Note: Effective September 1, 1997, CRS 30-10-406 requires that all documents received for recording or filing

rnargin ofat least one halfofan inch. The clerk and recorder rnay refuse to record or file any document that
does not conform, except that, the requirement for the top rnargin shalt not apply to documents using forms

Note: Colorado Division of lnsurance Regulations 3-5-1, Paragraph C of Article VII requires that 'Every
title entity shall be responsible for all matters which appear of record prior to the time of recording
whenever the title entity conducts the closing and is responsible for recording or filing of legal
docuoents resulting from the transaction which was closed". Provided that Land Tide Guarantee
Company conducts the closing of the insured tnnsaction and is responsible for recording the

C) The Company must receive an appropriate affidavit indennifring the Company against un-filed
mechanic's and material-men's liens.
D) The Company must receive payment of the appropriate premium.
E) If there has been construction, inprovements or rnajor repairs undertaken on the property to be purchased
within six months prior to the Date of the Commitnetrt, the requirements to obtain coverage
for unrecorded liens will include: disclosure of certain construction information; financial information
as to the seller, the buildet and or the contractor; payment of the appropriate premium fi.rlly
executed Indemnity Agreements satisfactory to the company, and, any additional requirements
as may be necessary after an examination of the aforesaid information by the Company.
No coverage will be given under any circrrmstances for labor or material for which the insured
has contracted for or agreed to pay.
Note: Pursuant to CRS l0-11-123, notice is hereby given;
This notice applies to owner's policy commitments containing a mineral severance instrument
exception, or exceptions, in Schedule B, Section 2.
A) That there is recorded evidence that a mineral estate has been severed, leased, or otherwise

The Town Staff has preliminarily reviewed the setback variance and design review applications
for the proposed garage addition and renovations lo 1673 Matterhorn Circle. To allow the Staff
to complete their review of this proposal, the following additional information and revisions musl
be submitted to complete these applications:
1. Submit a stamped, topographic survey.
2. Submit a site-specific geologic hazard report, prepared by a registered geologist or
protessional engineer, addressing the debris flow hazard on the site and the provisions
of Chapter 12-21 , Hazard Regulations, Vail Town Code.
3. The site plan must be revised as follows:. Label the lot size in square feet.. Show all existing and proposed easements.. Show all existing and proposed grades.. Show all existing and proposed roof ridge and eave elevations. For building
height calculation purposes, show all existing and proposed grades
underneath all rool lines.. Show all proposed driveway grades; including percent slope and spot
elevations at the property line, garage slab, and as necessary along the
centerline of the driveway.. Show the locations of all utility sources and service lines.. Show the surlace drainage on and off-site.. Show all snow storage areas and label the area sizes in square feet.. Delineate all required parking spaces with a 9'x18' box for inlerior spaces and
a 9'x19' box for exterior spaces.. Show the proposed fence.. Show lhe Matterhorn Circle edge of asphalt.. Submit site coveraoe calculations.

4. The landscape plan must be revised as follows:. Submit landscape area calculations.. Show all existing and proposed grades.. Show all existing and proposed lrees, shrubs, and ground cover.. Provide a detailed legend listing plant material types and sizes.
5. The floor plans must be revised as follows:. Submit one set of "red-lined" floor plans showing how the GRFA (gross
residential floor area) was calculated in accordance with the provisions of
Chapter 12-15, GRFA, VailTown Code.r Specifications must be show for any crawlspace, attic, or vaulted space
deducted from the GRFA calculations.
6. The elevations musl be revised as follows:. Show existing and finished grades.. Show roof line and ridge elevations.. Show the utility meters and screening.
7. Submit an exterior lighting plan indicating the type, location, number of fixtures, height
above grade, and luminance calculations.
8. The proposed garage rool form should be re-evalualed to minimize the amount of
building bulk and mass being requested within the required setback area.
Please submit revised plans to the Town of Vail Department ol Community Development
addressing the above listed items. These applications will be scheduled for review by the Town
of Vail Planning and Environmental Commission and Design Review Board after these
necessary revisions have been submitted.

Dear Stuart,
The Town Staff has reviewed the revised design review application lor the proposed exterior renovation
to 1673 Matterhorn Circle. The following is a summary of the comments lrom that review:
1. The revised site plan and landscape plan were not printed at scale and musl be resubmitted.
2. A completed Utility Approval and Verilication lorm must be submitted.
3. A Revocable Right-otWay Permit application must be submitted for all existing and proposed
improvements located with the Matterhorn Circle right-of-way.
4. All utility meters and associated conduit must be painted to match the building.
5. The site olan must be revised as lollows:o Accurately show the proposed roof plan. Please be aware that new roof eaves shall
not extend more lhan 4 feet into a required setback.o Delineate all exterior parking spaces with a 9'x19' box.. All parking spaces must be located within the property boundaries and shall not
overhang into the Matterhorn Circle right-of-way or the adjacent Lot 22.. All snow storage must be accommodated wiihin the property boundaries and shall
not be located within the Matterhorn Circle right-of-way.. The top-of-wall (TOW) and bottom-of-wall (BOW) elevations must be labeled for the
proposed retaining wall. Please be aware that that PE stamped engineering
drawings must be submitted for any retaining wall over 4leet in height.. The parking area must be labeled as "snowmelt heated" or "unheated".. The concrete pan shall be a 4 foot pan with a 2 inch invert.. Label the limits of disturbance fence.. Any new ground level deck or porch shall not encroach more than /z the minimum
required dimension into the required setback. Any new deck or porch projecting
more than 5 leet above grade shall not encroach more than 5 feet into the required
setback.. All above grade utility service lines must be buried.
6. The'red-lined" floor plans and GRFA calculations must be revised as follows:. Floor-to-ceiling heights must be labeled for the "open to below" areas on the upper
level. Any portion of the structure with a floor-to-ceiling heighl ol 16 or more feet in
height shall be calculated al two-stories ol GRFA.. The staiMays on the upper level must be included in the GRFA calculations.

TOV variance lequest statement - 1673 Matterhorn Circle

The following variance request statement is in regards to the existin$ duplex propefi located at
1673 Matterhorn Circle, Vail, Colorado. The variance reguest is twcfold. To improve the quality of
entry into each duplex unit, as well as the quality of the street fuqade, we are proposing to relocate
the front door of each unit to the front elevation of the existing building. This will include the
reconstruction of the existing upper level balconies as $/ell as the construction of a nerv front porch
at each unit. As the existing building balconies are already extendin€l beyond the dlnent buildin$
envelop and no new square footage will be added at the front of the home, we propose that this
violation of the front settack will present no additional complications beyond those which
currently exist.
In regards to the complications which do exist at the front of the propefi (and in the neighborhood
in general), lack of offstreet parking would be considered by most to be of primary concern. We
are proposing the construction of a new sin€lle car garage to be placed on the west side of the
home within the existinElside setback. This would provide one additional offstreet parkang space
as well as a deeper parking apron in front of the gara€le for trvo additional vehicles to park. This
would bring the duplex one parking space clooer to meeting existing code required parking spaces.
The existing home to the west would obviously be most affected by this new construction, but due
to its lower grade and the sighificant distance which exists between the two homes, we feel this
ampact would be minimal and the benefit to the parking situation of the neigfiborhood as a whole
would justify this variance request.
Lastly, an existing power line crcses the location of the proposed g',rage location, but a minor
relocation or heigfit modification would allow both to coexist at the west side of the proposed lot.

The Town Statf has preliminarily reviewed the setback variance and design review applications
for the proposed garage addition and renovations to 1673 Matterhorn Circle. To allow the Stafl
to complete their review of lhis proposal, the following additional information and revisions must
be submitted to complete these applications:
1. Submit a stamped, topographic survey.
2. Submit a site-specific geologic hazard report, prepared by a registered geologist or
professional engineer, addressing the debris flow hazard on the site and the provisions
of Chapter 12-21 , Hazard Regulations, Vail Town Code.

4. The landscape plan must be revised as follows:. Submit landscape area calculations.. Show all existing and proposed grades.. Show all existing and proposed trees, shrubs, and ground cover.. Provide a detailed legend listing plant material types and sizes.
5. The floor plans must be revised as follows:. Submit one set of "red-lined" floor plans showing how the GRFA (gross
residential floor area) was calculated in accordance with the provisions of
Chapter 12-15, GRFA, VailTown Code.. Specifications must be show for any crawlspace, attic, or vaulted space
deducted from the GRFA calculalions.
6. The elevations must be revised as follows:. Show existing and linished grades.. Show roof line and ridge elevations.. Show the utility meters and screening.
7. Submit an exlerlor lighting plan indicating the type, location, number of fixtures, height
above grade, and luminance calculations.
8. The proposed garage roof form should be re-evaluated to minimize the amount of
building bulk and mass being requested within the required setback area.
Please submit revised plans to the Town of Vail Department of Community Development
addressing the above listed items. These applicalions will be scheduled for review by the Town
of Vail Planning and Environmental Commission and Design Review Board after these
necessary revisions have been submitted.

Dear Stuart.
The Town Staff has reviewed the revised desiEn review application for the proposed exterior renovation
to 1673 Matterhoin Circle. The lollowing is a summary of the comments from that review:
1. The revised site plan and landscape plan were not printed at scale and must be resubmitted.
2. A completed Utility Approval and Verification form must be submitted.
3. A Revocable Right-of-Way Permit application must be submitted {or all existing and proposed
improvements located with the Matterhorn Circle right-ol-way.
4. All utility meters and associaled conduit must be painted to match the building.
5. The site plan must be revised as follows:. Accurately show the proposed roof plan. Please be aware that new roof eaves shall
not extend more than 4 feet into a required setback.r Delineate all exterior parking spaces with a 9'x19' box.. All parking spaces musl be located within the property boundaries and shall not
overhang into the Matterhorn Circle right-of-way or the adjacent Lot 22.. All snow storage must be accommodated within the property boundaries and shall
not be located within the Matterhorn Circle right-oFway.. The top-of-wall (TOW) and bottom-otwall (BOW) elevations must be labeled for the
proposed retaining wall. Please be aware that that PE stamped engineering
drawings must be submitted for any retaining wall over 4 feet in height.. The parking area must be labeled as "snowmelt heated" or "unheated".. The concrete pan shall be a 4 foot pan with a 2 inch invert.. Label the limits of disturbance fence.o Any new ground level deck or porch shall not encroach more than /a the minimum
required dimension into the required setback. Any new deck or porch projecting
more than 5 feet above grade shall not encroach more than 5 feet into the required
setback.. All above grade utility service lines must be buried.
6. The "red-lined" floor plans and GRFA calculations must be revised as follows:. Floor-to-ceiling heights musl be labeled for the "open to below" areas on the upper
level. Any portion of the structure with a floor-to-ceiling height of 1 6 or more leet in
height shall be calculated at two-stories of GRFA.. The stairways on lhe upper level must be included in the GRFA calculations.
