(5)If a petition isfiled pursuant to subsection (1 )or(2)of this section andthe territory sought to be annexed meets the specifications of section 31-12-106 (1),the governing body of the municipality withwhichthe petition isfiledshall thereupon initiate a n nexa tion proceedings pursuant tothe appropriate provisions of section 31-12-106 (I).Intheevent that any governing bodyfailsto initiate such annexation proceedings withina period of oneyearfrom the time that such petition isfiled ,annexation maybe effected byan action inthe nature of mandamus to the district court of the county where thelandtobeannexedis located,andthepetit ioner's court costs and attorney's fees incidenttosuch action shallbe borne bythe municipality . (7)For the purpose of determining the compliance withthe petition requirements inthis section,a signature byany landowner shallbesufficientsolongasany other owner infee of anund ivided interest in the same area ofland does not object in writing tothe governing body of the annexing municipality within fourteen days after thefiling of the petition for annexation or annexation election.The entire area of thelandsignedforshallbe c omputedas petitioning fora nnexation if suchsigning landowner has become liablefor taxes inthelast preceding calendar year or isexempt bylawfrom payment of taxes .One who is purchasing land under a written contract duly recorded shallbe deemed the owner of thelandwhich issubjecttothe contract ifhe haspaid the taxes the reon forthenext preceding taxyear.Thesignersforanarea owned by a corporation,whether profit or nonprofit,shallbethesame persons as those authorized to convey landforsuch corporation. Thefuture Arosa-Garmisch park will serve the adjacent neighborhoods,thus becoming a destination for nearby residents.Duetotheuse of thesiteasa park,negative impacts onthe region as well as the community willbe negligible.The proposed park will have a number of uses ranging from passive overlooks to unique play features forchi ldren of various ages.A shelter including restroom facilitieswill accommodate larger groups (+/-20 people).The proposed park is located atthe intersection of Arosa Drive and Garmisch Drive in West Va il. The terrain of the park is gently sloping near the street transitioning tovery steep onthe north portion of the site.Onthe northeast side of thesiteisaTown of Vail affordable housing complex accessible from Garmisch Street.Handicapped accessto shelters and play areas willbe reachable from the affordable housing complex.An additional handicapped parking space may be added tothe proposed parking lot adjacent tothis complex. Theterrain of the park is gently sloping nearthe street transitioning tovery steep onthe north portion ofthesite.On the northeast side of thesiteisa Town of Vail affordable housing complex accessible from Garmisch Street.Handicapped accessto s helters and play areaswillbe reachable from the affordable housing complex.An additional handicapped parking space may be added tothe proposed parking lot adjacent tothis complex. Effect of the use on light and air,distribution of population,transportation facilities, utilities,schools,parks and recreation facilities,and other public facilities and public facilities needs. OnFebruary19,1997,theTownofVailand t he UnitedStatesForest Service,entered intoan agreement toexchange approximately 62.268acresofNationalForest Lands forapproximately 75 .02 acresof non-federal lands inEagle County.Theexchange implementstheTow n ofVail LandownershipAdjustmentAnalysis,andportionsof t heTownofVailComprehensiveOpen LandsPlan.Thisunplattedlot waspart ofthisexchangeandwasannexedby theTownofVail inApril1999andzonedOutdoorRecreation. TheTownofVailpurchased fourlots,located at2497,2485,2487,and2477Garmisch ,from twofamilies in1990.Theparkisproposedtobelocatedpartially onlots1(2497),2 (2487),and 3(2485).Whenpurchasingtheselots,Council identifiedthemtoincludea neighborhoodpark, openspace,oremployeehousing.Th e1994Comprehensive OpenLandPlan statesthatthe landshouldbeused forapublic use,whichincludesemployeehousing.Neighborhood participation forproposals onthissitebeganinOctober of1998andcontinuedthrough Novemberwithneighborhoodmeetingsw ith designers.Councilapprovedthe development of sixunitsandaneighborhoodparkonNovember17,1998.OnJanuary20 ,1999andagainon June16,1999,thesiteplanforthehousingwasbroughttotheDesignReviewBoardfora conceptualreview.OnJanuary 26,1999,Council approvedtheconceptofa4-plexandduplex ontheeastsideofthelot,withtheneighborhoodparkonthewestsideofthelotsandonthe landannexedinApril1999.OnJuly7 ,1999theparkwasbroughttotheDesign ReviewBoard foraconceptual review. (See Attached Map) Theemployeehousingandpark willbedevelopedsimultaneously, 1 aspartofthesame row~ •• developmentteam.Theapplicant's letterhasbeenattachedforreference. II.STAFF RECOMMENDATION TheCommunityDevelopmentDepartmentrecommends approval oftheconditionalusepermit foraneighborhoodpark,subjecttothefollowing findings: 1.Thattheproposedlocationoftheuse isinaccordancewiththepurposesofthe conditionalusepermitsectionofthezoningcodeandthepurposesofthedistrict inwhichthesiteislocated. 2 .Thattheproposedlocationoftheuseandtheconditionsunderwhichitwillbe operatedormaintainedwillnotbedetrimentaltothepublichealth,safety,or welfareormateriallyinjurioustopropertiesorimprovementsinthevicinity. 3.Thattheproposedusewillcomplywitheachoftheapplicableprovisionsofthe conditionalusepermitsectionofthezoningcode. III.ISSUESFOR DISCUSSION ItisthePlanningandEnvironmentalCommission's roletoreviewtheproposeduseofthesite asapark.ThefollowingarediscussionitemspertainingtothePlanningandEnvironmental Commission's roleinreviewingthisConditionalUsePermit: A.Park Elements to include: Restroom PicnicShelter ADAAccessiblePath OpenTurfArea SoftSurfaceTrailtoCortinaLane ParellelParking OneHandicappedParkingSpace MultiplePlayStructures B.Vehicle Access Theparkisproposedtohave5parellelparkingspacesandonehandicapparkingspace withintheparkinglotfortheemployeehousingcomplex. C.Pedestrian Access Pedestrianaccesswillbeprovidedtoallstructuresandplayequipment,meetingADA requirements.TheTownofVailwillbeprovidingasidewalkconnectionacrossthe propertyofboththeparkandthehousing.Thereisalsoaproposedtrailfromthepark toCortinaLane. D.Potential Benefits Theproposedparkwillprovideactiveandpassiveparkusesprimarilyforthe neighborhood.Therearechildren'splayareasprovidedformultipleagegroups.A restroomandpicnicshelterhavealsobeenprovided.Allstructuresandplayequipment areaccessibleperADArequirements. IV.REVIEWCRITERIAFORTHIS REQUEST 2 •• ThereviewcriteriaforarequestofthisnatureareestablishedbytheTownofVailMunicipal Code.TheArosaiGarmischPark islocatedintheOutdoorRecreationandResidentialCluster zoned istricts.Theproposalissubjecttotheissuanceofaconditionalusepermit inaccordance withtheprovisionsofTitle12,Chapter16.ForthePlanningandEnvironmentalCommiss ion's reference,theconditionalusepermitpurposestatementindicatesthat: Inordertoprovidetheflexibility necessarytoachievetheobjectivesofthistitle,specified usesarepermittedincertaindistrictssubjecttothegrantingofaconditionalusepermit. Becauseoftheirunusualorspecialcharacteristics,cond itional usesrequirereviewso thattheymaybelocatedproperlywithrespecttothepurposesofthistitleandwith respecttotheireffectsonsurroundingproperties.Thereviewprocessprescribedinthis chapterisintendedtoassurecompatibilityandharmoniousdevelopmentbetween conditionalusesandsurroundingpropertiesintheTownatlarge .Useslistedas conditionalusesinthevariousdistrictsmaybepermittedsubjecttosuchcondit ions and limitationsastheTownmayprescribetoinsurethatthelocationandoperationofthe condit ional useswillbeinaccordancewiththedevelopmentobjectivesoftheTownand willnotbedetrimentaltootherusesorproperties.Whereconditionscannotbedevised , toachievetheseobjectives,applicationsforconditionalusepermitsshallbedenied . A.Consideration ofFactors: 1.Relationship andImpactoftheuseonthe development objectives ofthe Town. This neighborhoodhasbeen identifiedasinneedofaneighborhoodparkinthe ComprehensiveOpenLandsPlan.Throughnumerousneighborhoodmeetings, participantshaveidentifiedtheneedforpassiveandactiveparkuses .Staff believesthattheproposalfollowsthedevelopmentobjectivesoftheTownofVail. 2.Theeffectoftheuseon light andair,distribution of population, transportation facilities,utilities,schools,parksandrecreation facilities, andother public facilities needs. Theproposedparkwillfulfillalong-statedneedforaneighborhoodpocketpark intheWestVailneighborhoods.Theparkwillhavenoeffectontheotherabove- mentionedcriteria. 3.Effectupon traffic with particular referenceto congestion,automotive and pedestrian safetyandconvenience,traffic flowand control,access, maneuverability,andremovalofsnowfromthe street and parking areas. Staffbelievesthattheproposedneighborhoodwillnothaveanegativeeffecton theabovereferencedcriteria.Thereisproposedon-streetparking,alongwitha handicapparkingspaceproposedinconjunctionwiththehousingelement, whichwillbedesignatedasparkparking. 4.Effectuponthecharacteroftheareainwhichthe proposed useIstobe located,including thescaleandbulkofthe proposed useIn relation to surrounding uses. 3 •• Staffbelievesthisusewillhaveapositiveimpactonthecharacterofthe neighborhoodbyprovidingopenspaceandrecreationalactivitiesforthe neighborhood.Alloftheproposedstructuresonthesitewillbeintegratedinto thesite. B.Findings ThePlanningandEnvironmentalCommissionshallmakethefollowingfindingsbefore grantingaconditionalusepermit: 1.Thattheproposedlocationoftheuseisinaccordwiththepurposesofthe conditionalusepermitsectionofthezoningcodeandthepurposesofthedistrict inwhichthesiteislocated. 2.Thattheproposedlocationoftheuseandtheconditionsunderwhichitwouldbe operatedormaintainedwouldnotbedetrimentaltothepublichealth,safety,or welfareormateriallyinjurioustopropertiesorimprovementsinthevicinity. 3.Thattheproposedusewouldcomplywitheachoftheapplicableprovisionsofthe conditionalusepermitsectionofthezoningcode. 4 Arosa/Garmisch Park Site 4 2441 3 2458 2 2466 10 2447 1 2556 N 14 2 24572256622565 E S • Project Description: • Arosa-Garmisch Park Town ofVaH June 14,1999 • Relationship and impact oftheuscon development objectives of the Town. Thefuture Arosa-Garmisch parkwillservethe adjacent neighborhoods,thus becoming a destination for nearby residents.Duetotheuse of thesiteasa park,negative impacts onthe regionaswellas the community willbeneglig ible.The proposed park willhavea number of uses ranging from passive overlooks touniqueplayfeaturesfor children of various ages.A shelter including restroom facilitieswill accommodate larger groups (+/-20 people).The proposed park is located atthe intersection of Arosa Drive and Garmisch Drive inWestVail. The terrain of the park is gently sloping near the street transitioning tovery steep on the north portion of the site.On the northeast side of thesiteisaTown ofVaiI affordable housing complex accessible from Garmisch Street.Handicapped accessto shelters and play areaswillbe reachable from the affordable housing complex.An additional handicapped parking spacemay be added tothe proposed parkinglot adjacent tothis complex. Effect of the uscon light and air,distribution of population,transportation facilities, utilities,schools,parks and recreation facilities,and other public facilities and public facilities needs. Theintent of the park isforthesiteto remain open"with minimal struc tures.Asa result,there willbe negligible environmental impacts with respect tolight ,air,and pollution.The primary users of this park will typically be within walking distance.The park's location strengthens the connections between private andpublicusers.A pedestrian bridge is proposed at Cortina Lane linkingthe Arosa-Garmisch parktothe homes tothewest. The proposed restroom facility istobe small (onetotwofixtures)andwillonly have a minor impactupon utility needsandcosts .A portion of thesitewillneed irrigation forthe growing season.These needs w ould beme t withan automated underground irrigation system. Effect upon traffic,with particular reference to congestion,automotive and pedestrian safety and convenience,traffic flow and control,access,maneuverability,and removal of snowfrom the streets and parking area. As stated,t hepr imar y userso fthi s proposed par kwill be wi thin walkingd istance.T his indicate s that the park's effect o n c ongestion,trafficflow,etc.at the Arosa-Garmisch intersection willbe minimal.With people crossing streets toreachthepark,pedestrian safety willbe carefully considered,however,few problems are expected duetotheir limited traftic. Effect upon the character ofthe area in which the proposed useistobe located,including the scale and bulk of the proposed usein relation to surrounding uses. •• Because the proposed useisapublicparkitsrelationto surrounding uses will bea positive one. Itis particularly true inthis case duetothe surrounding usebeingprimarily residential neighborhoods.Thescaleo f theprojectissmall enough tonothave detrimental impacts yetstill capable of meeting therecreationalneeds of neighboring residents and their families. Theplansfortheparkandaccompanying architectural elevations areintendedtobe preliminary. Additional studies andalternatives will bedeve loped astheparkevolves.These drawings are included in order toconveythedesignintentfortheparkanditsamenities.
