lf this permit requires a Town of Vail Fire Department Approval, Engineer's (fublic Works)
review and approval, a Hanning Department revielv or Health Department review, and a
review by the Building Department, the estimated time for a total review will take as long
as three (3) weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum reguirements. Residential and small projeds should take a lesser
amount of time. Hower,rer, if residential or srnaller projec'ts impacf the various above
mentioned departments with regard to necessary review, these projeds may also take
three (3) weeks to review and approve.
Every attempt will be made by this department to expedite this permit as soon as
possible.

DRAINAGE AND CULVERT INSPECTIONS ARE REOUIRED BY PUBLIC WORKST
Please read and check off each of the items below:
The Town of Vail Building Department has developed the following procedures to ensure that new
construction sites have adequately established proper drainage from building sites along and
adjacent to Town of Vail roads or streets.
The Town of Vail Rrblic Works Department will be required to inspect and approve drainage
adjacent to Town of Vail roads or streets and the installation of temporary or permanent culverts at
access points from the road or street onto the construction site. Slch approval must be obtained
prior to any requests for inspection by the Town of Vail Building Department for footings,
temporary elec'trical or any other inspection. Flease call Leonard Sandoval al 479-2198 to request
an inspection from the Rlblic Works Department. Allow a minimum of 24 hour notice.
Also, the Town of Vail fublic Works Department will be approving all final drainage and culvert
installation with resulting road patching as necessary. $rch approval must be obtained prior to any
Final Oertificate of Occuoancv issuance.

MATERIAL STORAGE AND CONSTRUCTION PARKING

CODE 5-2-10: DEPOSITS ON PUBLIC WAYS PROHIBITED
e Unlavyful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof'
e Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty tour (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified doe not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
e Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal C,ourt of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 14-1 ol this code.
e Notice and Penalty: lt is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public WorK, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code. (,|997 Code: Ordinance 6 (1979).
COOES 7-3A-1 AND 7-3A-3: PARKING OBSTRUCTING TMFFIG & IMPOUNDMENT AUTHORIZED
e No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to interfere with the free rnovement of vehicular traffic or proper
street or highway maintenance. (Ord. 2(1968) S 1)
e Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a
street or upon any plaoe within this Municipality in such a manner as to constitute a violation of any
section of this Article, or left unattended for a period of twenty tour (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 424]1102" as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of srrch vehicle shall be charged to the owner of the vehicle in

The unit wiJl be locked at all tines, and only Shaw Coustructioa and
Coughlin and Company will hold kerys to this unit. No one will be
allowed in the unit unless an emplope of Shaw Constuction or Cor4hlin
& Company accompanies them. The door will always be locked again
inmediately when the unit is exited.
People who are visiting the site and viewing the model rmit will be
accompanied at all times by an employee of Coughlin & Company. All
visitors will wear hanl hats at all times. No menabcr of the public will be
allowed orsite wer without being.accompanied by Cougbtin & Company.
No mcmbcr of the public will be instnroted to mect at the Middle Creek
site. Visitors will always be mot by Coughlin & Company offsitc,
provided with ahar4 and gven some insfuuctions for safety, and then will

The DBF 4XL features our FX4XL fan with a housing
made from galvanized steel with a powder coat, baked
enamel finish suitable for most commercial applications.
The fans can handle lengths of duct up to 60 feet and six
elbows. The backward inclined blades allow lint to pass
through the fan. The attached fully automatic pressure
switch is mindful of your energy use, turning the fan otf
and on, in ten minute cycles, only while the dryer is
running,

Matt: Yeah, Leonard and I talked, and Peak Land was on site this
afternoon. The grades just dont work right in all areas over there,
but we are working through it with Peak. I should know more in the
morning.
Russ mentioned submitting Change to Approved plans for any exterior
modificalions on Friday when he was out with Charlie. The items that I
can think of are the following:
- We swapped out from Cement Siding Panel to stucco at the back
(north side) of Building 'C'. The cover slab back there is sloped, and
did not lend itself to work well with the siding, as the end result of
the cutting this siding on a sloped termination piece would look nasty.
- There was a request by Fire to add a stairway to the FDC of
Building 'B' that is not shown on the plans. This also served as entry
to the lower units of B. This is a railroad tie/cinder stairway that
has a handrail. I believe the request is to keep this permanent in
olace for the tenants and Fire-
- We probably need to document the West side of 'C'where the
canopy and fire lane turnaround don't work. The MSE retaining wall was
swapped out for a boulder retaining wall- | have some revised documents
from Peak Land on this, but it could change drastically now with a
potential wider fire lane. I guess this can wait until after the fix is
orovided for this area.
- The stair from B going down to the frontage road sounds like it
needs to be'redesigned'. lt is currently not lit, and does not tie
into the lower landing of B, both of these issues have been asked to be
completed/remedied by TOV. I will submit once I get the revised
document.
- The grades were not right at the East side of C (2 entrances
directly to the east). The plans showed dirt basically covering up the
windows at this area. Some grading changes and an added walkway have
taken place over here, which I have a fix for.
- Then whatever has to happen at the grades at the east side.
There may be something else I can think of, but thal is it.
I will call you tomorrow to go through the process here.

Just a reminder to ensure that things keep moving forward: please submit
a Change to Approved Plans DRB applicalion for any deviations from the
approved set of plans involving the exterior of the buildings or the
site work. (An example would be the modification to the north elevation
of Building C.)
I want to make certain that we will be able to process those changes in
a timely fashion and keep you on track with your scheduling needs.
Also, Leonard called me while I was writing this message and he stated
that he has concerns about the grades between the saddlebags and the ELC
not being at the required 2'.1 'atio. He is going to give you a call,
but as another "heads-up", if you're going to need to do retaining walls
instead of the approved grade contours, we need a Change to Approved
Plans DRB application documenting that modification as well.

Gentlemen: So as not to waste your time, we won't be requesting your
presence today for TGO inspection at Middle Creek. The fire alarm
system piece is still needing some help - there is a meeting at 11:30 am
today that will hopefully resolve this piece.
lf pu can hold onto the TCO inspection cards like you mentioned on
Friday for another day or so, I will keep 1lou informed on hor the fire
alarm piece is getting resolved.
Any other unit inspections, etc that were on the books for today we
still want to have happen.

Hey Barry,
The exterior of the entire building (with the exception of the "saddle{ags" as previously discussed) does
need to be completed prior to the issuance of a TCO; lherefore, the north elevation of Building C much be
finished prior to a TCO request whether that elevation is visible from the road or not.
At a minimum, a developer improvement agreement (i.e. bond) must be execuled for all incomplete
landscaping prior to a TCO for Building C. I understand the landscaping installation will be ongoing (and I
hope the weather will continue to cooperate so it can be ongoing); however, a DIA must be executed for
all landscaping work that is incomplete at the time of the TCO request for Building C.
Also, it is my underslanding that a proposed temporary parking plan will be required from the Public
Works and Building Departments as part of a TCO request for Building C. Please foruvard a copy of this
document to the Planning Deparlment as well.

Thanks for your help at Middle Creek. A couple of things:
1. The back of the building was a change on the documents and will be
finished shortly. The documents show hardi panel at the back, but this
was not possible because you can't trim out the hardi panel verywell on
a sloping walkway that is back there. The call was made for stucco, and
will be com pleted shortly once stucco guys are wrapped up elsewhere. I
am assuming that this won't be an issue for TCO of 'C' since you can't
see from the street...
2. Plan for completing landscaping - We still intend to landscape as
much as possible this year, weather permitting. Each week we seem to be
able to get more and more in... I honestly think that the actual
planting will stop with the expected snowfall of this weekend, however.
Final grading will need to be complete for TCO of lhe saddlebag units
and erosion control measures will be placed - but more than likely no
more actual planting will continue unless the weather really allows. We
have picked up a DIA for the landscaping (something Matt G mentioned
during our meetings). The intent always was for the DIA to be in place
when we leave the site (Building'A'& ELC) since until that time occurs
the valuation is kind of in fluctuation. ls there something more that
you wanl to see on my end for TCO on this? Once weather truly hits, I
can give you more of schedule and completion area - but until that time,
uE plan on planting, mulching and seeding as much as possible.

4. On sheet A4.5 - Building C, West elevation - the cast in place concrete must be stucco as shown on

ljust got off the phone with Charlie, and wanted to download this to you all. I think Shaw, Coughlin and
Odell need to have a conversation to analyze this conversation and whatwe need to do.
Firstly, TOV will not issue separate building permits, with the exception of the Children's Garden of
Learning. This means that they will also not issue a TCO until all the buildings and site work are
completed. They will isue a separate Grading permit.
We will be getting the Fire Department and Public works @mments soon. They had a meeting this
morning, and the fire department has some issues, the largest of which is that they have rejected the Fire
Alarm plan. There are also questions from Mike McGee regarding the adequacy of the water supply to the
project, as well as a turning radius issue at the CGL. Public Works is generally ready to release with one
exeption, they will not release without a notice to proceed from CDOT.
Perry Matthews work on the equivalency does not fly with the Building Department. He will need to back
up his recommendations with calculations and documentation.
Charlie is going on vacation for 2 weeks and will leave a checklist, which we will be copied on, of items to
be resolved before we can be issued a Grading permit. We can get a grading permit in his absence if this
list is complete.
So hr, I have received the comments on Buildings A, B and the CGL from Art Hougland, the plans
reviewer. We are ready to respond to Bldgs. A and B, and will try to get the CGL back this week. We are
not anticipating receiving comments on Bldg. C until next week. We have received and have responses on
both the Mechanical and Electrical comments. We have not seen any Structural comments as yet. We
met with Art and Charlie on Monday and have come up with a new way to create area separation in Bldg.
C , which we will get to them tomorrow.
That's the summary, we should probably get a conference call , Clark, to discuss the implications of this
conversation.

Middle Creek - Communication with Mark at Peak Land ref cul-de-sac
Mark and I discussed the lack of access. He said he based the design on specific data he obtained in
February. The data referenced old turning radia I developed for specific fire trucks in 1994. He did not
have a copy of the Design Guidleines until now.
I explained the risk of designing around a specific truck, noting the specific truck may be out of service, on
a prior call, sold, etc.. I explained the risk of having to back a fire truck out of the drive lane into oncoming
traffic on the North Frontage Road.
We did agree to explore roll over curbs in the head-in parking area, designation of one space as
Emergency Truck Tum Around, and the possibility of trying to squeeze enough space out of the northwest
side of the parking area or the southeast corner at the dumpster. lt appears we can resolve the issue and
resolve it soon without changing the overall design or necessitating another DRB review.
The propose alterations/modifications will of course be routed to Allison and PW for review.
Peak Land design also did the water line design. They confirmed waterwas available from ERW&S and
turned it over to Beaudin Ganze. Mark will contiact Beaudin Ganze. I offered to help them calculate the
domestic demand (or at least help them discern the proper procedure), estimate the fire flow (or give them
a name and number of a design professional that can help them), and estimate the fire sprinkler demand
(or give them a name and number of a design professional that can help them),.
Lee Mason indicated they do not have a fire sprinkler sub under contract to do that work. I explained fire
sprinkler subs do not calculate domestic demand anyway, but that we know people who can.
I expect we may resolve this sooner than later.

Charlie just shared an email to Clarek and I do want to make sure we are clear on the TCO process.
We do want to see a complete project at TCO. We will review a construction schedule with you and
determine if that schedule appears to be workable from our perspective as I mentioned on the phone. Our
ability to work with your schedule will depend on your ability to address critical life safety (building and fire
code), planning issues, and public works issues in a timely manner as the project moves forward.

Dear Eric Marquez,
The Town of Vail Public Works and Community Development Departments have
reviewed your building permit application for Middle Creek and have identified the
following issues which need to be resolved prior to issuance of the building permit:
1. Please provide detail information on the site plan for Middle Creek Debris Flow
trash grate.
2. Please provide additional information as to the material of the limits of
disturbance fence. The fence shall be a minimum of 4 ft. in height. This
information must be provided on the site plan.
3. Please provide a copy of the approved U.S. Army Corps of Engineerrs 404
Permit.
4. Please provide a copy of the approved Stormwater Discharge permit.
5. Please provide copies of both Nofice to Proceed Permits from the Colorado' Department of Transportation.
6. Any issues regarding the Fire Truck turnaround area need to be submitted for
approval from Public Works if any new grading and/or retaining walls are
required. This may also require Design Review Board approval. Please provide
revisions on all sheets impacted by any changes (including landscaping plans).
7. On sheet C2.2, please revise the radius to allow for the completion of the
proposed sidewalk onto Colorado Department of Transportation right-of-way.
8. Sign applications must be submitted for the Early Learning Center and Middle
Creek Village.
9. The Early Learning Center fencing has not yet been approved by the Design
Review Board. Additional review by the Design Review Board is required.
Please provide revisions to the proposed fence and I will schedule it for review by
the Design Review Board.

10. The final color seleclion of the reddish tower element color has not yet been
approved by the Design Review Board. Please provide color samples and I will

11. On sheet A4.5 - Building C, West elevation - the cast in place concrete must be

12. On sheet AC.z - Building A, indicate the roof material of the flat roof area above
the trash enclosure.
13. Please submit all information regarding lighting specifications.
14. Please indicate a phase line between the Early Learning Center and the housing
to delineate the limits of improvements association with each.
To expedite the permitting process, the Building Department has offered to issue a
grading permit for Middle Creek. The grading permit requirements of the Building
Department and Fire Department are attached. For the Planning Department to issue a
grading permit, the following is required:
1. The limits of disturbance fence must be on both uphill and downhill sides to
indicate construclion limits. Please indicate on a revised site plan.
2. I need to inspect the fencing and tree preservation prior to commencement of
grading. This may be installed prior to issuance of a grading permit. Please call
me at 970-479-2369 to inspeci all fencing and tree preservation.
3. An application for a temporary site development sign must be reviewed and
approved (if proposed). The application will be reviewed by the Community
Development Department for compliance with Title 11, Sign Regulations, Vail
Town Code. I have included a sign application for your use.

Code analysis - UBC Standard 904.1.3 states exceptions to the standard may not be applied if

l. Question is regarding allowing the toilet exhaust to discharge into the cavity between
the building and the layback wall, A grille would then be placed at grade on the top
ofthis cavity to relieve the toilet exhaust, Charlie approved this procedure'
2. Can the water heater and pumps be located rurder an exterior stair for building B?
Doug indicated to Charlie there is no gas fired heat or any electric heat in this space-
Thc water heater is side arm hydronic type. Charlie indicated the stair would require
a l -hour in-closure. Charlie also indicated that the fire engineer of record would have
to provide his approval for this installation.
3. Can PVC ptum6ing lines penetrate the 3-hour cap over the garage inbuilding C?
Charlie's response was that no PVC can be used in building C. Charlie indicated that
the area separation walls have changed since his original consideration of this item.
Charlie indicated he might reconsider upon the approval of this situation by the fire
engineer ofrecord.
4. po ttre exhaust dncts coming from a rated shaft into the individual toilet rooms need
to be fire darnpered when they leave the shaft? Charlie indicated the fire/srnoke
dampers would be required on these duct penetrations. One other possible exceptlon
may be to do a sheet metal elbow tumed 22" up in the chase to prevent the
requirement of the damper.
