General Information:

existing landscaping, gardening and landscape maintenarpe shall be exempt from this provision.

continue or complete work that has not received design approval as prescribed in this chapter andor is

board and the buiHing official.
C.Nonoonforming Sites And Structures; Effect Od Design Guldelines:
1. Buildings and sites whic-h are not in conformance with the design guidelines, due to annexations or
charges in code ptu/isions (i.e., legal nonconbrmities), shall be requircd to conform with the design
guidelines when alloruable gross residential floor area (GRFA) (the GRFA that is permitted by the density
control section of varicrs zme distdr:b), commercial floor area, or garage area credit is added to any
existing structura or site.
2. From the etfective date of July 21, 1998, there shall be permitted a one-time exclusion from this
provision for an expansion to single-family, two-family, and primary/secondary residential dwelling units.
This onetime exclusion shall be allowed for a single expansion of frve hundred (500) square feet or less of
allolable GRFA or garage area credit per dyvellirp unit. In which case, structures may be epanded
without rcqlirirtg upgrades to entire strucfilrer and siles to conform to the design guidelines. The addition
itself, however, shall conform to the design guidelines. An expansion which is greater than five hundred
(50O) square fe€t, or any subsequent expansion to a structure, regardless of size, shall require full
compliance of the dwelling unit with the design guidelines.
3. General maintenance and upkeep of a prope(y shall mntinue to be required regardless of the amount
of floor area added io a structure. The one-time exclusion noted above shall not preclude the design
review board, pursuant to the design guidelines, from requiring landscaping and other improvements
necessary to buffer or mitigate development impacts associated with the expansion/remodel.
4. Expansions rnade pursuant to sec{ion 12-'15-5 of this title shall require full compliarrce of the entire
dwelling unit with the design guidelines. Interior conversion additions pursuant to section 12-15-4 of this
tiile shall not trigger the requirement for upgrading sites and structures to fully comply with the design
guidelines, unless it can be classified as a 'demc/rebuild", pursuant to section 12-2-2 of this title. (Ord. 29

Note: Effective September 1, 1997, CRS 30-10-406 requires that all documents received for recording or filing
in the clerk and recorder's office shall contain a top margin ofat least one inch and a left, right and bottom
margin of at least one half of an inch. The clerk and recordel mey refuse to record or file any document that' does not conform, except that, the requirement for the top margin shall not apply to documents using forms
on which space is provided for recording or filing information at the top margin of the document.
Note: Colorado Division of Insuralce Regulations 3-5-1, Paragraph C of Article VII requires that "Every
title entity shall be responsible for all matters which appear ofrecord prior to the time of recording
whenever the title entity conducts the closing and is responsible for recording or filing of legal
documents resulting from the transaction which was closed". Provided that Land Title Guarantee
Company conducts the closing of the insured transaction and is respolsible for recording the

D) The Company must receive payment of the appropriate premium.
E) If there has been construction, improvements or major repairs undertaken on the property to be purchased

for unrecortled liens will include: disclosure of certain construction information; financial infonnation
as to the seller, the builder end or the contractor; payment of the appropriate premium fully

as may be necessary after an examination of the aforesaid information by ihe Company.
No coverage will be given under any circumstances for labor or ruterial for which the insured
has contracted for ot agreed to pay.

for the removal of three to four cottonwood trees on your property. Any proposal to remove the trees or
any other tandscaping would require the submittal of a Design Review application, which woutd need to
be'reviewed ny stbff inO approved by the Design Review Board or staff. In previous site visits I have
observed the three to four cotton*oois you would like to possibly r€move. I believe they are between
25 and 30 feet in height. I would suggest that an appropri'ate_replacement for the removed trees would
be a total of three to four euergtee-t1i ranging from 12 to 15 feet in height and three to four aspens
ranging 3 inches in caliper or g-reater. ThEse trees could be located all upon your property or some
could be located on the neighSoring property to the west, The overall goal should be to. replace the

Firstly, thank you for aftending the Design Review Board meeting held on September 20, 2006. I
apologize for my last minute absence, as several of my colleagues and I were forced to depart early
due to weather concerns for a professional conference on the Western Slope.
However, Warren Campbell informed me about the progress made at the meeting, which is congruent
with the information I conveyed to you previously: the desire of Staff and the Design Review Board that
the length of the parking area at the front (south) of the residence be reduced in size. From my
understanding, you are amenable to this request, but have requested some time to reevaluate the
proposal. I will wait to hear from you regarding any changes to the application. My hope is that upon
iesubmittal of the plans, I may review them at a Staff level to ensure that the requested changes have
been made. lf this is the case, we may be able to avoid attending another Design Review Board
meeting.

CONCEPTUAL DESIGN REVIEW
SUBMITTAL REQUIREMENTS
GENERAL INFORMATION
The conceptual review is intended to give the applicant a basic understanding ofthe compatibility of
the proposal with the Town's Design Guidelines. The DRB does not vote on conceptual reviews.
Complete applications must be zubmitted two (2) weeks prior to a scheduled DRB meeting.
I. SUBMITTAT REQUIREMENTS
A conceptual site and landscape plan at a minimum scale of 1"=20'or larger;
Conceptual architectural elevations showing exterior materials and a description of the; character of the proposed structure or structures;
Completed DRB application form.
Written approval from a condominium association, landlord and joint owner(if
applicable).
II. PROCEDURE
Upon receipt of an application for conceptual design review, the Department of Community
Development shall review the submitted materials for general compliance with the appropriatd
requirements of the zoning code. If the proposal is in basic compliance with the zoning code
requirements, the project shall be forwarded to the DRB for conceptual review. If the application
is not generally in compliance with zoning code requirements, the application and submittal
materials shall be returned to the applicant with a written explanation as to why the Community
Development Department staff has found the project not to be in compliance with zoning code
requirements,
Once a complete application has been received, the DRB shall review the submitted conceptual
review application and supporting material in order to determine whether or not the project
generally complies with the design guidelines. The DRB does not vote on conceptual reviews.
UI. DESIGN REVIEW BOARD MEETING REOUIREMENTS
For nefv construction and additions, the applicant must stake and tape the project site to indicate
property lines, proposed buildings and building corners. All trees to be removed must be taped.
The applicant must ensure that staking done during the winter is not buried by snow' All site
tapings and staking must be completed prior to the day of the DRB meeting.
The applicant, or their representative, shall be present at the Design Review Board Hearing.
Applicants who fail to appear before the Design Review Board on their scheduled meeting date
and who have not asked in advance that discussion on their item be postponed, will have their
items removed from the DRB aqenda until such time as the item has been republished,

twelve feet (12'). However, other roof forms are allowed. Consideration of environmental and
climatic determinants such as snow shedding, drainage, and solar exposure should be integral to
the roof design.
5. Roof lines should be designed so as not to deposit snow on parking areas, trash storage areas,
stairways, decks and balconies, or entryways. Secondary roofs, snow clips, and snow guards
should be utilized to proteot these areas from roof snow shedding if necessary.
6. The use of wood shake, concrete tile, slate, metal, asphalt shingle, fiberglass shingle, and builfup
tar and gravel roofing may be pennifted. Metal roofing, when permitted, shall not reflect direct
sunlight onto an adjacent property and shall be surfaced with a low-gloss finish or be capable of
weathering to a dull finish. Metal roofing, when permitted, shall be ofa heary gauge and designed
to provide visual reliefto the roof surface (including but not limited to a standing seam). Asphalt
and fiberglass shingles, when permifted, shall weigh no less than three hundred (300) pourds per
roofing square. The use of rolled roofurg shall not be permitted.
The use of any roofing material, including those not specifically identified by this Section, shall
only be permitted, unless otherwise prohibited by this Code, where the Design Review Board finds:
a. that the proposed rnaterial is satisfactory in general appearance, quality over time, architectural
style, design, color, and texture; and,
b. that the use of the proposed material complies with the intent ofthe provisions of this Code;
and,
c. that the use of the proposed material is compatible with the structure, site, surrounding
structures, and overall character of the Town of Vail.
'1. Rooftop heating and air conditioning equipment, large vent stacks, elevator penthouses and similar
features should be avoided; however, if necessary, shall be designed to be compatible with the
overall design of the stucture or screened from view of all adjacent properties. Rooftop antennas
shall not be permitted unless as allowed under a conditional use review as specified within the
Zoning Code.
8. Solar collectors shall lie flat on pitched roofs; however, when retrofitting an existing building with
active solar, the collectors should be designed and placed in a manner oompatible with the overall
design of the building.
9. Deep eaves, overhangs, canopies, and other building features that provide shelter from the
elements are encouraged,
10. Fenestration should be suitable for the climate and for the orientation of the particular building
elevation in which tle fenestration occurs. The use of both passive and active solar energy systems
is strongly encouraged.
I 1. In no instance shall a duplex structue be so constructed as to result in each half of the structure
appearing substantially similar or mirror image in design.
12. Building footings and foundations shall be designed in accordance with the minimum standards of
the adopted building code. Footings and foundations shall also be designed to be responsive to the
natual topography of the site, and shall be designed and constructed in such a manner as to
minimize the necessary amount of excavation and site disturbance.
Residentirl Development:
l. The purpose of this Section is to ensure that residential development be designed in a marmer that
creates an architecturally integrated sfucture with unified site development. Dwelling units and
garages shall be designed within a single structure, except as set forth ia subsection 2 below, with
the use of unified architectural and landscape design. A single structure shall have comrnon roofs

and building walls that create enclosed space substantially above grade. Unified architectural and
landscape design shall include, but not be limited to, the use of compatible buildiag materials,
architectural style, scale, roof forms, massing, architectural details, site grading and landscape
materials and features.
2. The presence of significant site constraints may permit the physical separation ofunits and garages
on a sile. The determination of whether or not a lot has significant site constraints shall be made
by the Design Review Board. Significant site constraints shall be defined as natural features of a
lot such as stands of mature trees, natural drainages, stream courses and other natural water
features, rock outcroppings, wetlands, other natural features, and existing structures that may
create practical dificulties in the site planning and development of a lot. Slope may be considered
a physical site constraint that allows for the separation of a garage Aom a unit. It shall be the
applicant's responsibility to request a determination from the Design Review Board as to whether
or not a site has significant site constraints before final design work on the project is presented.
This determination shall be made at a conceptual review of the proposal based on review of the
site, a detailed survey of the lot and a preliminary site plan of the proposed structure(s).
3. The residential development may be designed to accommodate the development of dwelling units
and garages in more than one structure if the Design Review Board determines that significant site
oonstraints exist on the lot. The use of unified architectural and landscape design as outlined
herein shall be required for the development. In addition, the Desigrr Review Board may require
that one or more of the following cornmon design elements such as fences, walls, patios, decks,
retaining walls, walkways, landscape elements, or other architectural features be incorporated to
create unified site deve lopment.
Outdoor Lighting:
l. Purpose:
This subsection of the design guidelines establishes standards for minimizing the unintended and
undesirable side effects of outdoor lighting while encouraging the intended and desirable safety and
aesthetic pqposes of outdoor lighting. It is the purpose of the design review guidelines to allow
illumination which provides the minimum amount of lighting which is needed for the property on
which the light sources are located. In addition, the purpose of this subsection is to protect the
legitimate privacy of neighboring residents by controlling the intensity of the light source.
2. Approval Required:
All outdoor lighting within the Town limits shall conform to the standards set forth below. For the
purposes of this subsection, residentially zoned properties shall be defined as those in Hillside
Residential, Single-Family, Two-Family, Primary/Secondary, Residential Cluster, Low Density
Multi-Family and Medium Density Multi-Family Zone District, as well as all special development
districts which have any of the above referenced zone districts as the underlying zoning. All other
zone districts shall be considered, for the purposes ofthis subsection, as being commercial zoned.
3. Luminance:
Light sources located on all property in the Town which are not fully cutoff shall exhibit a ratio of
source lumens to luminous area not exceeding 125. For example:

A single artificial point source of luminescence that emits measurable radiant energy in or near the
visible spectrum.

Amendment to the 20O2 N.E.C. Town of Vail Ordinance 4, Series of 2O05
Overhead seruices are not allowed in the Town of Vail.
Underground seruices shall be in conduit (PVC) from the utility transformer to the electric meter, main
disconnect switch, and to the first electrical distribution circuit breaker panel.
The main disconnect switch shall E readily accessible, andlocated next to the meter on the exterior wall of
the structure. All underground conduits are required to be inspected before back-fllling the trench.
In multi-family dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common

TOWN OF VAIL ELECTRICAL PERMIT GUIDELINES
All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade, you must also obtain a building permit.
If this permit is for installation of an exterior hot tub or spa on any existing deck or elevated platform,
a structural engineer must review the existing condition and veriry that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
If this is a remodel in a multi-family building with a homeowners association, a letter of permission
from the association is required.
If this permit is for a commercial space, two (2) sets of stamped drawings are required. Electrical
one-line and panel schedules are required if load is added or distribution is altered.
