PUBLIC WORKS PERI'IT PROCESS
How it relates to Building Permits:
1) Fill out our check list provided with a buitdino oermit aoolication.
lf yes was answered to any of the above questions then a "public way" is
required. You can pick up an application at either community Development,
located at 75 S. Frontage Road or Public Works, located at 1309 VailValley Drive.
2) Notice sign otfs for utility companies. All utilities must field verify (locate)
respective utilities prior to signing application. Some utility companies require up
to a 48 hour notice to schedule a locate.
3) A construction tratfic controystaging plan must be prepared on a separate sheet
of paper.An approved site plan may also be used. This plan will show locations
of all traffic control devices(signs, cones, etc..) and the work zone, (area of
construction, staging, etc..). This plan will expire on oct. 1sth. and will need to
be resubmitted for approval through the winter.
4) Sketch of work being performed must be submitted indicating dimensions (length,
width & depth of work). This may be drawn on the tratfic control plan or a iite
plan for the job.
5) Submit completed application to the Public Works's office for review. tf required,
locates will be scheduled for the Town of Vail Electricians and lrrigation crew. The
locates take place in the morning but, may require up to 4g hours to perform.
6) The Public Work's Construction Inspector will review the application and approve
or disapprove the permit. You will be contacted as to the status and any thai may. needed. Most permits are released within 49 hours of being received, but pledse
allow up to one week to process.
7) As soon as the permit is processed, a copy will be faxed to community
Development allowing the'Buibing Permit" to be released. Please do not confuse
the "Public Way Permit" with a "Building Permit'to do work on a project itself.

I am writing this letter in regard to your complaint of excessive dust resulting from automobile
traffic using the unpaved driveway and parking areas at 2039 Chamonix Lane. The Crooked Ski
Townhomes located on Lot 17, Vail Heights Filing 1 is a pre-existing non-conforming property.
Section 18.64 of the Town of Vail Municipal Zoning Code regulales non-conforming siles, uses,
structures and site improvemenls. This chapter allows non-conforming sites to continue and
perform normal maintenance without having to bring the entire property into conformance with
the Code. A review of the permanent address file of ihis property has turned up no construction
aclivity or site work of any kind since the original building permit was issued by Eagle County in
November of 1975.
The Crooked Ski Townhomes are non-conforming in regards to the parking and driveway areas.
lf this condominium complex were to be constructed today all parking and driveway areas would
have to be paved according to Chapter '18.64, the Design Review section of the Zoning Code.
However, since Crooked Ski Townhomes have performed no improvements since their original
construction and since Eagle County approved the condominium complex with a dirt parking lot
and driveway area, lhe Town cannot require the complex to pave these areas at this time. lf in
the future, the condominium complex decides to expand, or if the property is bought to be
demolished and conforming structures built on the property, the Town would require paving of all
driveway and parking areas. The Town requires paving of unpaved parking and driveway areas
when square footage is added to a building.
I also reviewed our air pollution control section of the code, and find nothing in that section that
would allow the Town to require paving based on air quality issues. Unfortunately, there appears
to be nothing the Town can do to relieve your problem until such lime as the proPerty redevelops.

It is highly recomnended that the owner of this multiple unit rental
complex be enjoyned to pave the driveway and parking lot. My property
at 2019 Chamonix Lane is inurediately adjacent to the Easf of these
renlal units and in the sunmertime it is impossible to comfortably sit
on the porch or enjoy the yard due to the dusl resulting from the cpnstant
traffic of up to 15 vehicles in the parlcing 1ot and driving up the drive-
way. Ttrere is a constant cloud of dust enveloping my property all Sumner.
Ttris is the only large multiple rmit rental property in this area that
has not been paved. There trave been a considerable nunber of improve-
ments to these units on both the front ( south) and rear ( north) sides
but the ordners or occupants have evidently not been requested to complyvith the construction ordinance of paving the parking and driveway areas.

RecenUy there was some confusion from the DRB members regarding site improvement
requirements. Eadier in the summer, the Town approved an expansion to the Johnson
residence (Lot 19, Block 3, bighorn Sth Filing). The Town required that the overhead electrical
be placed underground as a condition ol DRB approval. Larry was consulted before this
condition was applied and Kristan explained to the Board that it was appropriate.
In cases where the DRB application is for a repaint, reroof, a new skylight, etc. and does not
involve the addition of any GRFA, statf has declded that the design guidelines will be used lo
evaluate ihat specific proposal and that other issues pertaining to the rest of lhe house or the
site will not be evaluated. For projects where there is an expansion of the building, statf has
decided that all of the development standards apply. Unpaved driveways will be required to
be paved and overhead utilities will be required to be underground, etc. These requirements
will not only be applied to these types of additions, but also to 250 requests.

BACKGROUND:
on ]-I/28/92. at approximately 1343 hours. the vail Police Department
received a caLl from David Sherwood stating his roommate Dion Hood ltas
found dead. r was called in to assist hrith the investigation.
TNVESTIGATION:
Dion Hood is a 25 year old black male who has resided in the vail valley
since 1989. Hood is a long term employee for Safeway Food Stores. Hood
has had several seizures in the past, and has been diagnosed as having a
seizure disorder. Hood has been given a prescription for this disorder,
though no medication was found in his apartment.
oDuring the summer months of 19d2. Hood transferred to Boulder, CoLorado to
assist their Safeway Store. On October 4, L992. Hood returned to the VaiL
Safeway Storb working 15 to 2{ hours a week. Hood needed an apartment to
rent, but Hood dj.d not have enough money to afford a deposit. Hood
contacted Safeway produce manag'er Dave Sher$tood, who owns a condominium at
2039 Chamonix Lane, unit 1. Sherwood agreed to rent Hood the downstairs
laundry roorn for 9200 a month. Hood moved in several-bags of clothing' a
single mattress and box springs
The condominium which Sherwood owns is actually two complete units trith a
laundry room Iocated downstairs. Sherwood lives in one of the unit.s, and
rents the second unit to Bretc Lovett.. You access the apartments and
laundry room through one exterior door, which remains unlocked at all
times. rnside this exterior door is a small room witb three entry doors.
two leading to the apartments and one leading to the laundry room. A11 of
these interior doors have locking' door mechanisms. Sherwood and Lovett
state that the laundry room door is always left unlocked and open. Thisdoor is only closed when Hood is in the laundry room sleeping.
The laundry room is a small heated concrete room with no amenities. There
is a small furnace room adjacent to the laundry room via a door on the west
wall- There is only one entrance and no windows. Hood would use
Sherwood's apartment for the use of the kitchen, bat.hroom, telephone, and
television. Hood's rent is paid through December 4, !992.
Hood worked for Safeway on wednesday, LL/25/92, during the evening shift..
Hood did not have to work on 77/26/92. On Thursday, ll/26/ 92, Sherwood had
Hood, Lovett, and Jan wanamaker over for Thanksg'iving dinner. llanamaker is
Lovett's girlfriend who rents a bedroom in Sherwood's apartment. Sherwood
recalled Hood leaving at approximately 0001 hours on Eriday, Lt/27/92.
Hood told Sherwood that he was either going to go to the Jackalope for a
beer, or go downstairs to bed. sherr.rood states he heard Hood leave and the
door to the laundry room shut.. Sherhrood believes Hood went downstairs t.osleep as he would have heard Hood reeurn from the ilackalope.
on Eriday, LI/27 /92. at approximately 1330 hours, Sherwood walked doern t,o
the laundry loom to use the washing machine. Sherwood states he san Hood
on the bed and inferred that, he was sleeping. Hood was in the same
position when Sherwood found Hood dead on Il/28/92.
on Friday, LL/27 /92' at approximately 1500 hoursr Hood failed to show uP
for work and did not. contact anyone at Saferray.

on Friday' 17/2'l /92, ac approximately 2100 hours, Lovett went to the
laundry room and sav, Hood laying on the bed. Assuming that Hood was
sleeping, Lovelt returned to his apartment. lovett displayed Hood's body
position, and it. does not. appear that, Hood had moved since Sherwood's
viewing at 1330 hours that day.
on saturday, 1!/28/92, Sherwood $ras at Safeway talking to managers Speer
and Hayes. Sherwood lrag not aware that Hood had not come to $rork the
previous day. They became concerned for Hood's welfare. and the three of
them went. to Shendood's apartmenc to check on Hood.
Hood did not respond to their calling, so Hayes pulled back the bLanket
that was covering Hood. Hayes and Sherwood noticed that Hood's face and
left arm irras a "purplish bfack" color, and that Hood apPealed to be
deceased. Sherwood then contacted the vail Police DePartmenc.
OBSERVATTON:
Upon my arrival, I spoke to sherwood, Speer, Hayes, and Lovett. All stated
t.hat Hood r.ra s not taking any medication and appeared to be doing well . No
one knew that Hood had been diagnosed as having a seizure disorder and was
unaware of any other illnesses. All" mencioned that. Hood nas having
financial difficulties. and receiving pay advances regularly. No one
received any indication that, Hood was despondent, and in fact., Hood was
very much looking forward co going skiing.
Upon entering the laundry room, I noticed a sing:Ie bed laying long-ways
against the north wall. Hood's body was laying along the south edge of the
mattress, approximately 3 feet from the wall . Hood's body was laying east
to west with Hood's head tor.ralds the west wal"l . The bed did not have
sheets, but two blankets simulating sheets- Hood was laying on one blanket
and covered by the second--b:Lanket.
Hood r.ras laying face down with his right arm tucked underneath his body.
Hood's left arm was over hanging the edge of the mattress, displaying post-
moltem lividity and rigidity. Hood's leg's hrere straight and parallel . The
legs displayed post-mortern lividity and advanced rigidity. Hood's body was
cLothed in boxer-tlpe underwear and a white tee shirt. Hood's shoes andpants were found next, to the south side of the bed near Hood's feet.
Hood's face was turned slightly t.owards his left. shoulder. Notable
discharge from the mouth and nose caused wet stains on the pillow andblanket.. Upon lifting Hood's head, a large amount of clear/tan fluid was
expelled frorn the mouth and nose. After examining' the mattress, it r.ras
found that fluid from the mouth and nose area had saturated the mattress in
a circumference of approxirnately 18 inches. This fluid continued thxough
the mattress to the box springs and floor.
Coroner Doona Meineke arrived on scene and pronounced Hoodts death. I Cold
Meineke that less than one year ago Hood was in the Safeway Lunch room when
he had a seizure. Lovett and Speer were plesent during' the seizure and
they called the paramedics for Hood. They described Hood as turning colors
and being uncontrollable. speer st.ated that after the seizure, Hood rdas
senC t.o Denver for fult,her evaluation. Hood never discussed the results of
these tests with anyone present. Meineke stated she vril.I research VaiI
Valley Medical Center records for this incident, Meineke also coneacced
Hood's mother for notification.
f searched alL of Hood's ploperty. Hood's wallet contalnlng Colorado
driver's license and $12 was turned over to Meineke. Identification was
confirmed through his drlver's ficense photograph, as weII as Shelwood's,
Speer's, and Hayes' identification, No prescription or illegal narcotics
were found. There were no signs of forced entry, or Lndication of a
struggle.

I did find a hospital bill fron the Rocky Mountain IIFCW Union Health P1an.
This bill indicated that Hood received emergency room treatment on Jufy 28t
L992 at an unknown hospital.
ADDITIONAL:
ot I\/28/92. at approximately 1845 hours, I spoke to Jan wanamaker
reference Hood. wanamaker stated she is a Safeway employee and thae she is
currently renting a bedroorn in Dave Sherwood'g apartment. wanamaker stated
that on Thursday, lL/26/92. she rnade Thanksgiving dinner in Sherwood's
apaxtment for sherr ood, Lovett, and Hood. wanamaker recalled lhat Hood
relaxed on Sherwood's couch, watching television all day. wanamaker states
that Hood ate Thanksgiving dinner, came back for secondsr and staced he was
"too fuII" to go out anywhere. Wanamaker recalled that Hood Cook a showe!
around 2330 hours and erent to bed shortly thereafter. Wanamaker did not
see Hood again.
on tt/28/92, aL approximately 2055 hours' I spoke wit.h Meineke referenceher conversation wilh Hood's mother, Linda ToEtorcia. Meineke was told
thac Hood was diagnosed with a seizure disorder. Hood $as to be takingpreventative medicat.ion, though Tortorcia scated thac Hood may not have
refilled his medication and Hood did not accept his condition. Tortorcia
stated that in July 1992, Hood lras sent to the hospitaL after having a
seizure. Tortorcia told Meineke thac she felt sonething !{as }Jrong as Hood
was to meet r.rith family rnembe rs on Friday evening, Lt/27 /92, and he did not
arrive.
I checked Dion Hood's name through CCIC and found a Failure to Appear
r^rarrant through Jefferson County Sheriff. Jefferson Couney has beennotified reference Hood's death.

Dear Mr. Shenvood:
I am writing this letter lo address the issue of yoJ renting your laundry room at 2039 Chamonix
Lane as a sleeping room. This issue came to light during a police investigation involving the
dealh of a person and was lorwaded to us by lhe police.
The laundry room is not a habitable room according to the Uniform Building Code and cannot be
used as a bedrcom. This situat'ron violates the code and is a dangerurs situatbn as there isn't an
egress wirdow or any type of ventilation.
During our conversalion on 1A3Dp,Zyo'J stated that have removed the bed that was in lhe
laundry rcom and said you would no longer let anyone use this room lor sleeping purposes. I did
an inspection of the laundry room on 1/dgg and was able to conlirm that there wasn't any bed
present at lhat time.
I appreciate the cooperalion yor have given me regarding this matter and uould like to stress
once more in clcing that this is a serbus matter.
