Fasten the shield in place using the four pilot holes pro-
vided in the part. The shield should be oriented such that
the 13 1/8 inch dimension (longest dimension) is run-
ning in the same direction the elbow is pointing. The
shield should be centered directly above the elboq and
positioned so that it creates a 1/2 inch airspace between
the shield and the combustible surface. See Figure 21.
. lf the combustible materials are not in place at the time
of install the elbow heat shield may be screwed to the
exhaust pipe (see Figure 22). Cut the tabs as shown
and bend down. Using the screws found in the manual
bag secure the heat shield to the pipe maintaining 3" to
4" between the pipe and shield.
Continue adding ventcomponents, locking each succeed
ing component into place.
Ensure that each succeeding ventcomponent is secur+
ly fitted and locked into the preceding component in the
vent system.
90o elbows may be installed and rotated to any point
around the preceding component s vertical axis. lf an el-
bow does not end up in a locked position with the pre-
ceding component, aftach with a minimum of two (2)
sheet metal screws.
3, Install Support Brackets
For Horizontal Runs - The vent system must be supported
every five (5)feetof horizontial run by a horizontal pipe support.
To install support brackets for horizontal runs:
. Place the pipe supports around the vent pipe.
. Nail the pipe supports to the framing members.

4. Install Firestops
For Horizontal Runs - Firestops are REQUIRED on both
sides of a combustible wall through which the vent passes.
NOTE: Model DVK-01TRD does not need an erterior
flrestop on an exterior combustible wall.
To instiall firestops for horizontal runs that pass through
either interior or exterior walls:
. Cut a 12-inch by 12-inch (305mm X 305mm) hole through
the wall.

C. Vent Termination
For Horlzontal Terminations - To attach and secure the
termination to the last sec'tion of horizontal vent:
. Rotate and interlock the ends as described at the begin-
ning of the Installing Vent Gomponents section.
. The termination kit should pass through the wall firestops
from the exterior of the building.
. Adjust the termination cap to its final exterior position on
the building.
For trapezoidal cap termination kits:
. Using screws secure the cap to the exteriorwall through

ForVertical Termlnatlons -To locate the ventand install
the vent sections:
. Locate and mark the vent centerpoint on the underside
ofthe roof, and drive a nail through the centerpoint.
. Make the outline of the roof hole around the centerpoint
nail.
. The srze of lhe roof hole framing dimensions depend on the
pitch of the roof. There MUST BE a 1-inch (25.4mm)clear-
ance from the vertical vent pipe to combustible materials.
. Mark the roof hole accordingly.
. Cover the opening of the installed vent pipes.
. Cut and frame the roof hole.
. Use framing lumber the same size as the roof rafters
and install the frame securely. Flashing anchored to the
frame mustwithstand heavy winds.
. Conlinue to install concentric vent sections up through
the roof hole (for inside vent installations) or up past the
roof line until you reach the appropriate distance above
the roof (for outside terminations).
NOTE: This also peftains to veftlcal vent systems ln-
stalled on the outside of the bulldtng.
To seal the roof hole. and to divert rain and snow from the
vent system:
. Attiach a flashing to the roof using nails, and use a non-
hardening mastic around the edges of the flashing base
where it meets the roof.
. Attach a storm collar over the flashing joint to form a
water-tight seal. Place non-hardening mastic around the
joint, between the storm collar and the vertical pipe.
. Slide the termination cap over the end of the veni pipe
and rotate the pipe clockwise 1/4 turn.

Place the fireplace into position.
Level the fireplace from side to side and front to back.
Shim the fireplace with non-combustible material, such
as sheel metal, as necessary.
Secure the fireplace to the framing by nailing or screwing.
Two types of gas control systems are used with these models:

NOTE: Have the gas supply line installed in accotdance
with local bullding codes by a quallfled installer ap-

NOTE: Before the first firing of the flreplace, the gas
supply line should be purged of any trapped air.
NOTE: Consult local building codes to properly size
the gas supply llne leading to the l/2 inch (13mm)
hook-up at the unit.
This gas fireplace is designed to accept a 112 inch
(13 mm) gas supply line. To install the gas supply line:
. A listed (and Stiate of Massachusetts approved) 1/2 inch
(13mm) tee-handle manual shut-off valve and a listed
flexible gas connector are connected to the 1/2 inch
(13mm) inlet of the control valve. NOTE: lf substituting
for these components, please consult local codes for
comolaance.
. Locate the gas line access hole in the outer casing of
the fireolace.
. The gas line may be run from either side of the fireplace
provided the hole in the outer wrap does not exceed 2 '12"
in diameter and it does not penetrate the actual firebox.
. The gap between the supply piping and gas access hole
can be plugged with non-combustible insulation to pre-
vent cold air infiltration.
. Open the fireplace lower grille, insert the gas supply line
hrough the gas line hole, and con neci itbthe shutoff valve.
. When attaching the pipe, support the control so that the
lines are not bent or torn.
. After the gas line installation is complete, use a soap
solution to carefully check all gas connections for leaks.
. At the gas line access hole, use insulation to re-pack
the space around the gas pipe.
. Insert insulation from the outside of the fireDlace and
pack the insulation tightly to totally seal between the
pipe and the outer casrng.

Step 7. Gas Pressurc Requirements
Pressure requirements for Heat-N-Glo gas fireplaces
are shown in the table below
Aone-eighth (1/8) inch (3 mm) N.P.T. plugged tapping is
provided on the inlet and outlet side of the gas control for a
test gauge connection to measure the manifold pressure.
Use a small flat blade screwdriver to crack ooen the screw
in the center of the tap. Position a rubber hose over the tap
to obtain the pressure reading.
The fireolace and its individual shut-off valve must be
disconnected from the gas supply piping system during
any pressure testing of the system at test pressures in
excess of one-half (1/2) psig (3.5 kPa).
The fireplace must be isolated from the gas supply piping
system by closing its individual shut-off valve during any
pressure testing of the gas supply piping system at test
pressures equal to or less than one-half (1/2) psig (3.5 kPa).

This appliance comes with a 3 volt transformer found in the
manual bag. Plug the transformer leads to the green con-
trol module (see Figure 38). Then plug the hansformer into
the side outlet on the junction box.

Figure 39 shows the minimum verlical and corresponding
maximum horizontialdimensions of fireolace mantels or other
combustible projections above the top front edge of the
fireplace. See Figures 2 and 3 for other fireplace clearances.
Only non-combustible materials may be used to cover the
black fireplace front.
Note: There are 3 metal tabs holding the non-combustible
board in place for shipping. These tabs are to be cut off or
bent back before finishing around the fireplace front.

However, ANSI or CANCGA testing sbndards do nd require
hearth extensions for gas fireplace appliances.

Step 10. Installing Trim, Logs,
and Ember Material
Installing the Trim
Combustible materials may be brought up to the specified
clearances on the side and top front edges of the fireplace,
but MUST NEVER overlap onto the front face. The joints
between the finished wall and the fireplace top and sides
can only be sealed with a 300" F. (149' C) minimum sealant.
Install ootional marble and brass trim surround kits as
desired. Marble, brass, brick, tile, or other non-combustible
materials can be used to cover up the gap between the
sheet rock and the fireplace.
Do not obstruct or modify the air inleUoutlet grilles. When
overlapping on both sides, leave enough space so that the
bottom grille can be lowered and the trim door removed.
Positloning the Logs
lf the gas logs have been factory installed they should not
need to be positioned. lf the logs have been packaged
separately, refer to the instructions that accompany the
logs. Save the log instructions with this manual.
lf sooting occurs, the logs might need to be repositioned
slightly to avoid excessive flame impingement.
Placing the Ember Material
Ember material is shipped with this gas fireplace. To place
the ember material:
. Pull the four glass latches out of the groove on the glass
frame. Remove glass door from the unit (see Figure 42).
Embers CANNOT be placed directly over ports. Care
should be taken not to cover the lighting trail of ports
(from back to front).
When placing Glowing embers onto the burner care
should be taken so that the oorts are not covered. Place
the embers along side the port trail, but not on or in
between the ports (see Figure 43). Failure to follow this
procedure will likely cause lightjng and sooting problems.
Place Mystic embers on areas of base refractory away
from port holes. Use this material to give your fireplace a
realistic ash bed.
Save the remaining ember materials for use during fire-
place servicing.
Replace the glass door and a front trim door on the unit.
Pull out and latch the glass clips into the groove on the
glass frame.

sures as defined by the CPSC. The tempered glass has
been tested and certified to the requiremenb of ANSI 297.1-
1984 and CPSC 16 CFR 1202. (Safety Glazing Certification
Council SGCC# 1595and1597. ArchitecturalTesting, Inc.
Reports 02-31 91 9.01 and 02-31917 .01.)
Thrs statement is in compliance with SPCS 16 CFR Sec-
tion 1201.5 "Certification and labeling requirements" which
refers to 15 USC 2063 stating ".. . Such certificate shall ac-
company the product or shall otherwise be furnished to any
distributor or retailer to whom the oroduct is delivered."
Some local building codes require the use of tempered glass
with permanent marking in such locations. Glass meeting
this requirement is available from the factory. Please con-
tact your dealer or distributor to order.
Step 11. Before Lighting the Fireplace
Before lighting the fireplace, be sure to do the following:
Remove all paperurork from underneath the flreplace.
Revlew safety warnings and cautions
. Read the Safuty and Warnlng Information section at
the beginning of this /nsta//ers Gulde.
Double-check for gas leaks
. Before lighting the fireplace, double-check the unit for
possible gas leaks.
Double-check vent terminations and front grilles for
obstructions.
. Before lighting the fireplace, double-check the unit for
possible obstructions that could be blocking the vent ter-
minations or the front grilles.
Dou ble-check for faulty components
. Any component that is found to be faulty MUST BE re-
placed with an approved component. Tampering with the
fireplace components is DANGEROUS and voids allwar-
ranties.
A small amount of air will be in the gas supply lines. When
first lighting the fireplace, it will take a few minutes for the
lines to purge themselves of this air. Once the purging is
complete, the fireplace will light and will operate normally.
Subsequent lightings of the fireplace will not require this
purging of air from the gas supply lines, unless the gas
valve has been turned to the OFF posltlon, in which
case the airwould have to be purged.
NOTE: The fireplace should be run 3 to 4 hours on the
initial start-up. Turn it off and let it cool completely. Remove
and clean the glass. Replace the glass and run the fireplace
for an additional 8 hours. This will help io cure the chemicals
used in the paint and logs.
Step 12. Lighting the Fireplace
You've reviewed all safety warnings, you've checked the
fireplace for gas leaks, you know the vent system is
unobstructed, and you've checked for faulty components.
Now you're ready to light the fireplace.

Fireplace Maintenance
Although the frequency of yourfireplace servicing and main-
tenance will depend on use and the type of installation, you
should have a qualified service technician perform an appli-
ance check-up at the beginning of each heating season.
See the table below for specific guidelines regarding each

tr Floor plans of the proposed development drawn to scale and fully dimensioned, Floor plans and
building elevations must be drawn at the same scale.o Clearly indicate on the floor plans the inside face of the exterior structural walls of the building.o Label floor plans to indicate the proposed floor area use (i,e. bedroom, kitchen, etc.).o One set of floor plans must be "red-lined" indicating how the gross residential floor area (GRFA) was

Pre-aoolication Meetino
A pre-application meeting with Town of Vail staff is encouraged. The purpose of a pre-application
meeting is to identi$, any critical issues pertaining to the applicantb proposal and to determine the
appropriate development review process for an application. In many cases, the pre-application meeting
helps to expedite the development review process as critical issues are identified and dealt with in the
preliminary stages. A pre-application meeting may be scheduled by contacting Judy Rodriguez at

Time Reouirements
The Design Review Board meets on the 1st and 3rd Wednesdays of each month. A complete application
form and all accompanying material must be accepted by the Community Development Deparunent prior
to application deadlines. A schedule of DRB meetings and associated application deadlines may be found
on the World Wide Web at http://ci.vail.co.us/commdev/olanninq/drb/meetings/default.htm For a new
residential development the application deadline is typically 3.5 week prior to a Design Review Board
hearing.
Review Criteria
The proposal will be reviewed for compliance with the Design Guidelines as set forth in Tltle 12, (Zoning
Regulations) and Title 14 (Development Standards) of the Town of Vail Municipal Code.
Requirements for prooeties located in hazard areas
If a property is located in or adjacent to a mapped hazard area (i,e. snow avalanche, rockfall, debris flow,
floodplain, wetland, poor soils, etc.), the Community Development Department may require a site-specific
geological investigation. If a site-specific Aeological investigation determines that the subject property is
located in a geologically sensitive area, the property owner(s) must sign an affidavit recognizing the
hazard report prior to the issuance of a building permit. Applicants are strongly encouraged to consult
with @mmunity Development staff prior to submitting a DRB application to determine the relationship of
the property to all mapped hazards,
Reouired Plan Sheet Format
For all surveys, site plans, landscape plans and other site improvement plans, all of the following must be
shown.
1. Plan sheet size must be 24"x 36". For large projects, larger plan size may be allowed.
2. Scale. The minimum scale is 1"=20'. All plans must be at the same scale.
3. Graphic bar scale.
4. Nofth arrow,
5. Title block, project name, project address and legal description.
6. Indication of plan preparer, address and phone number.
7. Dates of original plan preparation and all revision dates.
8. Vicinity map or location map at a scale of 1"=1,000' or larger.
9. Sheet labels and numbers.
10. A border with a minimum left side margin of 1.5".
11. Names ofall adjacent roadways.
12. Plan legend.

Desion Review Board Meetino Reouirements
For new construction and additions, the applicant must stake and tape the project site to indicate
property lines, proposed buildings and building corners. All trees to be removed must be taped. The
applicant must ensure that staking done during the winter is not buried by snow. All site tapings and
staking must be completed prior to the day of the DRB meeting.
The applicant, or their representative shall be present at the Design Review Board Hearing. Applicants
who fail to appear before the Design Review Board on their scheduled meeting date and who have not
asked in advance that discussion on their item be postponed, will have their items removed from the DRB
agenda until such time as the item has been republished.
If the DRB approves the application with conditions or modifications, all conditions of approval must be
resolved prior to the issuance of a building permit.
Staff Aooroval
The Administrator (a member of the planning staff) may review and approve Design Review applications,
approve with certain modifications, deny the applicaUon, or refer the application to the Design Review
Board for a decision. All staff approvals are reviewed by the Design Review Board and any staff decision
is subject to final approval by the DRB.
Additional Review and Fees
If this application requires a separate review by any local, state or fuderal agency other than the Town of
Vail, the application fee shall be increased by $200.00. Examples of such review, may include, but are
not limited to: Colorado Department of Highway Access Permits, Army Corps of Engineers 404, etc.
The applicant shall be responsible for paying any publishing fees in excess of 50olo of the application fee.
If, at the applicanfs request, any matter is postponed for hearing, causing the matter to be re-published,
then the entire fee for such re-publication shall be paid by the applicant.
Applications deemed by the Community Development Department to have design, land use or other
issues, which may have a significant impact on the community, may require review by external
consultants in addition to Town staff. Should a determination be made by Town staff that an external
consultant is needed, the Community Development Depanment may hire the consultant. The
Depaftment shall estimate the amount of money necessry to pay the consultant and this amount shall
be forwarded to the Town by the applicant at the time of filing an application. The applicant shall pay
expenses incurred by the Town in excess of the amount forwarded by the application to the Town within
30 days of notification by the Town. Any.excess funds will be returned to the applicant upon review
completion.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Enginee/s (Public Works)
review and approval, a Planning Department review or Health Depaftment review, and a review
by the Building Departmenf the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible,

ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
n The Town of Vail Public WorK Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culvefts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the

CODE 5-2-10: DEPOSITS ON PUBLIC WAYS PROHIBITED
o Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rock, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
tr Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, muc,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any Such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
u Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 14-1 of this code.
o Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-l of
this Code. (1997 Code: Ordinance 5 (1979).
CODES 7-3A-L AND 7.3A-3: PARKING OBSTRUCTING TRAFFIC & IMPOUNDMENT AUTHORIZED
o No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to interfere with the free movement of vehicular traffic or proper
street or highway maintenance. (Ord. 2(1968) $ 1)
o Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a
street or upon any place within this Municipality in such a manner as to constitute a violation of any
section of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in
addition to a ten dollar ($10) impoundment charge. (Ord, 2(1968) $ 3: Ord. 28(1981) S 1)

Applicants requesting the review of additions which require the utilization of an Additional Gross
Residential Floor Area (GRFA) (250 ) requet must also submit a Planning and Environmental Commission
(PEC) application. If the addition requires an Addfional GRFA request, the applicant must receive PEC
approval prior to Design Review Board approval.
I. SUBMITTAL REOUIREMENTS
tr One complete set of e)(istino floor plans or "as-built" drawings with all specifications
shown.
D A preliminary title report, including schedules A and B, to veriry ownership and easernents.
tr Condominium Association approval, (if applicable).
tr Photos of the o<isting structure.
D Specifications of all materials and colors of the addition.
tr Tooooraohic survev, stamped by a licensed suryeyor, at a scale of 1" = 20' or larger, on
which the following infurmation b provided:

be clearly stated on the survey so that all measurements are based on the same
commencsnent point.

cstinute the arnount of money necessary to phy thc consultant and this amount shall be forwardcC to
thc Torvn by thc applicant at the time of filing an application. Expenses incurred by the Town in
excess of the amount ibr*'arded by the appiication shall be paid to thc Town by the appiicant within
30 days of notification by the Torvn. Any excess funds will bc retr.imcd to the applicant upon review
