Dear Robert:
On September 19, 1997, I sent you a letter expressing the Town's concern with the maintenance
and upkeep of your property at2765 Kinnickinnick Road.
I have again received complaints from your neighbors, with regard to the maintenance and
upkeep of your property.
On Thursday, August 13, 1998, I inspected the property and found a significant amount of
undesirable plants growing (Diffuse Knapweed, Leafy Spurge, Canadian Thistle, etc.) on the
property. I also noticed a lack of maintenance, as the flowerbeds and sidewalks are overrun with
weeds and in need of maintenance.
Section 5-1-6 of the Town of Vail Municipal Code regulates undesirable plants. Undesirable
plants are considered to be a public nuisance and all necessary action needs to be taken to
abate the nuisance.
Upon receiving this letter, please contact me within 5 working days, so we may discuss a time to
schedule the removal of the weed problem. You can reach me mosi easily by telephone at
9701479-2145, or by mail at the address above.
I am hopeful that you will contact me so thal we can resolve this matter quickly. I am confident
we can work together to resolve this issue to everyone's salisfaction.

Vent must terminate aboue the roof line.
Termination must be a minimum of 9' aboue the top of the appliance.
Horizontal ffiets are possible but must be no greater than 50% of the aent height abooe the appliance,
A one inch air space clearance must be maintained around all aenting components; a three inch
clearance must be maintained aboue any horizontally run aenting components.
We strongly discourage against any B-oent fireplace being installed in a basement or an area
susceptible to negatiae air pressure situations such as in a liaing room with cathedral ceilings.
When finishing the Genezta, combustible material may be brought up to the sides of the fireplace but must neaer ouerlap
the black area. The black metal may be cooered with noncombustible material only such as marble, tile, stone, etc. Radiant

4. TRANSFEREE'S REOUIRED DOCUME''l-,'t
When the presenter is a permitted Transferee under paragraph 3 above, the docrments required ior a draw shall include:
A. All documents required elsewhere in this Letter of Credit, except that sucfi documents may be in the name of and executed by ehher
the original Beneficiary or the presenter permitted by paragraph 3; and
B. When the presenter is a permitted Transfer€€ under paragraph 3.A or a third party under 3.8, a certified copy of the on€ or mor€

TIMING OF DISHONOR
Und€r no circumstances shall Lender be precluded fom rslying upon arry reason br dishonor given in a communication which
Beneficiary or the presenter receives within three (3) Banking Days after Lender has received the last document forming part of
Boneficiary's pres€ntment (the 'Three-Day Period'). Lender shall b€ snthled to rely upon any such reason without regard to eith€r (i) rhe
timing of any presentment made before the Expkaion Dde, or (ii) the timing inside the ThreeDay Period of any preliminary
communication(s) lrom Lender conccming the dishonor decision itself or any reason br dishonor. For any such r€ason so given during
the Thr€e-Day Period, Lender shall be conclusively deemed to have met the 'reasonable tim6', lrvithout dela)/, and other timing
r€quirements as the Uniicrm Customs and Praclics br Doanmentary Credits, '1993 Revision, ICC Publication No5OO, as most recently
published by the Int€mational Chamb€r of Commerca (h€roinaftor called th6 'UGP') may impose. The Expkation Date shall nor be
extended to ac@mmodat€ a pres€ntment made with less than three (3) Banking Days to go befor€ the Expiration Date, and Beneficiary
shall not b€ entitl€d to submit a draw request or provide Lender with any doqiments in support of a dralv after the Expiration Oate
hereof. Nor shall Lender ever be required to communicde a dishonor decision or its reasons within a time l€ss than the Thre+Day
Period. 'Banking Day' shall mean any day, except Saturday, on which commercial banks located in the state of Lende/s address are
either not ar.rthoriz€d or are not reouired to close.
COMPLIANCE BUBDEN
Under no circumstances shall Lend€r be held responsible br any impossibility or other diffiorlty in achieving strict compliance with the
requiremonts of this Lgtter of Credit precisely as wrifien. Beneficiary understands and acknowledges: (i) that unl€ss and until ths present
wording of this L€tt€r of Credh is amended with Lende/s pior writbn @nsent, the burd€n of complying strictty with such wording
remains solely upon Beneficiary; and (ii) that Lender is relying upon the lack of such amendment as clnstihJting Beneficiary's initial and
continued approval of such wording
NON.sEVERABILITY
lf any aspect of this Letter of credit is ever dedared unenbrceable br any reason by any court or govemmental body having jurisdiction,
Lender's €ntire engagement under this Later of Credh shall be deemed null and void ab initio, and both Lender and Benefidary shall be
restor€d to the position each would have occupied with all rigfrts available as though this Letter of Credit had never occurred. This
non-severability provision shall ovenide all other provisions in this L€tter of Credh, no matter wher€ suci provision appears within the
Lefte/s body.
cHorcE oF LAW/JURTSDTCTTON
The UCP shall in all respects be deemed a part hereof as fully as if incorporated herein and shall apply to this L€tter of Credit. This
Agreement shall be governed by and construed in accordance with the larrn of the State of Colorado United
States of America, except to the €xtent such lar,\c are inconsistent with the UCP. Lender and Beneficiary consent to t1e jurisdiction and
venue of any court selected by Lender in its discretion locded in the State of Colorado in the event ol any
legal proceeding und€r this Lettgr of Credh.
9. EXPIRATION

and accepted as completed by lhe Town of Vail Community Development
Department and Public Works Department.
2. To secure and guarantee performance of its obligations as set forth herein, the
Developer agrees to provide security and collateral as follows:

responsible for any accident, loss or damage happening or occurring to the work specified in this
Agreement prior to the completion and acceptance of the same, nor shall the Town, nor any
ofiicer or employee thereof, be liable for any persons or property injured by reason of the nature
of said work, but all of said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harrnless the Town, and nay of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are based
upon any performance by the Developer hereunder: and the Developer shall reimburse the Town
for any and all legal or other expenses reasonably incurred by the Town in connection with
investigating or defending any such loss, claim, damage, liability or action. This indemnity
provision shall be in addition to any other liability which lhe Developer may have.
5. lt is mutually agreed that the Developer may apply to the Town and the Town shall
authorize for partial release of the collateral deposited with the Town for each category of
improvement at such time as such improvements are constructed in compliance with all plans
and specifications as referenced hereunder and accepted by the Town. Under no condition will
the amount of the collateral that is being held be reduced below the amount necessary to
complete such improvements.
6. lf the Town determines, at its sole discretion, that any of the improvements
contemplated hereunder are not constructed in compliance with the plans and specifications set
forth in this Agreement on or before the date set forth in Paragraph 2, the Town may, bul shall
not be required to, redeem the letter ol credit as necessary to complete the unfinished
improvements. The Bank shall release such funds upon written request from the Town stating
that the improvements have not been completed as required by this agreement. The Bank shall
not require the concurrence of the developer prior to release of the funds to the Town nor shall
the Bank be required to verify independently that such improvements have not been completed
as required by this agreement, but shall release such funds solely upon the Town's written
request.
lf the costs of completing the work exceed the amount of the deposit, the excess,
together with interest at twelve percent per annum, shall be a lien against the property and may
be collected by civil suit or may be certified to the treasurer of Eagle County to be collected in the
same manner as delinquent ad valorem taxes levied against such property. lf the permit holder
fails ot'refuses to complete the cleanup and landscaping, ad defined in this chapter, such failure
or refusal shall be considered a violation of the Zoning Code.
7. The Developer warranls all work and material for a period of one year after
acceptance of all work referred to in this Agreement by the Town if such work is located on Town
of Vail property or within Town of Vail right-of-way pursuant to Seclion 17.16.250.
8. The parties hereto mutually agree that this Agreement may be amended from time
to time, provided that such amendments be in writing and executed by all parties hereto.

Upon Lender's honor of such drafts hereinafter, Lender, once the full amount of credit available under this Letter of Credit has been
drawn, shall be fully discharged of its obligations under this Lett€r of Credh and shall not thereafter be obligated to make any further
payments under this Letter of Credh in respect of such demand for payments to Beneficiary or any other person. lf a non-conforming
demand is made, Lender shall notify Beneficiary of hs dishonor on or before the time mentioned in Seaion 5 below.
Beneficiary shall have no recourse against Lender for any amount paid under this Letter of CrEdit after Lender honors any draft or other

3. PERMITTEDTRANSFEREES

TIMING OF DISHONOR

Beneficia4y's pres€ntment (the 'Thre+Day P€riod'). Lend€r shall be entitled to r€ly upon any such reason without regard to ehher (i) th€
timing of any presentment made before the Expiration Dde, or (ii) the timing insid€ tho Three-Day Period of any preliminary
communication(s) fiom L€nder conc€ming ths dishonor dscision itself or any reason for dishonor. For any such reason so given during
the Three-Day Period, Lender shall be conclusiv€ly deemed to have mst the 'r€asonable time', lvithout delay', and other timing

shall not be entitled to submit a draw request or provide Lender with any documents in support of a dravv after the Expiration Date
hereof. Nor shall Lender ever be required to communicde a dishonor decision or its reasons within a time less than the Thre+.Day
Period. 'Banking Day' shall mean any day, excep Saturday, on which mmmercial banks located in the state of Lende/s address are
either not authorized or are not roouired to close.
COMPUANCE BURDEN
Under no circumstances shall Lender bE held responsible br any impossibility or other difficulty in achieving strict compliance with the
requirements of this Letter of Credh precisely as written. B€n€ficiary und€rstands and acknowledges: (i) that unless and until the present
wording of this Letter of Credit is amended whh Lendeds prior written consent, thE burd€n of complying strictly with such wording
remains solely upon Beneficiary; and (ii) that Lend€r is relying upon the lack of such am€ndment as constiMing Beneficiary's initial and
continued approval of such wording.
NON-sEVERABIUTY
lf any aspect of this L€tter o{ Credit is ever declared unenforceabl€ ior any reason by any court or governmontal body having jurisdiction,

B. Lot 1A and Lot l-B shall be subject to the easehents noted on
the map and those set forth herein.

B. To the extent not inconsistent with this Declaration, the
general rules of law regarding party walls and fiability for damage due

6. I,ANDSCAPING, SERVICE FACILITIES AND PARKING.
A. The owner of one unit shall not unreasonably danage the value
of the other unit such as by shoddy upkeep outside, but both owners
shall make all reasonable efforts - to- preserve a har-rnonious conmon
appearance of the units. Each o$tner shall bear the entire cost and
illponsiUifity for installation and maintenance of landscaping on their
respective Lots.
B. Conmon utility or service connections or lines, connon
facilities or other eguiirnent and property located in or on either of
the units but used in dorniron with the other unit, if any, shall be owned
as tenants in cornmon of equal undivided one-half interests by the owners
of each unit and, except for any expense or.liability caused through the

B. Each owner shall be solely responsible for rnaintenance and
repaii of tne insiAe of his unit inc|lding -fixtures and inprovements and
ari utirity lines and equipment located therein and serving such unit

C. Utility or service connections or lines, facilities or other

(including a color scheme change), either pernanent or temporary and of

robf, and-all other common expenses as set forth herein to be shared by

9. MECHANIC'S LfENS: INDEI'INIFf CATfON:
A. Except for items incurred as a common expense as provided for
herein, if any owner shall cause any material to be furnished to his lot
or unit thereon or any labor to bL performed therein or thereon, the
other owner shall not under any circunstances be liable for the pal4nent

value thereof. Any owner may on 3O days' written notice, but not nore
frequently than once every two years, obtain a written estimate of the
replacernent cost of the Units by a Iicensed contractor, and the anount.
SuLh contractor shall be a disinterested and independent third party who
is unrelated in any manner to either owner whether through joint
business adventures or otherwise.
B. Each owner strall provide and keep in force, for the protection

the insurance carrier. The owners shall then promptly authorize the

Two mylar copies and one paper copy of the subdivision plat shall be submined to the
Department of Community Development. The plat shall include the following:
t The linal plat shall be drawn by a regislered surveyor in India ink, or other- substantial solulion, on a reproducible medium (preferably mylar) with dimension
of twenly-four by thirty-six inches and shall be al a scale of one hundred feet lo
one inch or larger wilh margins of one and one-half to two inches on the lefl and

Accurate dimensions to the nearest one-hundredth of a foot for all lines, angles
and curves used to describe boundaries, streets, s€tbacks, alleys, easements,
slructures, areas to be reserved or dedicated for public or common uses and olher
importanl features. All curves shall be circular arcs and shall be defined by the
radius, central angle, are scored distances and bearing. All dimensions, both
linsar and angular, are to b€ determined by an accurate control survey in the field
which must balance and close within a limit of one in ten thousand.

A systematic identification of all existing and proposed buildings, units, lots,
blocks, and names for all slreets.
An identification of the stre€ts, alleys, parks, and other public areas or facilities as
shown on the plat, and a dedication thereof to the public use. An idenlification of
the easements as shown on the plat and a grant thereof to the public use. Areas
reserved for future public acquisilion shall also be shown on the olat.
A writlen survey description of the area including the total acreags to lhe nearest
appropriale signilicant figure. The acreage of each lot or parcel shall be shown in
this manner as well.
A description of all survey monumenls, bolh found and set, which mark the
boundaries of the subdivision, and a descriplion of all monuments used in
conducting the survey. Monument perimeter per Colorado statutes. Two
perimeler monumenls shall be established as major conirol monuments, the
malerials which shall be ddterrnined by lhe town engineer.

Thank you for appearing before the Town of Vail Design Revicw Board on Wednesday, May 15,
I 996. for a conqeptual revicw of the proposed Sterico/Bradlcy duplcx. Thc purpose of tbis letter
is to inform you of the issues raised by the Design Revicw Boar4 as well as provide you with a
time line for resubmittal of this project for final design review.
In general, the Design Rcview Board had positive comments regarding tbe proposed changes to
the SterieoiBradlcy duplcx. The Design Review Board felt the off-sct of the building footprint, as
well as the break in the roofline were positive changes to the original proposal. The Design
Rcview Board however, did have several comments which need to bc addrcsscd prior to final
review of the proposed duplex. The following is a list of the Design Review Board's issues and
concems:

Att,ention should be given to improving thc dctailing elements of thc building-Ar=eas of
significant importancc includc window and door trim. soffit and fascia(deck railslnd
front entry features.

As proposed, thc window configuration on the buitding reflects a mirror imagiTi;;
review the proposod building elevations and climinate the mirror image.
3. At the time of final revicw, exterior building colors will need to bc reviewed by the Design
Review Board, The Design Review Board recommends the use of light, neutral-toned
colors. A darker accent color should be proposed to provide dctail and interest to the
building.
4. As proposed. the roofeavc ovcrhangs seem underproportioned. Please consider
increasing the roof overhangs to a minimum of 2 feet.
5. The west elevation of the building nceds more windows. As proposed, there are too many
large expanses of blank sfucco walls.
6. The roof pitch over the building at 3:,12 is too flat. The Town of Vail Design Guidelines
rccommend minimum roof pitches at4:12 or grcatcr. Please make the necessary changes.
7. The physical address of thc properly has becn determined nbe2TTl Kinnickinnick Road.
8. The landscape plan is inadcquate. Additional landscape material is necessaq/. The use of
evergreens is important to screen the building.
9. The driveway should be reduced in width to the minimum necessaDf to achieve thc
required access and parking.
10. Plcase provide a garage slab elevation. .
I l. Plcase indicatc the elevation of all roof ridges so building height may be determined.
The next DRB meeting you could appear at is Wednesday, June 19, 1996. If you wish to appear
before the DRB on the l9th. I will need a complete submittal addressing all the issues indicated
above by no later than Wednesday, June 5th. If you wish to appear before the DRB after the

Upon preliminary review of your application, there are sevcral issucs and concems that must be

revi€w, the total square footage of the proposed duplex structure is 4,508 sq. ft. This is
over the allowable square footage for the property by approximately 47 sq. ft. Please
review your proposedplads and reduce the total square fooiage by a minimum of 47 sq' ft.
According to the parking requirements for the Residential Clustcr Zonc Dishict, six
. parking spaces are required based upon the plan submitted for review. As proposed, only
four spaces have been provided. Please make the appropriate changes as necessary.

Dear Kris,
The Town of VaiI does have plans to develop a srnall park in the
Intermountain area, but not on the particular piece of property that
you described in your letter. The Town of VaiI, for several years, has
owned the property on the corner of Frontage Road and Kinnickinnick,
where the old cabin stands. There is a budget of $30,000.00 and we
have recently hired a landscape architect to help us design this park.
Our first step will be to hold a public meeting with the residents ofInterrnountain in order to determine the type of facilities people wouldlike to see in the park. I am assurning that if all goes we)-I with the
schedule this neeting will be held sorne time in the first two weeks of
Septernber. It is hopeful that work will start this Fall and will be
cornpleted in the Spring of 1990. We will be sure to contact you when
we set a specific date for this neeting so that you will have anopportunity to let us know your thoughts on this park.
With regard to the vacant lot at 277t Kinnickinnick, the Town of Vail'snext priority in purchasing open space will be in the northwest Vail-area. At present, the Town of Vail does not own any parkland in theVail das Schone/Vail Ridge area. Our next expenditure will be in thispart of town.
