3. That the applicant shall notify the Town Manger, or-his.duly
authorized-Lgent, twenty-four hours in advance of the time
for comnrencernent of construction, in order that proper
inspection rnay be nade by the Town.

oi Vaii, its ofiicers, employees and agents. from.and against
all liability, clains'and-demands on account of injury,-loss
or damage, iiituaing without linitation claims arising fron

understanding that the golf course wishes to keep this road open, andtherefore the road wouLd not be revegetated. I believe alI the

A copy of your letter to Ron Phillips was forwarded to ne on the
29th of April.
As busy as people are at the Town of Vail, I regret that you did
not contact us first concerning any questions that you may have had
relating to the three hornes that we are developing on Sunburst
Drive.
Regarding the rrwork roadrr, it is the Golf Coursets desire to keep
that road open as a work road for the golf course. we used an
existing road and that road will rernain after our construction and
landscaping are complete. We would prefer to landscape directly to
the golf course. However, as of last year, the golf course found
it necessary to maintain the rrwork roadrr.
As you are aware, for the last two v'reeks it has snowed consistently
leaving the ground snow covered, frozen and saturated. Because of
this, we have not been able to begin our landscaping. As soon as
the weather improves and the sun comes out and dries the land, we
wiII irnrnediately begin removing any construction debris and start
final grading for landscaping. Because of the wet spring, f will
be somewhat at the mercy of landscapers who have been on a late
start throughout the valley because of the amount of precipitation
during ApriJ-.

enclosed a copt of ttre Tovnrg hazard ordinances and highlighted
sections pertinent to this reguest. To sunnarize, we wiII need a
written slaternent frorn a qualified engineer stating that the
proposed developrnent will not illg:fgagg the hazards of rockfall
ind-debris fall-on adjacent lots and R.O.W. In addition, the two
lots affected by snow avalanche wiII reguire nitlgation.
Ideally, I would like assurances that any required nitigatiol cal
be acc6nplished through the design of the structure, ald will not

Dan the following will need to be corrected:
1) The ditch in the drainage easement on the west side of this
unit will need to be better defined. In the spring when there j.s
snow and ice in the ditch, the runoff has a potential to drain into
the lower unit of L825 because the ditch has inadequate freeboard.
A ditch with at least 18 inches of freeboard would help ensure the
Town from being liable frorn runoff in its easement entering the
lower unit.
2) A revocable right of way agreement will be required for the
landscaping in the right of way. It appears the Town plows will
catch the landscaping directly adjacent to the edge of asphalt.
It wouLd be to the Townrs and the property ohrners benefit to
establish the three foot gravel shoulder required on Town streets
before the defined landscaping begins to control the plow danageto the landscaping.
