WHEREAS, Georges U. Boyer and Jocelyn U. Boyer are the
owners of the property described as:
Lot 5, Block 1, vail Potato Patch Filing 1,
VaiI Colorado
herein referred to as the "subJect ptoperty"i and
WHEREAS, the owner wishes to place certain restrictions
on the use of the subJect land of the benefit of the o\dner
and the Town of VaiI, Colorado ('the To!rn').
NOW, THEREFORE, the owner does hereby impose,
establish, acknowledge, declare, for the benefit of all
persons who may hereinafter purchase, or lease, or hold the
subject land, the following restrictions, covenants, and
conditions, all of which shall be deerned to run with the
land and insure to the benefit and be binding upon the
owner, its respective grantees, successors, and assigns.
1. The subJect ploperty shall have one permanent
opening in the south facing wall near the east building
corner indicated on the drawings by fntratect of Septenber
24, 1990, and the area beneath the gatage wiII be
Per:manently restricted as uninhabiLable space, open to the
outside;
2. The proposed opening shall have a steel grille to
match the steel guardrails elsewhere on the building with an
insect screen behind the grille to minimize intrusion of
wer"min and insects.
3. The Office of Conrmunity development will be allowed
inspection of the area at any timei
4. The provisions hereof may be enforced by the owner
and the Town;
' 5. The conditions, restrictions, stipulations, and
agreements contained herein shall not be waived, abandonedt
terrinated, or anended, except by the written consent of
both the Town of Vail and the owner of the subJect proPerty.

Reception Number 129527, and recorded in Book 233 at page 629 of the Eagle
county' colordo, clerk and Recorder's records, allowing Easement Users the
use of such easement for the construction, maintenance and reconstruction
of sewerage, water, gas, electric and telephone transmission facilities, and
cable television, (hereinafter the ,'Utility Easement"), and,
WHEREAS, the Utility Easement is not presently used for the construction,
maintenance and reconstruction of such utilities; and,
WHEREAS, the owners rea'l ize no beneficial use in allowing such easement
to renrai n;

As discussed with you in your office and over the telephone I must have
the existing roof on my residence replaced. Due to poor workmanship on the part
oi ttt" original roofing company we have suffered some damage from leaks during
the winter when snow bu'i lds uP.
Time is of the essence and we have now decided on two alternative solutions
to the problem.
We can install a netal roof in accordance with the AEP snap seam SN 18 metal
roof system as descri bed in one of the DRB applicat'ions submitted herewith.
As I uirderstand it it might be possible to have this appljcation approved
by staff wh'i ch would save a lot of time.
The other alternative is to'i nstall a roof in accordance w'ith the TAMK0
roofing system as descri bed in the litterature subm'itted. The color would be the
"blacki ai shown in the sample. I understand, however, that this system would require
DRB approval assuming that it would be acceptable to staff. If this system is
acceptable to staff i respectfu'l ly request that this particular applicat'i on-
be submitted to the DRB fbr their next meeting which I understand is scheduled for
September l6th. The reason for o-ur request to-waive the deadline date for filing
toi- ttris September 16 meeting'i s that cold weather and snow are fast approaching
and we very'much want to get this project finished before w'i nter,whatever
system we use.
I believe that the TAMKO system has been used previously in Vail. We favor
this system because we understand its application will provide a waterproof
barri ei even more foolproof than the AEP'system. However we would be ready to
go with either system subiect, of course, to your approval.

Mike llollica explained the request. He said that the wall wouldbe 9'-10' high and about 20 feet long.. The staff recomrnendation
was for approval because there is a physical hardship because ofthe steepness of the site. Mike reviewed the criteria and

Parn Hopkins felt the watl appeared to be part of the residence,and she was not opposed to it. Diana felt that since there wereno setback variances involved, she had no probleur with the wall .Jin said that there was a lot of precedence for other privacywalls. Chuck wondered about the use of bushes as landscaping
and Pam told hin that the DRB saw the site as a site with solittle landscaping, that it would be appropriate to use only
bushes in front of the wall.
Peggy wondered how the height of the wall was deterrnined. andBill Pierce, the architect, stated that since the street washigher than the residencet 9t-LOt was considered necessary forprivacy froru the street. Kathy wondered if it would be possibleto place a berm in front of the wall. Bill said it was and
wondered how large a berrn should be used. Kathy felt it wouldbe good to keep the height of the waII to 8 feet. BilI said itcould be done, but it would depend upon wtrat the owners wantedto do.
Diana moved and Chuck seconded to approve the variance per thestaff memo with the finding of extraordinary circumstances andwlth the condition that the wall be broken up with plantings.

r.DESCRIPTION OF VARIANCE REQUESTED
The applicants are the ohrners of Lot 5, Block L, Potato patch
(804 Potato Patch Drive) and are requesting a variance toallow for the construction of a 9-l-0, high privacy walI
irnmediately north of their proposed home.
The Town of Vail zoning code allows for a naximum height of6' for fences, hedges, wal1s and landscaping screens, whennot in a front setback area.
The wall treatment will match the finish of the proposed
residence to provide a unified appearance, and the applicantproposes to break up the mass of the wall with the plantingof 10 Service Berry shrubs along the exterior of the wall.
II. CRITERTA AND FTNDINGS
Upon review of Criteria and Findings, Section L8.62.o50 ofthe municipal code, the Department of Cornmunity Development
recommends approval of the requested variance based upon thefollowing factors:

The Design Review Board has reviewed this reguest, at theirMarch 1, l-989 meeting, and by a unanimous vote of 5-o has
recommended approval of the proposal if the variance isgranted by the PEC.

The first item on the agenda, Antlers LionsHead - G-8.F4 (Gfoss
Residential }'1ooq Area) - Vaiiance REquest 'to permit additional
sliace for employee housing.
Bud Benedict was present to represent the AnLlers in the
request for a variance. The commission reviewed the plans and
it was brought out that this space was an addition to a unit that
at one time had been employee housing, but then had been put into
office space. Now they want to return it to employee housing and
add three bedrooms to it. Because of the severe shortage of
employee housi-ng, the Antlers -is ready to make an ag:l:eement to
leave this spaee., as employee housing- in perpetuity '
The staff recommends approval of thj-s variance request
because of the critical shortage of employee housing. After further
discussion, the Motion was made by Ed Drager to approve the -variancereque.st made by the Antlers LionsHead in ord.er to permit additional
spic" for emplbyee housing as set forth in the Department of
Community Development memorandum dated 2O October 1978 and subject
to an agreement to be drawn up and reviewed by Larry Rider, va11
Town Atiorney that the employ-ee housing will be retained for the
life of the building. Pam Garton seconded the Motion, the Commission
voted unanimous approval .

This item had been postponed from the meeting held trvo weeks
ago. Mrs. .Boyer was in attendance to represent her request. Jim
nuUin explained the situation to the Commission, that her reason
for this request is to make better access into the lots by driveway
placement. No easement is affected by this proposed change'
A l,lotion was made by Ron Todd for approval of the minor re-
subdivision by change of lot line as set -torth in the Department of
Community Development memorandum. Pam Garton seconded the lltotion
and the Commission voted unanimous approval.

The next Item on the Agenda was #4, Dave Elmore property
Zoning.
Pam Garton wanted to know what was suggested three weeksago. she was informed that for the 11* acre parcel that a maximumdensity be set at 1o uni.ts per acre with the possible addition of 4units per acre for tong-term rental units. The planning &Environmental Commission, after much discussion, felt that this densitywas too great.
Pam Garton then made a Motion that Dave Elmores 11!acres be zoned Residential cluster (6 units per acre), but that hecouLd build up to an additional 6 units per acre for long-termrental housing. The upper portion will be zoned pri.mary/secondary
and the small parcel on the west side will be included in the largeparcel for density but will not be allowed to have new developmentplaced on it. Seconded by Gerry lYhite. The Motion was passedwith unanimous approval .

Mrs. George Boyer has appl-ied for a Minor Subdivision
to change the lot line between her 1ots, Lots 5 & 6, Block
1, Vail Potato Patch Filing No. 1. These lots are in the
Residentlal Primary/Secondary Zone Distrist.
CRITERIA AND FINDINGS
"The minimum 1ot or site area sha11 be 15,000
square feet of buildable ar"ea-' and each site
shal1 have a minimum frontage of 3O feet' Each
site sha1l be of a size and shape capable of
enclosing a square area' 80 feet on each side,
within its boundaries" (18.13.050)

Mr. .Jeff Spinnell of Richards Engineering, the
surveyor of the plat in question was contacted by telephone on
October 5, L978. Mr. Spinnell stated that the re-plat involves
an lncrease to the lot area of Lot 5 facilitating access from
the Potato Patch Drive cu1-de-sac.
There are no factors negatively effecting the "buildable"
ate .
RECO}IMENDATIONS
The Department of Coinmunity Development has no
objections to the proposal as we understand it from verbal
communieations at this time. We would recommend approval
lf the application is made in accordance with appropriate
provisions in the Vail Munlcipal Code.
