Ms. Connelly:
Re: Del Patterson, Snow Fox Condominiums, 1030 Lionsridge Loop, Unit #2O3, Yall, Colorado
This unit *as "red tagged" by the Town of Vail in the past for enclosing the open dock with glass panels and
thereby increasing the GRFA of this unit. The panels in Unit 203 were then removed and further prosecution was
dcferred. The glass panels have now been reinstalled contrary to thc ageement with the town
When I owned and lived in Unit 103, I applied to the town for appropriate approval to install sirnilar glass panels
and was not approved. Sincc I would not enclose my dcck without approval. it was not donc. Do we have selective
enforcement here?
I would appreciate you're keeping mc informed of your enforcement in this matter. Thank you.

REs Snow Fox Condominiun Unit 202Balcony Enclosure
Dear l.lr. Stanek:
The purpose of this letter is to convey the snow Fox condoniniurnAssociation's prior approvar of the enclosure instarled on thebalcony of Unit 202.
rrom my recorlection, the enclosure was instalred in 1988 or thereabout. The generar concept of allowing encrosures was approved inthe Janualy 20, 1990, Annual Meeting of Owners of the Snow FoxCondominiung. Subseguent to that, the Board decided that allfuture enclosures were to be of the tlpe and etyle installed inUnit 202 to asgure a uniform appearance-for the building. As such, the installation done on unit 212 was essentiarry ,'granld fatheredi'by the Association.
rt is uncertain whether there is sufficient remaining GRFA that theTown of vail wourd allow the rernaining 15 unitg to- encrose theirbalconies in a sinirar way, however, the Association has no currentreguests frorn any Owners to do so.
Please call either myself at (303) 355-7527 or BilI Sargent, ofCrossroads Realty, Ltd, the Association,s llanaging Agent, at 4ZG-4300 if you need further assistance.
Sincerely,
Atu

Dear lls. Patterson:
It has been brought to our attention that you have enclosed your
deck. our records do not show approval by the Design Review Board
for this addition. Further, no building perrnit was obtained for
this construction. Our department has placed a rrred tagrr upon your
unit which indicates that these approvals must be obtained or the
construction must be removed.
In a previous request to enclose a deck, staff learned fron the
condoroinium map and declarations that the deck was a l.inited conmon
element, owneiship of which rested with all of the condoninium
owners, and as such, could not be enclosed for the use of one olrner
exclusively. Further, the snow fox condominiun Association did not
wish to give approval to the owner to use part of the rernaining
allowable gross residential floor area (GRFA).
l{e are requiring that a request for approval be subnitted to this
office by friday, March 8, 1991. In order to determine whettrer or
not this reguest can be approved, we will need the following:
1. A Letter of approval from the condoniniun association

Re: Addition to Snow Fox Unit #j.02
Dear llarvin:
As r tol'd you during our.phone conversation on February 23rd, theTown Attorney, Larry Eskwith, has exanined the snord Fox Londorniniurndecraratj-ons and the condoninium map and has deternined that youare not the owner of the deck area of Unit #102. The deck isdefined in the condominiurn declarations as a limited "orronelement, and although you have the use of the deck, ownership ofthe deck rests with all the condorniniurn owners of the snow FoxCondominiums.
consequently, the Town of vail cannot issue a building pernit forconstruction on property which you do not own.

Re: Unit 202, Snow l.ox
Dear BilI:
rt has been brought to our attention that ttre owner of Unit 2o2,
Ms. Del Patterson, has enclosed her deck. Our records do not show
approval of the Design Review Board for the enclosure of this deck.
f'urther, no building pernit was obtained for this construction. we
have placed a rrred tagrr upon this unit which indicates that these
approvals rnust be obtained or the construction nust be renoved.
In February 1990, Mr. llarvin Sirnon of Unit 102 requested to enclose
his deck. He applied for approval frorn the Design Review Board.
However, it was found that were two reasons why this could not be
done. The first reason was that Mr. Simon would have been
enclosing portions of a lfunited cornnon element, ownership of which
rested with all of the condoninium ohtners. The second reason hras
that the rr25o ordinancerr could not be used as exterior space in a
nulti-fanily dwelling.Further, the snolt Fox Condomlniurn

)
Associatj-on did not wistr to give l,!r. Simon pernission to use 142
sguare feet of Gross Residential Floor Area (GRFA). (The Snolt Fox
Condoniniuns have approxirnately 1r229 sguare feet of GRFA rertainingto be used. fhis anount coutd change if the zoning code is
changed. )
we are reguiring that a request for approval be Eubnitted to this
office by Friday, March 8, 1991. we have written Ms. Patterson to
this effect. In order to detennine whether or not this request can
