Shone Filing 1, and setting forth details in regard thereto.

SUMMARY
The applicant, Mr. Elfriede Devaney, is requesting a variance from Section 12-
6D-6, Setbacks, Vail Town Code, to allow for a residential addition lo encroach
into the rear setback, located at 2565 Cortina Lane/Lot 2, Block F, Vail Das
Shone Filing 1. Staff is recommending approval of the requested variance as a
special circumstance exists on the property and the granting of the variance will
not resull in a granting of special privilege to this individual property.
DESCRIPTION OF REQUEST
The applicant, Mr. Elfriede Devaney, is requesling a variance from Section 12-
6D-6, Setbacks, Vail Town Code, to allow for a residential addition to encroach
inlo the rear selback, located at 2565 Cortina Lane/Lot 2, Block F, Vail Das
Shone Filing 1. A vicinity map is attached for reference (attachment A).
The applicant proposes to construct a new floor on top of the existing garage
which will consisl of two new rooms which will be associated with lhe two existing
units on the site. The existing garage currently encroaches into the rear setback
by approximately eight inches. lf constructed, the proposal will add 7.8 square
feet of bulk and mass within the rear setback with 1 square foot of that being
Gross Residential Floor Area (GRFA) within the rear setback. Proposed floor
plans and elevations are attached for reference (attachment B)
BACKGROUND
According to the Town's files, the existing house was approved by Eagle County
priorto 1979
This property was annexed inlo the Town of Vail by Ordinance 26 of 1986 which
became effective on October 29, 1986. The properly was zoned Two-Family
Primary/Secondary Residential zone district.

Actions of DRB or PEC maybe appealed to the Town Council or by the Town
Council. Town Council evaluates whether or not the PEC or DRB erred with
approvals or denials and can uphold, uphold with modifications, or overturn the
board's decision.
Staff :
The staff is responsible for ensuring that all submiftal requirements are provided
and plans contorm to the technical requirements of the Zoning Regulations. The
staff also advises the applicant as to compliance with the design guidelines.
Staff provides a staff memo containing background on the property and provides
a staff evaluation of the project with respect to the required criteria and findings,
and a recommendation on approval, approval with conditions, or denial. Staff
also facilitates the review process.

this title as would result from strict or literal interpretation and enforcemenl,
variances from certain regulations^may be granled. A practical difficulty or

unnecessary physical hardship may result from the size, shape, or dimensions of
a site or the location ol exisling structures thereon; from topographic or physical
conditions on the site or in the immediale vicinity; or lrom other physical
limilations, street locations or conditions in the immediale vicinity. Cost or
inconvenience to the applicant of strict or literal compliance with a regulation
shall not be a reason for granting a variance.
B. Development Standards Excepted: Variances may be granted only with
respect to the developmenl slandards prescribed for each district, including lot
area and site dimensions, setbacks, dislances between buildings, height, density
control, building bulk control, site coverage, usable open space, landscaping and
site developmenl, and parking and loading requirements; or with respect to lhe
provisions of chapter 11 of lhis title, governing physical development on a site.
12-17-5: PLANNING AND ENVIRONMENTAL COMMISSION ACTION:
Within twenty (20) days of the closing of a public hearing on a variance
application, the planning and environmental commission shall act on the
application. The commission may approve the application as submitted or may
approve the application subject to such modifications or condilions as it deems
necessary to accomplish the purposes ol lhis title, or the commission may deny
the application. A variance may be revocable, may be granted for a limited time
period, or may be granled subjecl to such other conditions as lhe commission

12-17-6: CRITERIA AND FINDINGS:
A. Factors Enumerated: Before acting on a variance application, the planning
and environmental commission shall consider the following factors with respect
to the requested variance:
1. The relationship of the requested variance to other existing or potential uses
and struclures in the vicinity.
2. The degree to which relief from the strict or literal inlerpretalion and
enlorcement of a specified regulation is necessary to achieve compatibility and
uniformity of treatment among sites in the vicinity, or to altain lhe objectives ol
this title withoul grant of special privilege.
3. The effect of the requested variance on lighl and air, distribution of
population, transportation and traffic facilities, public facilities and utilities, and
public safety.
4. Such other factors and criteria as lhe commission deems applicable to the
proposed variance.
B. Necessary Findings: The planning and environmental commission shall make
the following findings before granting a variance:
1. That the granting of the variance will not constilute a grant of special
privilege inconsistent with the limitations on other properties classified in lhe
same district.

2. That the granting of the variance will not be detrimental to the public health,
safety, or welfare, or materially injurious 1o properties or improvements in the
vicinity.
3. That the variance is warranted for one or more of the following reasons:

Approval of the variance shall lapse and become void if a building permit is not
obtained and construction nol commenced and diligently pursued toward

VIII. CRITERIA AND FINDINGS
Consideration of Factors Reoardinq the Setback Variances:
1. The relationship ol the requested variance to other existing or
potential uses and slruclures in the vicinity.
Slaff believes that the proposed setback variance request is
compatible with and comparable to the surrounding development
along Cortina Lane and Davos Trail. The addition of an another story
above the existing garage which is currently wilhin the rear setback
less than a foot in the worst location will not have any negative
impacts on the existing or potential uses and struclures in the vicinity
of the applicant's lot. The proposed addition would add 7.8 square
feet of bulk and mass within the rear setback. Only 1 square foot of
the addition is GRFA. Staff believes that this proposal is very
minimal.
The degree to which reliel from the strict and literal interpretation
and enforcement of a specified regulation is necessary to
achieve compatibility and uniformity of treatment among sites in
the vicinity or to attain the objectives of this title without a grant
ol special privilege.
Staff believes that the granting of the variance will not constitute a
grant of special privilege inconsistent with the limitations on olher
properties classified in the same district. Staff believes there is a
practical difficult associated which this property as the existing garage
was constructed under County regulations and laler annexed into the
Town. To reouire the addition to be oulside of the rear selback would
create the need for a design which would not allow the applicant to be
equally lrealed under the Two-Family Primary/Secondary zone
district. Slafl believes that the degree of relief is very minimal as the
additional bulk and mass within the setback would be 7.8 square feel
with only 1 square foot of that being GRFA.
The effect of the requested variance on light and air, distribution
of population, transportation and tratlic facilities, public facilities
and utilities, and public safety.

Staff does nol believe there would be any negative impacts
associated with this proposal, il constructed, on the above-referenced
criteria.
4. Such other factors and criteria as the commission deems
applicable to the proposed variance.

c. The strict interpretation or enforcemenl of the specified regulation
would deprive the applicant of privileges enjoyed by the owners of
other properties in the same district.
STAFF RECOMMENDATION
The Community Development Department recommends approval of the requesl
for a variance from Section 12-6D-6, Setbacks, Vail Town Code, to allow for a
residential addition lo encroach into the rear setback, located at 2565 Cortina
Lane/Lot 2, Block F, Vail Das Shone Filing 1, and setting forth details in regard
thereto. Staff's recommendalion of approval is based upon the review of the
criteria in Section Vlll of lhis memorandum and the evidence and testimony
presented, subject to the following findings:
1. That the granting of the setback variance will not constitule a grant
of special privilege inconsistenl with the limitations on olher
properties in the Two-Family Primary/Secondary zone district as
the applicant is proposing compliance with the applicable
elements of the Town's planning documents.
2. That the granting of the setback variance will not be detrimental to
lhe public health, safety, or welfare, or materially injurious to
properties or improvements in the vicinity.
3. The variance is warranled for the following reason:
The strict literal interpretation or enforcement of the specified
regulation would result in practical difficulty or unnecessary
physical hardship inconsistent with the objectives of this litle.
Should lhe Planning and Environmental Commission choose to approve this
variance request, the Community Development Department recommends the
following condition:
1. The applicant shall submit an application to amend the
condominium map for Cortina Lane Condominiums, A
Resubdivision of Lot 2, Block F, to staff for review and approval
prior to requesting either a Temporary Certificate of Occupancy or
Certificate ol Occupancy. This variance approval is conlingent
upon the construction of the two new rooms above the garage.

With regard to the proposed addition of two rooms above the existing gerage, the existing
garage extends from 0" to 8" along a 26 fbot wall into the current setback. To build this
addition within the setback would require a small (8") step-back of the addition wall
located above the north garage wall. Because ofthis, a variance is required to build the
north addition wall in the same plane as the garage wall beneath it.
The use of a step-back would create awkward design detail not really consistent with the
design of the existing building.
The variance is small enough that here would be no discernable impact on light and air.
Distribution of populatiorq transportatiorq traffic facilities, utilities, and public safety are
not a factor in this situation.
While there maybe a small benefit in the ease of constructioq what is more important is
an improvement in appearance. There is no other gain to the property's zoning more than
which it is currently entitled. Therefbre we are requesting this variance.

Mr. Devaney,
This letter is to summarize the comments of the Design Review Board in regards to you proposed
addition at their April 21 ,2004, meeting. There comments were as follows.
. All the shutters on the home should match.. The north elevation should be conected as to show the true number, location, and dimensions ol
all existing and proposed windows.. The new proposed windows on the norlh elevation should be less random in location and
dimension.. Suggested leaving the wood on the home verse changing it all to slucco. There needs to be
some 3-Dimensional relief in the elevations.. Show window trim on the elevations.
Staff would also like to see lhe area lo the west of the driveway leading to the garages addressed.
Currently, it is used to slore a great deal of bricks and other miscellaneous items. This area should be
returned to the use as a garden as identified on your plans.
Your application will be scheduled on an agenda once plans addressing all the above comments have
been received. In order to be scheduled on the May 5'n agenda revisions must be submitted by 9:00 a.m.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Apolication.
If yes was answered to any of the questions then a "Public Way" permit is required. you
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verify (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November lst and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job,
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
NOTE: The above process is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this depaftment to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

been completed. Periodic inspection visits were made by me during the construction
process. Robert K. Barrett, P. G. was pres€nt during most of the work to assure that
the soils encountered were as anticipated and to verifu that the construction was
performed in accordance with the design.
Based upon the inspections made during the process, it is my opinion that the wall
was constructed in compliance with the design.

III. ]MPORTANT NOTICE REGARDING ALL SUBMISSIONS TO THE DRB:
A. In addition t,o meeting subnittal requirements, theapplicant. must stake and tape the project site toindicate property lines, building lines and buildingcorners. All trees to be removed must be taped. Allsite tapings and staking must be conpleted prior to the
DRB site visit. The applicant must ensure that staking
done during the wj-nter is not buried by snow.
B. The revie$r process for NEW BUILDINGS normally requirestwo separate meetings of the Design Review Board: aconceptual approval and a final approval . Applicants
should plan on presenting their development proposat ata minimum of two meetings before obtaining final
approval .
C. Applicants who fail to appear before the Design Review
Board on their scheduled meeting date and who have notasked in advance that discussion on their iten bepostponed, will have their items removed fron the DRBdocket until such time as the item has beenrepublished.
D. The following iLens may, at the discretion of thezoning adninistrator, be approved by the CommunityDevelopment Department staff (i.e. a formal hearingbefore the DRB may not be required):
a. Windows, skylights and similar exterior changeswhich do not alter the existing plane of thebuiJ-ding; and

much of the above information as possible onto the sitepIan.

A.Submittal requirements: The obrner or authorized agentof any project requiring design approval as prescribed
by this chapter may submit plans for conceptual reviewby the Design Review Board to the Department of
Community Development. The conceptual review is
intended to give the applicant a basic understanding ofthe compatibility of their proposal with the Town's
Design Guidelines. This procedure is reconmendedprimarily for applications more complex than single-family and two-family residences. However, developersof single-family and two-family projects shall not be
excluded from the opportunity to reguest, a conceptualdesign review. Complete applications must be submitt,ed
10 days prior to a scheduled DRB meeting.
The foLlowing information shall be submitted for a
conceptual review:
1. A conceptual site and landscape plan at a minimumscale of one inch equals tldenty feet;
2. Conceptual elevations showing exterior naterials
and a description of the character of the proposedstructure or structuresi
3. Sufficient information to show the proposal
complies with the development standards of the
zone district in which the project is to belocated (i.e. GRFA, site coverage calculations,

Procedure: Upon receipt of an application for
concept.ual design review, the Department of Connunit,y
Development shall review the submitted rnaterials forgeneral compliance with the appropriate requirements ofthe zoning code. If tbe proposal is in basic
compliance with the zoning code requirements, theproject shall be forwarded to the DRB for conceptualreview. If the application is not generally in
compliance with zoning code reguirements, theapplication and submittal materials shall be returnedto the applicant with a written explanation as to whythe Conmunity Developnent Department staff has foundthe project not to be in compliance with zoning codereguirements. Once a conplete appJ_ication has beenreceived, the DRB shall review the submitted conceptualreview application and support.ing material in order Lodetermine whether or not the project generally complieswith the design guidelines. Survey Requirements

The Town staff would like to make the 199L building season a
snooth one for all contractors, architects, surveyors as well as
the Town. Staff has identified a few problems that surfaced a
number of times last summer which can be avoided without much
additional work. I{ith the following policies, we think $te canprevent most of these problems. If you have guestions, please
call our office and request to speak to a planner so they canhelp you.
Of the seven policies listed below, five simply clarify thepieces of information the Town currently requires. The fast twopertain to projects involving setback or height variances or
t.hose built by owner,/builders.
A. Surey Policy Clarifications
L. rmprovement Location Certificate (ILC) . An ILC will be
required prior to any framing inspections to verify
that height and setback standards have been met. No
framing inspections will be schedul-ed until the ILC is
approved. Please a1low two working days from the time
the ILC is submj-tted to the time the inspection can be
scheduled. Listed below are standards for the
information to be shown on the TLC. Architects and
Builders should be aware that discrepancies exist in
established monumentation in the Vail Valley. Please
consult a surveyor to verify monumentation prior to
developing plans for a site.
2. Format for ILC Information. On the survey prepared for
the franing inspection, indicate the highest points of
the roof ridge using a symbol . Staff will indicate
on the approved field set of the building permit
drawings which ridge(s) need to be shot. The
contractor can then 1et the surveyor know what
information is needed. The roof plan does not need to
be drawn on the ILC. The planner will overlay the
survey on the approved building permit plans. The roof
ridge points identified with the symbol on the ILC
shoul-d align with the roof plan on the Town's set of
building permit p1ans.
3.Roof Heiqht. On the ILC, the surveyor should note the
roof mEteriaf (if any) on the highest point of the
ridge which exists the day of the shooting. The
planner will add the dlnensions of all other naterials
lexcept a cold roof vent) which will be built in the
following weeks. For example, if only the ridge beam
has been constructed the day of the sbooting, the
surveyor should note that on the survey and then the
planner wiII add the dimensions of the insulation,
sheathing, etc. to verify that the finished product
will not exceed the height limit. Ridge height will be
measured to the top ridge of the sheathing. On the
attached diagrams, the point identified with an
asterisk is the top ridge of the sheathing. A cold
roof vent, not exceeding 12 inches in height, measured
from the sheathing to the top of the shingles, is
considered an architectural projection and will not be
included in the height.
Setbacks. When specifying the distance of a setback on
the ILC, note the material existing on the structure
the day of the shooting. Planners will then add any
wall material to what is shown on the survey in order
to determine the final distance of the setbacks in the
same way that will be done for height. If ledges or
supports for rock veneer or any other facing material
have been built into the foundation, measure the
setback to that exterior point (see diagram below).
Final distance will be neasured from the outside edgeof the exterior wal1 material.
Benchrnark. On the ILC, identify the benchmark used for
the basis of the elevations. If the same benchmark is
used throughout the construction process, the
measurement of a building should be consistent. As
long as the same benchnark is used for every shooting,
the building can be measured accurately and shoufd not
exceed the height limit. Items which make good

benchmarks are sewer inverts, section cornersr andproperty corners. Do not use manhole rimsr the asphalt
in streets, or fire hydrants.
B. Suwey Requirenents f,or Projscts with Variances and

For owner/builder projects and developments that have
variances for setback or height, Tohrn staff believes the
following survey information-wil1 be helpful . Staff
encourages all owner/builders to provide this information to
avoid project layout problems that in turn affect height and
setbacks, but rill only require tbese items for proiectg
involving variances.
6. For owner/builders, the Town strongly suggests that a
registered surveyor stake out the foundation prior to
excavation or pouring. Additionally, after the
foundation walls have been poured, we strongly
encourage that a surveyor shoot the efevation of the
foundation wal]. with this information, contractors
will be able to accurately estinate the final height.

able to compensate in the construction process to
ensure that the structure does not exceed the height
1imit.
7. For all projects involving variances to the height or
setback standards, the suggestions listed in Nurnber 6
above will be conditions of approval at the time
Planning and Environmental Commission approval is
received. A11 projects involving a setback variance
must be laid out by a registered surveyor prior to
excavation or pouring. AII projects involving a height
variance nust be surveyed after the foundation walls
have been poured. Once the top of foundation wal1 has
been determined, the contracLor can compensate in the
construction process to ensure that the height approved
by the PEC is what is built.
The Planning staff would appreciate hearing your coflIments on this
nemo, and wilL try to ansvrer any questions you may have. ff you

cooperation.
Contractors wiII be asked to read the above memo and sign the
attached statement to insure that everyone is operating with the
same understanding. Two other documents, Building Permit
fssuance Time Frame and Construction Parking and Material
Storage, must be signed before a building permit is submitted.
The statement on survey policies will be a third item that must
also be signed prior to applying for a permit.
