Dear Sir,
This letter clarifies my intentions drywall removal and asbestos testing in Columbine
west condo unit 6. I took a survey sample of drywall tape and mud from upper and
lower bathrooms and found no asbestos in those samples (see test results from Alpine
Consulting Inc, certified in asbestos testing). I want your permission to remove
additionatlrywall in the kitchen exterior wall which will exceed 160 square feet of
drywall removal. This kitchen wall has many holes in it-mostly from past water
damage. Removal of the drywall will enable me to better insulate the wall and prevent
further water damage.
Another combined survey sample was taken of ceiling texture (popcorn) in both first
floor bedrooms and hallway. This survey contained significant asbestos. We propose to
encapsulate the asbestos on the ceiling with new drywall and new texture.

Dear Ms. Selig:
Thank you for your interest in the development potential of the referenced lot. Very little information was
found on this property within the Town's files. Per our conversation, the lot is located within the Residential
Cluster (R/C) zone district, which is defined in the Vail Town Code as "intended to provide slfes for srng/e-
family, two-family, and multiple-family dwellings at a density not exceeding six (6) dwelling units per acre,
together with such public facilities as may be appropriately located in the same dislrlcf..." (Section 12-6E-1).
According to some information which you gleaned from Eagle County, the property is non-conforming in
regard to several development statistics. Without the appropriate information on file, I cannot verify with
which statistics the property is out of conformance. Non-conforming status is allowed to remain for a non-
conforming use as long as the non-conforming use is not changed in any way that results in increasing the
existing non-conformity. However, a non-conforming use /oses lfs non-conforming sfatus and is required to
conform with all applicable regulations, once a demo/rebuild occurs. A demo/rebuild is defined as "The
destruction, demolition, or removal of fifty percent (509/o) or more of the gross residential floor area of an
exlstng dwelling unit or structure" (Section 12-2-2, Y ail Town Code).
In contrast, if the non-conforming use is being restored in accordance with the following scenario, it is allowed
to retain its non-conforming statusi
"Whenever a nonconforming use which does not conform with the regulations for
the district in which it is located, or a non-conforming structure or site
improvement which does not conform with the requirements for setbacks, height,
density control, building bulk control or site coverage is destroyed by fire or other
calamity, by act of God or by the public enemy, its use may be resumed or the
structure may be restored, provided the restoration is commenced within one
year and diligently pursued to completion. All new construction must conform to
the applicable adopted building codes, fire codes and other relevant codes
regarding safety and construction which are in effect at the time the rebuilding is
proposed" (Section 12-18-9, Vail Town Code).

more specific information, but without house plans, an exact lot size, and a background of the
