PRE-APPLICATION CONFERENCE
A pre-application conference with Town of Vail staff is required. No application can be accepted
unless the mandatory pre-application meeting has been completed. It is the applicant=s
responsibility to schedule this meeting by calling 970479-2L28.
TIME REOUIREMENTS
The Design Review Board meets on the 1st and 3rd Wednesdays of each month. A complete
application form and all accompanying material must be accepted by the Community Development
Departnent a minimum of three and a half (3 1/2) week prior to the date of the DRB public
hearing.
REVIEW CRITERIA
Your proposal will be reviewed for compliance with the Design Guidelines as set forth in Section 12-
11 of the Municipal Code.
NOTE TO ALL APPLICANTS:
A, If a property is located in a rnapped hazard area (i.e. snow avalanche, rocKall, floodplain,
debris flow, wetland, etc), a hazard study must be suhnitted and the owner must sign an
affidavit rccognizing the hazard report prior to the issuance of a building permit. Applicants
are encouraged to check with the planning staff prior to submittal of a DRB application to
determine the relationship of the property to all mapped hazards.
B. Basic Plan Sheet Format. For all surveys, site plans, landscape plans and other site
improvements plans, all of the following must be shown.
1. Plan sheet size must be 24'x36". For large projects, larger plan size may be
allowed.2, Scale. The minimum scale is 1"=20'. All plans must be at the same scale.
3, Graohic bar scale.4, North arrow.5. -litle block, project name, project address and legal description'
6. Indication of plan preparer, address and phone nurnber,
7. Dates of original plan prcparation and all revision dates.8. Vicinity map or location map at a scale of 1"=1,000' or larger.
9. Sheet labels and numbers.
10. A border with a minimum left side margin of 1.5".
11. Names of all adjacent roadways.12, Plan legend.
C. For new @nstruction and additions, the applicant must stake and tape the project site to
indicate propefi lines, proposed buildings and building corners. All trees to be removed
must be taped. The applicant must ensure that staking done during the winter is not
buried by snow. All site tapings and staking must be completed prior to the day
of the DRB meeting.
D. Applicants who fail to appear before the Design Review Board on their scheduled meeting
date and who have not asked in advance that dbcussion on their iEm be postponed, will
have their items removed from the DRB agenda until such time as the item has been
reoublished.
E. If the DRB approves the application with conditions or modifications, all conditions of
approval must be resolved prior to the issuance of a building permit.

V.STAFF APPROVAL
The Administrator may review and approve Design Rwierrr applications, approve wi$ certain modiFrations,
deny the application, or may refer the application to the Design Review Board for decision. All staff
approvals are subject to final appmval by the DRB. The following types of Design Review applications nny
be staff approved:
A. Any application tur an additbn to an existing building that b consistent with the archihctural design,
materiab and olors of the building, and approval has been received by an authorized mernber of
a condominium association, if applhable;
B. Any applicaUon to modify an o<isting building that does not signiFrcantf change the oGting planes
of the building and is generally consistent with the architectural design, materials and colors of the
building, including, but not limited to oterior building finish materials (e.9. stonework, siding, roof
materials, paint or stain,), exterior llhting, canopies or awnings, fences, antennas, satellite dbhes,
windows, skylights, siding, minor commercial facade improvernents, and other similar modifications;
C. Any application for site improvements or modifications including, but not limited to, driveway
modiftcations, site gcding, site walb, renp\ral or modifications b existing landscaping, installation
of accessory structures or recreational facilities.
ADDMONAL REVIEW AND FEES
A. If this application requires a separate rwiew by any local, state or Federal agency other than the
Town of Vail, the application fee shall be increased by $200.00. Framples of such review, may
include, but are not limited to: Colorado Depafinent of Highway Acces Perm@ Army Corps of
Engineers 404, etc.
B. The appliant shall be responsible for paying any publbhing ftes which are in ocess of 500,6 of the
application fee. If, at the applicant's request, any matter b postponed fur hearing, causing the
matter to be republished, then the entire fee for such re-publication shall be paid W fie applicant.
C. Applicatlons deerned by the Community Development Deparlment b ha\,/e design, land me or o$er
issues which may have a significant impact on the community may require review by consultants
in addition to Town staff. Should a detennination be made by the Town staff that an outside
consultant is needed, the Community Development Department may hire the consultant. The

C. For new construction and additions, the applicant must stake and tape the project site to
indicate property lines, proposed buildings and building corners. All trees to be removed
must be taped, The applicant must ensure that staking done during the winter is not
buried by snow. All site tapings and staking must be completed prior to the day
of the DRB meeting.
D. Applicants who fail to appear before the Design Review Board on their scheduled meeting
date and who have not asked in advance that discussion on their item be postponed, will
have their items removed from the DRB agenda until such time as the item has been
reoublished.
E. If the DRB approves the application with conditions or modifications, all conditions of
approval must be resolved pdAI to the issuance of a building permit.
STAFF APPROVAL
The Administrator may review and approve Design Rwiew applications, approve with certain modifications,
deny the application, or may refer the application to the Design Review Board for decision. All staff
approvals are subject to final approval by the DRB. The following types of Design Review applications may
be staff approved:
A. Any application foran addition to an existing building that is consistent with the architectural design,
materials and colors of the building, and approval has been received by an authorized member of
a condominium association, if applicable;
B. Any application to modify an o(isting building that does not significantly change the existing planes
of the building and is generally consistent with the architectural design, materials and colots of the
building, including, but not limited to erterior building finish materials (e.9. stonework, siding, roof
materials, paint or stain,), exterior lighting, canopies or awnings, fences, antennas, satellite dishes,
windows, slqlights, siding, minor commercial facade improvements, and other similar modifications;
C. Any application for site improvemenE or modifications including, but not limited to, driveway
modifications, site grading, site walls, removal or modifications to existing landscaping, installation
of accessory structures or recreational facilities.
ADDMONAL REVIEW AND FEES
A. If this application requires a separate review by any local, state or Federal agency other than the
Town of Vail, the application fee shall be increased by $200.00. Examples of such review, may
include, but are not limited to: Colorado Department of Highway Access Permits, Army Corps of
Engineers 404, etc.
B. The applicant shall be responsible for paying any publishing fees which are in excess of 50% of the
application fee, If, at the applicant's request, any matter is postponed for hearing, causing the
matterto be re-published, then the entirefee for such re-publication shall be paid by the applicant.
C. Applications deemed by the Community Development Departrnent to have design, land use or other
issues which may have a significant impact on the community may require review by consultants
in addition to Town staff. Should a determination be made by the Town staff that an outside
consultant is needed, the Community Development Depaftment may hire the consultant. The
Department shall estimate the amount of money necessary to pay the consultant and this amount
shall be forwarded to the Town by the applicant at the time of filing an application. Expenses
incurred by the Town in excess of the amount forwarded by the application shall be paid to the
Town by the applicant within 30 days of notification by the Town. Any excess funds will be returned
to the applicant upon review completion.

Allison,
We are hoping for a staff approval here, our changes to the exterior are very minor. On the East Elevation we are
proposing to replace the existing su[standard wood window and door with a Kawneer Storefront door and window
(same as bank building in style and color). We also propose adding an additional window on the same elevation
also with he high quality storefront system. The site plan shows a revised sidewalk configunation at our added
space in front of the bank. The grade changes here were preventing us form constructing as designed.

Dear Doug and Mark:
On September 1 0, 1998, an inspection was completed of the First Bank at the West Vail
properly, for the issuance of a Final Certificate of Occupancy. Upon completion inspection,
there were numerous improvements that were not completed. On June 28,2OOO,I completed
an additional inspection of the sile, prior to the issuance of a building permit for a lenant linish
within the building. The following issues remain outstanding:
1. The stairuell on the east side of the building needs to be painted to match the deck.
2. There are 5 dead aspen trees on the property. All of these must be replaced.
These two issues must be addressed prior to the issuance of a C.O. for the First Bank
building. In addition, these two items MUSf be completed prior to the issuance of a T.C.O. for
the tenant finish. Once the work is complele, please call 479-2139 and schedule a final
inspection for the First Bank Building. Should you have any queslions or concerns with
regards to lhe inlormation addressed in this letter, as always, please do not hesitate to call.

I. DESCRIPTION AND BACKGROUND OFTHE REOUEST
The applicant is requesting a minor subdivision to establish this parcel (a.k.a. Chamonix Corners)
as a separate ptattdO tot. tne applicant is requesting a variance from the minimum lot size in the
CC3 zohe distiict (25,000 sq. ft.i io allow the lot to be 21,736 sq. ft. and a parking variance. The
variance for landscape area is no longer a part of this reguest.
This property was platted as part of Tract C, Vail Das Schone, Filing No. 1 , in '1965' in Eagle
Coudty.' tn iglZ, while still uirder Eagle County jurisdiction, a deed was recorded which, in
esseni:e, divided Tract C into two parcels. This was an illegal subdivision according toJagl_e
County regulation. Since 1977, the parcel has changed hands several times and now First Bank
of Vail owns the parcel.
At the direction of staff, the applicant is requesting this minor subdivision in order to make the lot
"legal."
The applicant is also proposing to remodel and expand the building, adding approximately 964
sq. ft.-t6 the building, improving the exterior of the building and providing landscaping on-site.
The lot is non-conforming with respect to landscape area, therefore, no landscape area may be
reduced on-site. The proposed plan provides additional landscape area on-site.
The applicant is also seeking a parking variance (3 parking spaces) to allow 31 parking spaces,
where 34 parking spaces are required for the proposed expansion. The parking variance may
not be necessary f tne PEC agrees with the staff analysis of the parking requirement for a
furniture store. A furniture store is currently assessed parking based on the retail requirement of
1 parking space for each 300 sq. ft. of net floor area (in this case requiring 15 parking spaces).
There is no specific category for a lurniture store. However, furniture stores tend to occupy large
spaces due td me size and bulk of products sold, the related storage areas, and the number of
customers visiting such a store. Most other communities assess parking for furniture stores at 1
space per 1,000 iq. ft., which in this case would reduce the parking requirement by 10 parking
spaces (requiring 5 parking spaces). The code allows the PEC to determine parking
r6quiremenis when a use does not fit into one of the categories within the regulation_s. Staff
believes that the proposed assessment is reasonable and recommends that the PEC accept the
parking assessment. lf the PEC disagrees with this assessment, then the applicant is requesting

III. MINOR SUBDIVISTON CRITERIA
One of the basic premises of subdivision regulations is that the minimum standards for the
creation of a new lot mustbe met. This proiect will be reviewed under the Minor Subdivision
Crit"ria;purirint to Chaplei f Z, SuOOivisioir Regulations, ol the Town of Vail Municipal Code'
The first criterion to be considered by the Planning and Envaronmental Commission for a
Minor Subdivision APP|ication is:
Lot Area - The Zoning Code requires 25,000 sq. ft. of lot area for a lot located within the
CC3 Zone District.

the subdivision regulations, is as follows:
"The burden of proof shall rest with the applicant to show that the application is in
compliance with the intended purpose of Chapter 17, the Subdivision Regulations and
othei pertinent regulations that the PEC deems applicable. Due consideration shall be
given io fie recommendations by public agencies, utility companies and other agencies
consulted under Section 17.16.090. The PEC shall review the application and consider
its appropriateness in regard to Town policies related to subdivision control, densities
proposed, regulations, ordinances and resolutions and other applicable documents,
bttdcts on the aesthetics of the Town, environmental integrity and compatibility witt
surrounding uses."

proposals will be evaluated and to provide information as to the type and extent of
improvements required.

Cbmmunity Development Department recommends approval of the requested variance. The
recommendation for approval is based on the following factors:
A. Consideration of Factors:
1. The relationship of the requested variance to other existing or
potential uses and structures in the vicinity.
The proposed parcel exists as a separate deeded property and has existed in ftat
fashibn upon annexation to the Town of Vail. As with other properties annexed to

EASEMENT AGREEMENT
This agreement is made and entered into tnis?O day of August, 1996, by and
between Reaut Corporation, a Texas corporation ("Reaut'), whose address is 512 Main
Street, 14th Floor, Ft. Worth, TX761O2, and FirstBank of Vail, a Colorado banking
corporation ("BanK), whose address is 17 Vail Road, Vail, CO 81657.
Recitals
A. Reaut is the owner of certain real property located in the Town of Vail,
County of Eagle, State of Colorado (the'Reaut Parcel") which is more
particularly described on Exhibit A attached hereto and made a part
hereof.
Bank is the owner of certain real property located in the Town of Vail,
County of Eagle, State of Colorado (the "Bank Parcel") which is more
particularly described on Exhibit B attached hereto and made a part
hereof.
The parties wish to provide for a variety of easements that will benefit
both parcels as well as permit an exisiting encroachment upon the Reaut
Parcel.
Now, therefore, in consideration of the mutual undertakings, covenants and
promises contained in this agreement, the parties hereby agree as follows:
1. Definitions. As used in this agreement, the following words, terms and
expressions shall have the indicated meanings:
All references to the grant of an easement or right from one party
to the other party shall include all successors, assigns, agents,
officers, employees, tenants, invitees, licensees and guests of that
party.
All references to any encroachment shall refer to those existing
landscaping and cement walkway encroachments located on the
east portion of the Bank Parcel.
Reciprocal Parking Rights.
2.1 The parties hereby establish for the benefit of each other mutual,
reciprocal, and nonexclusive easements to use the unrestricted
parking spaces and parking areas located and designated by each
owner from time to time on either parcel for overflow parking. The

rights and privileges granted and conferred by this Section 2 shall
be exercised and enjoyed in common by the parties as long as
each owner continues to designate unrestricted parking spaces
and parking areas. However, each owner may upon sixty (60)
days written notice to the other owner act at any time to terminate
the easements created in this Section2by executing and recording
in the records of the office of the Clerk and Recorder for Eagle
County, Colorado a notice stating that the easements created in
this Section 2 are terminated. A copy of this notice shall be
provided to the other owner at least sixty (60) days prior to the
termination of the easements created in this Section 2 and the
recording of the notice. The rights and privileges granted in this
Section 2 should not be interpreted in any fashion as creating any
governmental or regulatory impediment to future development
plans on either parcel, and it is the intention of the parties to create
only such rights and privileges in this Section 2 as may be for the
convenience of the parties as well as being consistent with future
development or improvements on either parcel.
The term of the reciprocal parking easements and rights contained
in this Section 2 shall continue until terminated by either owner
pursuant to Section 2.1.
Each party shall bear the applicable costs of repair, maintenance,
clearing, trash removal, snow plowing and other expenses of
upkeep and preservation of the parking spaces and parking areas
on each party's respective property. The parties may enter into
separate or joint maintenance or repair arrangements concerning
the parking spaces or parking areas as may be appropriate or
desirable. However, each party covenants with the other party to
at all times keep the parking spaces and parking areas in a good
state of repair and maintenance.
Each party agrees to maintain liability insurance in order to protect
against normal risks and hazards relating to the parking spaces
and parking areas on each party's parcel.
The parties intend that the unrestricted parking spaces and parking
areas on each party's property be utilized in a nonexclusive
fashion under the terms of this agreement.
Each of the parties agrees that the unrestricted parking spaces and
parking areas on each party's property will not be used in a
manner which is inconsistent with the right of use granted to any

other party or person by this agreement. Each of the parties
agrees to refrain from placing or storing any equipment or
materials upon the unrestricted parking spaces or parking areas for
any significant length of time or taking any other action which might
hinder the use of the unrestricted parking spaces and parking
areas by other parties or persons.
2.7 Each of the parties agrees to permit access upon and across the
unrestricted parking spaces and parking areas on each party's
property any time for emergency vehicles and govemmental
officials while on ofiicial business.
Easement for Access.
Bank grants to Reaut a nonexclusive easement and right to the use
of the real property located on the Bank Parcel depicted in Exhibit
C as 'Access Easement Area No. 1" for vehicular and pedestrian
ingress and egress to and from both parcels. Reaut grants to Bank
a nonexclusive easement and right to the use of the real property
located on the Bank Parcel depicted in Exhibit C as'Access
Easement Area No. 2" for vehicular and pedestrian ingress and
egress to and from both parcels. The legal description for each
Access Easement Area is described in Exhibit D attached hereto
and incorporated herein by reference.
Each Access Easement Area shall be maintained in a clean and
sanitary condition and good state of repair by the owner of the
parcel on which it is located. This obligation shall include the cost
of paving or repaving the access easement area from time to time.
The owner of either parcel shall have the right to relocate its
respective Access Easement Area in accordance with local law at
any time, provided that ingress and egress will be maintained to
accommodate at least the same volume of vehicular and
pedestrian traffic as is presently accommodated on each
respective Access Easement Area. In the event either Access
Easement Area is relocated in this fashion, the party causing such
relocation shall record such documents with the office of the Clerk
and Recorder for Eagle County, Colorado as may be deemed
appropriate by both parties indicating the relocated Access
Easement Area and the applicable legal description.

5. Miscellaneous.
5.1 This agreement and the easements granted and provided for in this
agreement shall run with the land and shall bind and inure to the
benefit of the present and future owners of both parcels.
5.2 The easements granted and provided for in this agreement are
appurtenant to each of the parcels, and such easements may not
be transfened, assigned or conveyed apart or separately from such
parcels.
5.3 In the event of a breach or attempted breach of this agreement, the
affected owner shall be entitled to seek injunctive relief along with
all other legal and equitable remedies that may be appropriate
under the circumstances. The prevailing party in any such action
shall be entitled to recover an award of its attorney's fees and
costs expended in such ac'tion.
5.4 This agreement shall be construed and enforced in accordance
with the laws of the State of Colorado.
5.5 The term of the easements granted in Sections 3 and 4 of this
agreement shall be perpetual.
