Dear Mrs. Cheney,
Thank you for submitting an application for design review of the air conditioning unit that you are
proposing to install on the northeast side of your residence. I have staff-approved the proposal on one
condition: two or three five gallon shrubs must be planted around the unitin order to provide screening for
your neighbors to the north. As the Development Standards Handbook stiates,
"All utilig service systems shall be installed underground. Any utility system the operation of
which requires above ground installation shall be located and/or screened so as not to detract
from the overall site design quality." (Title 14:10:l:2)
I have enclosed the approval form which signifies the above condition and will allow you to apply for a
mechanical permit. The mechanical permit is geneElly issued two to three weeks from the date it is
applied for. Thank you, again, for your application and for your patience. Please do not hesitate to
contact me regarding any questions or concems that might remain and I will do my best to answer your
questions.

I. DESCRIPTION OF PROPOSED USE
In December of 1989, the Vail Tordn Council passed Ordinance
No. 31, Series of 1989 to allow Bed and Breakfasts in the
Town of Vail with certain criteria. The definition given in
that ordinance states that
rrA Bed and Breakfast means a business which
accornmodates guests in a dwelling unit in which the Bed
and Breakfast proprietor lives on the prernises and is
in residence during the Bed and Breakfast use.rl
A Bed and Breakfast may short term rent separately up to 3
bedrooms or a maximum of 9oo square feet of the dwelling
unit. , \,\.,,.
us. cheney has applied for a ponditional use pernit to allow
her to use one bedroom in hep bone in a Prinary/Secondary
zone district for a Bed and Breakfast rental . The bedroorn
contains 210 sq. ft. n{o gruests could stay in the bedroon.

Shelly MelLo presented the proJect explalning that the ABC Schoolproposed to add 868 sg. ft. on both the north and south sides ofthe building. The applicant was also propoeing to pave theparking area. The addition would provide addltlonaladninistrative area, a receptl.on roon, an additional clasaroon
and increaEed storage area. Shelly explalned that the property
was shown to be Ln a noderate rock fall zone as depicted by the
Town of VaiI geologtic hazard naps. A slte specific study had
been conducted by Nicholas, IanpLris, Pb.D. and the
reconmendation was nade that no nltigatlon for rock fall would berequired for construction of the addition. However, l.tr. Ianpirlsstated in hie report that the existing building, the proposedaddition, and playground area were in a debris flow area which
was not identified by the Tonntg Debrle Flow Study by Art llears,1984. Mr. Ianpirls prescribed rrextending or perhaps adding tothe existlng low, linear rocky hlllslde, northwest of the school
which was fomed by previous debrls flow decades ago.n
The staff reconmended approval of the conditl.onal use permLt
request for the ABC School expansion proposal . Staff felt thatthe use involved provLded a benefit to the connunity and the
proposed improvenents to the property would benefit both the ABC
School and the Learning Tree preachool . The staff recornrnendedthat the approval be conditioned upon the installatlon of thedebris flow nltigatlon.
DLana felt that the big concern was the beru, not the e:<pansion.
Bill Pierce, representing the ABC School , e:<plained that the ABC
School had planned to get a second oplnlon regarding the DebrieFIow. He explained that the location of the berm was alreadyestablished, but getting to it would be hard.
Diana suggested the possibility of building a concrete waII todivert the debris flow.
Chuck Crist asked how the Town, if conflictlng reports were
subrnitted, would determine which study to uEe and Kristan statedit would have to go before the Council.

committed for have been inserted in Schedule A hereof by the Company, either at the time of the isuance of this Commitment
or by subsequent endoresement.
This Commitment is preliminary to the issuanie of such policy or policies of title insurance and all liability and oblita-
tions hereunder shall cease and terminate six months after the effective date hereof or when the policy or policies committed for
shall issue, whichever first occurs, provided that the failure to issue such policy or policies is not the fault of the Company.

l. The term "mortgage", when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter
affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof,
and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved from liabiliry for any loss or
damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure of the proposed Insured
to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if the Company other-
wise acquires actual knowledge of any such defect, lien, encumbrancer adverse claim or other matter, the Company at its option
may amend Schedule B of rhis Commitmenl accordingly, but such amendment shall not relieve the Company from liability
previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties in-
cluded under the definition of Insured in the form of policy or policies committed for and only for actual loss incurred in re-
liance hereon in undertaking in good faith (a) to comply with the requirements hereof or (b) to eliminate exceptions shown in
Sctredule B, or (c) to acquire or deate the estate or interest or mortgage thereon covered by this Commitment. In no eyent dlall
such liability exceed the amount stated in Schedule A for the policy or policies committed for and such liability is subject to the
insuring provisions and the Conditions and Stipulalions and the exclusions from Coverage of the form of poligV or policies com-
mitted for in favor of the proposed Insured which are hereby incorporated by reference and made a part of this Commitmen(
except as expressly modified herein.
4. Any action or actions or rights of action that the proposed Insured may have or may bring against the Company adsing
out of the status of the title to the estate or interest or the status of the mortgage thereon covered by this Commitment must be
based on and are subject to thc provisions of this Cornrnitment.

1. Subsoil conditions are fairly uniform
over the site with topsoil to a depth of
3 feet underlain by silty sand and gravel .
2. The proposed residence shou ld be founded
on conventional spread footings designed
for a maximum soil bearing pressure of
2000 psf.
SCOPE
This report presents the results of a Soils and Foundation
Investigation for the proposed residence on Lot 3, Block 3,
Vai I Intermountai n Development Subdivision, Eagl e County'
Col orado. The i nvesti gati on was prepared by means of test
pits and laboratory testing of samples obtained from these
pi ts.
This investigation presents a description of surface and
subsurface conditions encountered at the site, recommended
foundation systems, allowable design pressures, and groundwater
conditions as wel I as design and construction criteria influenced
by the subsoils.
SITE LOCATION AND DESCRIPTION
The site is located at 2754 Basingdale Boulevard. Drainage
on the lot is to the north. Vegetation consists of grasses
and trees.
SITE INVESTIGATION
The field investigation performed on August 28' 1987'
consisted of excavating, 1oggir9, dnd sampling two test pits.
The locations of the test pits are shown on Drawing No. 1.
A summary of the test pit logs is detajled on Figures No. 1
and 2. A summary of the test results is shown on Figure
No. 3.
The test pits vlere excavated with a conventional backhoe.
A bu'lk laboratory samples was obtained for analysis.
SUBSURFACE AND GROUNDWATER CONDITIONS
Refer to the summary of test pits, Fjgures No. l and 2.
Subsurface conditions are fairly uniform, with topsoil to a
depth of three feet, underlain by sil ty sand and gravel.
No overlot grading has been done prior to this investi-
gation.
No groundwater was encountered in any of the test pits
at the time of excavation.
DEBRIS FLOW HAZARDS
"Debris-Flow and Debris-Avalanche Hazard Analysis, " prepared
for the Town of Vai l by Arthur I. Means; P.E., Inc., dated
llovember 1984, was reviewed jn the preparation of this report.

PROPOSED CONSTRUCTI ON
No specific design data has been provided, but for the
purpose of this analysis, it has been presumed that the
proposed residence will consist of two floors with a basement'
and that loads wi I I be 1ight. If the proposed proiect differs
significantly from this understanding, a review should be made
after the plans are more complete.
FOUNDATION RECOMMENDATI ONS
Slightly consolidating si'lty sands and gravel wi'l'l be
encountered i n the excavation. The proposed residence should
be founded on conventional type spread footings designed for
a maximum soi'l bearing pres'sure of 2000 psf. At this pressure,
foundation settlements will be to'l erable. It would be advi-
sabl e to proportion footings so as to minimize differential
settlements. The bottom of the footing should be placed a
minimum of 48 inches belovr final grade for frost protection.
SLAB CONSTRUCTION
The upper natural soils will provide adequate support
for slab-on-grade construction. If clean' granular soils are
imported to be used as select fill, no prob'l em with capillary
rise of moisture will occur. However, if the select fill
contains some clays or fine materials, there is always the

possibility of capillary rise of moisture. |.le suggest that
the plans and specifications be prepared wi th a specified
minimum of 4 inches of clean, washed gravel immediately under
the floor slabs. The purpose of this clean, lvashed material
is to break capillary rise of mojsture to avoid problem with
bondi ng of asphal t ti I es to fl oor sl abs and other probl ems
associated with minor amounts of moisture.
t,Je suggest densifying the surface of fill or natural
soils with a v'ibratory type compactor immediately prior to
placement of floor slabs. Slabs should be constructed in
accordance with ACI recommendations to minimize the risk of
shrinkage problems. Slabs should be scored into maximum
200 square foot areas to localize and control any cracking.
GROUNDI.IATER AND DRA I N SYSTEM
While little or no water was encountered at the t'ime the
fie'ld investigation was conducted, it js possible that seasonal
variations will cause fluctuations, or for a water table to be
present in rthe upper soils during the spring months, or after
a prolonged period of rain. A peripheral drain system as
detailed on Figure No.4 should be installed.
REINFORCII,IG
Foundation walls should be well-reinforced so as to
minimize the effects of differential movements. Refer to
foundation designs for rei nforci ng detai'ls.
l,lalls retaining earth should be designed to resist an
equivalent fluid pressure of 45 pcf for level backfill. This
value should be modified for any external ly appl ied loads.
CRAWL SPACE COVER
l.lhen moist soils are encountered in the excavation, the
ground surface in crawl space areas should be covered with
an impervious moisture barrier sealed against the footings.
This wi'l I help to reduce humidity in the crawl space area
and will a'l so prevent the moist foundat'i on soils from drying
and shrinking, which could possibly cause the structure to
settl e.
BACKFILL AND SURFACE DRAINAGE
Backfill should be moistened or dried to near its optimum
moisture content and compacted to at least 90Y" of the maximum
standard Proctor density. Structural backfill should be com-
pacted to at'l east 95% of the maximum standard Proctor dens'i ty.
Excessive wetting or drying of the exposed soils in the founda-
tion excavation and under-slab areas should be avoided.
BACKFILL AND SURFACE DRAINAGE - conti nued
Surface water running toward the structure from upslope
areas should be diverted around and away from the building
by means of drai nage swal es or other simi I ar measures.
The final grade should have a positive slope away from
the foundation walls on a'l I sides. A minimum of LZ inches in
the first ten feet is recommended. Downspouts and sill cocks
should discharge into splash blocks that extend beyond the
l imi ts of the backfi I I .Splash blocks should slope from the
foundalii on wal I s. The use of I ong downspout extensi ons i n
place of splash blocks is advisable.
