Asbestos Testing & Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. It is your responsibility to be in compliance with the State. Please contact the State directly
for their requirements at the contact info listed below.
When is asbestos testinq required?
APVY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two-Family Dwellings: 32 square feet
Atl Others (commercial spaces, hotel rooms, etc): 160 square feet
Definition of a single-family dwelling: any dwelling unit that is used primarily for a single family, including
multi-family/condominium units, and fractional fee units.
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified abatement contractor. The
clearance letter must be submitted to the Town of Vail before the building permit will be issued.

• Even recent construction projects may include asbestos-containing materials, so buildings of � age require testing.
The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos-containing product categories was set aside and did not take effect." - CDPHE

Mr. Turner,
Foothills Environmental Inc. (FEI) conducted a limited asbestos inspection on April 26�,
2012, of suspect asbestos materials that may be impacted during renovation activities at the
residence located at 508 East Lionshead Circle #103, Vail, Colorado. At your request the
inspection was limited to suspect materials that will potentially be impacted during
renovation. Mr. Andre Gonzalez, an asbestos inspector certified by the Colorado
Department of Public Health & Environment (#3199), conducted the limited asbestos
inspection. Aerobiology Laboratory, an independent laboratory accredited by the Nationa.l
Voluntary Accreditation Program (NVLAP) and the American Industrial Hygiene
Association (AIHA), analyzed the samples utilizing Polarized Light Microscopy (PLM).
A limited bulk sampling of suspect building materials was conducted to identify any
Asbestos Containing Material (ACM) that would be impacted by planned renovation
activities in the unit. An ACM is defined by the EPA as a material with an asbestos content
of greater than one percent (1%) by area. Select bulk samples of suspect building materials
were collected from areas that could be impacted during renovation.
The textwed drywall and sheet vinyl flooring located within the Kid's bedroom/bathroom
were inspected for ACM. FEI also sampled the sheet vinyl flooring in the kitchen. FEI did
not inspect outside of the proposed scope of work, underground conduit, electrical panels
instruments or other appurtenances.
The drywall texture and sheet vinyl flooring in the Kid's bedroom/bathroom contain >1% asbestos
and are considered asbestos containing materials.

CONCLUSIONS and RECOMMENDATIONS:
The Colorado Department of Public Health and Environment (CDPHE) and the
Environmental Protection Agency (EPA) define an Asbestos Containing Material (ACM)
as a material containing more than 1% asbestos. The following actions are required:
Joint Compounds associated with drywall materials are classified as non-friable as long as
the joint compounds remain painted and in good condition. If the joint compounds are
damaged by cutting, drilling, sanding etc., or damaged by water, the joint compounds could
become friable and release fibers. OSHA has concluded that removal of non-ACM
wallboard panels with ACM joint compound poses a potential hazard to workers that must
be controlled. If a wall shell is constructed of ACM joint compound and non-ACM
wallboard panels, then removal of the wall shell is Class II asbestos work.
Tezturing Compounds is classified as non-friable as long as the texturing compounds
remain painted and in good condition If the texturing compounds are damaged by cutting,
drilling, sanding etc., or damaged by water, the texturing compounds could become friable
and release fibers. Texturing compounds are also classified as surfacing materials and
must be removed prior to building demolition or renovation.
Vinyl Sheet Flooring has a fibrous backing which is friable. Because of this, vinyl sheet flooring
needs to be removed using asbestos trained personnel, wearing proper personal pmtective
equipment prior to demolition. The removal of this material requires adherence to all applicable
local, state, and federal regulations concerning asbestos removal and disposal.
LIMITATIONS
This report describes the locations and conditions of ACM identified in the residence
during the limited inspection. This limited inspection is localized to the drywall and sheet
vinyl flooring in the Kid's bedroom/bathroom and the kitchen sheet vinyl flooring. FEI
represents that our services are performed within the limits prescribed by applicable
regulations and in a manner consistent with the level of care and skill ordinarily exercised
by other professional consultants under similar circumstances. No other representation is
made to the client, expressed or implied, and no warranty or guarantee is included or
intended. This report should not be used as a bid document or Project Design as it dces not
include components of the design requirements set forth in Colorado Regulation No. 8,
Section III.C.3

♦ All regulated asbestos minerals (i.e. chrysotile, amosite, crocidolite, anthophyllite, tremolite, and actinolite) were sought in every layer of each sample, but only those asbestos
minerals detected are listed. Amosite is the common name for the asbestiform variety of the minerals cummingtonite and grunerite. Crocidolite is the common name used for the
asbestiform variety of the mineral riebeckite.
♦ Tile, vinyl, foam, plastic, and fine powder samples may contain asbestos fibers of such small diameter (< 0.25 microns in diameter) that these fibers cannot be detected by PLM.
For such samples, more sensitive analytical methods (e.g. TEM, SEM, and XRD) are recommended if greater certainty about asbestos content is required. Semi-quantitative bulk TEM
floor tile analysis is accepted under NESHAP regulations.
