Dear Mr. Young,
Thank you for submitting an application for the removal of a roof hip at your residence at the above address.
Per our conversations in the last couple of months, the removal of the roof hip would result in a ridge height in
excess of the Town's height regulation (33'for a sloping roof) for homes within the Two-Family Primary
Secondary zone district. Therefore, Staff cannot approve the application as submitted.
In order to keep this application from being reflected on each and every Design Review Board agenda until a
sof ution has been reached, I have withdrawn the proposal from the Town's active design review applications.
However, I would be more than happy to assist you in the process should you choose to re-submit another
application and thereby continue with a proposal of another sort.

This letter is being sent 10 summarize a conversation I had today with Darin from the
West Vail Shell. In that conversation Darin informed me that Shell has asked for
confirmalion that the sand blasted wood sign was required by the Town of Vail and that
changeable copy signs for displaying pricing are not permitted. Per the Town of Vail
Sign Code sand blasted wood signs are one option a business owners can selecl from,
however, all signs are to be made of natural materials (wood, metal, ect.) and no
internally illuminated signs are permitted. In addition, the Sign Code does not permit
changeable copy, pricing, signs.
There still remains one condition of approval which is outstanding. That condition was
for the replacement of the existing conduil and flood light fixtures which illuminated the
previous sign. Per the approval they were to be replaced by a gooseneck type fixture
which was to be selected by the owners and submitted 1o staff for review and approval
prior to installation. Please submit a replacement lixture to staff by no later than March
15, 2004. I have attached a copy of the Design Review Board approval which includes
the conditions which were reouired to be addressed.

all Town of Vail Ordinances, and Holy cross
Requirements.
This project will require a site improvement survey.
This survey sha1l be submitted and staff approved
prior Lo a request for a frame inspection. Under no
circumstances will a frame inspection be done
without an approved site improvement survey.
Exterior surfaces wiLh stucco sha1l be provided wiLh
exterior metal lath as per UBc 4706 with 2 layers of
paper. wi-ndows and doors are required Lo be
adequately flashed(not with just, screed metal) . A
lath inspection is required prior stucco
applicaLi-on.
A11 new construction within the Town of vail will be
required to have an initial inspection by TOV Public
Works Dept. to approve siLe drainage and culvert
installation. This approval musL be complete prior
to any inspection by the Building DeparLment.
This project is restricted from the burning of wood
in fireplaces. Unless the 1ot is a restricEed 1ot
in size, three gas togs fireplaces and three gas
appliances are permitted per unit allowed. Gas 1og
chimneys enclosures shall be one hr. protected.

locati.on and terminaLion, and combusEion air to be
supplied prior to any installation.
Due to Colorado SLaEe StaEutes, all sink faucetts
and shower heads are required to utilize flow
restriction devices. A1so, the maximum water closeL
ftush usage is limited to a maximum of 3.5 gallons
per flush.
The enclosed usable space under Lhe sEairs is
required to be protected by thr fire-resistive

At eaves and valleys an adequate underlayment shall
be provided to protect a structure from ice buildup
and water damage. Two layers of felt solid mopped
to sheathing and between layers or a commercial

SCOPE
This report presents the results of a Soils and Foundation
fnvestigation for ttre proposed residence to be constructed on Lot
4, Block D, VaiI Das Schone riling }Io. L, Town of Vail, Eagle
County, colorado. The investigation was prepared by rneans of test
pits, and laboratory testing of sarnples obtained frorn these pits.
The purpose of this foundation exploration was to determine
the various soil profile components and the engineering
characteristics of the foundation rnateriats, and to provide
criteria from a geotechnical point of view, for use by the
structural engineers in preparing the foundation design, and the
design engineers and architects in preparing grading and drainage
p1ans.
SITE LOCATION AND DESCRIPTION
The site is 0.24 acres Iot located at 2517 Arosa Drive inWest
Vail, north on fnterstate 7O, Eagle County, Colorado. The

topography of the lot is moderately flat, with a gentle slope to
the southeast. The vegetation consisted of dense grass. Drainage
is to the southeast. The lot is vacant.
STTE INVESTTGATTON
The field investigation perforrned on May LB I 1-994 consisted of
excavating, logging and sarnpling 2 test pits. The locations of the
test pits are shown on Drawing No. 1.
The test pits were excavated with a conventional backhoe.
Surnmaries of the test pit logs are detailed on Figures No. L & 2.
Laboratory sarnples were obtained at selected intervals be
driving a 'rCaliforniatt hand sampler into undisturbed soil.
Granular soils hrere sanpled by buLk sanpling.
These samples were returned to our laboratory, inspected and
classified in accordance with the unified soil classification
System and the test pit logs were edited as necessary. To aid in
classifying the soils encountered, and to determine general soil
characteristics, selected laboratory tests (noisture content, unit
weight, grain size distribution, sweJ-I/consolidation), were
perforrned on representative soir samples. surnmaries of the test
result,s are shown on Figures No. 3 - 5.
SUBSURFACE AND GROUNDWATER CONDITIONS
Refer to the summary of test pits, Figures No. L E Z.
subsurface conditions are fairly uniform with t-.0 to l-.5 feet of
topsoil over L.5 feet of organic, clayey-gravelly SAND, over

clayey-sandy GRAVEL to clayey-grave11y SAND with cobbles and
boulders.
We understand that no overlot grading has been done prior to
this investigation.
No Groundwater was encountered in any of the test pits at the
tirne of excavation.
Indexes to Geological Mapping, EagIe County, Colorado,
prepared by Charles S. Robinson & Associates, INC., in J-975, states
that the underlying bedrock is Minturn Formation, overlaid by
glacial moraine deposits.
AIso reviewed were the officiaS- rnaps for the Town of Vail, as
per Ordinance No. 5 and the proposed building envelope is not
located within any geologic hazards.
PROPOSED CONSTRUCTION
No specific design data has been provided, but for the purpose
of this analysis, it has been presuned that the proposed residence
will consist of 2 floors without a basenent, and that loads wilL be
light. rf the proposed project differs significantly fron this
understanding, a review should be made after the plans are nore
cornplete.
FOUNDATTON RECOT.II.IENDAT IONS
Organic clayey-grave11y SAND and clayey-sandy GRAVEL to
clayey-graverry SAND lrith cobbles and boulders will be encountered
in the foundation excavation. The proposed residence should be

founded on conventional type spread footings designed for a naxinum
soil bearing pressure of 2,OOO psf. The footings should be
constructed on the undisturbed clayey-sandy GRAVEL, at a minirnum
depth of 4 feet below the existing ground surface.
The footing excavations shourd be relativery smooth, free of
debris, organics, loose soil, frost, and standing water. Any over_
excavations should be backfilled and compacted to r-oo percent
within 2 percent of optimurn moisture as deterrnined by a standard
Proctor Test (ASTM D-698). A representative of this office shourd
be contacted to inspect the foundation excavation to verify that
the soil conditions are the same as those anticipated in this
report.
After alr of the finar- grading is completed, the bottom of the
footings shourd be covered with a rninimum of 48 inches of backfilr
for frost protection.
Voids reft by the rernoval of cobbles in the bottom of the
footing excavation shourd be filled with lean concrete or a
granular soil with a maximurn particle size of 3 inches compacted to
100 percent of Standard proctor Density (ASTM D_59g), within 2
percent of optinurn rnoisture.
SIJAB CONSTRUCTTON
All excavations made for the foundations under proposed slab-
on-grade areas nust be properly backfirred. with suitable material
compacted to a rninirnurn of 95 percent of the maximum standard
Proctor Density (ASTM D-698). The on-site soils, excLusive of
topsoil and organics are suitable for use as backfill. Due to the
high content of cobbLes and boulders, it wilt be necessary to
screen out rocks larger than 3 inches prior to using this rnaterial
as backfill. Before the backfirl is placed, all water and loose
debris should be renoved fron these excavations.
Prior to the construction of concrete floors, the undisturbed
subgrade, free frorn topsoil and organics, should be proof cornpacted
with a loaded rubber-tired loader to a uniforrn high density.
speciar care shourd be taken in areas where underground utirities
have been installed.
The floor slabs should be reinforced, and joints should be
provided at the junctions of the slab and the foundation walls, so
that a srnarl amount of independent movernent can occur without
causing darnage. The slabs shoul.d be scored in accordance with the
Anerican concrete rnstituters recomnendations to contror cracking.
A granular mat (-3/4 inch gravel, with less than 5 percent
passing No. 200 sieve), should be provided below the fLoor slabs.
This should be a rninimum of four inches in thickness. The purpose
of this granular nat is to provide a capillary break between the
subgrade and the slab.
GROUNDWATER AND DRAIN SYSTEM
Wh11e no ground water was encountered at the time the field
investigation was conducted, it is possibre that seasonar
variations wirr cause fJ.uctuations, or for a water tabLe to be
present in the upper soiLs during the spring months, or after
prolonged periods of rain. A foundation perineter drain
detailed on Figure No. 6 is recommended to reduce the risk
surface water infiltrating the footing subsoils.
REINFORCTNG
The foundation shourd be well reinforced and rigid enough to
withstand differential settlernents. Foundation warls retaining
earth should be designed to resist an equivaLent fluid pressure of
40 pcf for an rractivet case assurning a level drained backfill
condition.
CRAWIJ SPACE COVER
when moist soils are encountered in the excavation, the ground
surface in crawl space areas shourd be covered with an impervious
noisture barrier sealed against tbe footings. This wirl herp to
reduce hunidity in the crawr space area. The crawl space should be
vented.
BACKI'TIJI.I AND ST'RFACE DRAINAGE
The backfill placed around the found.ation walls should not
settle excessively after cornpletion of construction and the top one
foot of the backfilL rnaterial must be relativery impervious. The
on-site soils, exclusive of Topsoil and organics are suitable for
use as backfill. Due to the high content of cobbres and bou]ders,
it will be necessary to screen out rocks larger than 6 inches prior
to using this materiaL as backfi1l.

Backfi]l should be noistened or dried to near its optinun
rnoisture content and compacted to at least 9O percent of the
maximum Standard Proctor Density. Structural backfill should be
cornpacted to at least 95 percent of the maximum Standard Proctor
Density.
Surface water running toward the structure from upslope areas
should be diverted around and away frorn the building by means of
drainage swales or other sinilar measures.
The final grade should have a positive slope away from the
foundation walls on all sides. A nininum of 12 inches in the first
10 feet is recornmended. Downspouts and sil1 cocks should discharge
into splash blocks that extend beyond the lirnits of the backfill.
The use of long downspout extensions in place of splash blocks is
advisable.
LAWN IRRIGATION
Do not install sprinkler systems next to foundation walls,
porches or patio slabs. If sprinkler systems are j.nstaLled, the
sprinkler heads should be placed so that the spray fron the heads,
under full pressure, does not fall within five feet of foundation
wa11s, porches or patio s1abs. Lawn irri-gation must be controlled.
ff the future owners desire to plant next to foundation waIls,
porches or patio slabs, and are willing to assume the risk of
structural damage, etc., then it is advisable to plant only fJ.owers
and shrubbery (no lawn) of varieties that require very 1ittle
rnoisture. These flowers and shrubs should be hand watered only.

UTSCEIJIJANEOUS
The reconnendations provided herein are based on experience in
the area and frorn the on-site fierd exploration. The infornation
obtained form the field exploration and raboratory testing reflects
subsurface conditions only at the specific locations at the
particutar tines designated. subsurface conditions at other
locations and times may differ from the conditions at these
locations. The extent of any variations between the test pits rnay
not appear evident untir excavation is performed. However, onry
urinor variations are expected. rf during construction conditions
appear to be different, this office should be advised so re-
evaluation of the recommendations may be made.
This report has been prepared for the exclusive use of Mike
Lauterbach for the specific appl-ication to the proposed resj-dence
structure to be located on Lot 4, Block D, Vail Das Filing No. L,
Eagle County, Colorado.

paragraph, a lull time employee is one who works an aterage of a minimum of thirly (30)
hours each week.
A Type I EHU may be sold, translerred, or conveyed separalely from any single family two
lamily dwelling only if il meels the lollowing condilions.:
a) lt must be used by the orvner ot the.Type I EHU as a permanent resiience. For
the purpose of this paragraph, a permanent residence shail mean the home or
place in which one's habitation is lixed and to which one, whenever he or she is
absent has a presenl inlention of returning atter a departure or absence theretrom
regardless of the duralion ol absence. In determining what is a permanent
residence, the Town stalt shall lake the lollowing circumslances relaling lo the
owner ol rhe residence inlo account: business pursuils, employment, income

In consideration of ihe issuance ol a revocable permit for the structure above indicated,
applicant agrees as follows:
{l.That the structure herein authorized on a revocable permit basis is restricted
exclusively to the land above described.
That the permit is limited specifically to the type of structure described in this
application.3. That the applicant shall notify the Town Manager, or his duly authorized agent, tlventy-
four hours in advance of the time for commencement of construction, in order that
proper inspection may be made by the Town.4. The applicant agrees to indemnify and hold harmless the Town of Vail, its officers,
employees and agents from and against all liability, claims and demands on account of
injury, loss or damage, including without limitation claims arising from bodily injury,
personal injury, sickness, disease, death, property loss or damage, or any other loss of
any kind whatsoever, which arise out of or are in any manner connecled with
applicant's activities pursuant to this permit, if such injury, loss, or damage is caused in
whole or in part by, or is claimed to be caused in whole or in part by, the act, omission,
error, professional error, mistake, negligence or other fault of the applicant, his
contractor or subcontractor or any oflicer, employee or representative of the applicant,
his conlractor or his subcontractor. The applicant agrees to investigate, handle
respond lo, and to provide defense for and delend against, any such liability, claims, or
demands at the sole expense of the applicant. The applicant also agrees to bear all
other expenses relating thereto, including court costs and attorney's fees, whether or
not any such liability, claims, or demands alleged are groundless, false, or fraudulent.
The applicanl agrees to procure and maintain, at its own cost, a policy or policies of
insurance sufficient to ensure against all liability claims, demands and other obligations
assumed by the applicant pursuant to this Paragraph 4. The applicant further agrees
to release the Town of Vail, its officers, agents and employees from any and all
liability, claims, demands, or actions or causes of actions whatsoever arising out of any
damage, loss or injury to the applicant or to the applicant's propefi caused by the
Town of Vail, its officers, agents and employees while engaged in maintenance or
snow removal activities or any other activities whatsoever on Town of Vail properly,
streels, sidewalks, or rights-of-way.

That the permit may be revoked whenever it is determined that the encroachment,
obstruction, or other structure constitutes a nuisance, destroys or impairs the use of
the right-otway by the public, constitutes a traffic hazard, or the property upon which
the encroachment, obstruction, or structure exists is required for use by the public; or it
may be revoked at any time for any reason deemed sufficient by the Town of Vail.
That the applicant will remove, at his expense, the encroachment, obstruction, or
structure within ten days after receiving notice of any revocation of said permit.
That the applicant agrees lo maintain any landscaping associated with the
encroachment on the right-otway.
That in the event said removal of the encroachment, obstruction, or structure is not
accomplished within ten days, the Town is hereby authorized to remove same and
have the right to make an assessment against the property and collect the costs or
removal in the same manner as general taxes are collected.

provided in Chapter ie.-SZ - empfyee Housing. For the Purposes ol this Seqion' a lull-time

week. There shall be five (5) categories of EHUs: Type l, Type ll, Type lll, Type lv and Type
V. Provisions relating to eicn type of EHU are set forlh in Chapler 18'57 - Employee Housing

III. IMPORTANT NOTICE REGARDING ALL SUBMISSIONS TO THE DRB:
r [. ln addition to meeting submittal requiremenls, the applicant must stake and
tape the project site to indicate property lines, building lines and building
corners. All trees to be removed must be taped. All site tapings and staking
must be completed prior to the DRB site visit. The applicant must ensure that
staking done during the winter is not buried by snow.
B. The review process for NEW BUILDINGS normally requires two separate
meetings ot the Design Review Board: a conceptual approval and a final
approval. Applicants should plan on presenting their development proposal at a
minimum of two meetings before obtaining final approval.
C. Applicants who lail lo appear before the Design Review Board on their
scheduled meeting date and who have not asked in advance that discussion on
their item be posponed, will have their items removed from the DRB docket
until such time as the item has been republished.
D. The following items may, at the discretion of the zoning administrator, be
approved by the Community Development Department staff (i.e. a lormal
hearing before the DRB may not be required):
a. Windows, skylights and similar exterior changes which do not alter the
existing plane ol the building; and
b. Building addition proposals not visible from any other lot or public space.
At the time such a proposal is submitted, applicants must include letters
from adjacent property owners and/or from the agent for or manager of
any adjacent condominium association stating the association approves
of the addition.
E. lf a property is located in a mapped hazard area (i.e. snow avalanche, rockfall,
flood plain, debris flow, wetland, etc), a hazard study must be submitted and
the owner must sign an affidavit recognizing the hazard report prior to the
issuance of a building permit. Applicants are encouraged to check with a Town
Planner prior to DRB application to determine the relationship of the property to
all mapped hazards.
F. For all residential construction:
a. Clearly indicate on the floor plans the inside face of the exterior
structural walls of the buiEing; and
b. Indicate with a dashed line on the site plan a four foot distance from the
exterior face of the building walls or supporting columns.

NOTE: In order lo clarify the inter-relation of the various developmenl proposal
components, please incorporate as much of the above information as possible
