Mr. Pierce.
This letter is being sent to convey several comments I received from the Fire and BuildingD.epartments regarding your application to enclose four stainarays on the west elevation of theLionshead Arcade. The following are comments made by the Fire and Building Departments.

very simple and involves the removal of a door, rcplacement of an existing door and
irrstrllation of ncw windows. All finished conditions (paint, materials, etc.) will match

Thank you for submitting a "changes to approved plans" application for design review ol a revised paint scheme
at lhe above address. Per the request of the owner's representative, Gregg Carleton, the Design Review Board
tabled the application at its August 18'n meeting with instructions to Stafl to approve lhe application atter the
requested change in color scheme had been made. Today, Mr. Carleton submitted a revised color to be used for
the stucco ac@nts, which was simply a higher percentage (200) of the SW 6127 (lvoire) color that had originally
been submitted for the slucco body. The Design Review Board fell that the SW 6128 (Blonde) color incorporated
too much yellow inlo the color scheme.
Consequently, I have staff approved the application and enclosed the appropriate approval form. Please let me
know should you have any further questions or concerns.

Hello Mr. Alleman:
I wanted to confirm with you that the above project is scheduled for the next DRB meeting on July 21,
2004 at 3pm. Afier visiting the site again yesterday, I noticed that some stucco restoration/repair was
being done. This may continue, naturally. However, any change to the paint color or ofier changes that
have been proposed in the pending application may not begin until DRB approval is gained, as you
probably already know.
In order to be prepared for the meeting, I will tell you that I anticipate that the DRB will likely ask the
follorringquestions: will thewoodonthebuildingwill berepaintedaswell asthestucco? Andwouldthe
owner consider any other paint colors for the stucco? Additionally, the aurnings of the individual
businesses will need to be cleaned in some way or another as a condition of approval for the project.

Dear Mr. Campbell,
I met with you at the Vail city ofhces last week, as we discussed then I will be
representing Fieldscape and Robert Lazier in the Design Review process for the alteration
and addition to the planters in the pedestrian mall of Lionshead. I have a copy of Ric
Fields application for design review that was submitted to you and am assuming that
application is still valid, please let me know otherwise.
You will find the requested I1x17" plans and images attached to this letter. The files
represent five requested alterations, images of the areas as they exist today and modified
images ofthe requested changes. I have also attached an l lx17" reduction ofthe survey
completed by Peak Land Consultants on August 28,2003. We are requesting these
changes for the following purposes;
Plaza Entry from Lionshead Circle: These modifrcations are represented in sheets L2
and the before and after images by the same name. We are proposing to remove the
existing Bristlecone Pine at the Southeast comer ofthe Lazier Arcade, and to reduce the
size of the planter to the West of the Sculpure "The Lift". These modifications will open
the view to lhe commercial frontage of the arcade as well as the stores beyond. In
addition to the visual aspect it will improve pedestrian flow into the plaza by opening the
corridor to the South ofthe sculpture.
Staircase Planter: As depicted on sheet L3 we are proposing a seat wall at the base of
the stairs North of the Dakota Craftsman and South of the Swedish Clog Cabin to match
the majority of the planters in the pedestrian mall. The existing treatment of the end of
the planter looks temporary and unfinished. The proposed modification will make the
planter mesh with the design throughout the mall and allow for more planting at the base
of the stairs.
The French Deli: The proposed planter would define the outdoor dining area for the deli
redirecting trafhc around the diners and separate the entry to the jewelry store, see sheet
L4. The planter would also provide a base to locate an art exhibit in compliance with last
year's submittal.
Dakota Craftsman Planter: Sheet L5 shows how the Dakota Craftsman and the
Performance Sports are separated from the mall by the existing planter which creates
both a physical and visual barrier between the mall and the store fronts. The stores would
be more accessible from the mall by removing the Northem 7'-6" of the planter, and
, 1..
reconfiguring the walls and trash receptacle at a 45 degree angle next to the existing
benches.
Montauk's Planter: The outdoor dining area for the Montauk Seafood Grill is limited to
the raised patios on the South side ofthe building. The Southwest patio space is
restricted by an 18" tall planter which disrupts pedestrian flow and reduces potential
dining area. This planter and the existing cottonwood would be removed to allow for
additional seating, to ease access to and from the patio and open up the fagade ofthe
building allowing more light at the entry and into the interior dining rooms.

This letter is being sent to you in addition to the letler dated July 30, 2003 as I have now received
comments from both Public Works and the Fire Department regarding your application to alter the
existing public space adjacenl to the Lazier Arcade located at 531 East Lionshead Circle. These
comments should be addressed in a sel of revised plans to be submitted prior to scheduling on a Town
Council or Design Review Board agenda. The additional comments are shown below in bold along with
the previous comments.
. lt appears thal the proposed improvements occur wilhin Tract C which is owned by the Town of
Vail. A stamped survey needs to be provided showing the location of property lines and the
location of the proposed improvements. lf it is determined that the proposed improvements are
located on Town of Vail property you will be required to proceed to a Town Council meeting to
ask for permission to proceed through the process to aller Town of Vail property. lf approved to
proceed through the process by Town Council you will then be scheduled on a Design Review
Board agenda. Please see the attached copy of the recorded plat for clarification on this issue.
Public Works has delermined that the planter is located in the Public right-of-way. Please
provide a brief letter regarding your plans and goals for the proposal so that it might be
included in lhe information going to Town Councilfor review. Please also provide 8X11.5
inch plans lo be included in the packet including the survey of the area. Once this
information is received and you are ready I will schedule you to be heard at a Council
meeting.
. According to the Town's Geographic Information System (GlS) there are multiple property
owners on this site. Do you need to receive any approval from a condo association for these
improvements? lf so please provide an approval letter. As this is on Town Property no
property owners sign otf is required.

. Please provide a landscaping plan for the area in which the tree is proposed lo be removed.

Please provide elevation drawings for the new planter wall and photographs of the
existing wall.
The applicant will need to work with the Town of Vail lo resolve irrigation issues resulting
in the removal of the wall. Joe Kuchera can provide information on the location of
irrigation in the planter.
All concrete and brick pavers disturbed will be required to be repaired. The proposed
exlent of repaired concrete will need to be expanded per the attached photocopy of the
site.
A public-way permit and bond will be required for all the work as it is on Town Property.
Please advise your client that the firm of Heart Howerton is developing plans for redoing
much of the Lionshead public right-bf-ways to coincide with the improvements Vail
Resort will be beginning in the next couple of years. This area may be completely redone
under that scope of work in the next couple of years.
As it has been determined that this site is located within the public right-of-way we will need lo proceed
to Town Council first prior to scheduling on a Design review Board agenda. Plans should be submitled
at your earliest convenience. The need to advertise and go to Council will postpone review of this
project by the Design Review Board agenda to likely sometime in September if all runs smoothly.

DESCRIPTION OF THE REQUEST
Request to proceed through the development review process with a proposal to perform
several landscaping projects in the Town's pedestrian-way right-of-way, located in
Lionshead Village around the Lionshead Arcade and the Lifthouse.
BACKGROUND RATIONAL
It is the desire of Robert Lazier, owner of properties in the Lionshead Arcade and the
Lifihouse, to apply for several landscaping projects in the vicinity of his properties. The
improvements include the addition of landscape planter beds, removal of several trees, and
a reduction in the size of the planter behind the skier sculpture at the entrance to Lionshead.
Since the applicant is proposing to construct a significant portion of their landscape
improvements on Town of Vail property (i.e. Lionshead pedestrian-ways right-of-way), Town
Council permission is required to proceed through the development review process. lf
Council grants permission to proceed through the process the applicant will proceed forward
with their Design Review Board application.
STAFF RECOTi'ENDATION
Staff recommends that the Town Council grants approval to proceed through the
development review process.
