Applicant: Planner: PaulM.Sands MikeMollica 1.DESCRIPTIONOF TIlE VARIANCEREQUESTEDANDBACKGROUND Theapplicant,PaulM.Sands,isrequestingavariancefromSection17.28.330 of the Town of VailMunicipalCodetoallowaresidentialdrivewaytoexceedthemaximum slopepermitted .ThepropertyiszonedPrimary/SecondaryResidentialandhasan ex isting primaryunit,andanemployeerestrictedsecondaryunitlocateduponit. OnNovember15,1989,theDesignReviewBoardgrantedfinaldesignapprovalfor theSandsresidence .TheTownissuedabuildingpermitfortheprimary/secondary residenceonNovember20,1989.In earlyAugustof1990,theapplicantrequesteda framinginspectionfromtheTown 's BuildingDepartmentandsubmittedan improvementlocationcertificateindicatingtheridgeelevations of thebuildingaswell asthelocation of the building's footprint.Atthistime,itwasdiscoveredthatthe applicanthadconstructedthebuildingapproximatelyeightfeettothesouth of the approvedlocation.Astopworkorderwasplacedupontheprojectandtheapplicant wasinstructedthatDesignReviewBoardapprovalwasneededtomodifythebuilding location.OnAugust29,1990,theDesignReviewBoardunanimouslyapprovedthe modifiedbuildinglocationandthemodifiedlandscapeplan.Thestopworkorderwas releasedandworkonthebuildingcontinued.OnJuly26,1991,the Town's Building DepartmentissuedaTemporaryCertificateofOccupancyfortheproject.Landscaping andpavingwerenotcompleteatthistimeandwerelistedasconditionsofFinal 1 .,•• Cenificate of Occupancy approval.AFinal Certificate of Occupancy was requested bythe applicant inJuly of 1992.The Town's Public Work's Department was requested to complete an inspection of the property ,andonJuly17,1992,itwas determined thatthe applicant's driveway hadbeen installed atgrades exceeding 14%. As initially approved bythe Town 's DesignReview Board,andas permitted for construction,the project wastohavea maximum driveway grade of 8%. Section 17.28.330 of theTown of Vail Municipal Code indicatesthatthe maximum gradefora residential driveway shallbe8%.Thissection of thecode further allows forthe maximum grade of a driveway togoupto10%,if the Town's engineer's approval isobtained.Additionally,if the driveway istobeheated,thegrademaybe upto12 %withthe Town's engineer's approval .The driveway located onthis property isnot heated.In summary,the applicant is requesting to exceed the 8% maximum grade and to maintain the existing unheated driveway with a maximum grade of 14.1 %.Please see the attached drawing for the locations of the specific driveway grades. II.CRITERIA AND FINDINGS Upon review of Criteria and Findings,Section 18.62.060 of theVail Municipal Code, the Community Development Department recommends denial of the requested variance based onthefollowingfactors: A.Consideration of Factors: 1.The relationship of the requested variance to other existing or potential uses and structures in the vicinity. The adjacent propenies thenorth,south ,eastandwest of Lot14are alsozonedPrimary/S ondary Residential.In essence ,Lot 14is located ina residential neigh orhood adjacent to Chamonix Road.whiclJ:.thi&-iet ta~..itul(l(;es~isthemain entry totheVailDas Shone Filing Number One subdivision,VailDas Shone Filing Number Two subdivision,andtheVailRidgesubdiv ision tothe west Although the staff does recognize thatLot14has excellent southern exposure,wedohavesome concerns over thesafety of vehicles exiting thislotona driveway that exceeds 14%.Additionally,our concerns are forthesafety of thegeneralpublic utilizing Chamonix Road . 2.The degree to which relief from the strict and literal interpretation and enforcement of a specified regulation is necessary to achieve compatibility and uniformity of treatment among sites in the 2 •• vicinity or to attain theobjectivesofthistitle without grant of specialprivilege. Thestaff isunableidentifyaphysicalhardshipwhich existsonthislot whichwouldwarrantthesupport of adrivewaygradevariance .We couldfindnothingunusualabouttheshape,size,ortopographyofLot 14 to justify thesupport of thevariancerequested,andwebelieveit wouldbeagrant of specialprivilegetoapproveadrivewaygrade varianceforthisproperty. Theaverageslope of Lot14,fromthenorthernmostpropertylineto thesouthernmostpropertyline,averagesapproximately18.9%.The slope of thispropertyisconsistentwiththeslopes of theadjacentlots. 3.Theeffectofthe requested variance onlight and air,distribution of population,transportation and traffic facilities,public facilities and utilities,and public safety. It isthe staffs opinionthattheapplicant 's requestforadrivewaygrade variancemayhavesomeimpactonthepublicsafetycriterialisted above.WeareconcernedwiththewintertimeconditionsintheVail Valleyandwiththepossibility of vehiclesexitingLot14andbeing unabletostopatthebottomofthedriveway ,thereby jeopardizing the safety of passingmotoristsand/orpedestriansonChamon ix Lane. B.ThePlanningandEnvironmentalCommissionshallmakethefollowing findingsbeforegrantingavariance: 1.Thatthegrantingofthevariancewillnotconstituteagrant of special privilegeinconsistentwiththelimitationsonotherpropertiesclassified inthesamedistrict. 2.Thatthegrantingofthevariancewillnotbedetrimentaltothepublic health ,safetyorwelfare,ormateriallyinjurioustopropertiesor improvementsinthevicinity. 3.Thatthevarianceiswarrantedforoneormoreofthefollowingreasons : a.Thestrictliteralinterpretationorenforcementofthespecified regulationwouldresultinpracticaldifficultyorunnecessary physicalhardshipinconsistentwiththeobjectives of thistitle. b.Thereareexceptionsorextraordinarycircumstancesor conditionsapplicabletothesamesiteofthevariancethatdonot 3 • applygenerallyto other propertiesinthesamezone, c.Thestrict interpretation or enforcement ofthespecified regulation woulddeprivetheapplicant of privileges enjoyed by theowners of other propertiesinthesamedistrict. III.STAFF RECOMMENDATION The staff is recommending denialofthe applicant's requestforadrivewaygrade variance.The staff hasbeenunabletoidentifyaphysicalhardshiptosupporta driveway gradevariancerequestforthisproperty.Additionally,itis our belief thata variance inthis circumstance wouldbeagrant of specialprivilege,inconsistent with thelimitationson other properties inthe Primary/Secondary Residentialzonedistrict, andwebelievethatthereareno exceptions or extraordinary circumstances thatdonot generallyapplyto other propertiesinthe neighborhood.Wealsobelievethatthe grantingofthevariancemaybedetrimentaltothepublichealth,safety,andwelfare. Applicant: Planner: PaulM.Sands MikeMollica I.DESCRIPTION OF TIlE VARIANCEREQUESTEDANDBACKGROUND Theapplicant,PaulM.Sands,isrequestingavariancefromSection17.28.330 of the Town of VailMunicipalCodetoallowaresidentialdrivewaytoexceedthemax imum slopepermitted.ThepropertyiszonedPrimary/SecondaryResidentialandhasan existingprimaryunit,andanemployeerestrictedsecondaryunitlocateduponit. OnNovember15,1989,theDesignReviewBoardgrantedfinaldesignapprovalfor theSandsresidence.TheTownissuedabuildingpermitforthe primary/secondary residenceonNovember20,1989.In earlyAugust of 1990,theappl icant requested a framinginspectionfromthe Town's BuildingDepartmentand submitted an improvement locationcertificate .indicatingtheridgeelevations of thebuildingaswell asthelocation of the building's footprint.Atthistime,itwasdiscoveredthatthe applicanthad constructed thebuildingapproximatelyeightfeettothesouth of the approvedlocation.Astopworkorderwasplacedupontheprojectandtheapplicant wasinstructedthatDesignReviewBoardapprovalwasneededtomodifythebuilding location .OnAugust29,1990,theDesignReviewBoardunanimouslyapprovedthe modified buildinglocationandthemodifiedlandscapeplan.Thestopwork order was releasedandworkonthebuildingcontinued.OnJuly26,1991,the Town's Building Department issuedaTemporaryCertificate of Occupancyfortheproject.Landscaping andpavingwerenotcompleteatthistimeandwerelistedasconditions of Final 1 •• CertificateofOccupancyapproval.AFinalCertificateofOccupancywasrequested bytheapplicantinJulyof1992.The Town's PublicWork'sDepartmentwas requestedtocompleteaninspectionoftheproperty,andonJuly17,1992,itwas determinedthattheapplicant'sdrivewayhadbeeninstalledatgradesexceeding14%. AsinitiallyapprovedbytheTown'sDesignReviewBoard,andaspermittedfor construction,theprojectwastohaveamaximumdrivewaygradeof8%. Section17.28.330 oftheTownofVailMunicipalCodeindicatesthatthemaximum gradeforaresidentialdrivewayshallbe8%.Thissectionofthecodefurtherallows forthemaximumgradeofadrivewaytogoupto10%,ifthe Town's engineer's approvalisobtained.Additionally,ifthedrivewayistobeheated,thegrademay be upto12 %withthe Town's engineer's approval.Thedrivewaylocatedonthis propertyisnotheated.In summary,the applicant is requesting toexceed the 8% maximum grade and to maintain the existing unheated driveway witha maximum grade of 14.1 %.Please seethe attached drawing forthe locations ofthespecific driveway grades. II.CRITERIAANDFINDINGS UponreviewofCriteriaandFindings,Section18.62.060 oftheVailMunicipalCode, theCommunityDevelopmentDepartmentrecommendsdenialoftherequested variancebasedonthefollowingfactors: A.ConsiderationofFactors: 1.The relationship ofthe requested variance to other existing or potential uses and structures inthevicinity. G.At'loNll<~o,J., Theadjacentpropertiesthenorth,south,eastandwestofLot14are also zonedPrimary/SondaryResidential.Inessence ,Lot14islocated inaresidentialneighorhoodadjacenttoChamonix Road.~t ~isthemainentrytotheVailDasShoneFiling NumberOnesubdivision,VailDasShoneFilingNumberTwo subdivision,andtheVailRidgesubdivisiontothe west AlthoughthestaffdoesrecognizethatLot14hasexcellentsouthern exposure,wedohavesomeconcernsoverthesafetyofvehiclesexiting thislotonadrivewaythatexceeds14%.Additionally,ourconcernsare forthesafetyofthegeneralpublicutilizingChamonixRoad. 2.The degree towhich relief from the strict and literal interpretation and enforcement ofaspecified regulation is necessary to achieve compatibility and uniformity of treatment among sitesin the 2 •• vicinity or to attain the objectives ofthistitle without grant of special privilege. Thestaffisunableidentifyaphysicalhardshipwhichexistsonthislot whichwouldwarrantthesupportofadrivewaygradevariance.We couldfindnothingunusualabouttheshape,size,ortopographyofLot 14tojustifythesupportofthevariancerequested,andwebelieve it would be agrantofspecialprivilegetoapproveadrivewaygrade varianceforthisproperty. TheaverageslopeofLot14,fromthenorthernmostpropertylineto thesouthernmostpropertyline,averagesapproximately18.9%.The slopeofthispropertyisconsistentwiththeslopesoftheadjacentlots. 3.The effectofthe requested variance onlight and air,distribution of population,transportation and traffic facilities,public facilities and utilities,and public safety. Itisthe staffs opinionthattheapplicant'srequestforadrivewaygrade variancemayhavesomeimpactonthepublicsafetycriterialisted above.WeareconcernedwiththewintertimeconditionsintheVail ValleyandwiththepossibilityofvehiclesexitingLot14andbeing unabletostopatthebottomofthedriveway ,thereby jeopardizing the safetyofpassingmotoristsand/orpedestriansonChamonixLane . B.ThePlanningandEnvironmentalCommissionshallmakethefollowing findingsbeforegrantingavariance: 1.Thatthegrantingofthevariancewillnotconstituteagrantofspecial privilegeinconsistentwiththelimitationsonotherpropertiesclassified inthesamedistrict. 2.Thatthegrantingofthevariancewillnotbedetrimentaltothepublic health,safetyorwelfare,ormateriallyinjurioustopropertiesor improvementsinthevicinity. 3.Thatthevarianceiswarrantedforoneormoreofthefollowingreasons: a.Thestrictliteralinterpretationorenforcementofthespecified regulationwouldresultinpracticaldifficultyorunnecessary physicalhardshipinconsistentwiththeobjectivesofthistitle. b.Thereareexceptionsorextraordinarycircumstancesor conditionsapplicabletothesamesiteofthevariancethatdonot 3 ,.•• applygenerallytoother properties inthesamezone. c.Thestrict interpretation or enforcement of t hespecified regulationwoulddeprivethe applicant of privileges enjoyed by theowners of otherpropertiesinthesamedistrict. III.RESTRICTIONS Pursuant to Ordinance 22,Series of 1981 of the Town of Vail,prior to issuance of a building permit,an agreement to the following conditions mustbe signed by the property owner or owners onaform provided by the Department of Community Development: 1.That the secondary dwelling unit shall not be sold,transferred or conveyed separately from the primary unit for a period of not less than the life of Trent William RUder,a life in being,plus twenty-one (21)years from the date that the Certificate of Occupancy is issued for said second unit,and 2.That the secondary dwelling unit shall not be leased or rented for any period of less than thirty (30)consecutive days,and that if it shall be rented,it shall be rented only to tenants who 'are full time employees in the Upper Eagle Valley.The "Upper Eagle Valley"shall bedeemed to include the Gore Valley,Minturn,Red Cliff,Gilman,Eagle-Vail,and Avon and their surrounding areas.A "full-time employee"is a person who works an average of thirty (30)hours per week,and 3.That the secondary dwelling unit shall not be divided into any form of timeshares,interval ownership or fractional fee,and 4.That a declaration of covenants and restrictions shall be filed of record in the office of the Eagle County Clerk and Recorder in aform approved by the Town Attorney for the benefit of the Town to insure that the restrictions herein shall run with the land.
