Re: Permission to remove 2 trees
Roughly three weeks ago the first two major snow storms did major damage to
four of our cottonwood trees on the east side of the house.
We have had Shad Blakey (a certified arborist) of Eagle Tree and Lawn(970-
390-4311) prune the hees heavily and remove all of the debris.
The enclosed photos show some of the damage. Blakey has recommended that
we remove at least two of the trees. One was broken completely in half. The
other one is leaning so badly that it may well just fall down and if it does, it will
go straight into the neighbor's yard.

Hazard Evaluation prepared by Arthur Mears,P.E. and
dated 4/13/90.
It is the conclusion of this report that Lot 22 is
located outside of the designated rockfall zone. We
further realize that the current hazards map for
rockfall indicate LoE 22 to be within a "high severityrl
classification or zone .
We acknowledge these facts and request issuance of
a building permit. We further petition the Town of
Vail to revise the current hazards maps as per the
facts of Mr. Mears report.

CONDITIONS AND STIPULATIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or
other security instrument,
lf the proposed Insured has or acquires actual knowledge of any defect, lien,
encumbrance, adverse claim or other matter affecting the estate or interest or
mortgage thereon covered by this Commitment other than those shown in
Schedule B hereof, and shall fail to disclose such knowledge to the Company in
writing, the Company shall be relieved from liability for any loss or damage
resulting from any act of reliance hereon to the extent the Company is prejudiced
by failure to so disclose such knowledge, lf the proposed Insured shall disclose zuch
knowledge to the Company, or if the Company otherwise acqu ires actual
knowledge of any such defect, lien, encumbrance, adverse claim or other matter,
the Company at its option may amend Schedule B of this Commitment
accordingly, but such amendment shall not relieve the Company from liability
previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
Liability of the Company under this Commitment shall be only to the named
proposed Insured and such parties included under the definition of Insured inthe
form of policy or policies committed for and only for actual loss incurred in
reliance hereon in undertaking in good faith (a) to comply with the reguirements
hereof, or (bl to eliminate exceptions shown in Schedule B, or (cl to acquire or
create the estate or interest or mortgage thereon covered by this Commitment. In
no event shall such liability exceed the amount stated in Schedule A for the policy
or policies committed for and such liability is subject to the insuring provisions and
the Conditions and Stipulations and the exclusions from coverage of the form of
policy or policies committed for in favor of the proposed Insured which are hereby
incorporated by reference and are made a part of this Commitment except as
expressly modif ied herein.
4, Any claim of ioss or damage, whether or not based on negligence, and which arises
out of the status of the title to the estate or interest or the lien of the insured
mortgage covered hereby or any action asserting such claim, shall be restrictd to
the provisions and Conditions and Stipulations of this Commitment.

Dear Ur. Wiegers:
We note that Arthur Mears, PE, has written a letter dated April 13
in which he has states that field observations indicate that
rockfall nitigation will not be reguired in order to construct a
building such as shown on the oZ Architecture drawing.
Considering Mr. Mearsr letter, we see no reason why the rockfall
hazard on this property would prevent the Tohm of VaiL Building
Departurent from issuing a building perrnit. This assurance is with
the assunption that a1I applicable Town of vail building and zoning
regulations would be followed.

I have contracted to purchase the abovementioned vacant

During my investigatiion of the proPerty I discovered that
the property fal1s within a "high severity" rock faIl area
as designated in the Town of Vail hazard map. Acting under
a reconrmendation from a Design Review Board member, I employed
a hazard consultant, Arthur I. Mears to review the property
and the associated hazard.
You will note from Mr. Mearst report which I have attached
hereto that he has recommended that I-,o t 22 Ls not within a
"high severity" zone and is actually located below a "moderateseverity" rockfall area and is, in fact below or outside of
the designated rockfall zone.
Mr. Mears continues in stating that no rockfall mitigation
would be required or recornmended for a building as located
on LoL 22.
Upon your review of this analysis and assuuing tirat atry future
development would follow the normal guidelines and procedures
as perscribed by the Town of Vail and other governing bodies'
do you see any reason why a building permit may not be obtain-
able in the future?

Dear Mr Goss:
At your request, I con;rleted a site inspection of Lot 22, Vailpotito Patch, Vaii, Colorado, on April 10, 1990. The purpose of
this site inspection h,as to determine the potential severity of
rockfall hazard to a proposed residence on the Lot 22. The
residence is located as shown on an OZ Architecture site plan
datecl 4-7-90; the rockfall hazard analysis is based on this site
pIan.
The Town of Vail rockfall map
According to sheet 1t6 of. the vail ::ockf a1l hazard study, most of
Lot 22 is Iocated in a "high severity" rockfall area. According
to definitions given in this study, a high-severity area is
located below rock outcrops which are "thick and nunlerous" and
which have produced a "Iarge number of rocks or boulders at the
base of a steep hiIIside.,' The applicability of this hazard
designation is considered in light of the field observations
obtained for this st-udy and d j-scusscd bclow-
Field observations and rockfall hazar:d desiqnation
Field observatjons were obtajned on npriI l0 as they pertain to
the hazard at Lot 22. These are summarized bel.ow.
1. A sandstone mentber of the lqinturn Formation crops
out as a back-sLoping cliff band approximately 5-I5
feet thick Iocated 250-350 feet above Potato Patch
Drive.
2 - The cIi ff hand is mostly solid and unfractured'
however a few loose, clngular, sandstone rocks up to 3
feet long are Iocated on top of, within/ or inmediately
below the smalI cliffs.
3. A dispersed aspen (PopuIus tremuloides ) forest is
Iocated on the hilfslopeffiion between
the cliff and Potato Patch Drive. Approximately 303 of
the trees have falIen over, presunrably due to soil
instabilitv anci snow load in June , L984.

4. A few rocks up to 3 feet in dianreter have rolled
into the forest and have reached within approximately
50 feet of Potato Patch Drive; no rockfall boulders
appear to have crossed the road, although a number of
snrall boulders were pushed onto the upper part of Lot
22 during road construction.
Conclusions reqardj.nq rockfall hazard and mitigation requirements
The rockfall hazard below the sandstone cliff outcropping should
be redesignated as "moderate severity" instead of "high severity"
as classified on the Vail map. The moderate severity area should
extend only as far as the downhill edge of Potato Patch Drive.
Almost alL rocks that roll through the forest wiLl lose energy
and stop on the fLat road. Lot 22, therefore, is located below
the moderate rockfall area, outside of the designated rockETT
zone.
The probability of an extraorclinary'rockfaIl event that would
cross Potato Patch Drive and enter Lot 22 is so small as to be
insignifi.cant. The potential rockfall hazard is certainly much
Iess than the potential hazard associated with a vehicle sliding
off the road onto Lot 22, a risk accepted during everyday
activities. Nevertheless, even this r:emote rockfal I risk is notttoornrf r €rnt- rhat mUst be COnSidered by residents of LOt 22.-eL v I
RockfalI nritigation will not be required and is not recomnended
for a building as Located on Lot 22 and shown in the Oz
Architecture d rawi ng .
