RE: Sign Program Amendment
Dear Mark:
At their November 3,1999, the Design Review Board reviewed your proposal for an amendment
to the sign program at Crty Market, located at2109 N. Frontage Road West. The following were
their comments and concerns:
1. No tenant sign allowed on Frontage Rd.2. Sign locations need to respect the existing architecture ofthe building.
3. The type of sign prcferred was indirectly lit individual letters on a raceway. The lighting
shall be the same fixture for each sign.4. The sign sizes are limited to 5 sq. ft. for those with no extcrior access/frontage.5. Forthe retail space with frontage. sign size is limited to 2.5 sq. ft. for each 5 lincal ft. of
frontage. This sign shall be the individual pan-chanellcd lcttcrs similar to City Market's
existing signs.
6. The Design Review Board was also in favor of the location of thc proposed parking
garage sign. should the Planning and Environmental Commission choose to grant the
variance request on November 22, 1999.
Each individual sign and fixture can be approvcd at the stafflevel. Should you have any
qucstions or conccrns. please do not hesitate to contacr me a\ 970-179-2369.

Dear Charlie,
Thank you for your e-mail regarding the Town Council's call-up of the City Market Sign
Variance. At the applicant's request, the application for the sign variance has been withdrawn.
City Market is interested in exploring other opportunities to accentuate the underground parking.
After a meeting on site with staff, the applicant agreed with staff that doing some sort of
architectural feature above the entry-way to the garage and additional lighting would bring more
attention to the garage parking than the sign proposed. Most likely, these could be done within
the Town Code, requiring no variances. The sign code also allows for a traffic-directional sign
at 1 sq. ft. or 4 sq. ft, depending on the message. The code also allows for a joinfdirectory (the
First Bank Building in West Vail, for example). The applicant has expressed interest in both of
these options, but also has concerns about the size and number allowed. Should the applicant
pursue another variance, staff will likely continue to recommend denial, depending on the
proposal. The purpose statement of the variance section of the sign code states:
In order to prevent or to lessen such practical difficulties and unnecessary physical hardships
inconsistent with the objectives of this Title, variance from the regulations may be granted. A
practical difficulg or unnecessary physical hardship may result from the size, shape, or
dimensions of a structure, or the location of the structure, from topographic or physical conditions
on the site or in the immediate vicinity, or from other physical limitations, street locations, or traffic
conditions in the immediate vicinity. Cost or inconvenience to the applicant of strict or literal
compliance with a regulation shall not be a reason for granting a variance,
Should you have any further comments or concerns, please do not hesitate to contact me at

DESCRIPTION OF THE REQUEST
The applicant, City Market, lnc., is requesting a variance to allow for one additional
building identification sign located at 2109 N. Frontage Rd. WesWail Commons City
Market, Vail das Schone 3m Filing. The applicant is proposing to add a sign which states
"City Market Parking' above the parking structure. This sign will be approximately 20 sq.
ft. A rendering of the sign, along with the proposed location, have been attached for
reference. The applicant's letter argues that this additional sign is needed because the
lower level parking entrance is ditficult to see from the road. The applicant's letter has
also been attached for reference.
The Sign Variance Sections purpose reads as follows:
In order to prevent or to lessen such practical difficulties and unnecessary
physical hardships inconsistent with the objectives of this Title, variance from the
regulations may be granted. A practical difficulty or unnecessary physical
hardship may result from the size, shape, or dimensions of a structure, or the
location of the structure, from topographic or physical conditions on the site or in
the immediate vicinity, or from other physical limitations, street locations, or trafflc
conditions in the immediate vicinity. Cost or inconvenience to the applicant of
strict or literal compliance with a regulation shall not be a reason for granting a
varian@.
ROLES OF THE REVIEWING BOARDS
Plannino and Environmential Commission:
Action:The PEC is responsible for final approval/denial of a variance.
The PEC is responsible for evaluating a proposal for:
t
A. Special circumstances or conditions applying to the land, buildings, topography,
vegetation, sign structures or other matters on adjacent lots or within the
adjacent right of way, which would substantially restrict the effectiveness of the
sign in question: provided, however, that such special circumstances or
conditions are unique to the particular business or enterprise to which the
applicant desires to draw attention, and do not apply generally to all businesses
or enterprises.B. That such special circumstances were not created by the applicant.C. That the granting of the variance will be in general harmony with the purposes of
this Title, and will not be materially detrimental to the persons residing or working
in the vicinity, to adjacent property, to the neighborhood, or to the public welfare
in general.
D. The variance applied for does not depart from the provisions of this Title any
more than is required to identify the applicants business or use.E. Such other factors and criteria as the Planning and Environmental Commission
deems applicable to the proposed variance.
Desion Review Board:Action: The DRB has NO review authority on a variance, but must review any
accompanying DRB application.
III. STAFF RECOMMENDATION
Staff recommends denial of the applicant's reguest for the building identification sign
variance based on the following findings:
1. That no special circumstances or conditions apply to the land, building,
topography, vegetation, sign structures, or other matters on adjacent lots or
within the right-of-way, which would substantially restrict the etfectiveness of the
sign.2. That granting the variance would not be in general harmony with the purpose of
the sign code.3. The variance applied for does depart from the provisions of the approved sign
program more than is required to identify the applicants business use.
IV. APPROVEDVAIL COMMONS SIGN PROGRAM
According to the approved Vail Commons / City Market Sign Program, the signage that
is currently allowed specifically for City Market is one 20 sq. ft. Building ldentification
sign, and one 20 sq. ft. wall sign. Each individual retail establishment is allowed signage
per the code. To date, no sign variances have been granted.
V. CRITERIA AND FINDINGS
Before the Planning and Environmental Commission acts on a variance application from
the approved sign program, the applicant must prove physical hardship, and the
Planning and Environmental Commission must find that:
There are special circumstances or conditions applying to the land, buildings,
topognphy, vegetation, sign structures or other mafters on adjacent lots or within
the adjacent right of way, which would substantially restrict the effectiveness of
the sign in question: provided, however, that such special circumstances or
conditions are unique to the particular busrness or enterprise to which the
applicant desircs to dnw aftention, and do not apply genenlly fo a// busrnesses
or enterpises.
Staff Response: Staff does not believe that there are special circumstances
which warrant the granting of this variance. While it is difficult to identify the
parking structure as belonging to Vail Commons, staff believes that additional
signage is not necessary. Staff would instead encourage the applicant to place
some sort of signage regarding the availability of underground parking within City
Market. Staff believes that the existing signage is adequate in identifying the
business. The applicant would be allowed traffic control signage not to exceed
one sq. ft. (or 4 sq. ft. for multi-purpose traffic control signage.)
That such special circumstanes yvere not created by the applicant.
Staff Response: As stated above, staff does not believe that special
circumstances exist.
That the gnnting of the vaiance will be in genenl harmony with the purposes of
the sign code, and will not be mateially detrimental to the percons residing or
wofting in the icinity, to adjacent propetu, to the neighborhood, or to the public
welfae in genenl.
Staff Response: The current Vail Commons / City Market Sign Program
allows for adequate signage. Cunently, City Maftet has one tenant sign above
the entrance to City Market, along with a building identification sign on the
building facing North Frontage Road. Staff believes that this existing signage is
adequate.
The uaiance applied for does not depaft frcm the provisions of this Title any
more than is rcquired to identify the applicant's busrness oruse.
Staff Response: As stated above, staff believes that there is already
adequate signage to identify the applicant's business. The additional signage is
proposed to state "City Market Parking." Staff does not feel that the proposed 20
sq. ft. sign is necessary to identify the applicants business and staff does believe
that there are alternatives to encourage use of the parking structure other than
additional signage. In addition, one of the existing signs could be relocated to
this location.

For the reasons set out above, City Market' Inc' respectfully requests a variance from the

Before the Planning and Environmental Commission acts on a variance application from

That the granting of the variance wilt be in general harmony with the purposes of
the sign code, and witl not be materially detrimental to the persons residing or
working in the vicinity, to adjacent property, to the neighborhood, or to the public

Staff Response: The current Vail Commons / City Market Sign Program
allows for adequate signage. Currently, City Market has one tenant sign above
the entrance to city Market, along with a buibing identitication sign on the
building facing North Frontage Road. Staff believes that this existing signage is
adequate.
The variance applied for does not depart from the provisions of this Title any

Statf Response: As stated above, staff believes that there is already
adequate signage to identify the applicanfs business. The additional signage is
proposed to state "city Market Parking." stalf does not leel that the proposed 20
sq. ft. sign is necessary to identify the applicant's business and staff does believe
that there are altematives to encourage use of the parking $ructure other than
additional signage. In addition, one of the existing signs could be relocated to
this location.

non-illuminated, brown and white parking sign which is curently being used. This
brown and white trafhc control sign is too small to adequately identifu the location of the
underground parking structure. As such, it fails to draw the attention of customers to the
existence of the parking structure and because it is non-illuminated' fails to function at all
after dark.
The consequence of poor visibility and lack of identifying markers on the parking
structure is that customers drive past the entrance to the lower level parking garage onto
the upper level parking are4 unaware that the lower level parking area either exists or
that it belongs to City Market. This ueates a situation where traffic congests on the upper
level, while the lower parking area is relatively unused.
This proposed sign will bring attention to the fact that there is an additional underground
parking area and that this space is for City Market and Vail Commons customer use.
This will encourage customers to use the lower level parking garage, thus getting them
out of the snow and inclement weather and at the same time. alleviate some of the traffic
congestion on the upper deck.
Under these unique circumstances, the current statutory limitations on signage create an
undue burden and an unnecessary physical hardship on the City Market and the Vail
Commons Shopping Center. Furthermore, in as much as demand for parking in West
Vail often exceeds supply, the community as a whole is not realizing the fulI benefit of
this extensive parking facility.
t
This proposed sign will conform with the overall sign plan for Vail Commons in type,
size and color, and it will be placed at such a distance from the front entrance of the
building and other signs in the complex that it will not present a cluttered look. This sign
is also consistent with the type and size that would otherwise be found on neighboring
buildings. In essence this proposed parking structure identification sign will mitigate the
poor visibility and lack of identiffing markers on the lower level parking garage and at
the same time this sign is consistent with the unique development of Vail Commons and
the Town of Vail.
For the reasons set out above, City Market, Inc. respectfully requests a variance from the
Vail sign ordinance.

Subject City Market Sign Variance

"Judy Rodriguez" (commdev@ci.vail.co.us>
Please allow me a few thoughts about this issue.
1. City Market (rea11y Kroqer Cos., the largest super market operator
in this count,ry, and maybe on this planet) was able to effectively
receive a subsidy from the Town of Vail by waving their checkbook and
convincing the Town Council (I know, not aI1 of you guys) to 1et them
develope a supermarket and other comnerciaL space on Town oltned property
in conjunction with an "affordable housing project". They hired an
architect and a 1oca1 developer, both familiar with Vail's zoning
ordinances and related requirements , and they built their buildinq. At
that time, they agreed to Town rules and requlations, and were issued, I
assume. a Certificate of occupancy after they renoved an iL1eqa1 sign on
the southwest corner of the building that directed autos to underqround
parking and also at the same Eime effectively gave then another building
identification sign.
2. Now, three years 1ater, some member(s) of the Town Council think
chat city Market should be "subsj.dized't again with a sign variance
because the facility that they designed and built has not particularly
worked out the way they .,,anted it to. City Market relates that the
upper deck parking is "usua11y full" ( I itispute that) and that
"circulation in their 1ot is restricted,'. (Which I f eel- is due to poor
design-I know I don't like drivinq in there, so f avoid it. But I don't
go underground either, and f know it's there)
3. City Market has established a pattern of applyinq for variances like
this. They did the sane thinq in Eagle after being in buginess awhile.
"we need a sign that people can see rrthen they are going west on f -70'r'
Give me a Break! rn Sil-verthorne, they received concessions from the
Town for years and then picked up and moved. next door co anocher
municipality, taking hundreds of thousands of $$ in sales tax revenue
with them. At the same time, they effectively eLiminated any
competition by controlling any property at all suitable for another
supermarket in the to$rn. I don't think that makes them the best of
n6i dhh^rc I
4. I feel that it's an affront to any business or resident in the Town
of vail that has agreed to the various ru1es, regulations, ol:ilinances
and laws of the Town for the council to overturn a decision made by the
planning and EnvironmentaL corunission unless a policy is instituted to
a11ov, th sane benefit for every comparabJ.e circumstance. i.e., in this
case, ,,Parking Direction,' signs for every buildinq on the North Frontage
Road. That's certainly not a good idea either. Maybe the sign
ordinance does need an upgrade in some cases but I don't think an
exception should be made in this case. After all, every business in
this town wants more exposure, $rhether it be on a frontaqe road, Bridge
Street, wa1l Street, Gore Creek Drive, and Etc, Etc, Etc.
That's my opinion, and I'm sticking ttith it.
S i ncerely,
Charl i e Crowl"ey

Grand Junction, CO 8l 502
Dear Linda,
f;, . ., i.::;t!
I received your letter and felt that is was important to respond in writing. Usually in
these cases, a communication breakdown is the root of the problem. As you know we
waited for a very long time to get the signage accomplished at Vail Commons. Once our
Director at the center gave me a copy of the sign plan and vendors we initiated the
project. I contacted you to review plans to make sure we were handling things
appropriately. During our conversation, we discussed that I wanted to follow the sign
plan exactly so that we could expedite the process. I even discussed the fact that I
planned to use Bud Signs, the vendor that has produced all other channel letter signs in
the Business Park. The only other thing that we discussed was faculty and parent drop-
offparking.
We then contacted Bud from Bud signs to begin the project. We explained the
specifications we had received from you and told Bud to handle everything from his end.
This included pulling the permit for town approval. We were not at all concerned
because we were following the exact sign plan given to us'
On Tuesday, March 10, 1998, we leamed of the problem with the permit from the center
director and contacted Bud immediately to ask him why he did not pull the permit. Bud
explained that he had talked with you originally and you stated that he did not need a
separate permit because City Market had already pulled a permit that would cover this
sign as well.
I am not sure where the communication broke down, I know that it seemed to occur
between you and Bud. Bud explained that he would have gone through the permit
process if you had not told him otherwise.
Bud is now in the process of applying for the permit. My major concern is that Bright
Horizons has gonethrough all the proper channels and are faced with the possibility of
not being able to use a $4000 sign.

We will stay in close contact with you through the permit process. I plan to send Mr.
Andy Knudtsen a copy of ow letters so that he understands the entire process. I am very
concemed that the town of Vail might think that we purposely did not pull a permit.
Please contact me if you have further thoughts to share.

R.E: City Market Signs
Dear Mr. Shunk:
I have reviewed your letter of April 23, 1998. I apologize for the confusion caused by the lack of
communication on the approved sign program for City Market in Vail, Colorado. I hope to clari$r
the history ofapprovals forthis development as well as educate you on the approval process for
signs at this site.
On August 20, 1997, the Design Review Board approved a sign program for the City Market/Vail
Commons development. A sign program is required for new development or redevelopment
projects. The program establishes sign locations and sizes based upon the standards found in the
Sign Regulations. The sign program does not allow any variation for the square footage of signs or
numbers of signs permitted. Several locations of signs and the "Vail Commons" sign were
eliminated from the sign program at the meeting by your representative and the DRB, and marked
directly on the official sign program for this site. The "Vail Commons" sign was eliminated
because it would be one sign beyond what the Sign Regulations allow.
Additionally, a sign program is not a "sign permit." Therefore, every sign to be installed requires
an independent sign application and permit approval to ensure compliance with the approved sign
program and the Sign Regulations. No approvals or permits were issued for the "Vail Commons"
sign.
Therefore, this sign needs to be removed as it is in violation of the Sign Regulations and the
approved sign program. Please remove this sign by May 15, 1998.

Dear Mr. Mauriello.
-''-
I received your fax of 4-22-98 with attachments. The attachments appear to be
pages from the Sign Progam submitted for City Market No. 142, Vail Commons. I note
that one of the attachments has a hand written note indicating that the building
identification sign is 'Not Permitted". The other attachment is modified with a hand
drawn X through Section Number 4. Please find enclosed is a copy of each. I am
confused by this infoimation for the following reasons:
1. The Design Review Board of the Town of Vail approved the Sign Program for
City Market No. '142, Vail Commons as noted on a copy of approval. Please find
enclosed a copy of thiS approval as noted on Design Review Action Form of August 20,
1997. Please note that the only conditions noted on the approval are (a) font up to
individual tenants and (b) color to be red on all signs.
2. Subsequently sign permits were issued for these signs.
3. The first City Market heard,of this matter was last week.
It may be that a mistake has been made in the additional information that you
provided to me'as | find no others aware of these revisions. I would appreciate your
review of this matter and look forward to learning more regarding the changes noted on
the material you provided on 4-22-98.
Thank you for your assistance with this matter. Certainly, please call me if you
have any questions.

Mike .Tewett is concerned about Ehe
signage at City market .
According to Lauren, working with Andy,City market was allowed to have 2 wal-lssigns as one was to be classlfled as aBuilding Identification sign. and both
at 20 sq. ft.
My reading of the sign code suggests
that the only way you can have abuilding ID sign in a multi-tentantbuilding is in connection with a Jointdirectory (5 sq. f t.)
Al-so Lauren stated that Andy considersCity Market and the other retail as two
separate buildings. llhLch wouLd allowCity Market and the other retailbuildings to have their own building ID
s ign.
The sign plan shows that no sign ispermitteal on the r,rest portion of theretail area, however, a VaiI Corunonssign exists there. This again v"ould
have to be a .Joint directory.
We need to work this out. I will beout of the office for the reat of theweek. Bob would llke an answer beforenext Tuesday .
I think a planner and Andy need to sit
down and work this one out.

h'here a bullding fronts on a pedestrian
way AIiID is situated $ri bh the end of thebuilding fronting to the exteriorboundaries of cc3 (but only if thatfrontage is located on th€ North orSouth Frontage Road), bwo signs areallowed, I proposed that the Town
acknowledge the sidewalk area that runsin front of the grocercy store, pastthe May Pal.ace and other shops, and upbo Chamonix as a pedestrian way.
With thaC recognition, Che grocerystore is allov/ed to signs and theshopping center is allowed a joint
directory (which was proposed at aIater date, if I remember correctly).

VAIL TOWN COUNCIL HIGHLIGHTTi FOR APRIL 7
Plea& note: The sAft time tor the evening meeting has reen changed to 7 p.m.,
30 minutes earlier than the previous start time.
Work Session Briefs
Gouncil members present:Armour, Arnett, Ford, Jewett,Kutz, Navas
-Employee Anniversary
Sgt. Mike Warren and Officer Brad Baldwin of the Police Department were each
recognized for 10 years of service to the town.
--Design Review Board Review
During discussion of the most recent DRB meeting, Councilman Michael Jewett
suggested the Council call-up DRB's approval of a staff decision to approve an exterior
wall sign f*Sity Mattet. Jewett, who said there had been a question as to whether the
sign conforms to TOV'S sign code, suggested calling up the matter within the required
1O-day waiting period so as not to impede or delay the applicant's progress. Although
Jewett's motion died for lack of a second, Town Manager Bob McLaurin said the staff
would research the matter and take appropriate action. For more information, contact
Dominic Mauriello at 479-21 50.
--lnclusionary Zoni ng Presentation
Chuck Ogilby, a volunteer from the VailTomorrow Atfordable Housing Team, presented
examples of inclusionary zoning that have been approved in whisiler, snowmass
Village, Crested Butte, Telluride, Aspen and in other ski resorts. He asked the Council
to move fonruard in adopting similar legislation within the Town of Vail to be applied to
commercial projects. As proposed, ogitby suggested using a formula similar to the
snowmass Village ordinance that would house 62 percent of a project's employees on
site. A second tier would provide the balance of the 62 percent figure within the town's
boundaries. A third (and least desirable) option would provide a cash-in-lieu formula
(more)
MEDIA ADVISORY
{j**"*r r""
Vail Council Highlights/April 7, 1998/Addl
similar to the town's parking pay-in-lieu formula. Ogilby said the inclusionary zoning
concept should be considered as a funding-and siting-source for housing during the
Common Ground public involvement process. Because of the increased possibilities
within Lionshead and other commercial areas, Ogliby said the increased possibilities
for additional housing in Vail are "phenomenal." And, he said the concept would take
the pressure off the possibility of using some of the town's open space parcels for the
construction of affordable housing. Reaction by the Council was cautiously favorable.
Councilman Michael Arnett said the proposed pay-in-lieu component could be helpful in
generating the funding needed to pursue the possibility of adding housing to the top
deck of the parking structures, while Councilman Michael Jewett expressed concerns
about equitable employee-employer relationships among those who would reside on-
site. Mayor Rob Ford said the Town Council may well be moving in the direction of
inculsionary zoning or an employee generation ordinance, depending upon the
outcome of the Common Ground process. Ford said the controlling factor in the
discussions in Vail and throughout the county will be the amount of available land for
affordable housing. Ogilby said if the Town of Vail took the lead in such an etfort,
Eagle County would likely follow close behind. Ghuck Ogilby can be reached at 476-
3070.
--Discussion of Temporary Signs during Vail Village Summer Construction
In preparation for the evening meeting, the Gouncil reviewed a draft ordinance that
would allow for additional flexibility in the $pe and number of signs to be allowed on a
temporary basis during the summer construction season in Vail Village. Up to 16 public
and private construction projects are planned for the area between mid-April and mid-
September, including the renovation of Slifer Plaza, installation of heated stairways at
the Vail Village Parking structure and the Seibert Gircle streetscape projea. Weekly
Thursday briefings have been scheduled for contractors, merchants, and property
owners beginning at 10 a.m., April 16 at the Red Lion. Please see evening meeting
briefs for a recap of the ordinance, which was approved on first reading by a vote of &
0. For more information, contact George Ruther, senior planner, in the Community
Development Department at 479-21 45.
-lnformation Update
Announcements included: Vail Village Merchant Assn. meeting at 8:30 a.m. April 8 at
the Colorado Ski Museum;the Lionshead Merchant Assn. meeting at 10 a.m. April 9 at
Montauk; and the Community Development Department's open house during
International Building Safety Week.
Town Manager Bob Mclaurin presented an update on a recent meeting of the Vail
Village Property Owners Assn. He said the organization has expressed interest in
helping to cost-share a heated streets program. McLaufin said he's currently
researching various financing mechanisms which could include creation of a special
improvement district. McLaurin said it's possible the group could bring the matter to a
public vote in the November 1998 election. Councilman Ludwig Kurz noted the
timetable appears to be tight.

Re: Sign Application
Dear Kathleen,
I have discussed with Andy Knudtsen the calculation of 20 square feet of signage that we
are allowed for each logo sign at our store located in the Vail Commons Shopping Center
and we have determined that these signs could be larger than the two existing signs.
Therefore, to obtain individual sign approval, I am enclosing an application for 2 new
logo signs, the size of which is based on the new method of measurement.
As you will see, these 2 signs are designed exactly as the other 2 and in accordance with
the Vail Commons Master Sign Plan which has already been approved by the Design
Review Board.
Also included with the application are a copy of the example of measurement which was
sent to me from Andy Knudtsen, the 20 square feet calculation as provided by Bud's
Signs in Grand Junction, copies ofphotos ofthe shopping center which show the existing
signs and their locations and a check for $40.00 for the application fee.
