BUILDING PERMIT ISSUANCE TIME FRAME
If this permit reguires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departmenG with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Aoolication.
If yes was answered to any of the questions then a "Public Way" permit is required. you
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies, ALL utilities must field verify (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November lst and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.

DRAINAGE AND CULVERT INSPECTIONS ARE REOUIRED BY PUBLIC WORKS!
Please read and check off each of the items below:
The Town of Vail Building Department has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
The Town of Vail Public Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culvefts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at479-2198 to request an inspection from
the Public Works Department. Allow a minimum of 24 hour notice.
Also, the Town of Vail Public Works Depaftment will be approving all final drainage
and culvert installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Ceftificate of Occupancv issuance.

CODE 5-2-10: DEPOSITSON PUBUC WAYS PROHIBITED
N'Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or caus€ to be littered, tracked or deposited, sand, gravel. rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
\ ruoti..; Abatement: The Director of Public Works may notiff and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
, from any street or alley at the expense ofthe notiited.

\ Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 ofthis code.
NoUce and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section l-4-l of

CODES 7.3A.I AND 7.34-3: PARKING OBSTRUCTING TRAFFIC & IMFOUNDMENT AUTHORIZED
No person shall park any vehicle upon a street or at any other place within this Municipality in such a'manner or under such conditions as to interfere with the free movement of vehicular traffic or proper
street or highway maintenance. (Ord. 2(1968) 5 1)
Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a
street or upon any place within this Municipality in such a manner as to constitute a violation of any
seqtion of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 424-1102, as
amended, the officer shall require the vehide to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in

PUBLIC WORKS PERMIT PROCESS
How it relates to Building Permits:
1) Fill out our check list provided with a buildino oermit aoolication.
lf yes was answered to any of the above questions then a "public way" is
required. You can pick up an application at either community Development,
located at 75 S. Frontage Road or Public Works, located at 1309 Vail Valley Drive.
2) Notice sign offs for utility companies. All utilities must field verify (locate)
respective utilities prior to signing application. Some utility companies require up
to a 48 hour notice to schedule a locate.
3) A construction traffic controUstaging plan must be prepared on a separate sheet
of paper.An approved site plan may also be used. This plan will show locations
of all traffic control devices(signs, cones, etc..) and the work zone, (area of
construction, staging, etc..). This plan will expire on oct, 1sth. and will need to
be resubmitted for approval through the winter.
4) Sketch of work being performed must be submitted indicating dimensions (length,
width & depth of work). This may be drawn on the tratfic iontrot ptan oi a iite
plan for the job.
5) Submit completed application to the Public Works's office for review. lf required,
locates will be scheduled for the Town of Vail Electricians and lrrigation crew. The
locates take place in the morning but, may require up to 4g hours to perform.
6) The Public Work's Gonstruction lnspector will review the application and approve
or disapprove the permit. You will be contacted as to the status and any thai may
needed. Most permits are released within 48 hours of being received, but please
allow up to one week to process.
7) As soon as the permit is processed, a copy will be faxed to community
Development allowing the "Building Permif'to be released. Please do not confusi
the "Public way Permit" with a "Building permit" to do work on a project itself.
NOTE:
* The.above.process is.for work in a public way only.' Public Way Permits are valid only until November iSth.'A new Public way Permit is required each year if work is not complete.

unit and 40 percent allocated to the secondary un'it. The Turnbulls on Arosa Drive
are requesting that the total allowed GRFA be sp1 it evenly with their neighbor who

The applicants wish to retain equal development rights for both sides of the duplex.

comments on two of the items.
In regard to item 6, we are aware of the proposed plans
of Thomas i(. Turnbull and Don Klinger on Lot 11, Block E, Vail
Das Schone Filing I, 2597 Arosa Drive. We are the owners of
Lot 10, Block E, Vail Das Schone, Filing l, directly to the east
of the Turnbull and Klinger structure and vze reside in the
primary unit on Lot 10. ITe feel that the proposed improvements
would not be of any detriment to the neighborhood and we have
no objections to the proposed improvements.
In regard to item 4, we feel that commercial use should not
be allowed in a residential neighborhood. we also feel that
a potential access problem and traffic problem could be created
if this use were permitted.

consideration, hereby commits to issue its policy or policies of title insurance, as identified in Schedule A, in favor of the
proposed Inswed named in Schedule A, as ownei or mortgagee of the estate or interest covered hcreby in the land described or
iefeired to in Schedule A, upon payment of the premiumsiri'd charges therefor; all subject to tho provisions of Schedules A and
B and to the Conditions and Stipulations hereof.
This Commitment shall be effective only when the identity of the proposed Insured and the amount of the policy or policies
committed for have been inserted in Schedule A hereof by the Cornpany,either at the time of the issuance of this Commitment
or by subsequent endoresement,
This Commitment is preliminary to the issuance of such policy or policies of title insurance and all liability and obliga-
tions hereunder shall cease-and termiirate six months after the efiective dat-e hereof or when the policy or policies committed for
shall issue, whichever first occurs, provided that the failure to isue such policy or policies is not the fault of the Company.
CONDITIONS AND STIPULATIONS
l. The term "mortgage", when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter
affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof,
and shal'l fail to disclose such knowledge to the Company in wiiting, the Company shall be relieved from liability for any loss or
damage resulting from any act of reliance hereon to-the extent the Company is prejudiced by failure of the proposed Insured
to so disclose such knowl-edge. If the proposed Insured shall disclose such knowleiige to the Company, or if the Company other-
wise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company_ at its option
may amend Schedule B of this Commitment accordingly, but such amendment strall not relieve the Company from liability
previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties in-
cluded under the definition of Insured in the form of policy or policies committed for and only for actual loss incuned in re-
liance hereon in undertaking in good faith (a) to comply with the requirements hereof or (b) to eliminate exceptions shown in
Schedule B, or (c) to acquiie or create the estate or inierest or mortgage thereon co\€red by this Commitment. In no event shall
such liability exceed the imount stated in Schedule A for the policy or policies committed for and such liability is subject to the
insuring provisions and the Conditions and Stipulations and tfre exilusibns from Coverage of the form of policy or policies com-
mitted for in favor of the proposed lnsured which are hereby incorporated by reference and made a part of this Commitment
except as expressly modified herein.
4. Any action or actions or rights of action that the proposed Insured may have or may bring against the Company arising
out of the siatus of the title to the estate or interest or the-staius of the mortgage thereon covered by this Commitment must be
based on and are subject to the provisions of this Commitment.
STANDARD EXCEPTIONS
In addition 1o the matters contained in the Conditions and Stipulations and Exclusions from Coverage above referred to,
this Commitrrnt is also subject to the following:
l. Rights or claims of parties in possession not shown by the public records.
2. Easements,.or claims of easements, not shown by the public records.
3. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, and any facts which a correct survey and
inspection of the premises would disclose and which are not shown by the public records.
4. Any lien, or right to a lien, for services, labor or material theretofore or hereafter furnished, imposed by law and not
shown by the public records.
5. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first appearing in the public records or
attaching subsequent to the effective date hereof but prior to the date the proposed insured acquires of record for
value the estate or interest or mortgage thereon covered by this Commitment.

These developments intend to connect to the Upper Eagle Valley Sani-
tation District plant for sewage treatment. Al though the Upper
Eagle Val ley Sanitation District received approval to expand their
treatment plant the actual expansion has not been compl eted. This
plant is not meeting discharge standards and is reported to be by-
passing sewage at peak flows. This Department objects to any new
sewer taps being added to the collection system until such time as
the Upper Eagle Val ley Sanitation District plant is in compliance
with waste discharge standards and the capacity of the plant is
i nc rea sed .

Subj:Fife No. 8e-77-74 - Krueger Application for Exemption
This office has reviewed subject appl ication and the site. lt is recommended that
this appl ication be approved subject to the following discrepancies being corrected
prior to the application being heard by the County Commissioners. The noted
discrepancies are:
(a) the right-of-way adjacent to the property should be shaped up and seeded
to maintain the slopes;
(b) the culvert under the driveway should be repl acedwith a minimum 18'r
culvert. This will require reworking of the barrow ditch by the applicant;
(c) al I drainage from the site should be properly channeled into the barrow
ditch, or culvert and not al lowed to enter the roadway.
