Dear Mr. and Mrs. Sammons,
My name is Warren Campbell, and I am the Chief of Planning for the Town of Vail. I am writing
this letter to inform you of zoning violation which is present on your property located at the
above address. The violation is the installation of a chain link fence enclosure around your
trash cans at the site. Pursuant to Section 14-10-9, Fences, Hedges, Walls, and Screening,
Vail Town Code, chain link fencing is not permitted.
14-10-9: FENCES, HEDGES, WALLS, AND SCREEN,NG: (in part)
A. Placement: The placement of walls and fences shall respect existing landforms and fit
into land massing rather than arbitrarily follow site boundary lines. Fences shall not be
encouraged except to screen trash areas, utility equipment, etc.
B. Design: Design of fences, walls, and other structural landscape features shall be of
materials compatible with the site and the materials of the structures on the site. Retaining
walls and cribbing should utilize natural materials such as wood timbers, Iogs, rocks, or
textured, color tinted concrete. No chainlink fences shall be allowed except as temporary
construction fences or as required for recreational facilities.
The Town requests that the fence be removed by no later than November 31 ,2011. Please
contact me by email at wcamobell@vailsov.com or by phone at970-479-2148 in order to let me
know when the fence will be removed. The Town can work with you if some additional time is
necessary. The Town looks forward to the successful resolution of this violation.

Dear Randy,
The following is in response to your inquiry conceming the potential construction of a garage at2734
Basingdale:
As you are aware, the existing four-plex at2734 Basingdale was originally developed under Eagle County
jurisdiction and later annexed into the Town of Vail. Therefore, this property is legally non-conforming in
regard to several of the Town of Vail's zoning regulations (i.e. minimum lot size, density, setbacks, etc.).
This site consists of 10,122 sq. ft. and is zoned Two-Family Primary/Secondary Residential. Based upon
lot size and zoning, pursuant to Section l2-6D-8, Vail Town Code, the maximum allowable density on
this site is one dwelling unit and one Type I Employee Housing Unit.
The provisions of Section l2-6D-8, Vail Town Code, establish the maximum allowable Gross Residential
Floor Area (GRFA) for this site to be 2,530 sq. ft. In addition to this 2,530 sq. ft. of GRFA, Section 12-
l5-3, Vail Town Code, also allows for an additional 600 sq. ft. of gmage GRFA to be dedicated to one
dwelling unit. Based upon our conversations, one garage of 500 to 600 sq. ft. in size currently exists on
the site. Due to its non-conformance, pursuant to Section 12-18-5, Vail Town Code, the existing four-
plex and garage may not be enlarged to exceed the existing amount of GRFA (including garage credit)
currently constructed.
The exception to the provisions of Section 12-18-5, Vail Town Code, is the'250 Ordinance". The "250
Ordinance" (i.e. Section 12-15-5, Vail Town Code) grants each existing dwelling unit, consfucted prior
to November 30, 1995, an additional 250 sq. ft. of GRFA. This 250 sq. ft. GRFA bonus applies to all
units regardless of non-conformities.
Eacb of the existing four units at2734Basingdale Blvd. may be eligible for this 250 sq. ft. bonus, which
may be used for the construction of a garage. Please be aware that these 250 sq. ft. bonuses must be
attributed to an individual dwelling unit and may not be pooled together.

The present zoning on the above referenced property is Two Family Primary/Secondary
Residential. The cunent use on the site is considered nonconforming, in arcordance
with Chapter 12-18, NONCONFORMING SITES, USES, STRUCTURES AND SITE
IMPROVEMENTS. As this chapter states,
Whenever a nonconforming use which does not conform with the regulations for
the district in which it is located, or a nonconforming structure or site
improvement which does not conform with the requirements for setbacks, height,
density control, building bulk control or site coverage is destroyed by fire or other
calamity, by act of God or by the public enemy, ifs use may be resumed or the
structure may be restored, provided the restoration is commenced within one
year and diligently pursued to completion. All new construction must conform to
the applicable adopted building codes, fire codes and other relevant codes
regarding safety and construction which are in effect at the time rebuilding is
proposed.
Should this property be destroyed, the town of Vail will allow the structure to be rebuilt
as-is to its present use, in accordance with Chapter 12-22. Should you have any
