I have again received complaints from your neighbors, with regard to the maintenance and upkeep of your property. On Thursday, August 13, 1998, I inspected the property and found a significant amount of undesirable plants growing (Diffuse Knapweed, Leafy Spurge, Canadian Thistle, etc.) on the property. I also noticed a lack of maintenance, as the flowerbeds and sidewalks are overrun with weeds and in need of maintenance. Section 5-1-6 of the Town of Vail Municipal Code regulates undesirable plants. Undesirable plants are considered to be a public nuisance and all necessary action needs to be taken to abate the nuisance. Upon receiving this letter, please contact me within 5 working days, so we may discuss a time to schedule the removal of the weed problem. You can reach me mosi easily by telephone at 9701479-2145, or by mail at the address above. I am hopeful that you will contact me so thal we can resolve this matter quickly. I am confident we can work together to resolve this issue to everyone's salisfaction. This indemnity provision shall be in addition to any other liability which lhe Developer may have. 5. lt is mutually agreed that the Developer may apply to the Town and the Town shall authorize for partial release of the collateral deposited with the Town for each category of improvement at such time as such improvements are constructed in compliance with all plans and specifications as referenced hereunder and accepted by the Town. Under no condition will the amount of the collateral that is being held be reduced below the amount necessary to complete such improvements. 6. lf the Town determines, at its sole discretion, that any of the improvements contemplated hereunder are not constructed in compliance with the plans and specifications set forth in this Agreement on or before the date set forth in Paragraph 2, the Town may, bul shall not be required to, redeem the letter ol credit as necessary to complete the unfinished improvements. The Bank shall release such funds upon written request from the Town stating that the improvements have not been completed as required by this agreement. The Bank shall not require the concurrence of the developer prior to release of the funds to the Town nor shall the Bank be required to verify independently that such improvements have not been completed as required by this agreement, but shall release such funds solely upon the Town's written request. lf the costs of completing the work exceed the amount of the deposit, the excess, together with interest at twelve percent per annum, shall be a lien against the property and may be collected by civil suit or may be certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad valorem taxes levied against such property. lf the permit holder fails ot'refuses to complete the cleanup and landscaping, ad defined in this chapter, such failure or refusal shall be considered a violation of the Zoning Code. 7. In general, the Design Rcview Board had positive comments regarding tbe proposed changes to the SterieoiBradlcy duplcx. The Design Review Board felt the off-sct of the building footprint, as well as the break in the roofline were positive changes to the original proposal. The Design Rcview Board however, did have several comments which need to bc addrcsscd prior to final review of the proposed duplex. The following is a list of the Design Review Board's issues and concems: ) Att,ention should be given to improving thc dctailing elements of thc building-Ar=eas of significant importancc includc window and door trim. soffit and fascia(deck railslnd front entry features. 4ttJ. As proposed, thc window configuration on the buitding reflects a mirror imagiTi;; review the proposod building elevations and climinate the mirror image. 3. At the time of final revicw, exterior building colors will need to bc reviewed by the Design Review Board, The Design Review Board recommends the use of light, neutral-toned colors. A darker accent color should be proposed to provide dctail and interest to the building. 4. As proposed. the roofeavc ovcrhangs seem underproportioned. Please consider increasing the roof overhangs to a minimum of 2 feet. 5. The west elevation of the building nceds more windows. As proposed, there are too many large expanses of blank sfucco walls. 6. The roof pitch over the building at 3:,12 is too flat. The Town of Vail Design Guidelines rccommend minimum roof pitches at4:12 or grcatcr. Please make the necessary changes. 7. The physical address of thc properly has becn determined nbe2TTl Kinnickinnick Road. 8. The landscape plan is inadcquate. Additional landscape material is necessaq/. The Town of VaiI, for several years, has owned the property on the corner of Frontage Road and Kinnickinnick, where the old cabin stands. There is a budget of $30,000.00 and we have recently hired a landscape architect to help us design this park. Our first step will be to hold a public meeting with the residents ofInterrnountain in order to determine the type of facilities people wouldlike to see in the park. I am assurning that if all goes we)-I with the schedule this neeting will be held sorne time in the first two weeks of Septernber. It is hopeful that work will start this Fall and will be cornpleted in the Spring of 1990. We will be sure to contact you when we set a specific date for this neeting so that you will have anopportunity to let us know your thoughts on this park. With regard to the vacant lot at 277t Kinnickinnick, the Town of Vail'snext priority in purchasing open space will be in the northwest Vail-area.
