Gentlemen :
Warner Properties, Inc., ls requesting that the Vail Pl-anning Conrnission hear
a request for a setback variance on our Mountaln Meadow Project at the
regularly scheduled meeting of September 10, 1979.
We understand that a varlance request should be heard later Ln the month,
however, we are requesting that it be heard September 10th under the emergency
provislons of the ordinance.
We feel that it is imperatlve to continue framing so we can complete the roof
on the "F" Bulldlng by nid october. The bullding Ls situated at the extreme
south slde of the val1ey rLght next to the woods and as soon as snow fal1s ln
the Big llorn area it will probably stay on this building. If this happens
before we can get a roof on, l-t would make it very difftcult to complete the
bulldlng thls Fall. Three of the four units in the building are sold and the
prospectLve purchasers are anticl,patLng using the units this wlnter.
On approxinately the 16th of August we became aware that we had a problen with
setback and lot lLne on our cornnon border with the National Forest Service.
Wtthin an hour of discovering the posstble problem \"/e met with District Ranger
Ernle Nunn of the Forest ServLce and explalned the problem. On August 17th,
we had our surveyors Johnson and Kunkel come out and check the l-ocation of the
building. 0n the 17th they informed us that the building nas totally withln
our property and we rrere out of the setback. Early ln the week of August 20th'
I requested that Johnson and Kunkel come out and resurvey the vork because one
of the tno surveys they had done had to be ln error. The original survey that
they had done showed that the building did encroach and the later survey stated
that it didntt. Mid-week of the 20th, Johnson and Kunkel- came back and stated
that their survey of August 17th was incorrect. At the same time, I contacted
Jin Rub ln of the Town of Vail to advise him of the problen.
The orLglnal site plan in the survey work for Mountain Meadows showed that the
hillslde to the south was approximately 40 feet further to the south than lt
actually was. In locating the bulldings we needed to move the entlre ProJect
in a northerly direction ln order not to dlsturb the htllslde to the south of
the Pro i ect .

We aleo encountered a great deal- of ground water and some underground streans
on the slte. Thls was especlally true of the southwesterly corner of
Building rrFrt. In laying out Bulldlng ttFtt, we moved the structure so that lt
would not Lnterfere with an underground spring and in dolng so encroached on
the Townr s setback.
I{e have worked out the problern wlth the Forest Service so that we have none of
the structure encroaching on their property and they are the adJacent ProPerty
oltner.

He said thedeveloper had moved this building becJuse of some under-ground springs and after completion of foundations andframing discovered an error had been made and it was locatedon the 1ot line. Jim poi.nted out that the error had beenbrought to the Town's ittention by the applicant. Jim saidthe only alternative to this variince is- to tear the buildingdown.

Bob Warner, the applicant, explained that they had had someground w-ater problems and. sol_ved them by moving the building.They took a minor problem and created a major f,roblem. Thesurveyors rnade a-mistake originarly. He siad Lhey asked theTo-wn for permission to continue on- this and receiired a con-tinuance.'
Bob Ruder asked if there is an avalanche problem. Bob warnersaid there is no avalanche problem.
Jim Morgan asked about impact studies. Bob warner said theywere done at the beginning of the project.
Ed Drager asked about the difference between this requestand the Pierce Addition. Jim Rubin said this buildirig wasby1lt by rnistake and. is existing in the setback. The pierceAddition lras proposed to be built in the setback.
Gerry white said the onry reason to grant this is economic.

An inspection of the foundation excavations for units
B, c, and D in the Vail Lrast constructiolr project vras conducted
by this offlce on the tgth of.rune 19?8, and a further inspection
of A and J was made on the rTth or Aurlust 1979. Location of
these st,ructures in the Vair Llast buildinil complex is noted on
the attached site plan.
A thin rvall Shelby tube sample was obtained from the
foundation excavation of units B, c, ancl D anct subjected, to the
attached load compression studies. units A and J were evaluated
wlth nuclear moisture density eciuipment in accordance with the
procedures ln the.zr:jTM D 2922-7L; the results of which tests are
noted bel.ow for infornation ancl record.
'Ihe general area oL= this development consists of a
moderately undulating arruvial plane fornring the rower extremeties
of a mountaln meadow. The soi-ls notcd consisted of dark sandy
silts and silty qravels which are erosi()nal remnants and lnplace
alterations of local talus slone outwash. The naturaL materials
are in place at sonrewhat variable but none-the-less competent
moisture density configuration. Ihe are.rs of Unit ts, C, and I)
$rere extrernell' moist at the tir,re of the i.nspecti.on, however, resurts
of load cotnpr(rEsion studies conductecl or: tl-rcj;e materials incli.cates
that they have anrple bearing ca1:acj.ty f rir this bype of constructlon
uP to and lncluding a value of r,000 pounds per square foot. unit,s

controll.ed area fill. The natcrials in ur-rit A and J were in place

I'ounclation soil beari.ng components ior Units B, C,
and D should be designed about. a dead ro.rd soil bearing pressure
in the magnitude of 800 pounds per square foot,. Soil bearj.ng
components for these structures should be placed on an area of
free draining gravel nat.erial t.ilat has ireen clensified sufficiently
to bridge rocarized soft. pockets in areas of comparatively high
localized moisture. units A and J mai' be founded with simirar
soil bearing pressures, however, the utirization of gravel under
the footings need not be incorr:oratecl on these two sites.
Area wide, as well as locali.zed, drainage of atom
wat,er and locar run-off must be acconrplishe<l on all units of
this deveropment. The control of the ne-.'arb.7 r,linor drainage will
be essential and lt is the unclcrstandin,r oi this office that it
has been controlled at this writinq.
I{e-enforci.ng of exterior <;racle walls at this location
may be accomplished according to acceptecl residentiar st,ructural
engineering practices.
Localized problens cicvelopi.ng from expansive soil con-
dltions need not be considered at these Locations. Adequate
penetration of soil bearing com;:onents below potential frost levers
will be required, as will be the positive control of both exterLor
and localized intrusion of area wide run-off.

Floors over crawl spaces may be insulated either by insulating the foundation
is unvented, or if the crawl space is vented by placing insulation between the
method, as described below, is usually more economical.

Floors over wnted crrwl spacer (Fig 9b) can be insulated by installing
insulation between the ioists and holding it in place by:l. Using heavy4age wircs pointed at both ends and made especially for
this purpose. Bow the wires and wedge them under insulation and
between ioists.
2- Lacing wire back and forth between nails placed in bottom of joists.
3. Nailing chicken wire to bottom of joists.
In all cases, the vapor barrier side of the insulation should face the
floor above-that is, be adjacent to the warm side in winter.
Polyethylene may be used as a vapor barrier to cover the ground. lf it
is desired to prot€ct the insulation from the weather, such as may be
the cas€ in open crawl spaces, nail standard, interior grade softwood
plywood, nail-base insulation board, or similar covering to the bottom
of floor joists.

against the inside of the wall, Insulation is held permanently in place
by the sill plate or header joist if no sill plate is used. lf the bottom of
the insulation stands away from the wall, use stones, bricks or blocks
spaced as needed to hold it against the wall. The vapor barrier on the
insulation should face inward (the warm side in winter). ln this
method of installation. the insulation also serves as a sill sealer.
'Nalls of unvented crawl spaces also may be insulated by fastening
rigid insulation board to the inside face of the wall extending from
ground to top of wall. Follow manufacturer's instructions for method
and type of adhesive or fasteners.
ln basement and unvented crawl space constructions, sill sealer insulation may be used if necessary to prevent air
infiltration between sill and foundation or between header ioist and foundation. The sill sealer is merely unrolled on
top of foundation wall and temporarily taped in place as n.cessrry (Fig. 9c).
Wedge or staple short pieces of blanket insulation behind band or header loists (Fig. 9c and 9d). As an alternative,
when using insulation at the bottom ofloists, the header ioist may be insulated by "folding" the end of the blanket up
90 degecs and pushing it against the header (Fig.9c).
Headers in cantilevered floor construction (Fig" 9e) can be insulated as mentioned above. Insulate soffits below
cantilevered floors by cutting blanket to fit and wedging it in place, vapor barrier facing up. As an alternate, these
headers and soffits can be insulatcd by folding the end of the blanket against the header, as shown in the righthand
section of Fig 9c.

Due to the difficulty of terminatlng the kitchen duct system at
the roof of Village Center (Due to proximity of adjacent windovs
and problems of noise and maintenance) an alternaEe location
would be desirable.
Itith. the location of Marie Claire Ltd. at Ehe extreme eastern
end of Village Center Building "D", adjacent to an entry ramp
and above a parking garage, a logical location for the fan would
be the parking garage. The termination of the duct system would
be in the wall of the vehicle entry ramp iurmediately east of
Marie Claire Ltd.
That the proposed locations of this equipment would not negatively
affect the inhabitants of Village Center or oEher persons.

Gentlemen:
tr'larner Properties, Inc. has been working with the Building Official
of the Tor,m of Vail pertalning to Section 1305 (A) of the Uniforn
Building C,ode L976 Edition. Mark has suggested that we appeal to
you pertainlng to certaln parts of ihe Section that we feel are not
in the best interests of the ul-timate buyer.
The area that we feel is wrong is the venting of laundry rooms di-
rectly to the outside, in the event that they do not have natural
ventilation. Our feeling is that the washing machlne puts off
extremely 1ittle humldity and the dryer ls a]-ready vented. The
majority of the people llving ln the Vail- area are trying to intro-
duce additlonal humldity j.nto the house and any hr:midity that would
be put off by these two appllances would be beneficial to the resl-
dents in our location. Additionally, we feel that any venting to the
ouEside is a potential- for air lnfil-tration and addittonal- cost of
heating the units.
I,le wouLd also lLke to have authority to vent the dryers directly into
the garages. The reason for thLs ls that you can use the heat put
off by the dryer to heat an area rather than pouring that heated alr
lnto the cold. Additionally, usi-ng a dryer in extremely cold rrteather
can cause the outslde vent to build up wlth ice and not close properly
causlng a backdraft into the unlt.
Thirdly, we would like to use the CA/90 ductless fan for our bathrooms
and l-aundry rooms. These have been approved by I.C.B.O. #2805.
We would appreclate your considering the above j.tems for constructLon
in Phases II and III of our l,lountaln Meadow project. Phase I of
our Mountain Meadow project has been vented in accordance wlth the
1976 U.B.C. Code. Thank vou for vour cooperation.

During the past six months, Irve been worklng with you, your staff
and various boards and cott"nissLons Pertalning to the construction
of a rental housing proJect Ln the Torun of Va11. At the start I
recelved encourage[ent from the various people to proceed wlth
the proJect. Frou the tloe when we atarted rnaking actual presenta-
tlons to the varlous people lnvolved, we ttet lncreasingly nore oppo-
sition. The two exceptlons were the town etaff and the p l-annlng
co'r'ml sslon. After spending in excess of $5,000 in the planning
stagea of the rental houslng project, we now fLnd that lt would be
lmposslble to bulld the project at this tlne withln the Town of
vaft. Ttre followlng are some of the reasons why we have abandoned
thLs project.
Several weeks ago, lte met wlth the Tom Cotmcil and they requested
that certaln restrictions be placed on the use of the Project. At
that tiue the project ne nere proposlug met aLL zonlng requireuents.
The onJ.y conslderatioo we nere asklng f,ron the councll ltas that ln
the event rte rtere not able to obtaln a bulldlog pernit prior to
the down zoning which would take place later thle year, we would
be able to renain at the present deosity. I Itas instructed to ueet
with Dlana Toughill to sort out some restrictlons on the use of
the property. In the initlal neetlng wlth the Town Councll , we
discussed a fLve year program. Dlana and I met and subnitted a
proposal. that put restrictlons on the ProPerty for up to eight
years aod also gave a rlght of flrst refusaL to the tenants in
the event that the units were, at a later date, offered for sale'
After submltting ny proposal, the Council asked for an even longer
tlne than Dlana and I had agreed on for the project to stay as
l-ong term rentaL houslng.

tenant. Ttre proJect consieted of eight bulldings couposed of

tormhouse in concept. Each would have had a Prlvate yard area
for the exclusive use of that lndividual- apartment. Everybody
states that he wants rental housing, but no one rtants it in his
inrmediate nelghborhood. Slnce a project has to be located next
to sonebody it wil1 always affect some neighbor and, therefore,
probabJ-y roakes lt inpossible to construct. We were infonoed by
varlous people that the architecture was not consistent with
Vail. I find lt very difficult to determine what the architec-
tural s cheme of Vail is when you have buildings that are Bavar-
ian, shaped l-lke wind mills, vety modern, and a 1lttLe bit of
everything else. One of the criticisms of the builcling by vari-
ous peopl-e was that it was cheap or did not fit into the sur-
rounding nelghborhood. The exterlor material of the building
woul-d have been one by eight siding that has recently been used
ln several projects wtthin the Town of Va1l , and a built up roof
which is sinllar to the exlstlng units near the proPerty.
In doing ttrls project we deflniteLy dld not tal€ the most economlcal
uethod of constructing apartments. The most economical way would
have been to construct a three or four story walkup with the apart-
nents approximateJ-y 607" to B0% the size that we lrere Proposing.
The final- conslderation in abandoning the Program was economics.
We knew from the beginnlng that apartments would not yi.e1d the
hlghest return. I{owever, I.'lth the need for rental houslng and
the ultimate conversion and sale of the ProPerty' we felt that
the project could be econorn'l ca1ly feasible. Because of the income
that the project woul"d generate, it would have been necessary
for the investors to put up approxlmately $400,000 in egulty
cash in order to obtain a loan on the project. We had projected
a break even at 89% occupancy. Hovever, rte rtere conrmi tted
to have the units remaLn as apartnents wlth an occupancy of
752 which could have nreant the investors suffering a loss for ,
the period of tirne that the Town Council required us to keep
the units as rentals. Wlth the additlonal restrictions the
Torvn of Vail wanted to pJ-ace on us it wouLd have been lmpossi-
bLe to obt.aln investors to go lnto a project that could have
had a negatLve cash flow for 10-p1us years.
Under the present conditions wlthln the Town of Vai1, I think
that lt is lnpossibl-e to create long terl[ rental housing that is
econonically feasible for the investors. Of the hundreds of
projects that have been built ln the Vail valley by developers'
the overwhelning maJorlty have stayed away from long term rental
houslng because the income does not Justify the expense of this
type of investment. Hopefully wLth governnent assistance :

located on th Town of Vail, Eagle County'
Colorado.
In our neeting with the design review board, the acting chairman
stated that the proJect was lnconslstant vith Vai1. We tried
to obtain an exact transcrlpt of his codtrents, however, the tapes
of the meeting were b1ank. The glst of hls remarks were that when
he moved to Val1 he knew that Vai-J- was expenslve, and he feels
that houelng tn ValJ- shoul-d be expensive. He also stated that a
houslng project would not work until there was year round employ-
ment Ln the Vail area. Al-though enploynent has seasonaL peaks
and valleys, there l-s a substantial work force in the Gore Valley
throughout the year, contrary to his remarks. I.Ihen asked what
wouLd make the proJect acceptable, the design review board stated
that a total redesign woul-d be necessary. Thls rtas contrary to
Mr. Elden Beckrs feeling about the proposal ot 9/2L/77. IIe felt
that the projeet was acceptable wlth rn'l nor site changes.
We have al-so deveLoped a revised entryway whi ch meets aI-I- present
Vail zoning requirements, and we are, therefore, withdraving our
request for variance as to the leagth of the buililing.

Gentlemen:
Thj-s letter is to inforrn you of the decision of the Eorvn of
VaiI Adninistration regarding your request for a review of the
zone district proposed for the 7.97I acres known as Gore Range
II Limited Property.
It is the decision of administrative staff to make the folLow-
ing recomr,tendation to the Town of VaiI Planning Commission and
Town Council:
That the zone district for the property in question be
changed from Residential to Low Density l4ulti-Family'
provi.led tSat the property owner agrees to a maxj-mum of-60 awefling units for- the entire site and that any
clevelopment conforms with the appropriate development
standards of the Zoning Ordinanle. Further, that the
pregentorfuturepropertyownerrecognizestheexist-
irrg naturaL hazard-s a-ssociated with the site and that
an environmental impact statement wilL be required for
the entire site prior to any future subdividing or
develoPnrent.
The Town Administration makes the above recommendation based on
the foLlo$ting finclings:
(1) That the developable area associated wittr the site aPpears
to be of a suitibJ"e slope to accommodate a 1ow density' multi-famity clustered development;
(2) Tirere aPPears to be suitabLe oPen sPace avaiLable to permit
substanl-ial recreational amenities and green belt;
(3) That the proposed density does not substantially exceed
the original zoning clesignation;
(4) That th6 proposed zoning change is consistent with sirailar
zoning districts adjacent to said property;
